The Russian market represents big opportunities for Czech exporters in the near and distant future. Czech companies have gained a lot of comparative advantages in the past periode: language simillarities, trade connections, cooperation of producing companies, good knowledge of local regional specifities etc. There are large scale of opportunities in traditional and new industry, glass and wooden industry, petrol and gas companies. It is necessary to know specific conditions and risks of the Russian market. To be competitive it requests not only to export but to account with capital participation. Objectives and Hypothesis of the dissertation: Basic goals: Analysis of the business climate in Russia as the result of the transformation process from centrally directed to market system and democracy. Evaluation of changes in the competitive position of Czech exporters and investors on Russian market. There are various measures and tools of the improvement of the competitiveness of Czech exports on the Russian market. As the member of the EU the Czech republic participates on all trade agreements valid in the trade relations between EU and Russia, first of all it is Partnership and Cooperation Agreement inclusive MFN regime (the Most Favoured Nation Clause). Czech exporters have a lot of strong points in the return to Russian market. There are also certain weaknesses, a lot of opportunities but also threatens. The Czech institutions which provide effective and complex credit and insurance support for Czech exporters are: Czech Export Bank and Export Guarantee and Insurance Company.

A l’heure de la mondialisation, réguler la responsabilité sociétale des entreprises (RSE) au niveau international est un défi majeur auquel sont confrontés les Etats. Devant ce défi, le cadre du droit international classique semble sinon impuissant, du moins à la peine. Réguler la RSE nécessite de composer avec maintes difficultés tant en terme institutionnel que matériel. Concurrencés par de nouvelles normativités, tributaires de la volonté des Etats, les instruments de droit international classique semblent peu adaptés pour remédier à cette situation. En face de ses tentatives désarticulées et dispersées, le marché trouve sa traduction juridique internationale dans un espace normatif large, intégré, et doté d’un pouvoir de contrainte effectif : l’OMC. Entre une régulation internationale de la RSE qui s’apparente à une course d’obstacles en ordre dispersé et une régulation du commerce mondial doté de solides fondations, le décalage est considérable et le dialogue faible. Cette thèse a pour objet d’ébaucher une piste de rééquilibrage à travers un outil encore peu étudié : la standardisation. Parmi les instruments de régulation, les standards techniques offrent un potentiel intéressant à plus d’un titre. Instrument de soft law, ses dimensions juridiques sont nombreuses et il s’affirme comme un instrument incontournable tant pour le marché que pour la régulation des innombrables dimensions techniques de la RSE. Il semble le plus à même d’échapper aux contraintes auxquels font face les instruments de droit classique pour contribuer à davantage de cohérence entre la responsabilité sociétale des entreprises en droit international et le champ de l’OMC. / In a global world, regulate social responsibility (CSR) at international level is a major challenge for States. Framework of traditional international law seems powerless. Regulate CSR requires to cope with many institutional and material difficulties. In competition with new non-legal norms, dependent on the will of States, traditional international law instruments seem ill-suited to address this situation.In front of these disarticulated and scattered attempts, the international market finds its legal translation in a broad, integrated, normative space, with an effective power of constraint: the WTO. Between the international regulation of CSR and the world trade rules world the gap t is considerable and the dialogue is weak. This PhD thesis aims to draft a rebalancing trail through an understudied tool: standardization. Ttechnical standards have have a huge and unique potential. As soft law instrument, it is emerging as a key instrument for both international market and the regulation of innumerable technical dimensions of CSR. It seems best able to escape the constraints facing classical international law instruments to contribute to greater coherence between the social responsibility of corporations in international law and the WTO field.

The area of interest of the thesis is the horizontal liberalisation of the free movement of services based on Directives No. 2006/123/EC on services in the internal market, No. 2005/36/EC on the recognition of professional qualifications, No. 96/71/EC concerning the posting of workers in the framework of the provision of services and No. 2000/31/EC on electronic commerce. More precisely the main subject matter can be defined as the shift in the basic legal regime of free movement of services achieved through these four directives compared to the original state, i.e. the general regime under EU primary law as interpreted by the ECJ. The main objective is to analyze and critically assess the extent and significance of this shift. The basic questions are: To what extent is the resulting legal framework formed by the four horizontal directives different from the original situation? Is it merely a codification of the case law of the ECJ or a result of legislator's efforts to liberalise further the regime? To what extent does the liberalised regime enable or support abuse of free movement of services in order to circumvent the national law of the host state? L’analyse comparée du raisonnement du juge européen et du juge de l’OMC est menée en deux temps. Le raisonnement est, d’une part, déterminé, et d’autre part, finalisé. Il apparaît tout d’abord que le raisonnement du juge de l’Union et du juge de l’OMC est déterminé par des caractéristiques systémiques et normatives de ces organisations. Ainsi, la fonction assignée au juge et le caractère incohérent ou lacunaire des systèmes européen et de l’OMC conduisent les juges à raisonner de façon comparable. De même, l’indétermination des règles juridiques et la substance économique du droit ont une influence sur leur raisonnement. Il apparaît ensuite que le raisonnement est finalisé. La première finalité est inhérente au juge d’une organisation internationale ou supra nationale, et le raisonnement est alors un instrument mis au service de la réalisation des objectifs des Traités. First, it appears that the reasoning of both judges is determined by the systemic and normative characteristics of these organizations. Thus, the function the judge is given, along with the incompleteness and inconsistencies of the european and multilateral systems, lead both judges to reason in asimilar way. Likewise, the indeterminacy of legal rules and the economic nature of the lawboth have an impact on reasoning. Second, it appears that reasoning is harnessed. As it is true for any supranational or international judge, reasoning is used as an instrument to achieve theTreaties' objectives. Furthermore, reasoning is an integral part of the judge who uses it in order to ensure the acceptability of his ruling.

