The sustainability balanced scorecard : its theory and applications to companies operating within the South African fishing industry

Thesis (MBA (Business Management))--University of Stellenbosch, 2008. / AFRIKAANSE OPSOMMING: Verskeie korporatiewe fiaskos gedurende die afgelope dekade het wêreldwye opskudding veroorsaak met die gevolg dat daar vanaf ‘n nuwe oogpunt gekyk word na die wyses waarop korporasies bestuur word. Terselfdertyd is daar ‘n wêreldwye belangstelling gekweek in volhoubare ontwikkeling en korporasies se bydrae daartoe. Dit, tesame met korporatiewe bestuur, het tot die gevolg gehad dat die fokus vanaf die tradisionele finansiële verslaggewing geskuif het na rapportering op die sogenaamde “Tripple Bottom Line” en meer en meer maatskappye oor die wêreld genereer en publiseer deesdae op hul ekonomies-, maatskaplike-, omgewingsverantwoordelikhede en prestasies. Gou is daar egter besef dat rapportering en die opstel van beleide self nie genoeg is nie en een van die die grootste uitdagings aan korporatiewe bestuurders tans is om te verseker dat hul korporatiewe bestuurstelsels hul volhoubare strategieë ondersteun om te verseker dat die strategieë in hul maatskappystelsels en prosesse geintegreer is. Kaplan en Norton het in 1992 die Gebalanseerde Telkaart ontwikkel. Die telkaart is as instrument voorgestel om strategieë in aksie oor te skakel. Die telkaart erken dat die tradisionele finansiële maatstawwe nie voldoende is om die volhoudbare sukses van die maatskappy te verseker nie en skep ‘n balans tussen nie-tradisionele maatstawwe oor vier areas: finansieël, kliënte, interne prosesse en leer en groei. Alhoewel daar verskeie gevallestudies in literatuur voorkom waar Gebalanseerde Telkaart implementering gefaal het, het navorsing bewys dat in gevalle waar dit wel suksesvol geimplementeer is, die telkaart ‘n dramatiese verskil aan die maatskapy se prestasie gemaak het. Daar moet dus besef word dat die telkaart wel sy tekortkominge het en dat die implementering daarvan oordeelkundig moet geskied. Gedurende die 21st eeu het outeurs die potensiaal van die Gebalanseerde Telkaart om korporatiewe volhoudbaarheidsstrategië in aksie oor te skakel raakgesien om sodoende die gaping tussen volhoudbare korporatiewe bestuur en die integrasie van beleid en strategieë in die maatskappy prosesse en -stelsels te oorbrug met die integrasie van volhoudbare maatstawwe in die Gebalanseerde Telkaart. Wêreldwyd is die visvangbedryf gedurig onder die kollig vanweë sy impak op die omgewing en die Suid-Afrikaanse visvangbedryf word nie uitgesluit nie. Die visbedryf is ‘n bron afhanklike bedryf en maatskappye moet teen mekaar meeding vir toegang tot die ontgunning van die bron. Vanuit ‘n ekonomiese en ‘n omgewings oogpunt is dit dus van uiters belang dat maatskappye in die bedryf volhoudbare strategieë toepas om die hernubaarheid van die bron te verseker. Suid-Afrikaanse maatskappye bevind hulself egter in ‘n unieke situasie in terme van maatskaplike verantwoordelikheid vanweë die onregmatighede van die apartheidstelsel en maatskaplike verantwoordelikheid moet dus transformasie insluit. Daarvoor het die Departement van Handel en Industrie reeds Die Swart Ekonomiese Bemagtigings Telkaart ingestel om die vordering van maatskappye te meet. Hierdie telkaarte vorm dus ‘n uitstekende basis vir die volhoudbaarheids gebalanseerde integrasie, nie net om te voldoen aan die legislatiewe regulasies nie, maar ook om die geleenhede wat daaruit kan voortspruit ten volle te benut. Hierdie navorsingsverslag ondersoek dus die skakels tussen korporatiewe bestuur en korporatiewe volhoudbaarheid, die teorië rondom die Volhoudbaare Gebalanseerde Telkaart en die moontlike toepassing daarvan op die Suid-Afrikaanse visbedryf. / ENGLISH SUMMARY: Over the past decade outrageous corporate fiascos has resulted in a renewed interest in Corporate Governance and the way Corporates are managed. At the same time sustainable development and the Corporate contribution and Corporate sustainability has gathered worldwide interest in both institutional and corporate spheres. This has triggered new expectations for business transparency and has shifted the focus from traditional financial reporting to reporting on the organization’s impact and performance on the triple bottom line. More companies from across the globe are developing and reporting on their economic, social- and environmental responsibility and performance. It soon became clear that reporting on broad policy is simply not enough and one of the biggest challenges of corporate managers today are to ensure that their sustainable strategies and policies are integrated