O estatuto da criança e do adolescente (ECA) do Brasil e as recomendações da ONU

The methodological approach was qualitative and, therefore, study the following official documents: the American Convention on Human Rights (1969); United Nations Standard Minimum Rules for the Administration of Justice for Children and Youth Beijing (1985); Convention on the Rights of Child (1989); United Nations Rules for the Protection of Juveniles Deprived of Liberty (1990); United Nations Principles for the Prevention of Juvenile Delinquency Riyadh Guidelines (1990); Federal Constitution of Brazil (1988); Statute of Children and Adolescents (1990); and Social and Educational National Service System (2006). The first chapter aims to understand the context in which international documents issued by the United Nations (UN) that deal with the rights of children and adolescents from the 1990s, particularly those intended for the service were produced adolescent in conflict with the law. The second chapter dealt with the recommendations of the United Nations (UN) and its convergence with respect to the principles advocated by the Child and Adolescent (ECA). As is clear from the investigations, we found that the Principle of Humanity, the Principle of Legality, the Principle of Jurisdiction, the Adversarial Principle, the Principle of Impeachment, the Principle of Advertising Process and the Principle Absolute Priority are expressed in international recommendations and national legislation, particularly with regard to the principles advocated by the ECA, and constitute themselves as concerns the UN with regard to protecting the rights of children and adolescents, especially those who commit infractions. / Neste trabalho realizou-se um estudo sobre as recomendações da Organização das Nações Unidas (ONU), visando identificar as possíveis convergências e/ou divergências em relação aos princípios preconizados pelo Estatuto da Criança e do Adolescente (ECA). O percurso metodológico foi de caráter qualitativo e, para tanto, estudaram-se os seguintes documentos oficiais: Convenção Americana de Direitos Humanos (1969); Regras Mínimas das Nações Unidas para a Administração da Justiça da Infância e da Juventude Beijing (1985); Convenção sobre os Direitos da Criança (1989); Regras das Nações Unidas para a Proteção dos Menores Privados de Liberdade (1990); Princípios das Nações Unidas para a Prevenção da Delinquência Juvenil Diretrizes de Riad (1990); Constituição Federal do Brasil (1988); Estatuto da Criança e do Adolescente (1990); e o Sistema Nacional de Atendimento Socioeducativo (2006). O primeiro capítulo teve como objetivo compreender o contexto em que foram produzidos os documentos internacionais emanados pela Organização das Nações Unidas (ONU), que tratam do direito da criança e do adolescente a partir da década de 1990, com destaque àqueles que se destinam ao atendimento ao adolescente em conflito com a lei. O segundo capítulo tratou das recomendações da Organização das Nações Unidas (ONU) e sua convergência, em relação aos princípios preconizados pelo Estatuto da Criança e do Adolescente (ECA). Como resultado das investigações, constatamos que o Princípio de Humanidade, o Princípio de Legalidade, o Princípio de Jurisdicionalidade, o Princípio do Contraditório, o Princípio da Impugnação, o Princípio do Segredo de Justiça e o Princípio da Prioridade Absoluta estão expressos nas recomendações internacionais e na legislação nacional, particularmente no que diz respeito aos princípios preconizados pelo ECA, e constituem-se preocupações da ONU no que se refere à proteção dos direitos de crianças e adolescentes, com destaque àqueles que cometem atos infracionais

This measure is one of the sanctions applied to adolescents who have broken the law. The empirical field under analysis was the Assisted Conditional Release Community Program (LAC) developed by the Catholic Church’s organization Pastoral do Menor (PANEM) in the city of Fortaleza, State of Ceara, Brazil. The aim was to identify and evaluate configurations and meanings of that kind of action within a certain area of the Catholic Church; what were the practices and perceptions undertaken by the PAMEN’s agents, mainly by professionals from LAC; how this has an effect on the action and the kind of politics offered to targeted adolescents and other young people by the Program; and what is the role of the government in face of those relations and perceptions. This research has, therefore, an interface with the so-called areas covered by Public Policies for Infancy, Adolescence and Youth as well as Social Policies from the Catholic Church. Both institutions, government and Catholic Church, have their own rules and procedures and are influenced by several political and ideological disputes from which arise conflicts, tensions and negotiations related to the kind of discourse and actions to be adopted. Within this configuration one is to center attention upon the symbolic struggles (Bourdieu, 2003, 2005, 2008) that present hierarchies and connections involving the several agents and institutions in relation to the treatment given or that should be given to the these adolescents in their trajectories. / A presente pesquisa trata da execução da medida socioeducativa liberdade assistida, prevista no Estatuto da Criança e do Adolescente. Tal medida é uma das sanções direcionadas aos adolescentes em conflito com a lei. O campo empírico analisado foi o Programa Liberdade Assistida Comunitária (LAC), pertencente à Pastoral do Menor (PAMEM) – organismo vinculado à Igreja Católica – no município de Fortaleza, no estado do Ceará – Brasil. O objetivo foi perceber e analisar quais as formas e os significados desse tipo de ação em um determinado setor da Igreja Católica; quais as práticas e percepções movidas pelos agentes que compõem a PAMEN, em especial, os profissionais da equipe do LAC; como isso influencia na atuação e no tipo de política ofertada aos adolescentes e jovens a quem o Programa se propõe atender; e quais as relações e percepções referentes ao poder público. Esta pesquisa possui, portanto, interface entre os chamados campos das Políticas Públicas para Infância, Adolescência e Juventude e o das Políticas Sociais da Igreja Católica. Ambos possuem regras e funcionamentos próprios e são formados por diversas disputas político-ideológicas, nas quais existem conflitos, tensões e negociações sobre os tipos de discursos e ações a serem adotados. Nesse contexto, ressalta-se que as lutas simbólicas (BOURDIEU, 2003, 2005, 2008) em relação ao tratamento dado ou que deveria ser proporcionado aos referidos adolescentes possuem hierarquias e conexões entre os diversos agentes e instituições envolvidos em suas trajetórias.

