Above and below the surface : two models of subnational autonomies in EU lawFinck, Michèle January 2015 (has links)
This thesis examines the relation between subnational autonomies, that is to say regional and local authorities and the norms they create, and European Union law. The existence of local and regional autonomies within the various Member States of the EU is a factual truth. We know that they exist and co-exist with other levels of public authority, themselves generating norms. Yet, on its surface European Union law does not devise any substantive understanding of such autonomies. This stands in stark contrast to the relation between the Member States and the EU, which is governed by a complex catalogue of Treaty rules. As a consequence of European integration, however, subnational autonomies and EU law do interact, so that the latter cannot simply ignore the existence of the former. This thesis sets out to determine the contours of their mutual relation through an analysis of EU procedural and substantive law. It uncovers that the relation between subnational autonomies and EU law is multifarious and diverges depending on whether we look at the surface of EU law, that is to say the Treaties, or whether we look below its surface, at the Court of Justice's rich case law or soft law instruments of the Commission. I map this conclusion through a modelling approach, relying on what I term the 'Insider Model' and the 'Outsider Model' respectively. These models underline that, in some areas of EU law, SNAs are seen to be outsiders to the project of European integration whereas other areas recognise SNAs and especially their norms to be the insiders of that project. The coexistence of both models forces us intellectually to rearrange things. It challenges our 'constitutional imagination'. The key to understanding the coexistence of both models can be found in the evolution of EU law itself. While the Outsider Model remains attached to the public international law origins of the EU Treaties, the Insider Model captures the reality that not only States and citizens, but also SNAs, are integrated into the EU legal order.

This qualitative study aims to investigate how a multinational company works to promote workforce diversity and inclusiveness, how native and immigrant employees and managers experience social integration and social relations in the workplace, and how the managers work to contribute to social integration and social relations in the workplace. Interviews have been made with thirteen participants working in the same company. Among the participants there are natives and immigrants, and there are managers and employees. The theoretical framework is based on habitus, on capital, and on symbolic interactionism theory. The previous research is based on workforce diversity and inclusiveness, on social integration, and on social relations in workplaces. The findings indicate that the managers involve in different initiatives to promote diversity and inclusiveness inside and outside the company. Most participants have positive attitudes towards the position of the company in its work with diversity and inclusiveness. The findings also indicate that social integration and social relations in the workplace are of extreme importance for the employees and the managers. Most participants have good experiences of social integration in their workplace as they have feelings of inclusion, belonging, and community. Social relations in the workplace seem to be extremely significant for meaning, job satisfaction, well-being, and job performance. In addition, the findings indicate that the managers work with multiple initiatives to contribute to social integration and social relations in the workplace.

The diploma thesis focuses on the term risk in human life in general, as it is seen in the society and defined by current knowledge in the field of social science. Furthermore, the thesis explores the risk as a phenomenon connected to the social services. The social integration of disadvantaged groups of inhabitants into majority society have brought with it the need to defend the rights of people with disabilities, with an emphasis on their active involvement in everyday life, in seeking the opportunity to experience those situations that define this life. This focus brings a number of theoretical solutions for risk planning with respect to clients of social services. These solutions have been further taken into account in this section of the thesis. The experimental part of thesis focuses on the perception of risks by the employees who work in residential facilities in Zlín district, directly taking care of clients. This part of the thesis provides a relevant insight into risk awareness in selected residential facilities and its active use in practice. Consequently, it deals with other factors that may affect employees of facilities for people with disabilities when assessing risk planning and generally concerning their perception of the risk phenomenon in clients with mental disabilities. Idrottsämnet som en möjlig väg till integration har under de senaste tre decennierna fått allt mer uppmärksamhet i forskarvärlden. Forskare har hävdat att integrering, både in i skolans och samhällets struktur, har stora möjligheter att ske genom användandet av idrott som ett internationellt och kulturöverskridande språk. Emellertid har dessa slutsatser till stor del dragits utan att fråga skolelever med en utomeuropeisk etnicitet om vad deras upplevelser kring skolidrotten som en integrationsarena är. Syftet med vår undersökning är att undersöka vilka upplevelser elever med utomeuropeisk etnicitet har av idrottsämnet som integrationsarena. Genom att ta reda på deras åsikter och upplevelser hoppas vi kunna få en bättre uppfattning om idrottsämnet har eller inte har en integrerande roll och i så fall på vilket sätt. Vi har gjort en kvalitativ undersökning med öppna riktade intervjuer. Respondenterna utgörs av sex elever med utomeuropeisk etnicitet, som alla går i gymnasieskolan. Samtliga elever har vistats i Sverige i högst sju år vilket gör att de kan antas genomgå en integrationsprocess. Undersökningen visar att elever upplever idrottsämnet som en möjlig integrationsarena, dock skiljer sig deras åsikter åt i många avseenden. De upplever i olika grad idrottsämnet som en plats där de kommer i kontakt med den svenska kulturen, där de får en större förståelse för olika platser i samhället samt där de har en möjlighet att skapa vänner som de umgås med i skolan och på fritiden. Undersökningen visar också att möjligheterna till integration påverkar elevernas förutsättningar för innanförskap. Bland annat dessa aspekter gör att idrottsämnet kan ses som en arena som skapar förutsättningar för integration in i den svenska skolan men även in i det svenska samhället.