into their organizational governance structures and processes. Kapland and Norton have developed the Balanced Scorecard in 1992 to provide business managers with a management tool to translate their strategies into action. The scorecard recognizes that traditional financial measurements is not enough to ensure the continued success of organizations and creates a balance between non traditional measurements across four perspectives: financial, customers, internal processes and learning and growth. Although various case studies exist about Balanced Scorecard implementation, empirical research have indicated substantial performance improvement at organizations that have successfully implemented the Balanced Scorecard. Implementation thereof therefore has to be carried out with caution. During the 2000’s authors has recognized the potential of the Balanced Scorecard to translate Corporate sustainability strategies into action and bridge the gap between the way corporates are governed and sustainability by integrating sustainability measures into the Balanced Scorecard for the creation of the sustainability Balanced Scorecard. Fisheries, world wide are continually under the spotlight as a result of their impact on the environment and the South African fishing industry is certainly not excluded. Fisheries are a resource dependent industry and companies have to compete against each other for access to these resources. Apart from its environmental impact it is therefore of outmost importance that managers within the industry considers all the sustainability aspects in their organizational structures. This research report thus explores the link between Corporate Governance and Corporate Sustainability, the theory surrounding the sustainability Balanced Scorecard and the possible application thereof in order to ensure the long term sustainability of the industry.

L'exercice du droit de vote dans les sociétés / The exercise of voting rights in companies

Le droit de vote est la prérogative politique suprême de l’associé. Si de nombreux débats se sont intéressés à son caractère essentiel et à ses conditions d’attribution, peu de réflexions se sont concentrées sur ses modalités d’exercice. Celles-ci font pourtant l’originalité de ce droit individuel qui ne peut s’exercer que collectivement et sont déterminantes de son effectivité, lui qui ne peut se manifester qu’épisodiquement au gré des réunions de la collectivité des associés. La recherche des principes gouvernant son exercice, sujet méconnu car relevant surtout de la pratique, devrait permettre de mieux cerner sa portée. Sur le plan individuel, le principe essentiel est celui de la liberté du vote, qui peut même neutraliser partiellement les règles de son attribution, comme en cas d’abstention ou d’activisme actionnarial. Cette liberté suppose toutefois que l’intégrité du vote et son caractère éclairé soient préservés. Or il peut être altéré par des pressions extérieures, motivées par la valeur économique du droit de vote, ce qui requiert des dispositifs renforcés de protection. Sur le plan de l’organisation collective du scrutin, l’accent est mis sur l’intérêt social, justifiant la prédominance de la loi de la majorité et venant tempérer la liberté du vote. Ces règles organisationnelles, tout en garantissant le droit de participer aux décisions collectives, promeuvent une certaine loyauté du vote, notamment en sanctionnant les abus du droit de vote, et une certaine éthique du vote, comme au travers du say on pay. Cette prise en compte croissante des intérêts collectifs lors du vote invite à renouveler certaines réflexions majeures du droit des sociétés. Elle interroge en particulier sur le rôle de l’associé et sur le bien-fondé de certains principes tels que celui qui prohibe les cessions de droits de vote. / The right to vote is the supreme political prerogative of shareholders. While many debates have focused on its essential nature and the conditions under which it is granted, little thought has been given to how it should be exercised. The mode of exercise makes the right to vote unusual in that it arises from an individual right which can only be exercised collectively and indeed is critical for its effectiveness since voting rights can only be utilized episodically within the framework of general meetings of shareholders. The consideration of the principles governing the exercise of voting rights, a relatively unexplored topic since most effort in this area refers to practical aspects, should clarify the impact of this mechanism. At the individual level, the freedom to vote is a key principle, which can even partially