The monograph approaches the State?s democratic evolution and assertion of participatory democracy, within the necessary coexistence and combination with political representation, as the Democratic State of Law?s structure. In this perspective, the social participation in the constitutional outline is analyzed from the fundamental precept of citizenship and other instruments of direct democracy established by the Federal Constitution. The central theme lies in the defense of social participation in the State?s organization and management as the citizen?s constitutional guarantee, which derives from political citizenship and instruments of direct democracy, from the popular councils until all the democratizing directives of the Democratic State of Law. The effectiveness of the constitutional guarantee of social participation in the State?s management is defended by the sufficiency of the constitutional provisions guaranteeing citizenship and direct democracy, through the understanding of the unnecessary regulation and its limits, likewise the exemplification of adequate infra-constitutional legislation and eventual unconstitutionalities by restriction. Concurrently, the State?s power-duty and rulers are defended on the induction and guarantee of the effectiveness of social participation, as well as the limits of the institute. Some successful experiences in the State?s management, in the Executive, Legislative or Judicial Powers are highlighted not only as defense but also to imprint the importance of social participation. The conclusions find their essence on the defense of social participation as a constitutional guarantee, necessary and fundamental to the public management?s democratization, exercised as a citizenship?s fundamental right and combined with the political representation system. / O presente texto de disserta??o inicia com breves anota??es sobre a evolu??o do conceito hist?rico de democracia e sua fundamenta??o te?rica, seguido de apontamentos sobre fragilidades do sistema representativo e sua combina??o a democracia direta. Aborda a evolu??o democr?tica do Estado e afirma??o da democracia participativa, dentro da conviv?ncia necess?ria e combina??o com a representatividade pol?tica, como estrutura do Estado Democr?tico de Direito. Nesse espectro, aprecia-se a participa??o social no plano constitucional, a partir do preceito basilar da cidadania e outros instrumentos de democracia direta previstos na Carta Federal. O tema central encontra-se na defesa da participa??o social na organiza??o e gest?o do Estado como uma garantia constitucional do cidad?o, decorrente da cidadania pol?tica e instrumentos de democracia direta, desde os conselhos populares e todas as diretrizes democratizantes do Estado Democr?tico de Direito. A efetiva??o da garantia constitucional de participa??o social na gest?o do Estado ? defendida a partir da sufici?ncia das previs?es constitucionais garantidoras da cidadania e democracia direta, passando pela compreens?o da desnecessidade de regulamenta??o e seus limites, bem como a exemplifica??o de legisla??es infraconstitucionais adequadas e eventuais inconstitucionalidades por restri??o. Ao mesmo tempo, ? defendido o poder-dever do Estado e seus governantes na indu??o e garantia da efetividade da participa??o social, bem como os limites do instituto. Como defesa e import?ncia da participa??o social, s?o destacadas algumas experi?ncias exitosas na gest?o do Estado, no plano dos Poderes Executivo, Legislativo ou Judici?rio. As conclus?es fixam-se na defesa da participa??o social como uma garantia constitucional, necess?ria e fundamental para a democratiza??o da gest?o p?blica, exercida como direito fundamental da cidadania e em combina??o com o sistema de representa??o pol?tica.

O objetivo deste trabalho ? pesquisar a moldura do ordenamento jur?dico em rela??o ? mat?ria para isso se prop?e a investigar desde o seu planejamento e at? mesmo as formas de controle por interm?dio de pesquisa bibliogr?fica feita atrav?s de fontes secund?rias como livros e revistas especializadas e o posicionamento dos tribunais atrav?s de pesquisas jurisprudenciais. The objective of this work is to investigate the legal framework in relation to the subject for which it proposes to investigate from its planning and even the forms of control through bibliographic research done through secondary sources such as books and specialized magazines and the positioning courts through jurisprudential research. It was found that the legal system, beginning with the Federal Constitution, determines that the expansion of this type of spending must have strategic planning that determines harmony with the budget laws. In addition, it was also observed that the regulative legislation, defined by supplementary law No. 101/2000, also known as fiscal responsibility law, indexes the growth of public expenditure with personnel to the net current revenue of political entities with the objective of providing the sustainable growth of that type of public expenditure. It was also perceived a specific system of control that legitimizes the compulsory exoneration of public servants commissioned or effective. Stable or not to guarantee the costing of personnel sheet as determined by art. 169 of the Federal Constitution. The growth of public expenditure on personnel must also have legal relevance with the principles that structure the exercise of the administrative function. In addition, the Democratic Rule of Law determines that the acts of public administration must pass through the sieve of external control, which encompasses, in the parameters established by this research, the legislative function of Power, society and the courts of accounts. The external control of remuneration policy in the public service involves from the consideration of the matter in the justice and citizenship committees and budget, until the public hearings where not only the public servants and / or representative unions can participate in the discussions, but also the whole with the access to accounting reports with emphasis on the fiscal management report, should participate in the decision-making process related to the expansion of public expenditure with personnel.