The purpose of this study is to describe, analyze and comprehend the socio-educational measures in open environment, probation and provision of community services in the perspective of adolescents in conflict with the law, in the Socio-educational Program in Open Environment (Programa de Medidas Socioeducativas em Meio Aberto), in São Carlos city, located in the state of São Paulo, Brazil. The qualitative study, an observant participation, intends to establish an interaction between the researcher and the research participants and it assumes that participating in the context with the collaborators is essential to understand the studied phenomenon. The field visits to the canvas painting workshop called Expressarte: Arte em Liberdade were performed weekly, in March and June 2011. By observing and taking notes of the workshops, I could understand the meaning that adolescents attribute to the Program of Socio-educational Measures. Only by taking a role in the group and participating in daily activities I could experience the context in which adolescents are part from their perspective, seeking to better understand relevant aspects of this educational experience. By using different resources such as informal conversations, participant observation and document analysis, the data collection allowed the data triangulation. From the data analysis organized in field diaries emerged some foci of analysis: socio-educational measures in an open environment, the Expressarte workshop and the professionalization, which were analyzed by the Freire, Fiori and Dussel s concepts of education. The purpose was to understand the possibilities of people educate themselves in different social practices and the meaning of the socio-educational system for adolescents in conflict with the law. The deepening of the analysis of collected data in this research will constitute the object of further studies and it will produce discussions that contribute to the process of reflection on the importance of educational measures, analyzed from the perspective of adolescents in conflict with the law. / Este trabalho busca um aprofundamento das discussões existentes em relação a adolescentes em conflito com a lei e como significam as Medidas Socioeducativas de Liberdade Assistida e Prestação de Serviços à Comunidade. O estudo tem como objetivo descrever, analisar e compreender as medidas socioeducativas, na perspectiva dos adolescentes, no espaço do Programa de Medidas Socioeducativas em Meio Aberto, no município de São Carlos/SP. O estudo de natureza qualitativa, uma observação participante, intenciona estabelecer interação entre o pesquisador e os participantes da pesquisa, partindo do pressuposto que participar do contexto com os colaboradores é fundamental para se compreender o fenômeno pesquisado. As inserções foram realizadas semanalmente, na oficina de pintura em tela, denominada Expressarte: arte em liberdade, entre os meses de março e junho de 2011. Ao observar e registrar as oficinas foi possível compreender o significado que os adolescentes dão ao Programa de Medidas Socioeducativas, e somente assumindo um papel no grupo e participando das atividades cotidianas, pude vivenciar o contexto dos adolescentes, buscando melhor compreender aspectos relevantes dessa experiência educativa. A coleta de dados utilizando diferentes recursos, como as conversas informais, a observação participante e a análise documental, possibilitou a triangulação dos dados Da organização dos dados nos diários de campo emergiram alguns focos de análise: medidas socioeducativas em meio aberto, oficina Expressarte e profissionalização, que foram analisados com base na concepção de educação como prática de humanização de Paulo Freire, Ernani Maria Fiori e Enrique Dussel, buscando-se compreender as possibilidades das pessoas se educarem em diferentes práticas sociais e o significado do sistema socioeducativo para adolescentes em conflito com a lei. O aprofundamento das análises dos dados coletados nesta investigação se constituirá em objeto de estudos posteriores, fomentando discussões na busca de caminhos que contribuam com o processo de reflexão sobre a importância das medidas socioeducativas, analisadas na perspectiva de adolescentes em conflito com a lei.

