Transformative Power Challenged : EU Membership Conditionality in the Western Balkans Revisited

The EU is assumed to have a strong top-down transformative power over the states applying for membership. But despite intensive research on the EU membership conditionality, the transformative power of the EU in itself has been left curiously understudied. This thesis seeks to change that, and suggests a model based on relational power to analyse and understand how the transformative power is seemingly weaker in the Western Balkans than in Central and Eastern Europe. This thesis shows that the transformative power of the EU is not static but changes over time, based on the relationship between the EU and the applicant states, rather than on power resources. This relationship is affected by a number of factors derived from both the EU itself and on factors in the applicant states. As the relationship changes over time, countries and even issues, the transformative power changes with it. The EU is caught in a path dependent like pattern, defined by both previous commitments and the built up foreign policy role as a normative power, and on the nature of the decision making procedures. This path dependent pattern prevents the EU from actively using its strongest tools when trying to influence and steer the applicant states regarding reforms and norm transfer, effectively weakening the transformative power. Evidence from elections in Albania and Macedonia show how the domestic electoral stakeholders actively can resist, and even prune, important norms and laws, on best electoral practice, a key feature for the democratic structures required for EU membership. It is also apparent how there are few domestic change agent strong enough to actively promote normative changes, leaving much of the work for the EU. The clientelistic structures of these countries are a key aspect in shaping interests and actions of the political elite. The result is that layers of old and new institutions are created, producing the mixed pattern of reforms observed all over the Western Balkans. By combining the findings at both the EU level and in the applicant states, this thesis makes both important empirical and theoretical contributions, challenging some core aspects of the Europeanisation literature.

This thesis intends to analyse the notions of transcendental deduction and basic norm, presented in the works of Kant and Kelsen, respectively. These concepts are used by the authors quoted as a form to legitimize the objective validity of knowledge, in a general sense in Kant, and specifically the knowledge of Law in Kelsen. The idea to carry out this comparison originated from the analogy used by Kelsen, in his book Pure Theory of Law, between the Kantian categories of understanding, justified through of the transcendental deduction in the Critique of Pure Reason, and the basic norm, where the two notions appear like conditions of the possibility of knowledge. The work is divided into two chapters that deal, respectively, of the transcendental deduction, Objectives, strategies and method of the transcendental deduction of the categories , and of the basic norm, The legal thought of Kelsen and the Kantian s inspiration of the basic norm . Each of them will try to present the assumptions and characteristics of the concepts in question, starting from the objectives that led Kant and Kelsen to formulate them as forms of legitimation of knowledge. Finally, a comparison between the two projects and a discussion about the possibility of a transcendental deduction of the basic norm will be expounded, as well as some conclusions that can be drawn from the work / Este trabalho pretende analisar as noções de dedução transcendental e norma fundamental, apresentadas nas obras de Kant e Kelsen, respectivamente. Tais conceitos são utilizados pelos referidos autores como forma de legitimar a validade objetiva de conhecimento, de maneira geral em Kant, e especificamente o conhecimento do Direito em Kelsen. A idéia de realizar essa comparação surgiu da analogia realizada por Kelsen, em sua obra Teoria Pura do Direito, entre as categorias do entendimento kantianas, justificadas através da dedução transcendental na Crítica da Razão Pura, e a norma fundamental, onde ambas as noções aparecem como condições da possibilidade de conhecimento. O trabalho está dividido em dois capítulos que tratam, respectivamente, da dedução transcendental, Objetivos, estratégias e método da dedução transcendental das categorias , e da norma fundamental, O pensamento jurídico de Kelsen e a inspiração kantiana da norma fundamental . Cada um deles tentará expor os pressupostos e características dos conceitos em questão, a partir dos objetivos que levaram Kant e Kelsen a formulá-los como formas de legitimação de conhecimento. The Social Obligation Norm as the Framework for Land Restitution in South Africa

Doctor Legum - LLD / This research project proposes that the social-obligation norm of ownership should be adopted as the ethic on which land restitution is carried out in South Africa. While there exists a subtle and indirect appreciation of the social-obligation norm in South African constitutional property law, this is veiled by the respect given to the classical liberal conception of ownership which gives more regard to an owner's ius abutendi and subsequently, accepts that owners can do as they please with their property as long as they do not break any law. Of course, South Africa no longer adheres to such a classical liberalist approach to ownership. An adherence to classical liberalist views of ownership has arguably, led to the neglect of arable restituted land. To this effect, the Constitution as well as the Restitution of Land Rights Act 22 of 1994 (RLA) need to clearly and more positively express the social-obligation norm of ownership in order to promote productive and sustainable utilisation of cultivable restituted land. The thesis argues that the current failures of the land restitution programme are linked to the absence of a social-obligation norm in the RLA as well as the negatively framed Property Clause in the South African Constitution. Even the envisaged changes to the land restitution process as outlined in the 2011 Green Paper on Land Reform as well as in the Property Valuation Act, will not solve the current problems of wasteful neglect of land. The thesis therefore suggests that a positive expression and formulation of the social-obligation norm in the RLA as well as in the Property Clause will promote active, sustainable, productive, and optimal utilization of all cultivable land acquired through the country's land restitution process. This will assist with meeting the developmental aspirations for the rural economy as envisaged in chapter six of the National Development Plan 2030. Furthermore, utilising the land productively through the socialobligation norm is an expression of Ubuntu, a key constitutional theme in South Africa. The experiences of Brazil and Germany deserve special analysis. This is because the socialobligation norm occupies a prominent and positive place in the constitutional property law of both these countries. Further, both countries respect private ownership of property as long as the property is utilised in a manner that permits others to flourish and improve the quality of their life.