neutralize the rules of its allocation, as in the case of abstention or shareholder activism. However, this freedom presupposes that the integrity of the vote and the right to information related to it are preserved. However, these features can be altered by external pressures motivated by the economic value of voting rights, which leads to a requirement for reinforced protection measures. At the collective level of the organisation of the ballot, the emphasis is placed on corporate interests, justifying the predominance of the majority rule and tempering the freedom to vote. These organisational rules, while guaranteeing the right to participate in collective decisions, promote a certain loyalty, in particular by punishing abuses of the right to vote, and via the application of a collective ethical approach (e.g. say-on-pay). This growing influence of collective interests in the voting process invites us to reconsider certain major company law principles. In particular, questions are around the role of the shareholder and the validity of certain of those principles such as that prohibiting the sale of voting rights.

Initially, it will be necessary to analyze the Law in Postmodernity, checking the inevitable axiological content of standards involving the law of nature, inserted as a human right third generation. We will analyze some philosophical currents that support and assist the perception of contemporary environmental law, in particular his interpretation. Also be traced an overview of the evolution of environmental law by addressing their social, economic and ecologic character; and these pillars necessary for the realization of human dignity. Then, we intend to recognize the existence of a collective intangible heritage, analyzing the possibilities and difficulties of obtaining and quantify the damage of this nature, given the basic principles that will guide the collective protection. For this, we will study the civilian view of moral damage, through the transition that culminated in the extent of injuries caused to an ecologically balanced environment damage. Finally, we see the evolution of matter in the higher courts, analyzing aspects such as the quantification of collective damages and allocation of its resources to the defense fund of diffuse rights / A proposta do presente trabalho é oferecer um estudo sobre a possibilidade do reconhecimento de danos imateriais às lesões causadas ao direito ao equilíbrio ecológico, interesse metaindividual que transcende a esfera privada dos seres humanos, atingindo toda a coletividade. Inicialmente, será necessária uma análise do Direito na Pós-Modernidade, verificando o inevitável conteúdo axiológico das normas que envolvem o direito da natureza, inserido como direito humano de terceira geração. Para tanto, analisaremos algumas correntes filosóficas que embasam e auxiliam a percepção do direito ambiental contemporâneo, em especial a sua interpretação. Ainda, será traçado um panorama da evolução do Direito Ambiental, abordando o viés sustentável em seus aspectos social, econômico e ambiental; sendo esses pilares necessários para a concretização da dignidade da pessoa humana. Em seguida, pretendemos reconhecer a existência de um patrimônio imaterial coletivo, examinando as possibilidades e dificuldades de auferir e quantificar os danos dessa natureza, diante dos princípios basilares que vão nortear a tutela coletiva. Para isso, estudaremos a visão civilista dos danos morais, passando pela transição que culminou na extensão dos danos imateriais às lesões causadas ao meio ambiente ecologicamente equilibrado. Learners' environmental awareness, effects on home and school practices towards littering : an action research case

The presence of pre-packed items contributes toward littering in schools and at home milieu. Most people particularly, and learners’ discard packages of pre-packed wrappers on the ground, thus contribute to littering. This study is intended to help all relevant stakeholders to plan activities that could reduce littering. The study is grounded within the critical theory and living paradigm exploring the effect of household and school practices on learners’ environmental awareness (EA) towards littering. This case study employed action research as a methodology to unpack the problem. Fourteen learners, who are referred to as co-researchers in this study, were selected randomly from seven classes and their parents were inevitably included in the study. Three cycles were conducted with the co-researchers. Five data collection methods are used to collect data. Tables, score total percentages and coding used to analyse data. The results of the study show that environmental activities could be useful within home and school setup and continued practice of environmental activities will in the end conscientise learners towards littering if approached through action research. / Science and Technology Education / M. Effects of the biographic factors and religious convictions on littering to enhance waste management in Pretoria city, South Africa

