A presente tese investiga a forma pela qual a ideia de reconhecimento poderia nortear a leitura das interpretações fáusticas da primeira metade do século XX, a saber: Tragédia Subjectiva de Fernando Pessoa, Dr. Fausto de Thomas Mann e Meu Fausto de Paul Valéry. Ou seja, as apropriações do mito por Thomas Mann, Pessoa e Paul Valéry seriam apreensões distintas da tragédia do conhecimento cujo desenvolvimento residiria na ideia de uma falha de reconhecimento: falência ou impossibilidade de reconhecer. O conceito de reconhecimento será estudado a partir dos ensaios e livros do filósofo americano Stanley Cavell, entendendo-se reconhecimento enquanto denominador comum entre a ideia de tragédia e do ceticismo: ambos resultam de falhas no reconhecimento. Assim, o presente estudo busca compreender como as três interpretações fáusticas vivem a falência do reconhecimento reiterando, dessa maneira, o afastamento da tradição goetheana / This thesis aims at investigating the way in which the idea of acknowledgment could guide the reading of the Faustian interpretations written in the first half of the twentieth century: Tragédia Subjectiva by Fernando Pessoa, Dr. Fausto by Thomas Mann and Meu Fausto by Paul Valéry. That is, the appropriations of the myth by Thomas Mann, Pessoa and Paul Valéry would all be different interpretations on the tragedy of knowledge whose development lies in the idea of a failure of acknowledgement: failure or impossibility to acknowledge. The study of the concept of acknowledgment will be based on Stanley Cavells essays and books, by understanding that acknowledgment is the common denominator between the ideas of tragedy and skepticism: both result from a failure or impossibility to acknowledge. Judgment by acknowledgment on the basis of fiction Abstract This diploma thesis deals with the judgment by acknowledgment. It is an institute of civil procedural law. The judgment by acknowledgment can be issued on the basis of the express content of the defendant or applicatioan of the legal fiction of the acknowledgment. This paper deals with both types of judgment of acknowledgment but the main part is devoted to the fiction of acknowledgment. The thesis is divided into six chapters. Chapter One describes the history of the judgment by acknowledgment on Czech territory. Chapter Two deals with the issuance of a qualified call for expression and the requirements that are put on the expression of the defendant. Chapter Three analyzes legal conditions for issuing a judgment of acknowledgment based on both the express content of the defendant and the fiction of acknowledgement. In this chapter are also described the remedies that can be applied against it. Chapter Four is dedicated to the judgment of the Constitutional Court, which ruled on the constitutionality of the qualified call and the judgment of acknowledgment based on fiction. Tanken med följande kvalitativa studie är att visa hur ett antal förskolechefer motiverar sina medarbetare. Inledningsvis berör vi allmänt om vad som kan definieras som motivation, för att sedan gå in på motivationsteorier som vi anser är relevanta för vår studie. I vår teoretiska referensram använder vi oss av självbestämmande teorin (inre och yttre motivation), Maslows behovshierarki, Alderfers ERG teori och Herzbergs tvåfaktorteori. Vidare tar vi även upp om chefens roll vid motivation av sina medarbetare. Dock är det viktigaste utgångspunkten för vår studie sex faktorer som vi ur vår teoretiska referensram anser vara viktiga. Dessa faktorer är trivsel, missnöje, ansvar, självförverkligande, delaktighet och påverkan, kommunikation och feedback. Faktorerna som tagits ur vår teoretiska referensram kommer i sin tur knytas samman med det resultat vi har fått fram i vår studie.Sammanlagt har vi genomfört 10 semistrukturerade intervjuer med förskolechefer inom Borås och Skövde kommun, samtliga av dessa intervjuer utfördes på chefernas arbetsplats och några via telefon. Våra intervjuer hölls inom en viss struktur, men hade som avsikt att ge respondenterna en frihet då de svarade på våra frågor.Resultatet på vår studie visar att dialog och bekräftelse är två faktorer som är väldigt viktiga i chefers arbete för att motivera sina medarbetare. Dialog och bekräftelse handlar om att se och höra medarbetarna, vilket respondenterna tror skapar motivation och arbetstillfredsställelse.Studien är gjord på svenska.