Neste aspecto, a participa??o social se apresenta como uma das ferramentas mais importantes da democracia e verdadeira express?o da soberania popular. Abre-se, portanto, espa?o para a investiga??o dos aspectos democr?ticos envolvidos na representa??o da UFRN junto aos Conselhos, oportunizando a verifica??o de seu papel neste contexto, pelas possibilidades de contribui??o ao processo de democratiza??o do Pa?s. Conclui-se que se faz necess?rio maior destaque para as representa??es sociais nos conselhos gestores e melhores condi??es para ampla participa??o dos membros da Universidade nestes espa?os, objetivando alcan?ar reais possibilidades de contribui??o e efetivo exerc?cio da delibera??o p?blica. / This paper discusses the UFRN participation in the Councils Municipal Managers of Social Policies through a case study of its representation in the Municipal Board of Education in Natal / RN, as the democratic participatory system assumption adopted by the Federal Constitution of 1988. The descriptive search, as a transversal character, with data collection gathered in the Council and by semi-structured interviews with representatives of the UFRN Education Center, as well with the effective members of CME, will have a qualitative approach to analyze the obtained content. Therefore, we start understanding that throughout history democracy has become the political system best suited to the social organization, protection of individual rights and freedoms and that popular sovereignty has established itself as the foundation for its legitimacy. In this respect, social participation is presented as one of the most important tools of democracy and true expression of popular sovereignty. Therefore, it opens up space for research of democratic aspects involved in the representation of UFRN close to the Councils, providing opportunities to check its role in this context, the contribution of possibilities to the country's democratization process. The emergence of social policies management councils reveals the strength of citizen participation in the intervention and the formulation of public policies, in order to increase their efficiency through social control. Therefore, this study focused on democratic theories to analyze how they can contribute to the improvement of management councils, as well as the role of the Academy in this regard. A certain influence of the Municipal Executive was detected in the activities of the Council, limiting the autonomy of its activities and the amplitude of the scope of the deliberations initiated there. About the UFRN's chair at the CME in Natal, it does not constitute a full and wide representation of the Institution, it is confined to the Education Center and is compromised at a time when there are no discussions at the University about its positioning on the issues to be addressed Deliberated in that instance. It is concluded that it is necessary to emphasize social representations in the management councils and better conditions for broad participation of the members of the University in these spaces, aiming to reach real possibilities of contribution and effective exercise of public deliberation.

