Civilians as a direct target of violence : How modern warfare challenges International Humanitarian Law

This study aims to examine how the emergence of modern warfare are challenging International Humanitarian Law when it comes to the protection of civilians in armed conflict. Thereby gaining a better understanding of how modern warfare is putting civilians at risk and how International Humanitarian Law is being challenged by the development of warfare. This study is a multidisciplinary study of Peace and Conflict Studies and International Law, which gives a rare perspective on civilian’s position in modern warfare. Thereby this study is not only showing the legal challenges in armed conflict but also bringing in the perspective of civilian’s position in modern warfare. This study will make use of three case studies: urban warfare, non-state actors and the use of drones in armed conflict. This study concludes that the challenges which International Humanitarian Law meets in modern warfare, is related to the need of clarifications but also a need for a greater enforcement and respect of the law by all parties of the conflict, both state and non-state actors. Lastly, there is a need for strengthening the inclusion of non-state actors in international law and strengthen International Humanitarian Law to meet the challenges of modern warfare to protect the civilians.

Pedagogiska ämneskunskaper om proportionella samband / Pedagogical Content Knowledge about Proportional Relationships

Forskning om de särskilda matematikkunskaper som lärare behöver för att undervisa om proportionella samband är begränsad. Därav är syftet med denna studie att bidra med insikter om pedagogiska ämneskunskaper inom proportionella samband. Det görs med utgångspunkt i två frågeställningar, som utgår från två kategorier av pedagogiska ämneskunskaper i matematik som Ball et al. (2008) beskrivit: (1) Vilka kunskaper om proportionalitet och elever visar lärare? (2) Vilka kunskaper om proportionalitet och undervisning visar lärare? Studien har genomförts med hjälp av kvalitativa semistrukturerade intervjuer med fyra lärare som arbetar i grundskolan och undervisar i matematik. Resultatet visar på flera exempel på vad som är kunskap inom de båda kategorierna. Bland annat beskrivs olika representationsformer och hur de kan användas för progression av undervisning som exempel på kunskaper om proportionalitet och undervisning. Sådana kunskaper är av stor betydelse att lärare besitter eftersom förståelse för proportionella samband framhålls som viktigt inom flera områden i matematiken. / Research about the special kind of mathematical knowledge that teachers need to teach proportional relationships is limited. Therefore, the aim of this study is to contribute with insights into pedagogical content knowledge about proportionality. To study this, two questions were posed: (1) What can knowledge of proportionality and students be? (2) What can knowledge of proportionality and teaching be? The two questions are based on two different categories of pedagogical content knowledge in mathematics that Ball et al. (2008) have described. This study has been conducted through qualitative semi-structured interviews with four teachers who work with students in the ages of 10-13 and teaches mathematics.  The result of the study shows several examples of pedagogical content knowledge in both categories that has been studied. For example, different representations and how they can be used to progress the teaching are described as examples of knowledge of proportionality and teaching. It is of great importance that teachers possess such knowledge considering understanding of proportional relationships has been described as a key to many areas of mathematics.

Dynamic Fine-Grained Scheduling for Energy-Efficient Main-Memory Queries

Power and cooling costs are some of the highest costs in data centers today, which make improvement in energy efficiency crucial. Energy efficiency is also a major design point for chips that power whole ranges of computing devices. One important goal in this area is energy proportionality, arguing that the system's power consumption should be proportional to its performance. Currently, a major trend among server processors, which stems from the design of chips for mobile devices, is the inclusion of advanced power management techniques, such as dynamic voltage-frequency scaling, clock gating, and turbo modes. A lot of recent work on energy efficiency of database management systems is focused on coarse-grained power management at the granularity of multiple machines and whole queries. These techniques, however, cannot efficiently adapt to the frequently fluctuating behavior of contemporary workloads. In this paper, we argue that databases should employ a fine-grained approach by dynamically scheduling tasks using precise hardware models. These models can be produced by calibrating operators under different combinations of scheduling policies, parallelism, and memory access strategies. The models can be employed at run-time for dynamic scheduling and power management in order to improve the overall energy efficiency. We experimentally show that energy efficiency can be improved by up to 4x for fundamental memory-intensive database operations, such as scans.

