O federalismo numa visão tridimensional do direito

O presente trabalho pretende estudar o fenômeno do federalismo pela perspectiva tridimensional do Direito. Primeiramente, esboçar-se-á o federalismo de uma perspectiva fática, a primeira e mais natural associação humana. Depois, analisaremos a valoração do federalismo, ou seja, a intervenção de um processo racional no curso associativo natural do federalismo. Exemplificamos a valoração do federalismo a partir da teoria contratual de Montesquieu, o qual desenvolve um verdadeiro esqueleto organizacional da extensão territorial dos Estados, conformando as grandes monarquias às pequenas repúblicas: república federativa. Por fim, colocaremos em prática o federalismo fático, associado aos valores, no campo normativo dos clássicos modelos do Direito Constitucional: o federalismo Norte- Americano e o federalismo Alemão. / The present work intends to study the phenomenon of federalism from the tridimensional perspective of Law. Firstly, a picture of federalism from a factful perspective shall be drawn, as the first and most natural form of association. Later, the perceived value of federalism, which is, the intervention of a rational process in the course of federalism’s natural association, shall be analyzed. The perceived value of federalism is exemplified from Montesquieu’s contractual theory, which develops a real organizational scheme for the territorial extension of the States, applicable to both large monarchies and small republics: federative republic. At last, the model of factful federalism shall be put to practice, associating its values to the normative field of the classic constitutional law models: the American and the German federalism.

ENTI TERRITORIALI MINORI NELL'ARCHITETTURA EUROPEA / LOCAL AUTHORITIES IN EUROPEAN ARCHITECTURE

Negli ultimi decenni si segnalano due linee di tendenza in Europa: il ravvicinamento delle normative che interessano gli Enti territoriali minori (Comuni, Province e Città metropolitane), con una valorizzazione di tali realtà (ad eccezione della fase successiva alla recente crisi economica) ed un processo di progressivo spostamento delle decisioni dagli Stati membri all’Unione europea. È interessante comprendere, e lo si è fatto nel presente lavoro, come i due fenomeni si correlino ed in particolare, quanto influisca l’Unione europea sulle articolazioni interne degli Stati membri. La ricerca si concentra quindi sull’evoluzione della disciplina degli Enti territoriali minori non solo in Italia, ma anche negli altri Stati membri dell’Unione europea, al fine di apprezzarne le differenze e per evidenziare le linee di tendenza che accomunano i diversi ordinamenti (anche alla luce delle più recenti riforme). Quanto alla disciplina dell’Unione europea un’attenzione particolare viene dedicata, oltre che ai principi generali espressi nelle fonti primarie, anche all’analisi di specifiche politiche che prendono in considerazione la posizione dei livelli locali (ed in primo luogo le politiche di coesione economica, sociale e territoriale). Si è potuto così confrontare i dati per comprendere se ed in quale misura le riforme che hanno interessato gli Enti territoriali minori siano state indotte dalla normativa, dalle politiche e dalle azioni dell’Unione europea. Si è cercato infine di delineare il possibile e futuro ruolo degli Enti territoriali minori nell’architettura europea, in un’ottica di possibile federalismo multilivello. / During last decades, two trends have been underlined in Europe: laws on local authorities (municipalities, provinces and metropolitan areas) are getting less differing, enhancing the role of these entities (except for the phase following latest economic crisis) and we see a progressive transfer of decision-making powers from National States to European Union. It’s interesting – as it was done in this study – to understand how the two trends are connected and, particularly, how the European Union influences local authorities of member States. In order to appreciate differences and underline trends who associate different systems (also in the light of recent reforms), the analysis is focused on the evolution of legislation about local authorities, not only in Italy, but also in other States of European Union, Then, turning to European Union legislation, particular attention is dedicated not only to general principles listed into primary law, but also to the analysis of specific policies endowed with consideration for the role of local levels (primarily the policies about economic, social and territorial cohesion). In this way, a data comparison was made possible to understand whether the reforms interesting local authorities in recent past has been generated by legislation, by policies and actions of European Union, and to what extent. Finally, an attempt to outline the possible and future role of local Authorities into European architecture has been made, in a potential multi-level federalism perspective.