A atuação paradigmática do Brasil no processo de formação e atuação do G20 fez com que o país se tornasse um eminente player nas negociações agrícolas da Rodada de Desenvolvimento de Doha e entrasse de maneira definitiva no alto nível decisório da Organização. Dessa forma, o objetivo deste trabalho é explorar o debate relacionado à atuação das coalizões internacionais, bem como identificar os elementos que constituem a liderança política nesse modo de ação coletiva, sobretudo no que se relaciona ao caso da atuação do Brasil no G20 durante as negociações da Rodada Doha da OMC. / Since the creation of the WTO in 1995, developed and developing countries intensified the demand for a more effective and coordinated action, especially during the Doha Round, and began to influence the decision making process through the creation of international coalitions. The paradigmatic role of Brazil in the formation and performance of the G20 has rendered the country a prominent position in the agricultural negotiations of the Doha Development Round. Thus, the objective of this paper is to explore the debate related to the performance of international coalitions, and to identify the elements that constitute the political leadership in this mode of collective action, especially with regard to the case of Brazil\'s role in G20 during negotiations of the WTO Doha Round.

Os órgãos que compõem o Sistema de Solução de Controvérsias da OMC possuem competência para analisar reclamações fundadas nos denominados acordos abrangidos e formular conclusões e recomendações sobre a conformidade das medidas impugnadas com os referidos acordos. Para interpretar as disposições destes acordos, estes órgãos podem recorrer às regras costumeiras de interpretação previstas na Convenção de Viena sobre o Direito dos Tratados de 1969. Estas regras de interpretação, por sua vez, permitem àqueles órgãos recorrer a espécies normativas produzidas fora do contexto da OMC como subsídios para esclarecer o sentido dos termos das disposições dos acordos abrangidos. Ao se valer destas espécies normativas, os referidos órgãos estarão também, inevitavelmente, interpretando as disposições destes. Nesse contexto, esta pesquisa teve por objetivo analisar de que forma as espécies normativas tradicionais de Direito Internacional do Meio Ambiente (convenções, costumes e princípios gerais de direito) foram interpretadas pelos órgãos do OSC em três casos escolhidos para representar o problema. Os resultados da análise dos casos demonstraram que espécies normativas do Direito Internacional do Meio Ambiente são efetivamente admitidas no processo interpretativo dos acordos abrangidos, o que pode se dar de forma vinculante ou não, bem como podem influenciar efetivamente na interpretação destes acordos, confirmando-lhes o significado ou lhes atribuindo um significado não explícito, embora as conclusões desta interpretação nem sempre resultem em posicionamentos totalmente favoráveis às medidas unilaterais adotadas pelos Membros da OMC a título de preocupação ambiental. / The organs that make up the dispute settlement system of the WTO have power to examine complaints founded in so-called covered agreements and formulate conclusions and recommendations on the compliance of the contested measures with the agreements. To interpret the provisions of these agreements, these organs may make use of interpretation customary rules of the Vienna Convention on the Law of Treaties of 1969. These rules of interpretation, in turn, allow those organs resort to normative species produced outside the context of WTO as subsidies to clarify the meaning of the terms of the provisions of the covered agreements. By borrowing these normative species, those bodies will also inevitably interpreting the provisions of these. In this context, this study aimed to examine how traditional normative species of International Law of the Environment (conventions, customs and general principles of law) were interpreted by the DSB organs in three cases chosen to represent the problem. The case analysis results showed that normative species of International Law of the Environment are effectively admitted in the interpretive process of the covered agreements, which can occur in binding or not, and can effectively influence the interpretation of these agreements, confirming them the meaning or assigning them a no explicit meaning, although the conclusions of this interpretation does not always result in favorable positions to fully unilateral measures adopted by WTO Members in respect of environmental concern.