Metrics, Models and Methodologies for Energy-Proportional Computing

Massive data centers housing thousands of computing nodes have become commonplace in enterprise computing, and the power consumption of such data centers is growing at an unprecedented rate. Exacerbating such costs, data centers are often over-provisioned to avoid costly outages associated with the potential overloading of electrical circuitry. However, such over provisioning is often unnecessary since a data center rarely operates at its maximum capacity. It is imperative that we realize effective strategies to control the power consumption of the server and improve the energy efficiency of data centers. Adding to the problem is the inability of the servers to exhibit energy proportionality which diminishes the overall energy efficiency of the data center. Therefore in this dissertation, we investigate whether it is possible to achieve energy proportionality at the server- and cluster-level by efficient power and resource provisioning. Towards this end, we provide a thorough analysis of energy proportionality at the server and cluster-level and provide insight into the power saving opportunity and mechanisms to improve energy proportionality. Specifically, we make the following contribution at the server-level using enterprise-class workloads. We analyze the average power consumption of the full system as well as the subsystems and describe the energy proportionality of these components, characterize the instantaneous power profile of enterprise-class workloads using the on-chip energy meters, design a runtime system based on a load prediction model and an optimization framework to set the appropriate power constraints to meet specific performance targets and then present the effects of our runtime system on energy proportionality, average power, performance and instantaneous power consumption of enterprise applications. We then make the following contributions at the cluster-level. Using data serving, web searching and data caching as our representative workloads, we first analyze the component-level power distribution on a cluster. Second, we characterize how these workloads utilize the cluster. Third, we analyze the potential of power provisioning techniques (i.e., active low-power, turbo and idle low-power modes) to improve the energy proportionality. We then describe the ability of active low-power modes to provide trade-offs in power and latency. Finally, we compare and contrast power provisioning and resource provisioning techniques. This thesis sheds light on mechanisms to tune the power provisioned for a system under strict performance targets and opportunities to improve energy proportionality and instantaneous power consumption via efficient power and resource provisioning at the server- and cluster-level. / Ph. En el presente trabajo de investigación de tipo cualitativo se realizó un análisis sobre la determinación adecuada de la pena del delito de actos crueles contra animales domésticos conforme al principio de proporcionalidad en Perú. Para el mismo, se comenzó analizando el tipo penal de los actos de crueldad contra animales domésticos en relación de la Ley de protección y bienestar animal N°30407 para posteriormente explicar las razones que sustentan dicha modificatoria, en torno a que se ha podido identificar que la pena impuesta para estos delitos se encontraría vulnerando el principio de proporcionalidad, por lo que es menester viabilizar su reducción a una pena que se encuentre conforme a la finalidad disuasiva buscada por el legislador. / In the present qualitative research work, an analysis was carried out on the adequate determination of the penalty for the crime of cruel acts against domestic animals in accordance with the principle of proportionality in Peru. For the same, it has begun by analyzing the criminal type of acts of cruelty against domestic animals in relation to the Animal Protection and Welfare Law No. 30407 to later explain the reasons that support said modification, around which it has been possible to identify that the penalty imposed for these crimes would be in violation of the principle of proportionality, so it is necessary to make it possible to reduce it to a penalty that is in accordance with the dissuasive purpose sought by the legislator.

