Elective participation varies considerably among domestic and foreign born young adults. In 2014, there was a difference of 16,1 percentage among domestic and foreign born men in electoral participation and between women there was a difference of 19,3 percentage. In democracies, political equality is important where all citizens have the same political right. The purpose is to answear how political acts are seen among young adults (18-25 years old) domestic and foreign born and if there are similarities and differences and if the political acts are based on their living conditions. This is a qualitative study because I want to get the respondents’ responses at the individual level through interviews. The study showed no difference among domestic or foreign born to political acts based on their living conditions. The reason for that may be the respondents who were foreign born came to Sweden as children and had taken part in society in the same way as a native born.

La délimitation des frontières entre les domaines administratif et politique en droit public français / The demarcation of legal boundaries between administrative and political domains in French public law

Paradigme de la pensée juridique française, la distinction entre les domaines administratif et politique est devenue confuse en raison du renforcement de l’Etat de droit et des approfondissements de la décentralisation. Alors que l’Etat apparaît comme une entité politique avec une dimension administrative, les collectivités territoriales constituent des entités administratives dont la dimension politique n’est pas reconnue par la conception traditionnelle de la décentralisation. Pourtant, en distinguant de façon théorique les organes administratifs des organes politiques, les organes locaux tant exécutifs que délibérants présentent des caractères politiques, sans toutefois pouvoir être assimilées aux institutions politiques étatiques qui elles seules exercent la souveraineté. Succédant à cette délimitation organique, la délimitation matérielle des deux domaines, qui se concentre sur les fonctions juridiques de ces organes, leurs actes et leurs responsabilités, confirme le placement des entités étatique et locales à la frontière entre ces deux domaines. Croissante, la dimension administrative de l’Etat s’oppose à l’irréductibilité du politique. La dimension politique des entités décentralisées, qui s’exprime par un pouvoir décisionnel, ne peut s’affirmer que dans le cadre de l’Etat unitaire. Fondée sur une analyse de la doctrine et de la jurisprudence, la délimitation des frontières juridiques entre les deux domaines permet finalement de cerner les notions d’administration et de politique en droit public. / The distinction between administrative and political domains was always a paradigm of French legal thought, yet it became complicated by the strengthening of both the Rule of Law and local autonomy. While the State appears as a political entity with an administrative dimension, local authorities are administrative entities whose political dimension is not recognized by the traditional conception of local autonomy. Nevertheless, by trying to separate administrative bodies from political bodies, local authorities entail political characteristics without being equated with state political authorities (which are the only authorities that can exercise sovereignty). Subsequent to this organic demarcation, the material delimitation of both domains, which focuses on the legal functions of these bodies, their actions and responsibilities, confirms that the State and local authorities are at the boundary between these two domains. Increasingly, the administrative dimension of the State can be contrasted directly with the irreducibility of policy. The political dimension of local entities, which is expressed through decision-making power, cannot question the unitary State. Based on an analysis of the doctrine and jurisprudence, the delimitation of boundaries between the two domains allows us to define ultimately the concepts of administration and policy.

The traditional legalistic approach is currently giv-ing way to a more wide-ranging view, exemplified in Ronald Dworkin s theory of law as integrity through which not only rules, but also principles themselves, should be subjected to a systemic, integrated analysis. Given this, Dworkin s work forms the theoretical platform for the questions raised by this entire study, since the integrated application of principles and rules has become fundamental in the pursuit of the ideal of justice, bringing a new focus on the role of administrative law in an environment of deep and rapid change that typifies hypermodernity. Consid-ering the new concept of the separation of powers, the notion of strict legality, by presupposing a means of controlling the exercise of State power, must be set against other constitutional principles of equal importance, taking into account the particularities of each case in question. In this context, the traditional concept of discretionality is outmoded. Jurisdictive control of these acts is not only possible, but also absolutely essential in a democratic state of law. The synthesis of this new paradigm for administrative law is clear and should be an indissoluble part of administators agenda in contemporary society: citizens are the effective benefici-aries of constitutional rights and guarantees. The technique of balancing principles by assessing their values in the particular case is already part of the jurisprudence of hypermodernity, which is in synchrony with neopositivism and the theory of law as integrity / Esta dissertação demonstra a recente tendência doutrinária e jurisprudencial ob-servada no Direito da hipermodernidade, que indica efetiva diminuição da parcela de discricionariedade nos atos da Administração Pública, a partir da aplicação in-tegrada de princípios e regras. Da tradicional abordagem puramente legalista passa-se atualmente para uma visão mais abrangente na teoria do Direito como Integridade, de RONALD DWORKIN, mediante a qual não só normas, mas também princípios, devem ser analisados de maneira sistêmica, integrada. Dado isso, a obra de DWORKIN é a base teórica de apoio às questões instigadas por todo este estudo, porque a aplicação integrada de princípios e regras se tornou essencial à busca do ideal de justiça, trazendo novo enfoque quanto ao papel do Direito Ad-ministrativo nesta ambiência de profundas e rápidas transformações típicas da hi-permodernidade. Considerada a nova concepção da separação dos poderes, o princípio da legalidade estrita, por encerrar uma fórmula de contenção do exercí-cio do poder estatal, deve ser contraposto a outros princípios constitucionais de igual relevo, observado o caso concreto. A acepção clássica da discricionarieda-de, assim, encontra-se de vez superada. O controle jurisdicional desses atos não é só possível, mas imprescindível num Estado Democrático de Direito. A síntese desse novo paradigma para o Direito Administrativo é clara e deve pautar a agen-da dos administradores na contemporaneidade: os administrados são os efetivos destinatários dos direitos e das garantias constitucionais. A técnica de pondera-ção dos princípios contrapondo valores nos casos considerados já faz parte da realidade da jurisprudência da hipermodernidade, que se encontra sintonizada com o neopositivismo e com a teoria do Direito como Integridade