The economic and population growth have led to the increased volumes of municipal solid waste in South Africa, hence more pressure to the waste management facilities. Municipal solid waste management is a by-product of everyday living, this is the reason why there is an environmental burden caused by waste to the environment. This study was conducted in Pretoria within the three sampled areas, namely: Garsfontein, Marabastad and Pretoria Central Business District (CBD). The rationale of the study was to establish the influence and effects of biographic factors (age, marital status, educational background, gender) and religious conviction on littering. This project constitutes both qualitative and quantitative data collection methods. About 150 of the questionnaires were administered to each of the three sampled areas. Therefore, the overall proportion of the respondents was 450. Visual inspection was done in all the three sampled areas to observe the littering status quo and waste management situation in these particular areas. The visual inspection uncovered very interesting findings. It was established that Marabastad was cleaner in the morning than in the late hours while Garsfontein was clean throughout the day. Another problem that was discovered, amongst others was that of the condition of the bins in Marabastad and Pretoria Central Business District (CBD) which was bad compared to Garsfontein. From the questionnaire, it was found that the 72% of elderly respondents (< 36 yrs) are more environmental conscious than the young people (18-35 yrs) who 83% of them claim to litter when there is no bin. Further, among young people, 78% said litter cigarette butts and 93% of these said better street cleanliness would help reduce littering. 72% of adults said religious convictions would help reduce littering. The chi-square and correlation coefficient statistical data analysis methods were used to establish the relationship between different biographic and religious variables. Gender, marital status, monthly income, age and religious conviction were all found to have significant effects on issues regarding littering in the city. / Environmental Sciences / M. Sc. A metodologia utilizada foi à pesquisa-ação como caráter primordial a intervenção na realidade social. Utilizou-se a revisão bibliográfica para o aprofundamento dos conceitos teóricos relacionados à gestão do marketing sustentável e ao princípio da responsabilidade socioambiental. Realizaram-se, também entrevistas aos especialistas na gestão pública municipal e questionários junto à população. Para subsidiar estas entrevistas houve um estudo detalhado dos relatórios, por considerar relevante o dado obtido junto à Prefeitura e Secretarias do Município. Dessa forma, foi-se construindo um Estudo de Caso com o modelo de investigação PEIR (Pressão; Estado; Impacto; Resposta). Foram estabelecidos indicadores, os quais permitiram acompanhamento ao longo do estudo de caso e na evolução das ações ou interferências na construção do tema, bem como se tornou mais eficiente o processo de tomada de decisões. O resultado apresentado demonstra que o município possui deficiências no seu Sistema de Gestão Socioambiental. Apresenta conflitos comparados a qualquer região, mesmo as Regiões Metropolitanas, evidenciadas na sustentabilidade ambiental e controle social. Cabe relatar a limitação encontrada ao analisar os dadosda Secretaria Municipal de Saúde do Município de Miracema, DATASUS e SINAN. Os mesmos encontram-se defasados não refletindo o panorama da saúde no município. Por fim, o estudo sugere a Coordenação do Marketing na Estrutura Administrativa do Município, com objetivo de promover visibilidade, factibilidade e transparência, frente a um dos maiores desafios da humanidade: integrar desenvolvimento econômico com sustentabilidade socioambiental. / This thesis presents a study, which has been carried out in the city of Miracema, to evaluate the interaction of the marketing management in a healthy and sustainable city; for the building of the principle of social responsibility for health. The methodology that has been used was the action research, as the primary character of intervention in the social reality. A