Die Dissertation greift zwei neuere Ansätze der Platonforschung (P. Stemmer, N. Blößner) auf. Demnach ist Platons ''Politeia'' keine Lehrschrift, sondern eine kohärente Argumentation, die zudem den im ''Phaidros'' entfalteten Kommunikationsregeln folgt, also auf konkrete Situationen, Beweisziele und Personen bezogen ist. Der Autor konzentriert sich besonders auf den letzten Aspekt und hier vor allem auf die jugendlichen Gesprächspartner des Sokrates, die Brüder Glaukon und Adeimantos. Er zeigt, dass deren Analyse, die öffentliche Meinung der Zeit impliziere eine starke Tendenz zum Egoismus, und das bei ihnen daraus erwachsene, im Dialog drängend artikulierte Bedürfnis nach Gewinnung einer fundierten Gegenposition, die sie von Sokrates erwarten, Anlage und Durchführung von dessen Argumentation in der Tat wesentlich beeinflussen. Weil eine allen Einwänden standhaltende Begründung stets den Nachweis erfordert, dass gerecht zu sein ein intrinsisch notwendiger Bestandteil der Eudaimonie, d.h. eines gelingenden Lebens ist, erweist sich die reflektierte Lebenswahl somit als das zentrale Thema der ''Politeia'', das den Dialog zusammenhält und seinen Aufbau sowie den Zusammenhang seiner vielen unterschiedlichen Sachthemen letztlich erklärt. Behandelt wird dieses Thema aber nicht abstrakt, sondern mit Bezug auf die konkrete Situation der Brüder, von denen Glaukon (so der Autor) die initiative Rolle zuzuschreiben sei. Trotzdem gelinge es Platon, das Gespräch nicht um die Entscheidung einzelner Personen für ihre individuelle Lebensführung kreisen zu lassen, sondern um die grundsätzliche – und sich somit auch auf den Leser des Textes beziehende – Frage, auf welcher Erkenntnisbasis, auf welcher methodischen Grundlage und mit welchem Grad an Gewissheit man solche Entscheidungen überhaupt treffen kann. Diese Sicht macht auch die methodischen und erkenntnistheoretischen Explikationen, die Platons Dialog in beträchtlichem Maße enthält, zu essentiellen Bestandteilen der Argumentation. / This dissertation picks up on two recent approaches in Platonic scholarship (P. Stemmer, N. Bloessner), which view Plato’s ''Politeia'' not as a doctrinal work, but rather a coherent argumentation, which, moreover, applies the rules of communication as laid out in the ''Phaedrus'' and is thus related to the argumentative goals of concrete persons in a specific situation. The author primarily focuses on the second aspect, particularly on Socrates’ young interlocutors, the brothers Glaucon and Adeimantus. He shows how their analysis, according to which the public opinion of their time implies a strong tendency towards egoism, and their consequent desire for a well-founded counterargument, for which they turn to Socrates, in fact determines the structure and development of the latter’s argumentation. Since a justification which can withstand all objections requires the demonstration that being just is an intrinsically necessary component of eudaimonia, i.e. of true happiness, a rational life choice thus emerges as the central theme of the ''Politeia'', which gives the dialogue its inner coherence and ultimately explains its structure as well as the connection between the various topics it deals with. This theme is not, however, developed abstractly, but in connection with the concrete situation of the brothers, with Glaucon (according to the author of the dissertation) taking the initiative. However, Plato nonetheless succeeds at not letting the discussion revolve around the particular decisions of an individual regarding a particular way of life, but rather around the fundamental question – which thus also relates to the reader of the text – as to the epistemological and methodological basis for such decisions and the degree of certainty with which they can be reached. According to this interpretation, the methodological and epistemological explications, which figure prominently throughout the dialogue, should be viewed as essential elements of the argumentation.