O adolescente em conflito com a lei : representações sociais e julgamentos de estudantes de direito

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / The aim of this research was to explore the impact of skin color and social strata of adolescents in conflict with the law on social representations and judgments of law students. In this study, 102 students participated, between the fifth and the tenth period of law, within a private college located in Aracaju-SE. The ages ranged between 20 and 62 years (M = 27.9, SD = 8.06), 54 male participants (52.9%). The study was conducted with an experimental design. On the instrument, we presented a case of an infractional act and manipulated among the groups the variables skin color and social stratum of the adolescent. After reading the case, participants were asked which of the socioeducational measures provided by the Child and Adolescent Statute (ECA) would be applied to the juvenile offender. The instrument also contained items about the social representation of the adolescent in conflict with the law, attitude towards the reduction of the criminal responsibility age, explanations for the infractional conduct and representations of the future of adolescents in conflict with the law. The results indicate that imprisonment, most severe penalty, is the most applied by participants (44.1%). Contrary to what predicted our hypothesis, there were no significant statistical differences in the application of the measures based on skin color and social strata of the adolescent and there was also no effect of these variables on social representations. However, we identified a representation objectified by contextual elements as "Problems in education" and "poverty", besides of pejorative (marginal, vagabond) and essentialist (offender, criminal) terms indicating a view of criminal behavior as definitive condition for these adolescents. Based on the literature and in the light of the results we discussed relations between social representations, prejudices and judgments within the Justice for Children and Youth in Brazil. / O objetivo desta pesquisa foi investigar o impacto da cor da pele e do estrato social do adolescente em conflito com a lei sobre representações sociais e julgamentos de estudantes de Direito. Participaram 102 estudantes, entre o quinto e o décimo período, de uma instituição particular de ensino localizada em Aracaju-SE. As idades variaram entre 20 e 62 anos (M = 27.9; DP = 8.06) e 54 era do sexo masculino (52,9 %). O estudo foi desenvolvido com um delineamento experimental. No instrumento, apresentamos um caso de ato infracional e manipulamos entre os grupos as variáveis cor da pele e estrato social do adolescente. Após a leitura do caso, os participantes foram questionados sobre qual ou quais das medidas socioeducativas previstas pelo ECA aplicariam ao adolescente em questão. O instrumento continha também itens sobre a representação social do adolescente em conflito com a lei, atitude frente à redução da idade de responsabilidade penal, explicações para a conduta infracional e representações do futuro do adolescente em conflito com a lei. Os resultados indicam que a internação, medida mais severa, é a mais aplicada pelos participantes (44,1%). Ao contrário do que previam nossas hipóteses, não houve diferenças significativas na aplicação das medidas em função da cor da pele e estrato social do adolescente e também não houve efeito dessas variáveis nas representações sociais. Contudo, identificamos uma representação objetivada por elementos do contexto como “Problemas na educação” e “Pobreza”, além de termos pejorativos (marginal, vagabundo) e essencialistas (infrator, criminoso) indicando uma visão da prática infracional enquanto condição definitiva para esses adolescentes. Com base na literatura e à luz dos resultados discutimos relações entre representações sociais, preconceitos e julgamentos no âmbito da Justiça da Infância e Juventude no Brasil.

Circles of Courage : music therapy with adolescents in conflict with the law at a community based setting

The context for this study is a community based organization known as the National Youth Development Outreach (YDO) in Eersterust, Pretoria. This organization caters primarily for adolescents who are in conflict with the law who have been referred to YDO by the courts. YDO offers what is known as the Adolescent Development Programme as a means of social rehabilitation. This programme is based on what is known as the Circle of Courage which has its origins in the Native American approach to child rearing. This Circle of Courage has four components, namely, Belonging, Mastery, Independence and Generosity. Music therapy was introduced at the National Youth development Outreach in January 2003. My interest in the work of music therapy within this context gave rise to this dissertation. My aim in this study is to explore how music therapy can contribute to the Adolescent Development Programme and, in particular, how the Circle of Courage can inform the goals and practice of music therapy. In addition I wish to explore how music therapy practice needs to adapt in order to be relevant within such a context. The study is conducted within the qualitative research paradigm and thus seeks not to prove one single truth. This explorative study is conducted in a naturalistic setting. Data collection is in the form of a semi structured interview with 3 personnel members from the organization, clinical session notes and video recorded excerpts from two music therapy sessions. The clinical session notes form the basis of a description of the music therapy process at YDO from January to June 2003 and work with an individual client. These descriptions serve to contextualize the semi structured interview and video excerpts. The data are coded categorized and organized into themes. These themes highlight the social context in which YDO is situated which includes the individual, the organization and the community. The data highlights the primacy of the Circle of Courage within this specific context. Music as a tool for communication as well as a barometer of relationship is also discussed. This forms the basis for addressing the two research questions. This discussion focuses on the role of the Circle of Courage in informing the goals of music therapy through considering this at a conceptual level as well as viewing clinical improvisation through the lens of the Circle of Courage. The response to the second research question is from the premise of community therapy and considers the possibility of a wider application of music therapy in such a context. Music therapy is in its infancy in South Africa, especially with this client group. I am unaware of any published literature of music therapy work with adolescents in conflict with the law. Whilst this study has focused on a very small part of the whole, my hope is that it will stimulate further thinking and research about music therapy with this client group and will contribute to a broader body of knowledge. / Dissertation (MMus (Music Therapy))--University of Pretoria, 2006. / Music / unrestricted
