The thesis is denoted to two principal issues of European insolvency law - COMI notion interpretation and forum shopping. On the background of historic development, it interprets the current wording of European Insolvency Regulation in the light of case law issued by the Court of Justice of the European Union. It also analyses benefits and drawbacks of proposed legislative changes to COMI motion in the connection with the contemplated amendment of the European Insolvency Regulation. It proposes that COMI of companies is determined using irrebuttable presumption of COMI in the place of their registered seat. Further, it distinguishes between positive and negative forum shopping. Also, it provides an overview of risks and advantages related to forum shopping. The thesis evaluates the efficiency of current and potential tools for forum shopping elimination. It also deals with the relation of forum shopping to EU principal freedoms.

A tese \"More with less\" realiza uma indagação propositiva sobre uma nova geração de Equipamentos Coletivos para as periferias da Montevidéu Metropolitana. Nessas regiões a intervenção publica historicamente tem privilegiado ações isoladas de habitação, gerando territórios fragmentados e carentes de espaço público e centralidades. A hipótese, com base em estudos desde as ciências do homem, propõe a reformulação dos equipamentos coletivos desde a complexidade como paradigma e se baseia na desespecialização programática do projeto, visando uma viragem de qualidade na criação de urbanidade nas periferias da Grande Montevidéu. As condições de formulação desses novos equipamentos coletivos implicam: oferta de espaço publico de qualidade, escala significativa, imagem representativa que proponha um aporte estético e cultural, planejamento em rede visando o estabelecimento de relações urbanas ativadoras, concentração sinérgica de atividades e apertura programática para evoluir no tempo segundo a mudança das necessidades sociais e as politicas publicas. Esses equipamentos se constituem em Fórum, no sentido dos antigos romanos: um conjunto de equipamentos e espaços públicos atratores que estruturam e urbanizam. A definição do Fórum é estabelecida em termos abstratos como metaprojeto e é submetida a uma indagação projetual em contexto de laboratórios de ensino e pratica do projeto. O conjunto de projetos imagina, reconhece e expande as possibilidades da hipótese. / The doctoral dissertation \"More with less\" carries out a proactive research on a new generation of public equipment for the peripheral areas of metropolitan Montevideo. In these urban zones, public intervention has historically favored isolated housing developments which have produced fragmentary and unqualified public spaces and centralities. The hypothesis, based on human sciences studies, puts forward a reformulation of collective equipment assuming complexity as a new paradigm and starting from programmatic despecialization, aiming at improving urban conditions in the peripheral areas of metropolitan Montevideo. The formulation conditions for this new public equipment include: quality public space, significant scale, representative presence introducing aesthetic and cultural contributions, network design, looking forward to create triggering urban relationships, synergic concentration of activities and an open range of programs, in order to evolve in accordance with changes in social needs and political agendas. This equipment will turn into a forum (as in ancient Roman cities): a group of attracting pieces of equipment and public spaces capable of structuring and urbanizing the land. The definition of the forum is abstract. It is conceived as a metaproject and is the subject of a design research carried out within design teaching and practice labs. The set of projects imagines, recognizes and expands the hypothesis potential.