La métrique de la juste peine : une analyse des décisions de justice prises par les acteurs judiciaires et le public

La thèse délaisse l’étude des biais, des erreurs et des influences externes qui modulent les décisions de justice et formule l’hypothèse que les individus, confrontés à un dilemme normatif (quelle serait la juste peine?), manifestent un souci de justice qu’il est pertinent d’analyser en lui-même. Les résultats de cette thèse indiquent qu’une proportion appréciable des choix et des jugements des citoyens et des acteurs judiciaires interrogés témoignent, en raison de leur cohérence interne et de leur modération, d’un souci manifeste de justice. Les données de la thèse s’appuient sur un sondage sentenciel dans lequel on demandait à des répondants du public (n=297), mais aussi à un échantillon d’acteurs judiciaires (n=235), de prendre des décisions de détermination pénale dans trois histoires de cas bien détaillées. La thèse s’intéresse à la détermination de la juste peine, laquelle incorpore trois prises de décision distinctes. Le premier chapitre de la thèse s’attarde à la qualité des échelles individuelles de sévérité des peines qui peuvent être infligées pour sanctionner un délinquant reconnu coupable d’actes criminels. Les résultats indiquent que les citoyens, tous comme les acteurs judiciaires, n’utilisent pas la même métrique pour statuer sur la sévérité des peines, mais que certains d’entre eux, font usage d’une métrique pénale plus cohérente et plus raisonnable que d’autres. Un test décisif pour jauger de la valeur d’une métrique est son aptitude à établir des équivalences pénales entre les peines de prison, de probation, de travaux communautaires et d’amendes. Le deuxième chapitre s’attarde à la qualité des choix sentenciels des citoyens et des acteurs judiciaires. Deux critères sont utilisés pour distinguer les sentences les plus justes : 1) le critère de proportionnalité ou de cohérence interne (les sentences données sont-elles toujours proportionnelles à la gravité de l’infraction commise ?); 2) le critère de modération ou de cohérence externe (la sentence donnée peut-elle rallier le plus grand nombre de points de vue?). Les deux critères sont importants parce qu’ils contribuent tous deux à réduire la marge d’incertitude du dilemme sentenciel. Le troisième chapitre prend acte que toute sentence fera possiblement l’objet d’un aménagement subséquent. Les formes les plus manifestes d’aménagement pénal sont régies par l’octroi d’une libération conditionnelle qui écourte la durée de peine qui sera purgée en prison. Certains acteurs judiciaires choisiront de tenir compte de cette libération anticipée en gonflant leur sentence, alors que d’autres se refuseront à le faire. Le dernier chapitre s’attarde aux raisons qui motivent leurs choix. / This thesis neglects the analysis of external influences, such as biases and errors, which may interfere in court judgments and propose that when facing a normative dilemma (What is the just decision?), individuals are driven by a concern for justice. This concern has not been properly scrutinized. When studying legal decisions, we note that a large proportion of all judgments and evaluations made by interviewed citizens and judicial actors are coherent and moderated, which demonstrates a concern for justice and equity. The results of the thesis are based on a sentencing survey conducted among citizens (n=297) and criminal justice professionals (n=235) who had to adjudicate upon three detailed case studies and specific sentencing questions. The thesis examines the process of determining the just sanction and is concerned with three types of judgments. The first chapter explores the quality of different penal severity scales that can be used to punish a criminal convicted of a crime. Results indicate that citizens, as well as criminal justice professionals, have different ways of conceptualizing penal severity, and that some of these views are more coherent and more reasonable than others. This chapter shows that one way of assessing penal metrics quality is to look at the exchange rates among qualitatively different sanctions (months of prison, years of probation, hours of community work and dollar amount of fines). The second chapter examines the sentencing choices. Two important judicial criteria are used to distinguish just sentences from unjust ones: 1) proportionality or internal consistency (are sentences always given in accordance to crime seriousness?); and 2) moderation or external consistency (is the sentence able to merge opposite points of views?). Both criteria are important in reducing a portion of uncertainty that is intrinsic to the sentencing dilemma. Indeed the search for the just punishment and strategies for uncertainty reduction are intimately connected. The third chapter takes into account the fact that sentences are not fully determined at the judicial level. This is especially the case for prison sentences since conditional release mechanisms drastically shorten the time actually spent behind bars. We attempt to understand the differential propensity among judges, crown and defense attorneys and probation officers to anticipate the likely impact of conditional release in determining the presumptive duration of the court sentence. Some court players will incorporate parole outcomes in