The extinction of fiction: breaking boundaries and acknowledging character in medieval literature

My dissertation applies narrative theory and ordinary language philosophy to two major works bookending medieval English literature: Beowulf and Le Morte Darthur. Capitalizing on the descriptive power of narrative theory's lexicon, I outline the aesthetics, rhetoric, and other effects on the reader when these medieval writers depict transgressive movements--theoretically termed metalepsis--across borders in the story world, and over boundaries separating that world from our own. I often find that spatial transgressions, as they are visualized in narrative terms, entail or simultaneously occur with a breakdown of the fourth wall separating fiction from its audience. Malory's Sir Lancelot crosses into a spiritual world in pursuit of the Holy Grail only to arrive at an awareness of his existence as narrated fiction. My dissertation argues that moments like this, first analyzed through narrative theory, challenge the reader to recognize the fictional character's force of life, and in so doing expand the imagination to reconsider those metaphysical distinctions that have long rendered the nonhuman inferior. Those distinctions are unnecessary and often senseless, I argue. The ethics of reading fiction that I propose seeks the acknowledgment of limits to knowledge, to what we can claim to know about literature, its characters, and, indeed, our fellow human beings. Given that they are constructed by our ordinary language use, fictional characters are the essence of the other. Fictions, then, and as Stanley Cavell would agree, serve as testing grounds for our capacities of acknowledgment. I argue that both the Beowulf poet and Malory fashioned fictional worlds that preserve a secular heroism from potentially hostile contexts. In the process, these medieval narratives show us that fictional characters move us as a matter of ordinary language--our ordinary interactions with narrative: they play a significant role in our lives that cannot be reduced to any particular theory. There is no need for recourse to ontological, or theological, frameworks to invest them with some unutterable or mysterious meaning. They matter as a matter of course.

S'allier à autrui par des liens de confiance ou par le jeu d'obligations juridiques, pour faire face à l'incertitude et à la complexité, est l'affaire de l'homme depuis qu'il a besoin d'un autre pour sa survie et son mieux-Être. La juridicisation des relations sociales a envahi plus récemment le monde de la santé, remettant en question le lien de confiance dans la relation de soin. Il semble nécessaire d'aller au-Delà de ce présupposé opposant relation de confiance et relation contractuelle. Car le droit contraint notre liberté mais protège aussi le plus vulnérable et si la confiance oblige, elle engage de ce fait notre responsabilité.Phénomène pluridimensionnel particulièrement riche dans ses expressions et ses usages, la confiance permet l'engagement dans la relation, elle en est à la fois la cause, le moyen et l'effet. La relation de soin, où technicité et subjectivités se rencontrent, met en évidence une dynamique complexe de la confiance, entre nos attentes, nos contradictions et nos craintes. Aux moments charnières, encadrée par des textes récents, du parcours de soin: l'engagement dans la relation, l'information, la décision partagée, l'épreuve de l'obstination ou du refus, nous retrouvons la nécessité de la confiance entrecroisée à celle des droits du patient. Nous voyons s'inventer aujourd'hui, non sans déstabilisation, de nouvelles figures de la relation de soin.Au terme de cette double exploration émerge la question de la reconnaissance, celle des droits et celle de la personne dans le bouleversement de la maladie. Une reconnaissance mutuelle entre soigné et soignant qui se conjugue à une confiance réciproque comme fondement éthique de la relation de soin. / Dependency on others for one's survival or well-Being has always meant allying oneself with others. In this way, relationships founded on trust or legal obligation can make it easier to manage the inevitable problems and insecurity. The juridicisation of social relations which has emerged recently in health care is undermining the bond of trust in the health care relationship. It therefore seems necessary to explore this presupposition in which the trust relationship has come to be viewed in direct opposition to the contractual relationship. And if the law is there to restrain, it is likewise there to protect the weakest; confidence in somebody creates moral obligations, thus requiring commitment.Trust, a multi-Faceted phenomenon with many forms of expression and uses, is what makes a commitment to others possible. In the health care relationship, where technology and subjectivities come together, the complex dynamics of trust, between our expectations, contradictions and fears, are vividly exposed. At pivotal moments on the care pathway, we find the need for trust bisecting the patients' rights: commitment, information, shared decision-Making, the tug of war between obstinacy and refusal. This is where we see new features cropping up in the patient-Carer relationship.From this double investigation emerges the idea of acknowledgement of patients' rights and of the person struggling with the disease. A mutual acknowledgement between patient and carer combined with a reciprocal trust as an ethical basis for the health care relationship.
