The aim of this essay is to problematize the role of living support in a group home and to examine staff reflections about the users' opportunities for and possibly limits to self determination and, in addition to this, how they work towards supporting this right. The study is conducted through seven semi-structured qualitative interviews. The theoretical points of departure are theories of empowerment and paternalism. We have analysed the study results from the vantage point of these theories. The results are consistent with earlier research showing lack of guidance for supporters and also a lack of common approach towards users.

Working for family, nation and God : paternalism and the Dupuis Frères department store, Montreal, 1926-1952Matthews, Mary Catherine. January 1997 (has links)
From 1868 to 1978, the Dupuis Freres department store serviced the French Montreal community from its headquarters on St. Catherine Street, east of Saint Laurent. This thesis looks at the management strategies of Dupuis Freres through its employee newspaper, Le Duprex, from 1926 to 1946, and then at their collapse with the Dupuis Freres strike in 1952. The Dupuis Freres management retained the loyalty of its employees by using a combination of paternalism and welfare capitalism. The company supported a union, organized leisure activities, provided sales incentives and rewarded loyalty financially and socially. In addition, the store integrated its French Canadian and Catholic identity with its employees' understanding of their work to impart cultural meaning to their employment. Dupuis Freres equated support for the company with the success of the French Canadian people, and its connections with the Catholic clergy added a sacred element to its enterprise. Dupuis Freres strike in 1952 divided French Canadians along class lines, and those who supported the workers were seen by neo-nationalists as doing so at the expense of French Canadian survival.

A Contextual Approach for Ethical Analysis in Clinical GeneticsMadelyn Peterson Unknown Date (has links)
Genetic medicine is an emerging area of healthcare which constantly raises novel ethical challenges in the clinical realm due to its capacity to reveal information that has deeply personal meaning. Genetic tests can reveal more than is strictly essential for immediate medical care because they can diagnose conditions that cannot be cured, treated or effectively managed. The diagnosis of a genetic condition in one individual can have repercussions throughout an extended family, and genetic knowledge has created innovative, technologically driven, reproductive options. For clients of genetic counselling, moral choice does not readily result from uncluttered logic or easy personal preference, nor does it involve the application of sterile principles and laws, but is a much richer process involving personal history and culture, as well as reflection upon personal values, current resources and projected life goals. For these reasons, I question the validity of the exclusive use of a narrow version of Principlism, as it is commonly operationalised, for the medical sub-specialty of clinical genetics. Its heavy emphasis on individual autonomy, which has become synonymous with clinical medicine, does not take into account the fact that most genetic tests have little or no immediate clinical utility, or that genetic medicine is primarily about the way in which genetic conditions pass through families, and management of recurrence risks by choice of reproductive options. Therefore, the aim of this dissertation is to develop and explore a broader contextual moral framework, which is better suited to deliberation about complex ethical dilemmas in clinical genetics, than the current dominant approach which tends to follow a restrictive and non-inclusive application of Principlism. To achieve this aim, I have started with a review of relevant history and socio-political forces that have shaped the current status of the genetic medicine, and examined the evolution of current attitudes that underpin recognition, analysis and management of the ethical challenges in genetic medicine. I have analysed the manner in which Principlism and other normative theories are employed by bioethicists and clinicians in response to ethical dilemmas, and presented an alternative approach which employs a broader contextual ethical framework. I have devised an approach which attends to the importance of both current social opinion, and the tradition of evidence-based medicine, with reference to selected traditions in philosophical analysis. vi In conclusion, I advocate attention to concrete circumstances, which includes recognition of historical development, which has shaped current medical and wider social values, beliefs, norms and attitudes political context, including critical analysis of relevant political motivations social context, particularly situational power structures, trust relationships and relational obligations personal values, resources and experiences of the stakeholder(s) the range of realistically available options for the stakeholder(s) the impact of economic limits, which might be institutional and / or personal And, to achieve this objective of building a ‘thick’ ethical discourse, I propose a series of questions, which can be readily utilised by genetic and non-genetic health professionals as well as other members of society to work towards resolutions that represent a balance of fairness, economic responsibility with scarce resources, and socially acceptability. This approach appropriately attends to the relational and communicative aspects of moral dilemmas in clinical genetics, and is likely to yield more meaningful (and less likely paternalistic) conclusions, which would be of greater value to our morally pluralist society.