Its purpose is to contribute to the qualification of the social assistance policy through the constitution of theoreticalmethodological, technical-operative and ethico-political subsidies. The critical dialectical method supports the realization of mixed-focus research, which was developed through a combination of documental analysis and semi-structured interviews. The research sample comprises 11 of the 34 municipalities of the RMPA, where actions related to the activity were identified between 2014 and 2017. It is based on the historical contextualization and characterization of the aspects that set the socio-assistance surveillance, problematizing theoretical and ethical-political assumptions that are being established since its inclusion as a social assistance activity. Then, it sought to unveil how the socio-welfare surveillance has been operating at the municipal level, addressing processes such as data collection, construction of indicators, use of technology associated with information management, planning, institutional relations, diagnosis, monitoring and evaluation. Data on the constitution of the technical teams, the qualification and qualification of the workers and their working conditions are presented. The reflections also cover the subjects who are demanding the actions of social assistance and the way in which their participation in the different spaces and processes, including those related to socio-assistance surveillance, has taken place or not. It is concluded that this function is permeated by an ethical-political dimension, which contribution will depend primarily on the social direction that is printed. By a bias closely connected with conservatism, it contributes to the perpetuation of the condition of subalternity of the workers and users of SUAS. Already, from a critical perspective, it adds the possibility of contributing to the democratization of social assistance and to the construction of emancipatory social processes. Yet in the same way that social direction is decisive, attention is drawn to the fact that it does not consolidate immediately or in isolation. It is necessary to consider the disputes and contradictions that make public social policies either a place of resignation and resistance. However, considering the delimitations of time and space of the research, the historical counterfacts found give indications that, despite the significant advances, the operationalization of socio-assistance surveillance little reflects the adoption of a more critical social direction perspective. / Esta tese tem como tema central a vigil?ncia socioassistencial no Brasil, apresentada a partir da an?lise de sua conforma??o e de sua fundamenta??o no RS. Tem por finalidade contribuir para a qualifica??o da pol?tica de assist?ncia social por meio da constitui??o subs?dios te?ricometodol?gicos, t?cnico-operativos e ?tico-pol?ticos. O m?todo dial?tico cr?tico embasa a realiza??o da pesquisa de enfoque misto, que foi desenvolvida por meio da combina??o das t?cnicas de an?lise documental e entrevista semiestruturada. It conceptually retakes the notion of civil society and popular participation in the decades of 80 and 90. The objective is to critically deepen the reading of the sprouting and evolution of the managing advice. In such a way it analyzes the performance of the City Council of Environment of Campinas (Comdema), as a case study, in the definition of the urban and environmental politics of the city in the period of 2006 to 2008. Through the reading and critical interpretation of documents produced for the Council (acts, deliberations, motions, to seem) that verifies the performance of the Council, the existing conflicts in the interior of this space, the limits and possibilities of interference in the municipal public politics. Para tanto analisa a atua??o do Conselho Municipal de Meio Ambiente de Campinas (Comdema), como estudo de caso, na defini??o da pol?tica urbana e ambiental da cidade no per?odo de 2006 a 2008, atrav?s da leitura e interpreta??o cr?tica dos documentos produzidos pelo conselho (atas, delibera??es, mo??es, pareceres) verificando assim a atua??o do conselho, os conflitos existentes no interior desse espa?o, os limites e possibilidades de interfer?ncia nas pol?ticas p?blicas municipais, uma vez que, enquanto conselho gestor o Comdema situa-se no n?cleo de tens?o entre o poder p?blico e a sociedade civil e busca se afirmar como espa?o interinstitucional e aut?nomo em rela??o ao poder executivo, tendo contudo uma estrutura fragilizada e pass?vel de mudan?as.

It aims to evaluate, from the investigation process of preparing a Local Plan in Campinas (SP), how this requirement foreseen in the Statute was integrated in the construction of a democratic management of the city. It focuses on the role of institutionalized popular participation space Management Councils based upon the 88 Federal Constitution, its limits, contradictions and possibilities of interference in municipal policy, and observes how the various social strata and interests interacted in decision taking and in the search for territory solutions. The presented reflections refer to the city of Campinas and two management councils, the Municipal Urban Development (CMDU) and City Council (ConCidades), which were involved in the process of municipal urban planning and of great importance during the elaboration process of the 2006 Participatory Master Plan and Local Macro-area 05, the analysis object of the research. / A presente disserta??o tem como objetivo geral analisar a quest?o da participa??o popular na elabora??o de pol?ticas urbanas no Brasil desde a aprova??o do Estatuto da Cidade. Long avenues and important highways connecting major regions in the State cross this area, that is occupied by a low-income population, predominantly African descent. The surroundings of this farm are currently experiencing the insertion of new housing development projects. Thus, the present work examines the actions of Comunidade Jongo Dito Ribeiro, linked to other social and cultural Afro-brazilian