With a view to proposing some thoughts in this respect, we analyze the collections of textbooks approved by the National Program of textbook for high school (PNLEM/2009) and the notebooks bimonthly adopted by the Education Secretary of the State of São Paulo (SEESP/2009), made available to students and teachers, distinctly. We judge the relevance in analyzing these materials because we act in the public network of State of São Paulo aiming contributions that may occur. The analysis of these materials was carried out considering the tasks proposed on the content Analytic Geometry, limited to studying the equation of a line. The theoretical contribution that substantiate our analyses followed the assumptions of Anthropological Theory of didactic Yves Chevallard (1999) that focuses the study of praxeological organization mathematics and didactics designed for teaching and learning of Mathematics and the work of Nicolas Balacheff (1988), which aims to study the typology of proofs produced by students. Supported by this theoretical, we realize our analyses with the purpose of responding to our question: Which mathematics and didactics organizations involving proofs and demonstration are proposed for didactics materials of high school, on content Analytic Geometry? Answering this question, we developed a qualitative research with approach documentary and from survey bibliographic we might have idea of problems involved in the teaching and learning of proofs and demonstrations on mathematical content, both in elementary and high school. The analysis of these materials confirmed two of our research hypotheses and showed that the work with proofs and demonstrations in didactics materials was not abandoned, but the clarity of the terms belonging to deductive system is unsatisfactory for understanding of what is demonstration in Mathematics / O presente estudo tem como objetivo analisar como os autores de materiais didáticos do Ensino Médio organizaram as tarefas propostas envolvendo provas e demonstrações no conteúdo Geometria Analítica para a 3ª. série do Ensino Médio. Com o intuito de propor algumas reflexões a esse respeito, decidimos analisar as coleções de livros didáticos aprovadas pelo Programa Nacional do Livro Didático para o Ensino Médio (PNLEM/2009) e os cadernos bimestrais adotados pela Secretaria da Educação do Estado de São Paulo (SEESP/2009), disponibilizados para alunos e professores, distintamente. Julgamos a pertinência de analisar conjuntamente esses materiais por atuarmos na rede pública estadual paulista, visando às contribuições que vierem a ocorrer. A análise desses materiais foi realizada considerando as tarefas propostas sobre o conteúdo Geometria Analítica, limitado ao estudo da equação de uma reta. O aporte teórico que fundamentou nossas análises seguiu os pressupostos da Teoria Antropológica do Didático de Yves Chevallard (1999), que focaliza o estudo das organizações praxeológicas Matemática e didática pensadas para o ensino e aprendizagem da Matemática, e o trabalho de Nicolas Balacheff (1988), que visa ao estudo da tipologia de provas produzidas por alunos. Apoiado por esse referencial teórico efetivamos nossas análises com o intuito de responder à nossa questão de pesquisa: Quais organizações Matemáticas e didáticas envolvendo prova e demonstração são propostas por materiais didáticos do Ensino Médio, no conteúdo Geometria Analítica? Visando a responder a esta questão, desenvolvemos uma pesquisa qualitativa com enfoque documental, e a partir do levantamento bibliográfico pudemos ter ideia da problemática envolvida no ensino e na aprendizagem de provas e demonstrações em conteúdos matemáticos, tanto no Ensino Fundamental quanto no Ensino Médio. A análise desses materiais confirmou duas de nossas hipóteses de pesquisa e nos revelou que o trabalho com provas e demonstrações em materiais didáticos não foi abandonado, porém a clareza dos termos pertencentes ao sistema dedutivo é insatisfatória no que diz respeito à compreensão do que seja passível de demonstração em Matemática

La preuve en droit fiscal répressif : mise en forme du droit de la répression fiscale / Proof in repressive tax law : shaping the law of tax repression