Abstract My research questions are: why are there differences in how the four characters (Mr Collins, Charlotte, Lady Catherine de Bourgh and Mary) react to and adapt themselves to the social definitions of male and female roles? What were the social ideas about gender roles in the 18th century and how are these connected to the expressions and actions of my characters? How are the differences significant to the plot and the story of the four characters mentioned above; in other words, what are the consequences of the differences in their social life? As method in writing this essay I have used the primary source Pride and Prejudice, Judith Butler’s theory of gender performativity and secondary sources such as different kinds of books and articles. These sources helped me to understand what it was like to live in the 18th century. Writing this essay has provided me with the insight that the gender performances of the characters reveal a complexity which might not be expected.

Becoming Legitimate: How PMSCs are Seeking Legitimacy in the International System

The use of private military and security companies (PMSC) by state governments has raised many questions regarding the role of the private security industry (PSI) in conflict. This use of PMSCs by states has resulted in much debate in the public and academic spheres (Avant 2005, Dunigan 2011, Kinsey 2006, Leander 2005, Singer 2008). The PSI and PMSCs are altering the international system of norms and redefining what it means to be secure and make war. States are no longer the only entity in the international system with security needs. Intergovernmental organizations (IGOs), non-governmental organizations (NGOs) and multinational corporations (MNCs) also purchase security services provided by PMSCs. With the ever-growing presence of PMSCs in conflicts, peacekeeping, and humanitarianism, the legitimization of PMSCs is vital for their missions to succeed. Furthermore, companies that operate at the international level as well as their clients have vested interests in changing their image from ‘mercenaries’ and ‘dogs of war’ to ‘private warriors’ and ‘legitimate soldiers’. This dissertation addresses why and how PMSCs seek legitimacy in the international system. I argue that PMSCs desire and need legitimacy to justify their existence and support the claim that their actions are desirable, proper, lawful, and just because they follow a socially constructed system of norms. My dissertation builds on private security literature by drawing on constructivist approaches to norms and legitimacy and employing discourse analysis. Through my analysis, I identify rebranding and self-regulation as measures taken by PMSCs and the PSI to build and solidify the perception of legitimate security providers. PMSCs and the PSI developed their own discourse through the creation and implementation of the Montreux Document, International Code of Conduct for Private Security Service Providers (ICoC), and the ICoC Association to counter the negative perceptions created by media coverage and controversial incidents involving PMSC personnel. The rebranding and self-regulation efforts of PMSCs and the PSI supports the argument that they need and desire legitimacy. Without legitimacy and a shift in perception, the actions of PMSCs and their contractors will always be questioned and full integration into the state and international security apparatus will remain out of reach.

Inclusão na escola de surdos : estratégias de normalização dos sujeitos surdos down