A interação no ensino a distância sob a ótica dos estilos de aprendizagem

As pessoas têm diferentes preferências no aprender, que acabam se refletindo nas suas diversas características acadêmicas e profissionais. Há muito tempo se procura uma resposta para a pergunta: \"por que nas mesmas condições de ambiente e forma de ensino, dois estudantes de mesmo nível intelectual, possuem níveis de aprendizagem diferentes?\". Parte da resposta pode ser encontrada nos estilos de aprendizagem, os diferentes modos pelos quais as pessoas percebem e processam as informações. Entender os diferentes estilos de aprendizagem é um passo importante para favorecer a individualidade, tirar proveito das habilidades e também identificar os modos menos preferidos de aprender. Esse autoconhecimento é fundamental ao tratamos do ensino a distância (EaD), que requer que os próprios alunos se organizem e otimizem seu próprio aprendizado. A partir do momento em que conhecem suas preferências, os estudantes têm a possibilidade de dirigir sua aprendizagem nessa direção. Por outro lado, o professor também tem subsídios para planejar atividades e disponibilizar recursos que atendam a uma variedade maior de alunos, diminuindo assim a taxa de desistência e mantendo a motivação, uma vez que a mesma também está intimamente ligada com o nível de comunicação e interação na sala virtual. Assim, o objetivo deste projeto é mapear os estilos de aprendizagem de estudantes matriculados em um curso de licenciatura em Computação na modalidade EaD e analisar a influência desse construto na interação desses estudantes no fórum. Para a coleta dos estilos de aprendizagem dos 36 alunos foram usados os instrumentos desenvolvidos por Felder e Soloman (1991) e o de Keirsey e Bates (1984), ambos traduzidos para o português. Os resultados identificam uma distribuição dos estilos de aprendizagem bem característica para alunos de um curso de licenciatura em Computação a distância. Além disso, as correlações entre esses estilos de aprendizagem e a interação na sala virtual na ferramenta fórum demonstram que os alunos ativos (FELDER; SOLOMAN, 1991) foram os que possuíram níveis de maior interação e de forma oposta, os racionais (KEIRSEY; BATES, 1984) estavam entre os que menos participaram das discussões. Verificou-se também uma predominância de indivíduos ativos dentre os que responderam aos tópicos de forma objetiva (critério de interação C1), assim como uma tendência de indivíduos dessa dimensão relacionarem mais os assuntos discutidos (critério de interação C2). Dessa forma, os resultados confirmam que o modo como os alunos interagem no fórum tem relação com seus estilos de aprendizagem, os quais podem auxiliar na proposição de atividades que motivem e incrementem a participação na sala virtual. / People have different preferences in learning, that reflect in their several professional and academic characteristics. Long ago it is looking for an answer to the question: \"why, in the same conditions of environment and education form, two students of same intellectual level, have different learning levels?\". Part of the reply can be found in the learning styles, the different ways for which people perceive and process the informations. Understanding the different learning styles is an important step to favor the individuality, to make good use of the abilities and also identify the ways less preferred to learn. This self-knowledge is fundamental when we are dealing with the long-distance education, which request that the own students organize themselves and optimize their own learning. From the moment when they know their preferences, the students have the possibility to direct their learning in this direction. On the other hand, the teacher also has subsidies to plan activities and to arrange resources for a bigger variety of students, thus diminishing the desistance rate and keeping the motivation, a time that this one is also deeply connected to the level of communication and interaction in the virtual room. Thus, the objective of this project is to map the learning styles of the students registered in a computer science course in long-distance education, and to analyze the influence in these students\' interaction in the forum. For the collection of the learning styles of the 36 students, it had been used the tools developed by Felder and Soloman (1991) and the Keirsey and Bates\' (1984), both translated into portuguese. The results identify a distribution of the learning styles well characterized for students of a long-distance bachelor course in Computer Science. Moreover, the connections between these learning styles and the interaction in the virtual room in the forum tool show that the active students (FELDER; SOLOMAN, 1991) were who had the levels of bigger interaction and, in contrast, the thinkers students (KEIRSEY; BATES, 1984) were among the ones that had less participated in the debates. It was also verified a predominance of active individuals between who had answered to the topics objectively (interaction criterion C1), as well as a trend of individuals of this dimension relate more the argued subjects (interaction criterion C2). This way, the results confirm that the way as the students interact in the forum has a relation with their learning styles, which can assist in the proposal activities that motivate and develop the participation in the tools of the virtual classroom.

Conectores de causa e condição em fóruns de discussão na Internet / The cause and conditional connectors in e-forums within the Orkut social network service