Dans cette thèse, nous nous sommes intéressés à l'ouverture des EIAH (EnvironnementsInformatiques pour l'Apprentissage Humain), pour répondre à leur faible déploiement dansles établissements de formation, en facilitant leur appropriation par des usagers. Notre travailde recherche s'inscrit dans le cadre du projet REDiM (Réingénierie des EIAH Dirigée par lesModèles) mené au LIUM (Laboratoire d'Informatique de l'Université du Maine), dont un desobjectifs est d'intégrer les enseignants dans le processus de conception des scénariospédagogiques d'un EIAH.Nous proposons une approche d'ingénierie et de réingénierie pour rendre un EIAH ouvertà la conception et à l'adaptation de ses scénarios pédagogiques par les enseignantsutilisateurs. Nous avons défini un processus de conception basé sur la modélisationde scénarios pédagogiques ouverts (SPO), qui permet l'instrumentation des enseignantspour les aider dans la conception continue (i.e. qui se poursuit dans l'usage) d'une activitéd'apprentissage. Nous faisons trois propositions scientifiques :- Un modèle de représentation des SPO, qui permet de les structurer en variantes enfonction des contextes d'exécution. Nous qualifions ce modèle de rationnel puisqu'il s'appuieprincipalement sur l'approche du Design Rationale que nous avons adaptée à notreproblématique.- Un processus itératif et incrémental d'ingénierie et de réingénierie qui guide lesenseignants pour concevoir et adapter des SPO conformes au modèle que nous avonsdéfini.- Une méthode dirigée par les modèles et spécifique au domaine métier pour instrumenterle processus d'ouverture des scénarios pédagogiques d'un EIAH existant. Cette méthoded'instrumentation, reposant sur l'IDM (Ingénierie Dirigée par les Modèles) et le DSM(Domain-Specific Modeling), implique les enseignants utilisateurs de l'EIAH, considérés icicomme des experts du domaine. Elle est structurée en plusieurs phases qui amènentprogressivement à définir, de façon spécifique à l'EIAH considéré, un langage d'expressiondes SPO (ADSGEML - Adaptive Domain-Specific Graphical Educational ModelingLanguage) et un éditeur associé permettant la conception et l'adaptation des SPO dansl'univers métier de l'EIAH.Afin d'évaluer et de raffiner nos propositions, nous les avons appliquées sur l'EIAH"Hop3x", préalablement conçu au LIUM dans le cadre d'un autre projet pour pratiquer laprogrammation orientée objet. Nous avons donc élaboré un ADSGEML et un environnementd'édition graphique pour permettre aux enseignants de concevoir et d'adapterdynamiquement des sessions ouvertes de Hop3x, à un niveau élevé d'abstraction.

Rational Krylov Methods for Operator Functions

We present a unified and self-contained treatment of rational Krylov methods for approximating the product of a function of a linear operator with a vector. With the help of general rational Krylov decompositions we reveal the connections between seemingly different approximation methods, such as the Rayleigh–Ritz or shift-and-invert method, and derive new methods, for example a restarted rational Krylov method and a related method based on rational interpolation in prescribed nodes. Various theorems known for polynomial Krylov spaces are generalized to the rational Krylov case. Computational issues, such as the computation of so-called matrix Rayleigh quotients or parallel variants of rational Arnoldi algorithms, are discussed. We also present novel estimates for the error arising from inexact linear system solves and the approximation error of the Rayleigh–Ritz method. Rational Krylov methods involve several parameters and we discuss their optimal choice by considering the underlying rational approximation problems. In particular, we present different classes of optimal parameters and collect formulas for the associated convergence rates. Often the parameters leading to best convergence rates are not optimal in terms of computation time required by the resulting rational Krylov method. We explain this observation and present new approaches for computing parameters that are preferable for computations. We give a heuristic explanation of superlinear convergence effects observed with the Rayleigh–Ritz method, utilizing a new theory of the convergence of rational Ritz values. All theoretical results are tested and illustrated by numerical examples. Numerous links to the historical and recent literature are included.