Essai sur le droit commun / Essay on the concept of "droit commun"

Le présent travail propose une étude d’ensemble sur le droit commun, notion fondamentale au coeur de la théorie et de la pratique quotidienne du droit. Contrairement à une première impression suivant laquelle il serait une notion à géométrie variable (droit civil ? théorie générale ? droit romain ? droit européen ? principes ?), le droit commun apparaît comme le concept technique désignant, pour une institution donnée, les règles juridiques dont le domaine d’application est indéfini. En outre, l’étude en révèle les deux applications pratiques fort distinctes que sont le droit commun territorial et le droit commun matériel. Le droit commun territorial d’abord, apparaît mal connu mais techniquement et historiquement premier ; c’est celui que l’on trouve par exemple à l’article 1393, alinéa 2, du code civil (qui vise le « droit commun de la France » des régimes matrimoniaux), ou dans un principe fondamental reconnu par les lois de la République dégagé par le Conseil constitutionnel en 2011. Le droit commun matériel ensuite, se révèle mieux connu mais appelle une synthèse ; c’est celui qui est visé, par exemple, dans la section contenant les articles 2333 et suivants du code civil (sur le « droit commun du gage ») tels qu’ils résultent de l’ordonnance du 23 mars 2006. Ces deux volets du droit commun expriment une "summa divisio", dans laquelle s’ordonnent toutes ses utilisations en droit positif. S’ils présentent des similitudes de régime, ils se distinguent néanmoins : ils ne renvoient pas aux mêmes règles – règles au domaine d’application "ratione loci" indéfini d’un côté, règles au domaine d’application "ratione materiæ et personæ" indéfini de l’autre. / This work offers a comprehensive study on the “droit commun” (approximately translated into “general rules of law” or “ordinary law”), a fundamental concept at the core of the theory and daily practice of French law. Contrary to traditional approaches involving the impression of a changing and variable concept (civil law, general theory, Roman law, European law, principles?), “droit commun” is a technical concept referring, for a given institution, to the legal rules whose scope of application is indefinite. This study also reveals the two distinct applications of “droit commun”; “droit commun territorial” (“territorial general rules of law”) and “droit commun matériel” (“material general rules of law”). The first application, “droit commun territorial”, although lesser known, is technically and historically primal. Droit commun territorial is specifically mentioned for in article 1393 of the French civil code (regarding the matrimonial property regimes), and in a fundamental principle identified by the French Constitutional Council in 2011. The second application, “droit commun matériel”, is better known but needs an overview. In particular, the section of the French civil code which contains articles 2333 and following (on the “droit commun” of pledging of corporeal movables), refers to it. These two applications of “droit commun” are the expressions of a summa divisio. Although both applications have similarities, they remain fundamentally different. The respective applications of “droit commun” do not refer to the same rules of law: rules where territorial scope of application is unlimited versus rules where material and personal scope of application is unlimited.

La rationalisation de l'organisation territoriale de la République. / The rationalisation of the territorial organisation of the French Republic