to the Housing State Program under PAC Beberibe have on experiencing their right to the city, taking into account the consumption perspective of collective use-driven goods. Besides the economic reasoning, consumption can be also construed as a social distinction factor, and also as political expression, when reasoned as a purpose of grassroots struggle for the equal access right to the ensemble of goods and services made available within the urban background. The perspective of the said consumption construing further enhances the studies dedicated to social inclusion process, in particular, when dealt with the urban setting and upon taking the city as a product of human labour, placed within a capitalist environment that brings together not only the physical structural dimension, but also the cultural, symbolic and the political dimension underneath the daily life. Aiming to meet the purposes of the said survey, the paper hereof turned out to be an exploratory, quality-led research. The empirical background of this paper comprised the families who have left the wretched dwellings in the banks of Beberibe River and currently live in council
housings built according with Beberibe Basin’s Integrated Sanitation Programme
(PAC Beberibe), carried out in the municipality of Recife, State of Pernambuco. Hence, upon the sample selection based on the snowball sampling technique, the empiric contribution to the speech analysis was employed as related to the French line to guide the search for the meaning given to the right to the city as experienced by the recipient families through their own descriptions. Among the outcomes thus achieved, it should be stressed that it is becomes indispensable that social housingoriented public policies are built upon the housing concept in a broader sense than its physical infrastructure, by encompassing the home feeling awareness and the entitlement to other social rights to the family, including the access to mass consumption goods and services and the actual involvement at the urban development, based upon the adoption of the citizenship status. / A presente dissertação tem por objetivo, compreender a percepção que as famílias beneficiárias do programa habitacional do PAC Beberibe possuem sobre a vivência do direito à cidade, levando em consideração a perspectiva do consumo dos bens de uso coletivo. Além da racionalidade econômica, o consumo pode ser interpretado também como um fator de distinção social e ainda como uma expressão política, quando pensado como um propósito de luta popular pelo acesso igualitário ao conjunto de bens e serviços disponibilizados no ambiente citadino. A observação destas interpretações do consumo, enriquece ainda mais os estudos que se dedicam ao processo de integração social, especialmente, quando se trata da esfera urbana e se admite a cidade como um produto do trabalho humano, imerso em um contexto capitalista que congrega não só a dimensão estrutural física, mas também a cultural, simbólica e a política que subjazem o viver cotidiano. E para atender os propósitos desse estudo, este último configurou-se como uma pesquisa qualitativa. Teve como universo empírico, as famílias que saíram de habitações miseráveis às
margens do rio Beberibe e que hoje residem nos habitacionais sociais construídos através do Programa de Saneamento Integrado da Bacia do Beberibe (PAC Beberibe) executado no município de Recife em Pernambuco. Assim, após a seleção da amostra com base na técnica bola de neve, fez-se uso do aporte teórico da Análise do Discurso referente à linha francesa para nortear a busca pela compreensão do sentido dado à vivência do direito à cidade pelas famílias beneficiárias através de suas narrativas. Entre os resultados obtidos, destaca-se que é imprescindível que as políticas públicas voltadas para habitação social
alicercem-se no conceito de moradia em um sentido mais amplo que o de sua infraestrutura física, ao englobar a sensação de lar para o núcleo familiar e o atendimento dos outros direitos sociais, incluindo o acesso aos bens e serviços de consumo coletivo e a efetiva participação no desenvolvimento urbano a partir da apropriação da condição de cidadania.