bibliographic review has been used for the deepening of the theoretical concepts related to the management of sustainable marketing and to the principle of social and environmental responsibility. There were also interviews with specialists in public municipal administration and questionnaires distributed to the public. In order to support these interviews there was a detailed assessment of the reports, considering relevant data obtained from the City Hall and the City Departments. Thus, a case study has been built up with the model of research PSIR (Pressure, State, Impact, Response) and indicators have been established that allowed to monitor the case study, the development of actions or the interference in the construction of the theme and made more efficient the decisionmaking. The result shows that the local council presents deficiencies in its social and environmental Management System. Presents conflict when compared to any region, even the metropolitan regions, highlighted in environmental sustainability and social control. It is necessary to mention the limitation found when analyzing data from the Municipal Health Secretariat of the Municipality of Miracema, SINAN and DATASUS. They are not updated and therefore do not reflect the actual picture of health in the municipality. Finally, the study suggests the coordination of the Marketing in theAdministrative Structure of the City, aiming to promote visibility, feasibility and transparency when facing one of humanity's greatest challenges: integrating economic development with social and environmental sustainability.

Licenciamento ambiental em áreas militares: proposta de método para a conformidade ambiental de um posto de abastecimento de combustível / Environmental licensing in military areas: proposed method for environmental compliance of a fuel supply post

O Exército Brasileiro tem entre suas atribuições o permanente preparo de sua tropa, visando sua melhoria operacional, pronto emprego e a utilização responsável do meio ambiente sob sua responsabilidade. A Lei Complementar nº 140/2011, atribuiu às Forças Armadas a dispensa do licenciamento ambiental de empreendimentos e atividades que envolvam o preparo e emprego da tropa. Desta forma, surge a necessidade de elaboração de procedimentos que conciliem a atividade militar com a conformidade ambiental. Através de um estudo de caso, esta pesquisa analisou, descreveu e criticou os procedimentos realizados pelos órgãos ambientais, necessários ao licenciamento ambiental para um posto de abastecimento de combustível de veículos automotores. Foi proposto método a ser aplicado pela Diretoria de Meio Ambiente do Exército Brasileiro para verificação da conformidade ambiental de seus futuros empreendimentos. O método proposto é dividido em duas fases, a primeira chamada de licenciamento de 1ª Fase, e a segunda, de licenciamento de 2ª Fase, com a previsão da renovação da 2ª Fase. Foram criados formulários para cada fase do licenciamento, bem como roteiros de fiscalização de tanques de armazenamento e tubulações. Como resultado da aplicação do método, propôs-se uma minuta de Instrução Normativa, que se adotada irá padronizar a conformidade ambiental para aquela atividade dentro do Exército Brasileiro. Ao se analisar os processos administrativos dentro do Exército Brasileiro pode-se concluir que não há procedimentos específicos que tratem de forma administrativa ou técnica o licenciamento ambiental de um posto de abastecimento de combustível. Concluiuse que 58 % dos quesitos poderiam ser suprimidos, sem prejuízo do processo de licenciamento. Pode-se perceber como vantagens da aplicação do método: a economia de tempo e recursos financeiros decorrentes da maior rapidez do rito proposto em comparação ao licenciamento tradicional, a conformidade ambiental da atividade de abastecimento dentro do escopo da atividade militar e, sob a ótica administrativa, a padronização do licenciamento ambiental. Como desvantagem conclui-se que o autolicenciamento pode propiciar desvios de conduta no interesse institucional, os quais podem ensejar a não conformidade ambiental, almejada pelo método, tais falhas administrativas precisam ser verificadas e combatidas por meio de efetiva fiscalização por parte de órgãos externos ao Exército Brasileiro ou através da fiscalização cruzada isto é, a verificação do processo da conformidade ambiental realizado por uma Força Armada diferente da que realizou o processo, ou seja o Exército Brasileiro fiscalizaria os processos de licenciamento feitos pela Marinha do Brasil e Aeronáutica, sendo a recíproca verdadeira. Outra desvantagem é a necessidade de alocação