La procédure fiscale répressive s’est ouverte à une large prise en compte des droits du contribuable. De la vérification à la perquisition, en passant par l’interrogation de l’individu, le pouvoir fiscal se trouve encadré, contrôlé, obligé de se déployer par référence à un ordre supérieur. La recherche des faits et l’administration de la preuve véhiculent une haute idée tant de l’individu que des garanties de justice. La protection procédurale, y compris en ce qu’elle requiert de l’accusation fiscale de faire la preuve complète des composantes de l’infraction et oblige l’Etat de tout mettre en œuvre pour conjurer l’arbitraire, laisse intacte le pouvoir de persuasion de l’administration des impôts. Massives, les facilités de preuve de celle-ci sont sans commune mesure avec les possibilités du contribuable, ce justiciable qui demeure tout de même un assujetti quelle que soit sa capacité argumentative. Cette latitude procède de la diversité des mécanismes de répression et de preuve mis à la disposition des services fiscaux. Elle découle aussi et surtout de l’approche de la culpabilité : afin de consolider le pouvoir fiscal, le système juridique a créé la théorie de l’infraction délibérée et habilite le fisc à s’y fonder, devant le juge pénal comme le juge de l’imposition, pour l’emporter facilement. / The repressive tax procedure has opened up to a wide consideration of the taxpayer's rights. From the verification to the search, through the interrogation of the individual, the fiscal power is framed, controlled, forces to be deployed in reference to a higher order. The search for facts and the administration of the evidence convey a high idea of both the individual and the guarantees of justice.Procedural protection, including in that it requires the tax charge to fully prove the components of the offense and obliges the state to do everything possible to ward off arbitrariness, leaves the tax administration’s power of persuasion intact. Massive, the proof facilities of this one are out of proportion to the possibilities of the taxpayer, that person who remains a taxable person regardless of his argumentative capacity.This flexibility stems from the diversity of the repressive and evidential mechanisms available to the tax services. It also follows from the approach of guilt: in order to consolidate fiscal power, the legal system has created the theory of deliberate infringement and empowers the tax authorities to rely on it, before the criminal judge as well as taxation judge, to win easily.

A noção de livre convencimento estipula ao julgamento de processos judiciais uma investigação sobre fatos amparada em avaliação epistemológica. Essa estratégia, entretanto, apresenta dificuldades insuperáveis nas diversas formulações desse tipo de raciocínio por não oferecer respostas definitivas para solucionar problemas práticos, como aqueles envolvidos na concretização do direito, levando a graus diferentes de dúvida. Diante desse quadro surge a pergunta sobre qual nível de confirmação será aceito para respaldar uma decisão. Esse trabalho propõe como solução a tal aporia uma aproximação dos argumentos utilizados para a decisão em matéria de fato à estrutura dos argumentos práticos. Assim, além das reflexões epistemológicas, incorporam-se elementos morais e políticos em seu esquema central. Por meio dessa conclusão são introduzidos obrigatoriamente ao raciocínio judicial o que se denomina critérios de suficiência, orientações sobre o grau de comprovação das versões levantadas num caso concreto. Esse instituto, além de imprescindível para viabilizar a racionalidade dos juízos de fato, assume ainda a função de distribuir o risco de decisões equivocadas entre os litigantes. Trata-se de elemento de legitimação das decisões em matéria de fato, mediante a argumentação dos riscos que o processo envolve. Esse raciocínio não é de forma alguma ignorado pela dogmática jurídica brasileira, embora não seja adequadamente sistematizado. Daí a importância de sua abordagem teórica, a demonstrar que é requisito imprescindível de legitimação das decisões sobre fatos tomadas nos processos judiciais, e verificação prática de diversos institutos, integralmente compatíveis com essa proposição. A partir de experiências jurídicas que tratam do assunto de modo sistematizado a mais tempo, propõe-se uma discussão sobre os termos que devem ser observados no ordenamento brasileiro em acordo com suas características. / The idea of free proof stipulates to judicial process decision an investigation over facts supported only by epistemological evaluation. This strategy, however, presents unbearable difficulties in the various manifestations of this kind of reasoning, as it does not offers definitive answers to solve practical problems, like those involved in applying the law, which leads to different degrees of doubt. Considering this picture, emerges the question about what level of confirmation will be accepted to sustain a decision. This dissertation proposes as a solution to the presented aporia an approximation of the arguments utilized to decide about facts to the structure of practical argumentation. Thus, beyond epistemological reasons, moral and political elements are incorporate to its central sketch. Through this conclusion are necessarily introduced to judicial reasoning what is called standards of proof, guidance about the degree of confirmation which versions must sustained to be successful on specific situations. This institute, additionally to its importance to validate the rationality of factual decisions, it assumes the purpose of distributing the risk of wrong perceptions among litigants. Its an element of legitimating decisions about facts, by reasoning the risks that the process handles. This reasoning is not at all ignored by Brazilian law, in despite of its lack of systematization. Hence the importance of its theoretical approach, which demonstrates that is an indispensible requirement of legitimacy to the decisions about facts taken in judicial processes, and of its practical approach, verifying the compatibility of several law mechanisms to this proposition. Build on juridical experiences that study the subject in an systematized fashion and longer than our occupation of the subject, it is proposed a discussion about the terms in which these should be observed in Brazilian law, in accordance to its characteristics.