L’abondance des propositions de redécoupage de la carte des collectivités territoriales témoigne du décalage persistant entre leur taille et leur rôle. Leur territoire ne permet plus à certaines collectivités d’exercer efficacement leurs compétences. La première solution consisterait à redécouper le territoire des collectivités territoriales ; la seconde consisterait à modifier le rôle de chaque niveau de collectivités territoriales. Dans les deux cas, c’est l’organisation territoriale de la République qu’il faudrait réformer. Il appartient alors au juriste de déterminer si le législateur est compétent, à droit constitutionnel constant, pour mener seul ces réformes. Le droit constitutionnel, s’il ne prévoit pas toujours la compétence de l’État pour réformer l’organisation territoriale de la République, ne s’oppose pas à ce que l’État engage seul de telles réformes. Pourtant le législateur s’est montré soucieux des intérêts des collectivités territoriales existantes en évitant d’en supprimer des unités et en ne mettant pas en place une hiérarchie normative entre elles. En conséquence, les réformes menées par l’État n’ont pas permis de résorber le décalage entre la taille des collectivités et leur rôle. Cet échec ne saurait témoigner de contraintes constitutionnelles contrairement à ce qui est parfois soutenu dans le discours politique. Il révèle en revanche le poids des contraintes politiques qui s’exercent sur le législateur, notamment par le biais du cumul des mandats. La fin de cette originalité française viendra peut-être confirmer cette affirmation. / The abundance of proposals aiming to redraw the map of the local authorities reflects the remaining gap between their size and their role. Some authorities cannot effectively exercise their powers anymore. The first solution would be to redraw the boundaries of the local authorities; the second one would be to change the role of each level of local authorities. In both case, it is the territorial organisation of the Republic which should be reformed. It is then up to legal experts to determine whether the legislative power is allowed by the Constitution to carry out alone those reforms. If the Constitution does not always assert the jurisdiction of the State to reform the territorial organisation of the Republic, it does not forbid the State to engage alone such reforms. However, the attitude of the legislative power was to protect the interests of the existing local authorities by avoiding to remove units and by not setting a normative hierarchy between them. Consequently, the reforms carried out by the State have failed to resorb the gap between the size and the role of the local authorities. This failure does not give proof of constitutional constraints, contrary to what is argued in the political discourse. It reveals by contrast the weight of the political constraints which the legislative power has to face with, especially because of the combination of elective offices. The end of this French peculiarity will maybe confirm this assert.

La cohésion territoriale et l'ordre juridique de l'Union européenne / The territorial cohesion and the legal order of the European Union

La cohésion territoriale a fait son apparition dans le droit de l’Union à l’ex article 16 TCE aux côtés des SIEG. Elle a connu une consécration dans le droit primaire de l’Union avec son érection au rang d’objectif de l’Union européenne en devenant la troisième dimension de la politique de cohésion aux côtés de la cohésion économique et sociale. Cette nouvelle place dans le droit primaire n’est pas sans poser des questions sur la normativité de ce nouvel objectif et plus largement de sa place dans l’ordre juridique de l’Union. La principale difficulté réside aujourd’hui dans sa définition et ses modalités d’expression et d’intervention. Le Livre vert de la Commission européenne de 2008 consacré à la cohésion territoriale a eu le mérite de mettre l’objectif en perspective en lui donnant une concrétisation à travers essentiellement la politique régionale, mais également plus largement par la nécessaire coordination des politiques à impact territorial. Cette thèse a pour objectif de mettre en lumière les expressions de la cohésion territoriale, appelée à se développer avec la mise en œuvre du traité de Lisbonne. La cohésion territoriale peut également se fonder sur de nombreux autres principes juridiques, à l’image du principe de subsidiarité, pour se doter d’une normativité dans le droit matériel de l’Union, du travail législatif et réglementaire à la mise en œuvre des politiques sectorielles sur le territoire de l’Union. La cohésion territoriale peut enfin s’appuyer sur le droit institutionnel de l’Union et sur le rôle croissant des collectivités infraétatiques pour faire entendre la voie d’une solidarité territoriale dans le modèle d’intégration européenne. / The territorial cohesion appeared in the European Union law at the ex article 16 TCE beside the SIEG. It knew a consecration in the primary european Union law with its erection to the rank of objective of the European Union, becoming the third dimension of the cohesion policy beside the economic and social cohesion. This new place in the primary law is not without asking questions on the normativity of this new objective and more widely its place in the legal order of the european Union. The main difficulty is based on its definition and its modalities of expression and intervention today. The green Book of the European Commission of 2008 dedicated to the territorial cohesion had the merit to put the objective in perspective by giving it a realization through essentially the regional policy, but also more widely by the necessary coordination of the policies with territorial impact. This thesis has for objective to put in light the expressions of the territorial cohesion, called to develop with the application of the treaty of Lisbon. The territorial cohesion can also base itself on the other legal principles, just like the principle of subsidiarity, to build a normativity in the European Union material law, from the legislative and statutory work to the application of the sector-based policies on the European Union territory. The territorial cohesion can finally lean on the european Union institutional law and on the increasing role of the local gouvernment to make the way of a territorial solidarity taken in consideration in the model of the European integration.