de recursos humanos adicionais para aplicação do método, necessitando de um aperfeiçoamento constante de seus militares. / The Brazilian Army has among its attributions the permanent preparation of its troops, aiming at its operational improvement, ready employment and responsible use of the environment under its responsibility. Complementary Law No. 140/2011, assigned to the Armed Forces the exemption of the environmental licensing of undertakings and activities that involve the preparation and employment of the troops. In this way, the need arises to elaborate procedures that reconcile military activity with environmental compliance. Through a case study, this research analyzed, described and criticized the procedures performed by the environmental agencies, necessary for the environmental licensing for a fuel supply station of automotive vehicles. A method was proposed to be applied by the Brazilian Army's Environment Directorate to verify the environmental compliance of its future projects. The proposed method is divided into two phases, the first licensing call for Phase 1, and the second, for Phase 2 licensing, with the expected Phase 2 renewal. Forms have been created for each phase of the licensing, as well as inspection scripts for storage tanks and pipelines. As a result of the application of the method, it was proposed a draft Normative Instruction, which if adopted will standardize the environmental compliance for that activity within the Brazilian Army. When analyzing the administrative processes within the Brazilian Army it can be concluded that there are no specific procedures that deal with the environmental licensing of a fuel supply station in an administrative or technical way. It was concluded that 58% of the items could be deleted, without prejudice to the licensing rite. The advantages of applying the method can be perceived as: the saving of time and financial resources resulting from the increased speed of the proposed rite compared to traditional licensing, environmental compliance of the supply activity within the scope of military activity and, from the administrative point of view , the standardization of environmental licensing. As a disadvantage, it can be concluded that self-certification may lead to deviations of conduct in the institutional interest, which may lead to environmental non-compliance, as desired by the method, such administrative failures must be verified and countered by effective oversight by external bodies. Brazilian Army or through cross-inspection, ie the verification of the environmental compliance process carried out by a different Armed Forces from the one that carried out the process, ie The Brazilian Army would supervise the licensing processes carried out by the Brazilian Navy and Aeronautics, being the reciprocal true. Pagamento por serviços ambientais para conservação de áreas protegidas particulares

O interesse sobre Pagamento por Serviços Ambientais (PSA) deve-se à possibilidade de conciliar os interesses econômicos da propriedade rural com a conservação ambiental, conforme previsto em recentes legislações. Desde a instituição do Código Florestal pela Lei n.º 4.771/1965, o Brasil adota a Reserva Legal e a Área de Preservação Permanente (APP) como mecanismos de manutenção de áreas protegidas particulares. Pela Constituição Brasileira de 1988, a exploração de propriedades rurais está condicionada à responsabilidade socioambiental, que visa garantir a preservação dos recursos naturais para a manutenção das condições ambientais de interesse de toda a sociedade. Buscando conciliar o interesse particular dos produtores aos interesses sociais da qualidade ambiental, o Pagamento por Serviços Ambientais (PSA), contemplado nas recentes legislações federais e estaduais, visa integrar interesses econômicos e ambientais. A Lei n.º 12.651/2012, que alterou o Código Florestal, previu instrumentos econômicos para gerar incentivos e ampliar a atratividade em manter áreas protegidas em propriedades particulares, mediante valoração dos recursos naturais. No Paraná, foi sancionada a Lei n.