Colour proof quality verification

<p>BACKGROUND </p><p>When a customer delivers a colour proof to a printer, they expect the final print to look similar to that proof. Today it is impossible to control if a match between proof and print is technically possible to reach at all. This is mainly due to the fact that no information regarding the production circumstances of the proof is provided, for instance the printer does not know which proofer, RIP or ICC-profile that was used. Situations where similarity between proof and print cannot be reached and the press has to be stopped are both costly and time consuming and are therefore wished to be avoided.</p><p>PURPOSE </p><p>The purpose of this thesis was to investigate the possibility to form a method with the ability control if a proof is of such good quality that it is likely to produce a print that is similar to it.</p><p>METHOD </p><p>The basic assumption was that the quality of a proof could be decided by spectrally measuring known colour patches and compare those values to reference values representing the same patches printed at optimal press conditions. To decide which and how many patches that are required, literature and reports were studied, then a test printing and a comparison between proofing systems were performed. To be able to analyse the measurement data in an effective way a tool that analyses the difference between reference and measurement data was developed using MATLAB. </p><p>RESULT </p><p>The result was a suggestion for a colour proof quality verification method that consists two parts that are supposed to complement each other.The first one was called Colour proofing system evaluation and is supposed to evaluate entire proofing systems. It consists of a test page containing colour patches, grey balance fields, gradations and photographs. The second part is called Colour proof control and consists of a smaller set of colour patches that is supposed to be attached to each proof. </p><p>CONCLUSIONS </p><p>The method is not complete since more research regarding the difference between measurement results and visual impression is needed. To be able to obtain realistic tolerance levels for differences between measurement- and reference data, the method must be tested in every-day production. If this is done the method is thought to provide a good way of controlling the quality of colour proofs.</p>

Nondeterminism and Language Design in Deep Inference

This thesis studies the design of deep-inference deductive systems. In the systems with deep inference, in contrast to traditional proof-theoretic systems, inference rules can be applied at any depth inside logical expressions. Deep applicability of inference rules provides a rich combinatorial analysis of proofs. Deep inference also makes it possible to design deductive systems that are tailored for computer science applications and otherwise provably not expressible. By applying the inference rules deeply, logical expressions can be manipulated starting from their sub-expressions. This way, we can simulate analytic proofs in traditional deductive formalisms. Furthermore, we can also construct much shorter analytic proofs than in these other formalisms. However, deep applicability of inference rules causes much greater nondeterminism in proof construction. This thesis attacks the problem of dealing with nondeterminism in proof search while preserving the shorter proofs that are available thanks to deep inference. By redesigning the deep inference deductive systems, some redundant applications of the inference rules are prevented. By introducing a new technique which reduces nondeterminism, it becomes possible to obtain a more immediate access to shorter proofs, without breaking certain proof theoretical properties such as cutelimination. Different implementations presented in this thesis allow to perform experiments on the techniques that we developed and observe the performance improvements. Within a computation-as-proof-search perspective, we use deepinference deductive systems to develop a common proof-theoretic language to the two fields of planning and concurrency.

Printing colour hard proofs using EFI Colorproof XF v. 3.1 and Photoshop CS3, and production substrates.

EFI Colorproof XF was found to be more convenient from a user’s aspect, and had features which are covered in the ISO 12647-7 standard (e.g. the ability to simulate screening and print margin information), which Photoshop CS3 lacked. None of the proofing systems distinguished itself in a clear way from the other; sometimes, on certain substrates, Photoshop CS3 produced most accurate colours, sometimes EFI Colorproof XF did. Further investigations need to be carried out to tell more exactly which system produce most accurate colours. Only 6 out of 34 simulation-combinations had colours within the tolerances in the standard. The result also shows that the production substrates should not be used as proofing substrates. Instead the proofing papers especially made for ink jet should be used to obtain more colour-accurate prints.