The present investigations study the John Stuart Mill thinking and his position towards paternalism justification, taking into account the harm principle elaborated in his book “On Liberty”. Two are the objectives of this paper. In first place, the anti - paternalist tesis sustained by this autor will be analyzed to identify deficiencies and limitations. In second place, it is sought to determine to what extent they actually opposed such interventions, to verify the accuracy of that somewhat extended belief that sees Mill a strong opponent of paternalism. It is concluded that the defects of Mill’s theses are explained in good account due to an excess of optimism in the capacities of human beings for self-regulation, a strong skepticism about the capacity of the State to achieve effective paternalistic measures, granting From an excessively strong and unrealistic weight to individual autonomy, among other erroneous considerations. It is also concluded that it is not correct to say that John Stuart Mill has maintained an extremely broad or almost absolute antipaternalistic thesis. Although his famous principle of harm makes it impossible to validate many measures of this nature, a more detailed review of his entire work shows that Mill admitted the validity of many interventions in adults. / La presente investigación estudia el pensamiento de John Stuart Mill y su posición alrededor de la justificación del paternalismo, tomando en consideración el principio de daño elaborado en su obra “Sobre la libertad”. Dos son los objetivos de este trabajo. En primer lugar, se analizarán las tesis anti-paternalistas sostenidas por este autor para identificar sus deficiencias y limitaciones. En segundo lugar, se busca determinar hasta qué punto dichas tesis realmente se opusieron a dichas intervenciones, para verificar la exactitud de aquella creencia algo extendida que considera a Mill como un fuerte opositor del paternalismo. Se concluye que los defectos de las tesis de Mill se explican en buena cuenta debido a un exceso de optimismo en las capacidades de los seres humanos para la auto-regulación, un fuerte escepticismo sobre la capacidad del Estado para lograr medidas paternalistas efectivas, el otorgamiento de un peso excesivamente fuerte e irrealista a la autonomía individual, entre otras consideraciones erróneas. Asimismo se concluye que no es correcto afirmar que John Stuart Mill haya sostenido una tesis anti-paternalista sumamente amplia o casi absoluta. Si bien su famoso principio de daño permite excluir de validez a muchas medidas de dicha naturaleza, una revisión más detallada de toda su obra permite mostrar que Mill admitió la validez de muchas intervenciones en adultos.

sertão baiano oitocentista. A hipótese central é de que os subalternos tinham clara noção de
sua condição dentro da sociedade e, valendo-se do paternalismo, buscavam obter dos senhores
vantagens para si e suas famílias. Defendo que as relações entre senhores e subalternos eram
construídas levando em conta a confiança, a proteção e sentimentos afetivos, muitas vezes,
difíceis de mensurar. Para entender a dependência no mundo rural baiano, segui as trajetórias
do casal Soares da Rocha e de alguns de seus dependentes (escravos, libertos e ex-agregados).
Formado pelo coronel Quintino Soares da Rocha e dona Umbelina Adelaide de Miranda, o
casal era o mais rico proprietário de terra, maior produtor de gado vacum e cavalar e principal
escravista da vila de Nossa Senhora da Graça do Morro do Chapéu (Chapada Diamantina).
Isso permitiu a ele adquirir centenas de dependentes. Para (re)construir as experiências do
casal e dos dependentes usei uma gama variada de documentos, como: livros de notas,
registros eclesiásticos (batismos, casamentos e óbitos), inventários e processos criminais.
Apliquei o método da ligação nominativa. Empregado nos estudos de micro-história,
biografia e trajetórias, o método possibilitou, também, entender as redes familiares de
escravos, libertos, homens livres pobres e seus descendentes, compreender que dentro dos
grupos havia gradações de dependência.
This work analyses the relations of personal dependence among landowners and their
dependents in 18thcentury Bahia sertão/wilderness. The main hypothesis assumes that the
subalterns held a clear notion of their condition in society, and by making use of paternalism,
attempted to obtain from their landowners advantages for them and their families. I argue that
the relations among the landowners and the subalterns were constructed based on trust,
protection and affective sentiments, hard to measure. To understand the dependence in Bahia
rural world, I have followed the trajectories of the Soares da Rocha couple and of their
dependents (slaves, freed slaves and former households). The couple consisted of colonel
Quintino Soares da Rocha and “dona” Umbelina Adelaide de Miranda. They were the richest
landowners and greatest livestock (vacum cattle) and horse breeders, and, thus, the main slave
owners in Nossa Senhora da Graça do Morro do Chapéu (Chapada Diamantina) village. To
(re)construct the couple‟s and their dependents‟experiences, I have used a varied range of
documents, such as: notebooks, ecclesiastical documents (baptisms, weddings, and death
certificates), inventories and criminal processes. I have applied the method of nominative
relation. This method, when used in micro-history, biographies and trajectory studies makes
possible to understand slaves, freed slaves and free men family and community networks, as
well as understand the degrees of dependence within those groups.