movements, for the urban regeneration of Fazenda Roseira, as well as the role of the cultural expression of Jongo, also known as Caxambu, in this process. Fazenda Roseira as a " memory place ", is the matrix on which social dispositions and spatial forms are articulated , stimulated by the actions of the Jongo community integrating cultural identity with territoriality in the production of a urban space. This case presents the combination of two segments of the cultural heritage: in one hand Fazenda Roseira as a material heritage characterized by environmental and architectural fragments from the colonial period and the nineteenth century; in the other hand Jongo as an intangible heritage recognized since 2005 by IPHAN (National Institute of Historical Heritage), is also represented by Comunidade Jongo Dito Ribeiro, an important witness in the construction of the historical memory of black people in the city of Campinas. / Este trabalho aborda aspectos da luta pela preserva??o da Fazenda Roseira do Campo Grande antiga fazenda de caf? e marco referencial cultural e hist?rico, situada na regi?o noroeste de Campinas,SP, num territ?rio entrecortado por extensas avenidas e por importantes rodovias de conex?o regional e ocupado por uma popula??o de perfil predominante de baixa renda com forte presen?a de comunidades de afro descendentes. O entorno da sede convive atualmente com a inser??o de um novo loteamento fechado nos terrenos remanescentes da Fazenda. O trabalho analisa a atua??o da Comunidade Jongo Dito Ribeiro, articulada a outros movimentos sociais e culturais de origem africana, pela requalifica??o urbana da Fazenda Roseira bem como o papel do jongo/caxambu que a constituiu enquanto manifesta??o cultural e pol?tica. This work aimed to understand whether the main cultural and social skills, as well as the time of operation of the Counsellor of health define your effectiveness deliberative in Social control of the SUS. For the development of the survey was carried out a previous contact with the municipalities selected, planned and scheduled visits were carried out in the municipalities selected for implementation of a semi-structured questionnaire to directors (the) appointed by the Council Municipal health; the questionnaire with open and closed questions was answered in writing in the location indicated by the participant; also were carried out bibliographic research, which amounted to the attention of the researcher on the topic "Participation and Social control in the SUS"; after collection, the data were analyzed, systematized and classified . Were covered the municipal health Councils in the region Expanded the Jequitinhonha, which consists of 15 municipalities. In the course of this work was covered a brief history of public health in Brazil, in which we describe popular participation and social control in health; report on the health of Diamantina; We present our analysis and discussions contemplating: the structure and functioning of the Council; the actions and responsibilities of the Board of health; the identification and health advisor profile; and concluding with the final considerations. It was possible to identify the profile of the health advisors, analyzing the health boards and assign the actions of health counselors face the public health policies of the SUS. We treat the actions and responsibilities of the health counselor, as political agent of public relevance, their competence to deliberate on public health issues and the need for a process of better training of Health Advisor.

This Program was created after the demand presented by the national entities of popular movements in Brazil and it differentiates from the others for having as a focus the cooperative and association work, with the intention of fortifying the "self help" practice and the popular organization. To realize a critical analysis of the Program, this dissertation begins with a historical reconstitution of the ways of housing provision, with emphasis in the self help building and popular participation. The capitalist development, through the housing production, is presented as a way to understand the relations between the agents involved in the current forms of provision. The analysis of the social agents gives clues to explain its current interlocutions. Some notes about the current scene present a compose the changes presented in the civil society and in the State toward the recent public politics for social housing and the popular participation. In the end a panorama of some Brazilian regions is presented, with different ways of utilization of the Program. A study of a more specific case was made in Embu das Artes city, SP, for having, until then, appropriated the Program on a more complete way. The field research had as intention to illustrate the arguments presented throughout the work, basing the critiques made to the Program. Critiques that in the end had been organized in three great axles: provision, interlocution between the present social agents and participation, always aiming at answering the question: changes in the scene?. / Esta disserta??o trata do recente Programa do governo federal para Habita??o Popular, o Cr?dito Solid?rio. Esse Programa foi criado ap?s demanda apresentada pelas entidades nacionais de movimentos populares e se diferencia dos demais por ser voltado ao cooperativismo e associativismo, com o intuito de fortalecer as pr?ticas de gest?o e da organiza??o popular. Para proceder a uma an?lise cr?tica do Programa, este trabalho parte de uma reconstitui??o hist?rica das formas de provis?o habitacional, com ?nfase na autoconstru??o e participa??o popular. O desenvolvimento capitalista, por meio da produ??o habitacional, ? apresentado como forma de compreens?o das rela??es entre os agentes envolvidos nas atuais formas de provis?o. A an?lise dos agentes sociais presentes busca explicar suas atuais interlocu??es e, a partir de algumas notas sobre o cen?rio atual pretende-se compor as mudan?as ocorridas na sociedade civil e no Estado no que se refere ? habita??o e participa??o popular.