determining their prison sentence while others refuse to do so. JUDr. Alena Macková, Ph.D. ABSTRACT: The thesis deals with the problems of inadmissibility of evidence by the audio and video recordings in civil proceedings. Attention is focused mainly on problems of using illegally obtained records as proofs. Diploma searches for the solution to the contemporary course which seems to be ineffectual. The thesis is divided into six chapters. The first and second chapters introduce the theoretical basis of proving in civil proceedings. The third chapter refers to the evidence by the sound and audiovisual records in the area of civil proceedings and deals with the main factors of its potential proving use. In the fourth chapter author deals with the collision of basic rights and interests, especially with the general personality right and the interest of effective Justice and proposes a Proportionality test as the solution. The fifth chapter contains a comparison of the Czech and German case law. Finally, the last, sixth chapter summarizes the most important findings and concludes the thesis. After the concept of human dignity has spread into a large number of constitutions from all over the world, detailed examination of this phenomenon is steadily gaining importance. This thesis finds three autonomous approaches to human dignity in constitutional law, namely a subjective human right, the source of human rights and an objective constitutional value. Each of these approaches is based on a particular historical view on human dignity. The key argument of this thesis states that the connection of the three aforementioned legitimate approaches leads to the creation of dangerous and undesirable hybrid forms of human dignity. These forms tend to be axiomatic, preventing from the rational legal argumentation as well as from the use of the proportionality principle. The implementation of the concept of human dignity in such an axiomatic way is an argumentative foul, unfortunately so frequently made by both judiciary and doctrines. The thesis further focuses on the examination of the axiomatic human dignity phenomenon with respect to the Constitutional Court of the Czech Republic decision-making specifically. La thèse analyse le recours, en droit pénal, à la technique énumérative, particulièrement aux listes d'infractions. Cette figure légistique, jadis utilisée dans les conventions bilatérales d'extradition, est aujourd'hui fortement répandue pour délimiter le champ d'application de règles exceptionnelles. Le droit pénal international, le droit pénal français et le droit pénal italien sont simultanément interrogés sur leurs recours à la technique énumérative. L'intérêt de ce rapprochement est de fournir un corpus d'étude riche et varié mettant en jeu différents systèmes et ordres juridiques. La liste n'est pas considérée sous le seul aspect légistique ; sa fonction politique est également analysée. Opérant une sélection d'infractions soumises à un régime différencié, elle est au service d'une répression aggravée ou innovante.L'utilisation de cette technique législative est évaluée à l'aune des résultats escomptés d'une part et avérés d'autre part. On découvre que l'extension, qui est naturelle à toute énumération, appelle une appréciation tantôt critique, tantôt positive. On regrette la dénaturation des listes d'infractions par des rédacteurs qui en détournent la vocation première. L'évaluation se fonde sur les grands principes du droit pénal, à savoir les principes de légalité et de proportionnalité, dont le respect effectif constitue in fine le remède proposé à la dénaturation des listes d'infractions. / The thesis analyses the utilization of enumeration through the "listing of crimes" as a legislative technique in criminal law. Such a method of legislative drafting was used historically in bilateral conventions, specifically in the area of extradition, but nowadays it is heavily employed in criminal law to delimit the scope of application of exceptional rules. Aiming at providing a rich and solid base of knowledge in a domain that is rarely studied, this work reviews various systems and legal orders. As such, the resort to "listing of crimes" will be examined in international criminal law as well as in French and Italian criminal law. Being a tool to select a group of crimes in order to treat them differently than the common crimes, the listing technique serves the needs of aggravated or innovative repression. In that regard, the "listing" technique is not only considered as a means of legislative drafting, but its political function is also analyzed. The utilization of this technique is assessed in the light of the expected as well as the verified results. The extension of an existing "list of crimes", a normal consequence of resorting to enumeration, is found to be positive in some cases but more or less criticized in other cases where legislatures deviate from the original reason for which this drafting technique has been elaborated. Examined from the perspective of the fundamental principles of criminal law, namely the principle of legality and the principle of proportionality, the usage of this technique is appraised. The respect of these two primordial principles constitutes the ultimate solution proposed for any deviated resort to "listing of crimes" as a legislative tool.