Cette recherche est une thèse analytique des entraves à l’adhésion de l’Iran à l’OMC (Organisation Mondiale du Commerce).La présente recherche a répondu à ces questions : pourquoi, après tant d’années, la République Islamique d’Iran n’a-t-elle pas pu adhérer à l’Organisation mondiale du commerce ? Pourquoi l’Iran peine-t-il à devenir membre à part entière de l’OMC ? Dans cette thèse nous avons analysé ces entraves dans trois domaines : juridique, économique et politique. En effet les obstacles (juridiques, économiques et politiques) internes à l’Iran sont des plus importantes. or dans le domaine juridique la contradiction entre les lois nationales iraniennes, et les règles de l’OMC sont les plus notables entraves à son adhésion. Dans le domaine économique la domination du Secteur public et de l’Etat sur le commerce extérieur et l’existence d’un Etat rentier pèsent sur l’économie du pays, aussi les restrictions sur l’investissement direct étranger en Iran, sont de nombreuses entraves à cette adhésion. Dans le domaine politique la souveraineté nationale de la République islamique est un facteur important qui empêche son adhésion à l’OMC. En effet les conflits d'intérêts et les contradictions fondamentales entre la République Islamique d’Iran et les grandes puissances comme les Etats-Unis et les pays européens, en plus du conflit sur le dossier nucléaire iranien sont des obstacles considérables. Aussi la politique extérieure de l’Iran et la poursuite d’une politique internationale idéologique et la politique de confrontation avec l’occident ne sont pas cohérentes avec le processus de la mondialisation et sont donc des obstacles a cette adhésion. / This research thesis analyses the obstacles Iran is undergoing in its plight for membership to the World Trade Organization. This research aims at answering the following questions: Why after so many years has Iran been unable to join the World trade organization as a full member? Why does Iran have such difficulty in becoming a full member? In this thesis we have analyzed these obstacles in three areas, legal, economic and political. It is in the legal field within Iran itself where obstacles show to be of the greatest significance. The constitution, regulations on import and export, laws on the monopoly of trade and the rules of the W.T.O. itself, all hinder its membership. As far as the economic sphere is concerned, there are several factors which prevent Iran from becoming a full member. First of all, Iran has a domineering public sector. In addition, state foreign trade, restrictions on direct foreign investment in Iran and its rich resources are all contributing factors which influence the country’s economy. In the political field, the sovereignty of the Islamic republic is a major barrier to its adhesion. Conflicts of interest and fundamental contradictions between the Islamic republic of Iran and the great powers, Europe and the United States, as well as the dispute over the nuclear issue, together make considerable obstacles. Iran is also held up from becoming a full member because of its foreign policy, its continuous pursuit of ideological international policies and its political confrontation with the West which is not consistent with the process of globalization.

Entre 1992 e 2005, representantes de 11.921 organizações não governamentais (ONGs) participaram de conferências realizadas pela Organização das Nações Unidas (ONU) e pela Organização Mundial do Comércio (OMC). Tendo em vista que, tradicionalmente, apenas os representantes dos Estados-membros dessas duas organizações seriam admitidos, a crescente presença de atores não-governamentais nesses eventos foi considerada uma das evidências empíricas do surgimento de uma sociedade civil global. Contudo, alguns críticos afirmam que a sociedade civil não seria global, mas concentrada geograficamente em alguns países. Nosso objetivo é analisar se, de fato, existe tal concentração e quais suas principais características. Com esse objetivo, analisamos a distribuição geográfica das sedes das ONGs credenciadas para esses eventos, discutindo dois dos principais argumentos contrários à idéia de sociedade civil global: o primeiro afirma que a sociedade civil não é global porque seus atores estão concentrados em países do Norte (gerando um desnível Norte-Sul, com predomínio numérico e político de ONGs do Norte sobre as do Sul); o segundo, defende que a concentração das ONGs espelha as atuais constelações de poder em âmbito internacional (pois as ONGs seriam, predominantemente, de países localizados no eixo Europa-América Anglo-Saxônica). Considerando que todos seríamos parte da sociedade civil global, procuramos constatar de onde são as pessoas e organizações que efetivamente têm participado das discussões e decisões a respeito de questões que dizem respeito a todos (os habitantes do planeta). / Between 1992 and 2005, 11921 representatives of nongovernmental organizations (NGOs) participated in conferences held by the United Nations (UN) and the World Trade Organization (WTO). Given that, traditionally, only representatives of Member States of these two organizations would be admitted, the growing presence of \"nongovernmental\" actors in these events was considered one of the empirical evidence of an emerging \"global\" civil society. However, some critics argue that civil society is not global, but geographically concentrated in some countries. Our goal is to examine whether, in fact, exist that concentration and their main characteristics. With this objective, we analyzed the geographic distribution of headquarters of accredited NGOs to conferences, discussing the two main arguments against the idea of global civil society: the first asserts that civil society is not \"global\" because their actors are concentrated in North countries (creating a North-South divide, with numerical and political dominance of NGOs from the North on the South); the second claims that the concentration of NGOs reflects the current constellation of power in the international arena (as the NGOs would be predominantly of countries located in EuropeAmerica Anglo-Saxon). Whereas we would all be part of global civil society, we see where are the people and organizations that have effectively participated in the discussions and decisions about issues that concern all (the inhabitants of the planet).