This thesis is concerned with finding a relationship between the principles of Catholic social teaching and the written views of the Freedom and Direct Democracy - Tomio Okamura party as presented on the party's website. At the beginning of the thesis the reader is briefly introduced to individual principles of Catholic social teaching. For the purposes of this thesis five principles have been chosen which are mentioned in the Compendium of the Social Doctrine of the Church. These are the principles of human dignity, the common good, universal destination of goods, subsidiarity, and solidarity. Then the reader is acquainted with the basic views of the Freedom and Direct Democracy - Tomio Okamura party (SPD). By way of indicative research on the particular views of SPD, three topics are then formulated, which are most often mentioned by SPD. These consist of the European Union, foreign policy and migration. Comparison of these most frequently mentioned topics with Catholic social teaching and other relevant resources creates a base for further confrontation between Catholic social teaching principles and the views of SPD. Diploma Thesis "Assistance of dignified life for the elderly - Social services in field" is focused on the field of social services for the elderly, which's main function is to enable seniors to remain as long as possible at home, despite difficulties with self-sufficiency and independence, leading to a better quality of life. Due to the aging of population and new trends in the way of care for the elderly, it was necessary to fundamentally change the way of this kind of care in the Czech Republic- the current requirements are quality of life, individual approach and subsidiarity. To create the background leading to providing quality services and care, there was the need to change the law. In 2007 came into force the Act 108/2006 Coll. on social services, which changed the setting of social services, their definitions, rights and responsibilities, funding, but also shifted the responsibility for providing services and quality control on the region, as well as for the availability of services. At the same time steps have been taken, which should support the market behaviour of service providers to achieve their accessibility, affordability and quality. The theoretical part defines related terms and types of migration. Further describes the causes and effects of migration in the economic, social and demographic. This work also introduces the current migration theories. The work also reflects the integration and integration policy of the state to receive and foreigners living in the Czech Republic. Zásady firemního dobrovolnictví v ČR / Principles of corporate volunteering in the Czech Republic

The aim of this study is to describe the corporate volunteerism in the Czech Republic and subsequently define a structured set of ethical principles that should be complied by companies to enhance the ethical standards of corporate volunteerism and its positive impact. The theoretical part introduces the civic and corporate volunteerism, pointing out their legal and content differences and also the environmental non-profit organizations and economic subjects companies. Corporate volunteerism (CV) is defined as a part of the donation, which is a social component of corporate social responsibility (CSR). This study describes CSR as a tool of business ethics and assesses its impact on corporate culture and social work environment in favour of solidarity projects as CV. Based on the experience and study of scientific texts, four models reflecting the company's ethical maturity phase are defined in the practical part of the study. Their names are derived from the context and causes of the launch of CV - models naturally moral, promotional, human resources and employee model. The analysis of models aimed at meeting the objectives of the work, compiling seven ethical principles for CV - principles of real potential, plan and impact, quantity and quality of the target, the benefits of a coordinator´s position, equal access, freedom to make decisions and the principle of truthful communication. The principles are not procedures, however, the principles ask questions and concentrate ethical basis for project of CV. This text is accompanied by an evaluation comment using practical examples (from the institutional, social and individual ethical perspective).