Magistro baigiamajame darbe analizuojami su įrodymų leistinumu ir sąsajumu civiliniame procese susiję aspektai. Įrodymų leistinumas ir sąsajumas aktualūs tuo, kad būtent nuo byloje surinktų įrodymų priklauso galutinis teismo sprendimas ir tai, ar pažeista asmens teisė ar interesas bus tinkamai ir operatyviai apginti. Siekiant tinkamai suprasti leistinumo ir sąsajumo kriterijų reikšmę, pirmoje darbo dalyje pateikiama ir aptariama įrodymų bei įrodinėjimo priemonių samprata. Antroji darbo dalis skiriama įrodymų leistinumo ir sąsajumo kriterijų analizei. Leistinumo kriterijus svarbus tuo, kad apibūdina įrodymų procesinę formą, rinkimo bei tyrimo tvarką, o sąsajumo taisyklė padeda užtikrinti proceso ekonomiškumą bei koncentruotumą. Analizuojant leistinumo aspektą, aptariama ir 2011 10 01 įsigaliojusio nebaigtinio įrodinėjimo priemonių sąrašo reikšmė, nes įsigalioję pakeitimai praplėtė įrodinėjimo galimybes, tačiau paliko neaiškumą dėl konkrečiai neįvardintų įrodinėjimo priemonių leistinumo reikalavimų. Trečioje darbo dalyje dėmesys skiriamas ne tik atskiromis įrodinėjimo priemonėmis gaunamų įrodymų leistinumui, bet ir konkrečių įrodinėjimo priemonių panaudojimui. Aptariami dažniausi būtinojo įrodinėjimo ir draudimo naudoti konkrečiai numatytas įrodinėjimo priemones atvejai. Kaip atskira leistina įrodinėjimo priemonė aptariami elektroniniai įrodymai, kurių panaudojimas civiliniame procese auga. [toliau žr. visą tekstą] / The Master’s thesis analyzes the aspects, related to admissibility and correlativity of evidence in civil procedure. The admissibility and correlativity of evidence are relevant, because a final judgment depends on the evidence collected in the case, and whether the person’s rights or interests will be properly and promptly defended. In order to properly understand the importance of factors of admissibility and correlativity of evidence, the first part of the Thesis presents and discusses the concept of evidence and means of proof. The second part of the Thesis is focused on an analysis of the factors of admissibility and correlativity of evidence. An admissibility criterion is important because it describes the procedural form of evidence, collection and the investigative procedure, and the rule of correlativity helps to ensure economy and concentration of the process. In analyzing the admissibility aspect, the value of a non-finite list of means of proof is also discussed, which came into force on 2011 10 01. These changes which came into force have expanded the capabilities of proof, but have left uncertainty in respect of the requirements of the admissibility of innominate means of proof. Proof, rigour and informality : a virtue account of mathematical knowledge

This thesis is about the nature of proofs in mathematics as it is practiced, contrasting the informal proofs found in practice with formal proofs in formal systems. In the first chapter I present a new argument against the Formalist-Reductionist view that informal proofs are justified as rigorous and correct by corresponding to formal counterparts. The second chapter builds on this to reject arguments from Gödel's paradox and incompleteness theorems to the claim that mathematics is inherently inconsistent, basing my objections on the complexities of the process of formalisation. Chapter 3 looks into the relationship between proofs and the development of the mathematical concepts that feature in them. I deploy Waismann's notion of open texture in the case of mathematical concepts, and discuss both Lakatos and Kneebone's dialectical philosophies of mathematics. I then argue that we can apply work from conceptual engineering to the relationship between formal and informal mathematics. The fourth chapter argues for the importance of mathematical knowledge-how and emphasises the primary role of the activity of proving in securing mathematical knowledge. In the final chapter I develop an account of mathematical knowledge based on virtue epistemology, which I argue provides a better view of proofs and mathematical rigour.