O propósito desta tese é estudar os conectores de causa e condição em fóruns eletrônicos de comunidades do Orkut. Esta pesquisa integra o projeto Gramática contrastiva alemão-português: conectores, realizado no Institut für Deutsche Sprache (IDS), em Mannheim (Alemanha), e apresenta os primeiros resultados da aplicação do modelo teórico que fundamenta as investigações para a constituição dessa gramática em um corpus inteiramente em língua portuguesa. A natureza argumentativa do fórum eletrônico propicia uma grande incidência de conectores de causa e condição e viabilizou a aplicação do modelo para a investigação desses recursos. Além disso, ao analisar os conectores textuais presentes em fóruns eletrônicos do Orkut, esta tese procura contribuir com os trabalhos destinados à caracterização da versão digital do gênero discursivo fórum de discussão e intensificar os estudos sobre as interações virtuais realizadas na rede de relacionamentos Orkut. Dessa forma, este estudo vincula-se também a um segundo projeto de pesquisa: Oralidade e escrita: características e usos dos gêneros midiáticos, desenvolvido no Departamento de Letras Clássicas e Vernáculas da Universidade de São Paulo (USP). Os resultados encontrados a partir da análise dos dados demonstram a aplicabilidade do modelo teórico adotado para estudos em língua portuguesa e as contribuições que pode oferecer para a compreensão do funcionamento sintático, semântico e discursivo dos conectores de causa e condição. Em relação ao gênero discursivo fórum eletrônico, a análise evidencia que algumas características já identificadas por outros pesquisadores, como a argumentatividade e a escolha do registro informal em interações virtuais, também podem ser observadas nos fóruns eletrônicos do Orkut. No entanto, a característica essencial dos fóruns de promover a discussão em torno de uma questão social controversa em busca de uma solução coletiva (cf. Xavier e Santos, 2005) parece estar mais rarefeita nos fóruns que se realizam nessa rede de relacionamentos. / The main purpose of this thesis was to investigate the cause and conditional connectors in e-forums within the Orkut social network service, under the frame of the project German-Portuguese Contrastive Grammar: connectors, carried out at the Institut für Deutsche Sprache (IDS), in Mannheim (Germany). It presents the first results of the application of the theoretical model of this grammar to a corpus entirely in Portuguese language. The argumentative nature of the e-forum provides a great incidence of cause and condition connectors, particularly attractive for the investigation of the resources and limitations of the model under evaluation. Moreover, by analyzing the textual connectors in Orkut\"s e-forums, this thesis aims to contribute to the recent investigation trend on the characterization of the electronic version of discussion forums and to intensify the studies of virtual interactions carried out in Orkut. Therefore, this research fits also to a second research project: Orality and writing: characteristics and uses of media genres, developed at the Departamento de Letras Clássicas e Vernáculas da Universidade de São Paulo (USP). Data analysis demonstrates the applicability of the model under evaluation to studies on the Portuguese language and the contribution that it can offer to the understanding of the syntactic, semantic and discursive functions of the cause and condition connectors. Regarding the e-forum genre, some characteristics which have already been identified by other researchers, such as the argumentativeness and informality of the texts, were observed in Orkut\"s e-forums as well. However, the forums essential characteristic of promoting a discussion around a controversial social issue in search of a collective solution to a given problem (Xavier e Santos, 2005) seems to be dissipated in the forums of this particular social network service.

A fidalguia universal como questão: Biscaia na monarquia católica (entre o século XV e inícios do XVII) / The universal nobility as a question: biscay in the catholic monarchy (from the 15th century until beginnings of the 17th)

Partindo da existência de uma fidalguia coletiva na região basca de Biscaia, ratificada juridicamente pela monarquia de Carlos V (1527) através da aprovação do conjunto de leis conhecido como Foro Novo, nos perguntamos: como esse fenômeno produziu-se? Quais os agenciamentos discursivos envolvidos em sua emergência? Sendo assim, recorremos a um estudo genealógico não-linear que abrangesse tal processo. Para tanto, utilizamos séries documentais tocantes à sociedade biscainha a partir século XV - especialmente - por meio das quais verificamos a passagem de uma sociedade assimétrica (regulamentada pelo Foro Velho - 1452) para a constituição fidalga em nível territorial. Além disso, não tomamos a fidalguia biscainha como um estatuto petrificado, mas nos preocupamos em analisar seu uso, funcionamento, articulações e produções de saber até inícios do século XVII no contexto monárquico. / Starting by the existence of a collective nobility in the Basque region of Biscay, juridically confirmed by the emperor Carlos V (1527) through the approval of a set of laws known as Fuero Nuevo, we have inquired: How this phenomenon was produced? Which agencies were used for its emergency? In this sense, we have resorted to a non-linear genealogical study, which comprehends that process. To do that, it has been selected documents related to the Biscayan society from the 15th century principally - through which it was verified the transformation from an asymmetric society (regulated by the Fuero Viejo 1452) to the noble constitution in this territoriality. Besides that, we do not understand the Biscayan nobility as a petrified statute, so we were concerned in analyzing its use, operation, articulations and knowledge productions until the beginning of 17th century in the monarchical context.