Rationalität und Qualität von Wirtschaftsprognosen / Rationality and Quality of Economic Forecasts

Wirtschaftsprognosen sollen die Unsicherheit bezüglich der zukünftigen wirtschaftlichen Entwicklung mindern und Planungsprozesse von Regierungen und Unternehmen unterstützen. Empirische Studien bescheinigen ihnen jedoch in aller Regel ein unbefriedigendes Qualitätsniveau. Auf der Suche nach den Ursachen hat sich in Form der rationalen Erwartungsbildung eine zentrale Grundforderung an  die Prognostiker herausgebildet. So müssten offensichtliche und systematische Fehler, wie bspw. regelmäßige Überschätzungen, mit der Zeit erkannt und abgestellt werden. Die erste Studie der Dissertation übt Kritik am vorherrschenden Verständnis der Rationalität. Dieses ist zu weitreichend, weshalb den Prognostikern die Rationalität voreilig abgesprochen wird. Anhand einer neuen empirischen Herangehensweise wird deutlich, dass die Prognosen aus einem anderen Blickwinkel heraus durchaus als rational angesehen werden können. Der zweite Aufsatz zeigt auf, dass in Form von Befragungsergebnissen öffentlich verfügbare Informationen bestehen, die bei geeigneter Verwendung zu einer Verbesserung der Qualität von Konjunkturprognosen beitragen würden. Die Rationalität dieser Prognosen ist daher stark eingeschränkt. Im dritten Papier erfolgt eine Analyse von Prognoserevisionen und deren Ursachen. Dabei zeigt sich, dass es keinen Zusammenhang zwischen der Rationalität und der Qualität der untersuchten Prognosezeitreihen gibt. Die vierte Studie dient der Präsentation der Ergebnisse eines Prognoseplanspiels, welches den Vergleich der Prognosen von Amateuren und Experten zum Ziel hatte. Es stellt sich heraus, dass die Prognosefehler erhebliche Übereinstimmungen aufweisen.

Rewarding inventive ingenuity through patent ownership as part of the Australian innovation strategy

The government has indicated that innovation fosters economic growth and is essential to maintaining a competitive position in international markets. Patents are the preferred mechanism by which the Australian Government and other governments encourage their nationals to protect their innovations. The question of the entitlement was raised in several cases in the Federal Court of Australia where there has been a failure to name all of the inventors on a patent grant (non-joinder) or where persons were mis-named as inventors, who were not and consequently have no interest in a grant (rnis-joinder). In both cases, parties who were not themselves daiming an entitlement to the invention, brought objections based on a number of grounds, including entitlement. The results have been the revocation of the patent in the case on the non-joinder of an inventor and in the case of mis-joinder, the preliminary view of a judge of the Federal Court has been, that the patent would be invalid through lack of entitlement. The result is that competitors are permitted to 'exploit' the invention, as the subject matter is not protected by a patent. The implications are far reaching, For example, where a research team in collaboration with another develops an invention but omits the inventive contribution of even one member of one team or includes a person who has not made an inventive contribution in the patent grant, the patent will be invalid. In these circumstances, the author considers that the result produces a disincentive to innovate. Consideration of this area in other jurisdictions reveals that the U.S. and the U.K. have recognised this as an unsatisfactory state of affairs. As a result, Congress in the U.S. made provision in their Patent Code in the early 1950's, that in the case of error or mistake giving rise to a non-joinder or mis-joinder of inventors, the patent would not be invalid but could be rectified by the Director of Patents and Trade Marks (the 'Director'). In the U.K., the Comptroller has powers to deal with a wide variety of cases involving entitlement to ownership of a patent. The situations include but are not limited to cases where some but not all of the persons entitled to the grant have been granted the patent, i.e. non-joinder, or where a person entitled to be granted a patent, has been granted a patent together with a person who is not entitled, i.e. mis-joinder. The thesis will focus on the non-joinder and mis-joinder of inventors, but the U.K. provision addresses a wider field of parties entitled, whether entitled as inventors or on some other basis. In addition, the U.K. and Germany have made provision restricting the persons who are able to challenge a patent on entitlement grounds. This is restricted to those persons having an interest in the patent, rather than open to any person, as is the case in Australia. The Australian decisions have been determined on historic cases dating back to the 17th century. It is timely to consider amendments which will overcome revocation of patents under Australian law, for what is essentially a matter between the persons interested. These amendments will accordingly encourage innovation, particularly in an environment where intellectual property has taken on greater importance and where the identification of the inventor has become more complex as collaborations in research become more common.

The study is composed of a history of federal estate, gift, and generation-skipping taxes, current legal aspects of those taxations, and the rationale for the taxations. The characteristic of the legal aspects in the wealth transfer taxation in the nation is to tax a right and competence for a wealth.