Critérios para o controle das normas tributárias indutoras: uma análise pautada no princípio da igualdade e na importância dos efeitos / Criteria for the control of extrafiscality: an analysis guided on the principle of equality and the importance of the effects

O Direito Tributário não tem como finalidade única a arrecadação de receitas para custear os gastos estatais. Embora esta seja a sua finalidade principal, a verdade é que ela coexiste com outras funções, como a finalidade de distribuição de riqueza e de intervenção na ordem econômica e social. Nesse contexto, o objetivo desta dissertação é aprofundar o estudo sobre a utilização instrumental das normas tributárias, determinando quais seriam os critérios de controle para a utilização dessas normas cuja função precípua é a promoção de determinada finalidade social, política ou econômica, e não a mera arrecadação de recursos. Para isso, inicia-se o trabalho com a delimitação do regime jurídico atinente a estas normas, analisando a legitimidade da função indutora na tributação diante da Constituição de 1988 e verificando quais são as limitações próprias da tributação e os princípios da ordem econômica a elas aplicáveis. Em seguida, passa-se a demonstrar que a função extrafiscal precisa ser controlada através da verificação da validade da finalidade buscada com relação às restrições impostas aos direitos envolvidos, especialmente no que tange ao princípio da igualdade e a aplicação da capacidade contributiva. Além disso, evidencia-se que a função extrafiscal não pode ser definida apenas pela sua causa, mas também pelos seus efeitos no mercado, uma vez que a indução de comportamentos faz parte de sua própria natureza. Após isso, identifica-se a necessidade de controle sobre a utilização das normas tributárias indutoras, apresentando os critérios para tanto: o princípio da igualdade, a aplicação da capacidade contributiva, o controle de eficácia, o exame de proporcionalidade, a complementaridade, a subsidiariedade, a economicidade e o cumprimento da finalidade. Por fim, estes critérios são aplicados em exemplos de normas tributárias indutoras no sistema tributário brasileiro, a fim de contribuir para o desenvolvimento do debate jurídico acerca da extrafiscalidade. / The Tax Law does not have the sole purpose of raising revenue to fund state spending. Although this is its main purpose, the truth is that it coexists with other functions such as the purpose of distribution of wealth and intervention in economic and social order. In this context, the aim of this dissertation is to deepen the study of the instrumental use of tax rules, determining the criteria to control the use of tax rules whose primary function is the promotion of a specific social purpose, political or economic, not mere fundraising. For this, the work begins with the definition of the separate legal status to these rules, analyzing the legitimacy of the regulatory function in taxation in the 1988 Constitution and checking what are the limitations of taxation and the principles of Economic Order applicable to them. Then it goes to show that the extrafiscal function needs to be monitored by checking the validity of the order sought in relation to restrictions on rights involved, especially with regard to the principle of equality and the implementation of ability to pay. Furthermore, it is evident that the extrafiscal function cannot be defined only by their cause, but also for their effects on the market, since the induction of behavior is part of their nature. After that, we identify the need for control over the use of Tax rules to induce the taxpayers behavior, presenting the criteria for that: the principle of equality, the implementation of ability to pay principle, effectiveness control, proportionality test and complementarity, subsidiarity, economy and fulfillment of purpose. Finally, these criteria are applied to examples of Tax rules to induce the taxpayers behavior in the Brazilian tax system in order to contribute to the development of the legal debate over extrafiscality.