Considerando, ainda, que tais incriminações ampliam a invisibilidade e a reprovabilidade
social que recaem sobre a prostituição, de forma que prejudicam o exercício de sua
atividade, obrigando-as a se lançarem às ruas sem qualquer rede de apoio, a despeito da licitude do comércio sexual. Tendo em vista, nesse sentido, que a criminalização do lenocínio se insere em um direito penal de cariz liberal cuja função reside na tutela de bens
jurídicos e no respeito à autonomia individual, em especial aos valores da autodeterminação e da autenticidade sexual, por preencherem o conteúdo da dignidade sexual. Objetiva-se verificar os limites da intervenção penal nos crimes de lenocínio no caso da intermediação
da prostituição exercida por pessoas maiores e capazes. Para tanto se procederá à investigação dos fundamentos para a criminalização do lenocínio, considerando-o integrante do gênero dos crimes sexuais, do ponto de vista discursivo, ético, jurídico e político. Em seguida, serão apresentadas as razões postas à limitação do poder punitivo em um Estado
democrático de direito, cuja tradição jurídica liberal por meio da teoria do bem jurídico, afasta o moralismo e o paternalismo jurídico-penal em respeito às liberdades, nos limites dos interesses legítimos de um ramo público do direito, ademais serão investigadas as formas de consideração da vítima nessa seara, com a finalidade de demarcar sua proteção
e o espaço intangível de sua autonomia individual. Por fim, tomando a dignidade sexual como vetor interpretativo, pretende-se demonstrar que a vontade para se prostituir exercida por pessoas maiores e capazes é apta à afastar a tipicidade dos crimes de lenocínio nos casos em que não houver indevida exploração sexual indevida, ou seja, aquela que afete a

Finally, in view of the fact that the Brazilian State is based on the protection of freedoms and is inserted in a liberal legal tradition since the promulgation of the 1988 Constitution. It is intended to answer the question of how to equate the criminalization of pimping with the autonomy to prostitute. For this purpose, the objective is to verify the limits of the criminal intervention in the crimes of pimping in the case of the intermediation of prostitution exercised by bigger and able people. In order to do so, we will investigate the grounds for the criminalization of pimping, considering it to be part of the sex crimes genre,
from a discursive, ethical, legal and political point of view. Next, the reasons given for the limitation of punitive power in a democratic State of law, whose liberal legal tradition by means of the theory of legal good, will remove morality and criminal-legal paternalism with
respect to freedoms, within the limits of the interests legitimate aspects of a public law branch, in addition to investigating the victim's consideration in this area, in order to demarcate their protection and the intangible space of their individual autonomy. Finally, by
taking sexual dignity as an interpretive vector, it is intended to demonstrate that the will to prostitute exercised by larger and capable persons is capable of removing the typical pimping crimes in cases where there is no undue sexual exploitation, in other words, the one that affects autonomy and vulnerability.

Previous issue date: 2007 / Resumo: John Stuart Mill é considerado neste trabalho um dos representantes mais significativos do utilitarismo. Suas idéias são tomadas como as mais inspiradoras e aquelas que contribuíram decisivamente para a construção de um utilitarismo matizado, qualificado e mesmo inovador. Mill, ao contrário do que alegam seus detratores, possuía, desde sua crise mental, uma capacidade extraordinária para abrigar as mais diversas tendências filosóficas de seu tempo, o que motivou grande parte das críticas que lhe foram dirigidas. Duas destas críticas a que se reporta neste trabalho é aquela empreendida por Henry John McCloskey e Gertrud Himmelfarb, sendo que esta entende ser Mill um porta-voz das idéias de seu pai, James Mill e de sua esposa Harriet Taylor, e que por ter abrigado idéias tão díspares em seu pensamento, teria acabado por se tornar ambíguo e defensor de teses contraditórias. Mais do que refutar tal interpretação analisa-se, aqui, as perspectivas que mobilizaram Mill, particularmente nas duas obras que circunscrevemos como exigência para o tratamento das reflexões do filósofo britânico: On Liberty e Utilitarianism. Considera-se, aqui, que Mill possui uma coerência nos temas a que se refere constantemente, quais sejam, a preocupação com o ideário utilitarista e com sua defesa da liberdade civil e dos direitos entendidos como prima facie. Esta tese analisa, ainda, as principais contribuições dadas por Mill e defendidas em On Liberty. Tal defesa ressalta a preocupação com as noções de autonomia, auto-desenvolvimento e liberdade positiva, posicionando-se por uma leitura de Mill como um pensador que rechaça o paternalismo e declara sua mais controversa e ao mesmo tempo frágil intenção, a fundamentação do liberalismo sobre bases utilitaristas / Abstract: John Stuart Mill is considered in this work one of the most significant representatives of the utilitarianism. His ideas are taken as the most inspiring and those that had definitely contributed for the construction of a complex, qualified and even innovative utilitarianism. Mill, in contrast with what his detractors allege, possessed, since his mental crisis, an extraordinary capacity to shelter the most diverse philosophical trends of his time, what has motivated most of the critics against him. Two of the critics that he reports to in this work is the undertaken by Henry John McCloskey and Gertrud Himmelfarb, which seems to show Mill as the spokesman of the ideas of his father, James Mill, and of his wife Harriet Taylor, and for establishing such different ideas in his thought, he would end up becoming ambiguous and a defender of contradictory theses. More than refuting such interpretation it can be analyzed, here, the perspectives that had mobilized Mill, particularly in the two works that we circumscribe as requirement for treating the reflections of the British philosopher: On Liberty and Utilitarianism. It is considered, here, that Mill possesses a harmony in the subjects he constantly refers as, whatever they are, the concern with the utilitarian idealism and with his defense of the civil freedom and of the known as prima facie. This thesis analyzes, still, the main contributions provided by Mill and defended in On Liberty.