A presente tese é uma reflexão etnográfica sobre o processo de constituição do Fórum Social Mundial (FSM) como experiência política particular, vinculada à realização de encontros internacionais anuais na cidade de Porto Alegre (RS, Brasil) entre 2001 e 2005, no contexto mais amplo de protestos, encontros e debates associados ao ciclo contestatório dos movimentos antiglobalização ou alter mundialistas. Partindo da análise de textos produzidos a respeito do FSM, de documentos de registro da dinâmica organizativa e de memórias institucionais e pessoais de participação neste processo, este trabalho elabora algumas sínteses a respeito da relação entre a forma de práticas e discursos e os modos de produção dos sentidos das experiências políticas contemporâneas. A tese contribui para reforçar as análises qualitativas e críticas a respeito do fenômeno complexo do Fórum Social Mundial, através de uma perspectiva antropológica que tem como base exercício etnográfico de atenção e descrição dos usos particulares de categorias generalizantes tais como estratégia, metodologia e memória. Voltada para a dimensão processual e expressiva dos modos de fazer e modos de dizer coletivos, este trabalho busca destacar densidade de significados e a historicidade das linguagens da ação política, a partir de inspirações teóricas retiradas das análises das práticas cotidianas, que permitem aproximações entre as antropologias da arte e dos rituais às da política e do conflito. / This thesis is an ethnographic reflection on the process o constitution of th World Social Forum (WSF) a particular political experience, strongly linked to the annual meetings that took place in Porto Alegre (RS, Brasil) between 2001 and 2005, in the context of protests, encounters and debates associated to the contention cycle of the anti or alter globalization movement. Taking as a starting point the analysis of texts written a about the WSF, documents that register its organizational dynamics and both personal and institutional memories of this process, this work develops a few synthesis about the relation between the form os practices and discourses and the production of meaning in contemporary politics experiences. The thesis is a contribution to the qualitative and critical analysis of the complex phenomenon of the World Social Forum, through an anthropological perspective built on the ethnographic exercise of attention and description of their particular uses of broad categories strategy, methodology and memory. Focused on the processual and expressive dimension of the ways of doing and ways of saying, this work makes an effort to highlight the density of meaning and historicity of the languages of political action, having as a reference the analysis of daily life practices, which allow us to bring together the anthropologies of art and ritual and those of politics and conflict.

A Basílica romana é, para Zanker (2000: 36-7), uma das estruturas mais caracteristicamente romanas de qualquer cidade romana. Símbolo concreto da estrutura política, jurídica e social romana, sofreu alterações morfológicas e funcionais ao longo do tempo e do espaço que ainda intrigam os pesquisadores. O presente estudo busca conhecer esta estrutura, suas origens, principais características físicas e funcionais, transformações em Roma e no Império, mas especialmente na Gallia Comata, entendendo-a como um elemento utilizado pelo Império no processo de urbanização das províncias gaulesas. Para tal, foi realizado o estudo das basílicas desde seu surgimento, em Roma, sua difusão pelo Império. Como forma de conhecer as basílicas das Três Gálias (Lugdunense, Aquitânia e Bélgica, esta se desdobrando também em Germânia Superior e Inferior), elaborou-se um catálogo buscando, apesar das diferenças tipológicas, a homogeneidade dentro da sua utilização como elemento de urbanização romana da antiga Gallia Comata. E, para melhor entender a urbanização, foram estudados os oppida gauleses, as proto-cidades celtas dos séculos II e I a.C., o período imediatamente anterior à conquista romana. / According to Zanker (2000:36-7), the Roman Basilica is one of the most characteristic Roman structures of any Roman city. A concrete symbol of the political, juridic and social Roman structure, it suffered morphologic and funcional alteractions both in time and space that still intrigate the scholars. The present work tries to reveal and understand this structure, its origins, its main physical and functional caracteristics, its transformations in Rome and the Empire, but most specially in the Gallia Comata, seeing it as an element of the process of urbanization of the Gallic privinciae. To do so, we performed a study of the basilicas since its begnning, in Rome, its difusion by the Empire and, like a means to know the basilicas of the Three Gauls (Lugdunensis, Aquitanica and Belgium, this one divided into Belgica, Germania Superior and Germania Inferior), a catalog was made, searching, besides the typological differences, the homogeneity in their utilization as elements of Roman urbanization of the former Gallia Comata. And, for better understanding the urbanization, it was studied the Gallic oppida (hillforts), the Celtic proto-cities of the II and I centuries BC, the period that immediately preceded the period of the Roman conquest.