Esta dissertação tem por objetivo analisar as estratégias de normalização dos sujeitos surdos down incluídos em uma escola de surdos de Porto Alegre/RS a partir da análise de diferentes campos de saberes que circulam sobre esses alunos na escola. Analiso os ditos sobre os sujeitos surdos down encontrados em documentos como relatórios de avaliação e pareceres clínicos e realizo entrevistas com as professoras que trabalham com eles. Utilizo como ferramentas teórico-metodológicas, as noções de inclusão, norma e normalização. Os materiais mostraram uma regularidade discursiva entre os diferentes campos de saberes – médico, social, psicológico e pedagógico – que fabricam os surdos down como sujeitos dóceis, mas também com “limitações” e “dificuldades na linguagem compreensiva e expressiva” da Língua de Sinais. Os materiais pesquisados constituíram as seguintes unidades de análises: 1) Pareceres clínicos: exame e enquadramento dos sujeitos: discursos individuais ou em conjunto dos diferentes campos de saberes da área da saúde, que são investidos de poderes e produzem verdades sobre os surdos down e seus familiares quando estes procuram o ingresso na escola; 2) Adaptação curricular como estratégia de normalização: se constitui nas análises dos objetivos adaptados, dos comentários sobre o desenvolvimento dos alunos nos relatórios de avaliação e a relação destes com os discursos sobre as práticas pedagógicas com os alunos surdos incluídos nas turmas de surdos; e, 3) Normalização lingüística: gerenciamento do risco da não-aprendizagem: mostra a preocupação com o ensino da Língua de Sinais (L1) e da Língua Portuguesa (L2), sendo essa preocupação uma constante na prática diária dos professores em sala de aula com os alunos surdos com deficiência e alunos surdos sem deficiência, ocorrendo assim, uma comparabilidade e hierarquização dos sujeitos conforme as suas competências lingüísticas. Para gerenciar o risco da não-aprendizagem da L1 e L2, são criadas estratégias de ensino para aproximar o aprendizado da Língua de Sinais dos surdos sem deficiência (sujeitos fluentes na língua) com os surdos down (sujeitos que estão em processo de aprendizado da língua), pois se acredita que dessa forma poderão alcançar o aprendizado da Língua Portuguesa. Assim, essa pesquisa, pretendeu problematizar as estratégias de normalização na escola de surdos, quando nela ocorre a inclusão de alunos surdos down, sujeitos que se diferenciam dos demais surdos por apresentarem característica físicas/biológicas e outros tempos de aprendizado. / This paper aims to analyze the strategies of normalization of the subjects deaf down included in a deaf school in Porto Alegre/RS from the different fields of knowledge. I do an analysis of statements about the deaf down subjects found in school´s documents, such as evaluation reports and clinical opinions. I realize, too, interviews with teachers who work with deaf down students. Use as analytical tools, the concepts of inclusion, norms and normalization. The materials showed a discursive regularity between different fields of knowledge - medical, social, psychological and educational - that make the deaf down as docile subjects, but also with "limitations" and "difficulties in receptive and expressive language" of the sign language. The materials studied were the following units of analysis: 1) Clinical Opinions: examination and guidelines of the subjects: individual or group speeches of different fields of knowledge in the health area, who are vested with powers and producing truths about the deaf and its down family members when they seek to enter in the school; 2) Curriculum adapting as a strategy of normalization: it consist in the analysis of the adapted goals, in the comments about the development of students in the evaluation´s reports and in their relationship with the discourses on pedagogical practice with the deaf students included in the deaf classes; and, 3) Linguistic Normalization: managing of the risk of non-learning: it shows the concern with the teaching of Sign Language (L1) and of the Portuguese Language (L2) being a constant concern in the daily practice of teachers in the classroom with deaf students with disabilities and deaf students without disabilities, thus allowing a comparison and ranking of subjects according to their language skills. To manage the risk of non-learning of L1 and L2, teaching strategies are created to bring closer the learning of Sign Language of deaf people without disabilities (individuals fluent in the language) with the deaf down (subjects who are in the process of language learning ) because it is believed that this way will achieve the learning of Portuguese. So, this research, intended to discuss the normalization processes in the deaf school, when it occurs the inclusion of deaf students down, subjects who are different from others because they have deaf characteristic physical / biological and other pace of learning.

Seleção de carteiras com restrição da norma do vetor de alocação : uma aplicação a dados brasileiros

Este trabalho estuda o problema de seleção de carteiras de variância mínima com base em uma recente metodologia para otimização de carteiras com restrições nas normas das exposições brutas proposta por Fan, Zhang e Yu (2012). Para esse propósito, consideram-se diferentes estimadores da matriz de covariâncias condicional e incondicional. A grande contribuição deste artigo é de natureza empírica para o mercado de ações brasileiro. Avaliam-se índices de desempenho fora da amostra das carteiras construídas para um conjunto de 61 ações negociadas na Bolsa de Valores de São Paulo (BM&FBovespa). Os resultados mostraram que as restrições nas normas dos vetores de alocação (restrição de exposição bruta) geram ganhos substanciais em relação às carteiras restringidas para venda a descoberto, aumentando o retorno médio ajustado pelo risco e diminuindo o turnover dos portfólios. / This paper studies the problem of minimum variance portfolio selection based on a recent methodology for portfolio optimization restricting the allocation vector proposed by Fan, Zhang e Yu (2012). To achieve this, different conditional and inconditional covariance matrix estimators are considered. The great contribuition of this paper is one of empirical nature for the brazilian stock market. We evaluate out-of-sample performance indexes for the portfolios constructed for a set with 61 different sotcks traded in the São Paulo stock exchange (BM&FBovespa). The results show that the restrictions on the norms of the allocation vector generate substantial gains compared to the no short-sale portfolio, raising the average return adjusted by the risk and lowering the portfolio turnover.

The exploration of underwear is based onmethods formed to create a wider concept of how mens underwear couldlook like regarding shape, color, material and details. Explorations of stereotypical and significant elements of underwear suchas graphics and logotypes has been reworked to create a graphical identitybound to a brand. This is made to contextualize the work aiming to present new options andvariety in mens underwear rather than stating examples using symbols orstereotypic elements. In the making of the examples for this work the process goes front and back from digital to physical using different media to create compositions of color, graphic designs and outlines using transfer printer, digital print, and laser cutting machine.
