The Effects of Racial Bias on Perceptions of Intimate Partner Violence ScenariosRubenstein, Batya Yisraela 17 June 2016 (has links)
The purpose of this study was to explore how racial bias affects perceptions of intimate partner violence (IPV). Public perceptions of IPV have been studied under numerous contexts to ascertain how characteristics of victim and the offender can affect these attitudes. A portion of this body of research has been dedicated to understanding the role of race in perceptions of IPV and a large portion of the findings have been mixed due to the interaction of biases and attitudes about race and IPV. Very few studies have looked at multiple forms of IPV in comparison with one another while also studying the sole effect of racial bias on these attitudes.
This study aimed to explore how racial bias affects perceptions of multiple forms of IPV. Through a survey design that utilized vignettes to present three forms of IPV, participants were randomly assigned to one of four racial dyads for the offender and victim in the vignette and then asked a series of questions about the vignette that measured perceptions of seriousness of the scenario, offender and victim culpability, and punitiveness of punishment. Participants’ attitudes towards domestic violence, racial bias, and violence in general were also measured using known attitudinal scales. The final sample consisted of 401 participants who were recruited through Amazon’s Mechanical Turk and completed the online survey.
Findings from this study suggested a role of racial bias on the sample’s perceptions of the seriousness of the scenario, offender culpability, and labeling the vignette a violation of the law.

The primary purpose of this study was to investigate how the life experiences of educators impact upon classroom discipline. The study considered the present situation regarding classroom discipline practice. As circuit manager directly involved with schools I was concerned to see that there were dysfunctional schools in my area because of the failure to manage classroom discipline effectively. <p.>The findings of the study indicate that classroom discipline practices can be improved if we understand the life experiences of educators. A qualitative narrative approach was applied and narrative interviews, observation and lived stories of educators were used to gather data from nine participants. All these educators were drawn from one circuit in the Nkangala Department of Education, a region in Mpumalanga Province, and are teaching in secondary schools. Purposive sampling was used to select the nine participants; all were prepared to share their lived experiences and ultimately, data analysis provided cogent answers to the research hypothesis. The research focused on issues such as recent South African studies conducted on discipline and corporal punishment, theories of discipline, how lived experiences impact on current behaviour. Le rôle du juge répressif dans les mesures pénales d'enfermement / Role of criminal judges in confinement measuresPelletier, Laure 10 July 2015 (has links)
La thèse se propose d’aborder l’enfermement strictement pénal sous l’angle des pouvoirs du juge répressif. À partir du choix d’une classification binaire des mesures pénales d’enfermement, articulée autour du critère de culpabilité, deux mouvements distincts ont pu être identifiés. Tout d’abord, la première évolution porte sur le rôle du juge répressif dans l’enfermement qui se fonde sur le critère de culpabilité, autrement dit qui se justifie par la commission certaine de l’infraction pénale et qui vise principalement à punir son auteur. L’étude s’emploie à déterminer le degré de liberté qui est accordé au juge dans le processus de la peine d’enfermement. Sa souveraineté est sujette à une double mutation. Tandis qu’elle se trouve limitée dans le processus de recours à la peine d’enfermement, tantôt par le parquet, tantôt par le législateur, elle est au contraire pleinement consacrée lorsqu’il s’agit pour le juge d’adapter son exécution, de manière prépondérante au stade post-sentenciel et de manière plus ponctuelle au stade sentenciel. Ensuite, la seconde partie de la thèse tend à démontrer que le rôle du juge, dans le cadre de l’enfermement qui n’est pas la conséquence directe de la culpabilité, car ne remplissant pas une fonction essentiellement punitive, est en construction. L’étude distingue alors les mesures privatives de liberté pré-sentencielles, destinées au bon déroulement d’une procédure pénale, qualifiées d’ « enfermement procédural », de celles qui se fondent essentiellement sur la dangerosité de l’individu auquel elles s’appliquent, qualifiées d’« enfermement-sûreté ». Pour les premières, le rôle du juge semble être en quête d’équilibre, eu égard à l’impérieuse nécessité de concilier le respect de la présomption d’innocence et les nécessités de la détention comme ultima ratio, à travers la recherche permanente de la garantie judiciaire idéale. S’agissant des secondes, on assiste à l’émergence d’un rôle original, inédit, dépassant les frontières classiques du droit de punir. Pour preuve, depuis 2008, le juge peut, d’une part, tirer les conséquences juridiques de l’irresponsabilité pénale de l’auteur de l’infraction atteint d’un trouble mental et d’autre part, prononcer un nouvel enfermement à l’encontre d’une personne ayant déjà exécuté une première condamnation. Dans ces deux situations, le fondement de la dangerosité vient se substituer à la responsabilité pénale classique. En conclusion, à la charnière du droit de la peine et de la procédure pénale, cette étude se présente comme un essai de théorisation de l’évolution du rôle du juge répressif en matière d’enfermement et s’inscrit dans une réflexion plus globale sur l’office du juge au XXIème siècle. / The thesis proposes to apprehend the criminal confinement strictly in terms of the role of criminal court. From a binary classification of criminal confinement measures, centered around the culpability test, two separate movements could be identified. The first change concerns the role of the criminal court in confinement which is based on the criterion of guilt. The study then examines the freedom granted to it in the process of the sentence of imprisonment. It appears that the sovereignty of the judge is subject to a double mutation. While sovereignty appears weakened in the process of recourse to the death of confinement, due to authorities that exercise some influence on him, it is fully devoted to the contrary when it comes to the judge to adapt the execution of that sentence. This development questions more broadly about the meaning and the future of the office sanctioning the criminal courts.The second change concerns the judge's role in the custodial measures that stand in contrast to the foundation of guilt. The judge appears here under construction. The study then distinguishes the deprivation of liberty prior to sentencing, for the proper conduct of criminal proceedings, described as "entrapment-procedural ', those are mainly based on the dangerousness of the individual to whom they s'apply, described as "confinement-security". For the former, the role of the judge appears in search of balance, given the need to balance respect for the presumption of innocence and the needs of investigations. Regarding the second, we are seeing the emergence of an original role, unique, transcending the boundaries traditionally assigned.