Miljömässigt kundbeteende? Kikaboni : Att differentiera sig på en marknad med syfte att sälja miljö- och hälsovänliga småbarnskläder via internet

Det samhälle vi lever i idag ser inte ut som det gjorde när våra fäder och deras generation växte upp. Utvecklingen har gjort att både globaliseringen och speciellt tekniken som berör information och kommunikation har tagit ett stort steg framåt.Tack vare teknikutvecklingen får många personer tillgång till en ny typ av information. Idag känner flertalet konsumenter till att det förkommer flera olika mer eller mindre farliga kemikalier som finns kvar i de klädesplagg som hänger i butik. En marknad har uppstått med kläder som är miljö- och hälsovänligt tillverkade. En övergriplig och en djupgående konsumentundersökningen har genomförts, samt en konkurrentanalys. Utifrån undersökningarna har vi utformat en övergriplig affärsplan. Syftet med uppsatsen är att undersöka, beskriva och analysera hur ett företag går tillväga för att starta upp en verksamhet som säljer miljö- och hälsovänliga småbarnskläder för barn i åldern 0-3 år. Anledningen till att vi valt att inrikta oss på småbarn är att barnen i så små åldrar har känsligare hud och lättare får allergier. Därför är ekologiskt framställda kläder viktigare för småbarn än för vuxna. Vår undersökning har i första hand ett beskrivande syfte men även till viss del ett explorativt syfte. Det innebär att när vi påbörjade den här studien så hade vi en relativt liten kännedom om undersökningsproblemet. Vi har dels använt oss av en kvalitativ metod och dels en kvantitativ metod och anser att vi har använt oss av en tvärsnittsansats i samtliga undersökningar. I vår studie har vi valt att kombinera primär och sekundärdata. De primära källor som vi har använt oss av är exempelvis vår marknadsundersökning. Grunden för arbetet, det vill säga vår teori som skapat våra problemformuleringar är sekundärdata.I slutsatsen har vi kommit fram till att det finns konsumenter som efterfrågar småbarnskläder som är miljö- och hälsovänliga via internet. Vi anser även att det finns ett sätt att differentiera sig på marknaden med vårt valda koncept. Vi skulle t.ex. kunna erbjuda ett sortiment med könsneutrala kläder som ej förekommer i större mängder i dagsläget. Det förekommer inte heller så många företag som erbjuder särskilt generösa servicevillkor. / <p>The society we live in today does not look like it did when our ancestors and their generation grew up. The development has made the globalization and technology, especially concerning information and communication taken a big step forward. Thanks to technological advances, many people have access to a new kind of information. Today a majority of consumers knows that more or less hazardous chemicals might remain in the garments that are hanging in the store. A market has emerged with clothes that are free from substances that are unhealthy and bad for the nature. A overall consumer survey, a profound survey and a competitor analysis has been done. From the surveys we have developed a simple business plan. The purpose of this essay is to explore, describe and analyze how to start up a company with a concept of selling eco-friendly and healthy clothes for children aged 0-3 years. The reason to why we chose to focus on toddlers is that a child in young age has a more sensitive skin and is more susceptible to allergies. Organically produced cloths are for that reason more important for toddlers than for adults. Our study has primarily had a descriptive purpose but also partly an investigational purpose. This means that when we began this study, we had quite little knowledge of the investigation problem. We have partly used a qualitative method and partly a quantitative method and we have used a cross-sectional approach in all investigations. In our study, we have chosen to combine primary and secondary data. The primary sources we have used are for example our market researches. The basis for the work, our theory that created our problem formulations is secondary data. In the conclusion, we are taking up conclusions that there are consumers who are seeking for toddler clothes that are eco-friendly and healthy by web shops. We also believe that there is a way to differentiate against the competitors with our selected concept. We could, for example offer a range of unisex clothes that are not present in significant quantities in the present situation.