º 17.134/2012, que instituiu o Pagamento por Serviços Ambientais. Essas leis ainda carecem de regulamentos e mecanismos operacionais para sua efetiva implementação, sendo propósito deste trabalho verificar as possibilidades e limitações do PSA na conservação de áreas protegidas particulares, mediante revisão bibliográfica sobre PSA e análise de políticas ambientais de proteção de áreas adotadas no Paraná, complementadas por entrevistas com técnicos que trabalharam com essas políticas. O objetivo do trabalho é sugerir mecanismos para que esses instrumentos de política pública efetivamente incentivem os produtores a manterem áreas protegidas e sejam capazes de despertar o interesse de agentes usuários nos serviços ambientais, mediante estabelecimento de condutas e regulamentos legais. / Environmental Service Payment (Pagamento por Serviço Ambiental - PSA) is addressed to meet the need of conciliating rural property economic interests and environment conservation, according to the new environment laws. Since Law n. 4771/1965 established the Forestry Code, Brazil uses the natural resources’ Legal Reserves and Permanent Preservation Areas (Área de Preservação Permanente- APP) as mechanisms to help maintaining private protected areas preserved. As provided in the Brazilian Constitution of 1988, rural property exploration is subjected to socio-environmental liabilities in order to assure the preservation of natural resources and maintain ideal environmental conditions in behalf of the society interests. The Environmental Service Payment, in force both at Federal and State levels, seeks the conciliation between the producer private interest and the environment quality social interests. Law n. 12651/2012, which changed the Forestry Code, provides economic tools addressed to encourage rural property owners to maintain protected areas within their private properties through increasing the natural resources value. In the State of Paraná, Law n. 17134/2012 established the Environmental Service Payment. The aforementioned laws need rules, regulations and operation tools to be effectively implemented. The present work aims at checking the Environmental Service Payment possibilities and limitations concerning private protected area conservation in the State of Paraná through carrying out a bibliographic review and analyzing the environment protection policies, besides interviewing technicians who work with such policies. Our work objective is also to suggest mechanisms able to effectively encourage rural producers to maintain and protect natural areas, as well as to arouse the environmental user interest by establishing legal behaviors and rules.

O interesse sobre Pagamento por Serviços Ambientais (PSA) deve-se à possibilidade de conciliar os interesses econômicos da propriedade rural com a conservação ambiental, conforme previsto em recentes legislações. Desde a instituição do Código Florestal pela Lei n.º 4.771/1965, o Brasil adota a Reserva Legal e a Área de Preservação Permanente (APP) como mecanismos de manutenção de áreas protegidas particulares. Pela Constituição Brasileira de 1988, a exploração de propriedades rurais está condicionada à responsabilidade socioambiental, que visa garantir a preservação dos recursos naturais para a manutenção das condições ambientais de interesse de toda a sociedade. Buscando conciliar o interesse particular dos produtores aos interesses sociais da qualidade ambiental, o Pagamento por Serviços Ambientais (PSA), contemplado nas recentes legislações federais e estaduais, visa integrar interesses econômicos e ambientais. Maximal Proposition, Environmental Melodrama, and the Rhetoric of Local Movements: A Study of The Anti-Fracking Movement in Denton, Texas

The environmental problems associated with the boom in hydraulic fracturing or "fracking," such as anthropogenic earthquakes and groundwater contamination, have motivated some citizens living in affected areas such as Denton, Texas to form movements with the goal of imposing greater regulation on the industry. As responses to an environmental threat that is localized and yet mobile, these anti-fracking movements must construct rhetorical appeals with complicated relationships to place. In this thesis, I examine the anti-fracking movement in Denton, Texas in a series of three rhetorical analyses. In the first, I compared fracking bans used by Frack Free Denton and State College, Pennsylvania to distinguish the argumentative claims that are dependent on the politics of place, and affect strategies localities must use in resisting natural gas extraction. In the second, I compare campaign strategies that use local identity as a way of invoking legitimacy, which reinforces narrative frameworks of environmental risk. In the third, I conduct and analyze interviews with anti-fracking leaders who described the narrative of their movement, which highlighted tensions in the rhetorical construction of a movement as local. Altogether, this thesis traces the rhetorical conception of place across the rhetoric of the anti-fracking movement in Denton, Texas, while seeking to demonstrate the value of combining rhetorical criticism with rhetorical field methods.