The purpose of the study was to examine the perceptions of learners and teachers on the alternatives to ‘Alternatives to Corporal Punishment’ (ATPC) in particular and discipline generally in the King William’s Town Education District in two high schools. The study ascended as a result of the decline of learner’s discipline in high schools. This study is located in the interpretive paradigm and adopted a qualitative research approach using questionnaires, interviews focus groups and field notes in the collection of data. The Data revealed that schools were using different strategies to maintain learner’s discipline such as Code of Conduct, Disciplinary hearing, Safety and Security Committee, Educators, Corporal Punishment, Alternative methods to Corporal Punishment and the role of parents. It further revealed that the Department of Education is not supportive in the maintenance of discipline in the schools under study in King William’s Town District. The conclusion that was arrived at was that all the stakeholders should agree upon and be acquainted with the Code of Conduct and rules that are guiding the schools. The study came up with the proposal that learners should know the consequences of transgressing the Code of Conduct. To address disciplinary problems, the study came up with the key recommendation that all stakeholders must have ownership and to work as a team in the implementation of those policies.

Verbal hate speech and the legitimacy of its criminal punishment Hate speech has been enjoying an elevated level of media attention in the last few years. These biased expressions of hate - most often verbal - targeted against specific groups of people are a manifestation of social antagonisms and as such, disturb public order and coexistence of people; furthermore, they are often associated with issues of prejudice, bias-motivated violence, xenophobia, discrimination, and extremism. Criminal punishment of this type of expression is already possible today and it can be reasonably expected to become increasingly important. The purpose of this thesis is a critical review concerning the legitimacy of criminal punishment of verbal hate speech in the Czech Republic, including identification of troublesome elements of the current legislation. Conclusions of this review shall stem primarily from the legal analysis of constituent elements of relevant crimes, commentary literature, jurisprudence and legal literature related to the topic. The first chapter aims to explain the central concepts - hate speech, verbal hate speech and the relationship between them. Challenges in global politics like climate change, maritime piracy and fighting highly contagious diseases concern global public goods. The related policy decisions are mostly made by teams. In contrast, economic models of global public goods typically assume a single rational decision-maker. We use a laboratory experiment to compare team decisions to decisions of individuals in a finitely repeated public good game with and without a costly punishment option. Teams of three participants coordinate on decisions either by majority or unanimity rule. We find that in absence of a punishment option teams contribute more to the public good than individuals. With a punishment option subsequently to the contribution decision team treatments exhibit a less frequent use of anti-social punishment and lower levels of social as well as anti-social punishment. Extreme preferences for punishment are eliminated by the majority decision rule. Overall, team decisions are closer to the social optimum and teams yield higher net payoffs when compared to individuals.

In the Western States, a pecuniary punishment represents a proven alternative to (un)conditional imprisonment. By joint effort of the Supreme Public Prosecutor's Office and the Supreme Court, the pecuniary punishment has become a trend over the last few years also in the Czech Republic. Why should criminal justice bodies strive for more frequent imposition of the pecuniary punishment? In which cases is the pecuniary punishment an appropriate criminal sanction? And how is, or rather should be, the pecuniary punishment imposed and enforced? The submitted master's thesis draws attention to the obstacles of effective legal regulation and its inconsistent application. It deals with substantive and procedural aspects of the matter, relevant case law and statistical data. Conscious of the limits of comparisons in criminal law, the author also takes into account the law of Germany, Austria and the Netherlands. The first part of the thesis deals with the pecuniary punishment in general. The diploma candidate describes its purpose, position in the system of criminal sanctions and basic characteristics.