The reversal of the burden of proof, rule destined mainly to aid the judge in his decision has been frequently used in the field of the consumer s right, authorized in the Brazilian Consumer Code. It allows that, as long as specific fundamentals are present, that the Judge can decide favorably to the weakest part in case that there is a doubt regarding the demonstration of the facts by the parts involved, not using the normal rule of distribution of the burden of proof, but the inversion of such distribution. As it is a rule of exception, it has to be clearly expressed. The questioning that is done is that considering the present characteristics of modern criminality, and the tendency to make some of the basic institutions and rules of the criminal law process more flexible, and in order to try to answer to the organized crime, that such instrument would be able to be used in this kind of legal process. The goal will be to provide the judge with a new rule to distribute the burden of proof, different of the usual in dubio pro reo. It comes as a fact that the modern criminality requires changes in the field of the criminal process. There are new theories worldwide in criminal law and its practical use, pointing to changes, some of them very extreme. It became necessary a detail exam of the truth, of the proof itself, of the criminal proof, of the burden of proof and of its inversion. With all these analyzed, it was realized that it will not be possible, considering the present Brazilian constitutional structure, to use the inversion of the burden of proof in the criminal process. To circumvent this, two legislative proposals were then formulated, one in the constitutional arena, and another in the area of the Brazilian Criminal Code. The first one to permit the reversion of the burden of proof in the practical determination of a criminal offense, after been established the certainty that the accused is part of a criminal organization. The second proposal, allowing the utilization of the reversal of the burden of proof considering the civil effects of the criminal sentence, with emphasis in the loss of property supposedly acquired with the product of a crime and which it was not proved that the acquisition was performed with unlawful proceeds. / O presente estudo teve como objetivo principal examinar a possibilidade do uso da inversão do ônus da prova no Processo Penal Brasileiro. A inversão do ônus da prova, regra destinada principalmente ao julgador no iter da decisão, vem sendo utilizada com freqüência na área das relações de consumo, autorizada pelo Código Brasileiro de Defesa do Cosumidor. Permite que, presentes requisitos específicos, o Juiz possa decidir favoravelmente ao hipossuficiente, caso esteja em dúvida com relação à demonstração dos fatos pelas partes, não aplicando a regra normal de distribuição do ônus da produção de provas, invertendo tal distribuição. Como é regra de exceção, precisa ser expressa. O questionamento que se faz é se, à vista da moderna criminalidade, e de uma tendência de flexibilização de alguns dos institutos basilares do direito penal e processual penal, para tentar responder ao crime organizado, tal instrumento poderia ser usado nesse ramo do Direito. A finalidade seria a de permitir ao juiz do processo uma nova regra de distribuição do ônus da prova, diversa do in dubio pro reo. Partiu-se da constatação que a criminalidade moderna está a exigir alterações no campo da persecução penal. Há novas teorias penais e uso prático das mesmas, apontando para mudanças, algumas extremadas. Passou-se ao exame específico da verdade e da prova, da prova penal, do ônus da prova e de sua inversão. Dominados esses institutos, apontou-se que não seria possível, dentro da atual estrutura constitucional brasileira, o uso da inversão do ônus da prova no campo penal. Para sua implementação, duas propostas legislativas foram então formuladas, uma no campo constitucional e outra na esfera do Código Penal Brasileiro. A primeira, para permitir uma inversão do ônus da prova na aferição da prática delitiva, após ter sido constatada a certeza de que o acusado é partícipe de organização criminosa. A segunda, permitindo a utilização da inversão do ônus da prova na esfera de efeitos civis da sentença penal, mormente no perdimento de bens presumivelmente adquiridos com o produto do delito e sobre os quais não fora feita prova de aquisição com aportes lícitos.

A partir de experiências jurídicas que tratam do assunto de modo sistematizado a mais tempo, propõe-se uma discussão sobre os termos que devem ser observados no ordenamento brasileiro em acordo com suas características. / The idea of free proof stipulates to judicial process decision an investigation over facts supported only by epistemological evaluation. This strategy, however, presents unbearable difficulties in the various manifestations of this kind of reasoning, as it does not offers definitive answers to solve practical problems, like those involved in applying the law, which leads to different degrees of doubt. Considering this picture, emerges the question about what level of confirmation will be accepted to sustain a decision. This dissertation proposes as a solution to the presented aporia an approximation of the arguments utilized to decide about facts to the structure of practical argumentation. Thus, beyond epistemological reasons, moral and political elements are incorporate to its central sketch. Through this conclusion are necessarily introduced to judicial reasoning what is called standards of proof, guidance about the degree of confirmation which versions must sustained to be successful on specific situations. This institute, additionally to its importance to validate the rationality of factual decisions, it assumes the purpose of distributing the risk of wrong perceptions among litigants. Its an element of legitimating decisions about facts, by reasoning the risks that the process handles. This reasoning is not at all ignored by Brazilian law, in despite of its lack of systematization. Hence the importance of its theoretical approach, which demonstrates that is an indispensible requirement of legitimacy to the decisions about facts taken in judicial processes, and of its practical approach, verifying the compatibility of several law mechanisms to this proposition. Build on juridical experiences that study the subject in an systematized fashion and longer than our occupation of the subject, it is proposed a discussion about the terms in which these should be observed in Brazilian law, in accordance to its characteristics.
