The sports in Sweden has previously been self-regulated with its own rules and provisions. As the commercialisation and professionalization have increased the common legal system has a greater impact on sports. The purpose of this study is to investigate the professional ice hockey adjustments to the labour law regulation. Furthermore the purpose is to illuminate possible advantage and disadvantage with the professional ice hockey player’s conditions of employment. To answer the purpose and the research questions of this study the legal dogmatic method, the legal sociology method and qualitative method with interviews has been used. The study shows how the professional ice hockey has adapted the labour law regulations with collective agreement due to the semi-dispositive provisions found in Swedish labour law. In Swedish professional ice hockey only the fixed-term contract is applied and most of the provisions about employment security are not available for the ice hockey players. In return the players has a stronger protection during the employment. As an employee and a parent the right to have a parental leave is statutory. The study shows a complex of problems with ice hockey player’s opportunity to have a parental leave, which is a right as an employee. This raises questions about equality between men and women in the labour market of ice hockey.

Investigating accountability and governance practices in joint development zones : a case study of Nigeria and Sao Tome & Principe's Joint Development Zone

This study critically assesses the appropriateness of the governance system used to control all aspects of oil exploration and production within the Nigeria São Tomé and Príncipe Joint Development Zone (NSTP-JDZ). The motivation for carrying out the research emerged from a review of the literature on oil and gas joint venture operations which straddle more than one country’s borders. In the case of the NSTP-JDZ, several reports had criticised its governance practices but had failed to provide a rigorous analysis to substantiate their claims. The study therefore contributes to the literature relating to the governance of oil and gas joint development zones. A mixed method approach was used in the empirical research and the results were analysed against a globally acknowledged good governance theoretical framework. The results confirmed that there are major flaws in the NSTP-JDZ governance system, although there are also positive aspects of the practices. Four areas of concern were identified: Firstly, inadequate personnel skills were impairing management of the zone to such an extent that it could not be guaranteed that resources will be safeguarded for the benefits of future generation. Secondly, control of resources was severely impaired by an uncertainty about who had the authority to implement actions and, of more concern, by political and other conflicting interventions in the management decisions of the NSTP-JDA. Thirdly, the findings indicated the need for improvement in the audit procedures and communication culture between local communities and NSTP-JDZ operators. Lastly, there was a body of opinion that employment practices within the zone were unfair. In addition to identifying the above deficiencies in the governance system, the study has identified and analysed differences in views on governance issues between key stakeholders in the zone. These differences are important as they may well pinpoint why the governance system is deficient and, more importantly, reveal how the governance system can be improved. The vested interests of stakeholders are known to shape stakeholder views and, when there are stakeholders from different countries representing their nation’s interests, these differences can be acute; the findings may be extrapolated to other joint development zones although the various characteristics of the parties involved in each zone will affect the degree to which it is applicable. Finally, the study may have significant economic consequences for both Nigeria and the São Tomé and Príncipe - bearing in mind the importance of oil resources to both countries.

International tax coherence : a development perspective

This thesis attempts to resolve the deadlock to achieve an equitable division of taxes, and thereby internation equity. As the present tax laws were not negotiated, it is not considered here as fair. In this thesis it is proposed that an equitable division could be achieved through a division based on the levels of human development (combining Rawlsian schema and Sen’s capability approach). Therefore, it is argued that such a division would be equitable; because it would be based on entitlements (territorial claims), it would generate cooperation and thereby lead to greater efficiency. Importantly, this thesis establishes that the present tax treaties neither generate cooperation nor cohere with global welfare. Similarly, it is also found that the other institutions (OECD, IMF, WB and Dispute Settlement) related the tax regime presently do not promote development based on human capabilities. This could help developing countries to pursue a division favouring development (laws favouring development) and understand the institutions better suited to pursue such goals.

Bakgrund och problem: Bakgrunden till denna studie är Statistiska Centralbyråns uppmärksammande om att kommunala gymnasieskolor har 7000 kronor dyrare kostnad per elev än den fristående gymnasieskolan. En av de bidragande faktorerna till att kostnaden är lägre hos fristående skolor kan vara att de har en mer effektiv inköpsprocess. Tidigare studier beskriver fristående skolornas situation som mer flexibel medan de kommunala skolorna präglas av mer byråkrati. Den problemformulering vi förhållit oss till var: Vad finns det för skillnad i inköpsprocessen vid kommunala respektive fristående skolor som leder till att kommunala skolor har en högre kostnad per elev? Syfte: Syftet med studien är att utifrån en komparativ fallstudie finna de likheter och skillnader som återfinns i inköpsprocessen hos de olika skolverksamheterna. Därefter analyseras orsaker till inköpsrelaterade olikheter fram. Metod: Vi har gjort en komparativ fallstudie av inköpsprocesser i gymnasieskolor som bedrivs av offentlig sektor och privata aktörer. Vår empiri bygger på semistrukturerade intervjuer med nyckelpersoner som berörs av hur inköpen går till på skolorna. Empiri: Det empiriska resultatet visar att de aktiviteter som skiljer sig åt i inköpsprocessen är val av leverantör och tilldelning av kontrakt. De fristående skolorna har ett relationsfokus i sitt arbete med leverantörerna, något som de kommunala skolorna inte har möjlighet att skapa på grund av att de är tvingade att följa Lagen om offentlig upphandling. De fristående skolorna är mer flexibla vid val av leverantör då deras ramavtal inte är bindande. Det kan även konstateras att de fristående skolorna har ett större fokus på att hålla ner sina kostnader då de har ett vinstsyfte med sin verksamhet, medan de kommunala skolorna endast behöver sträva efter att hålla sin budget och att bedriva bra undervisning. Slutsatser: Den största uppmärksammade skillnaden vi kunnat urskilja i studie är att friskolorna arbetar på ett mer flexibelt sätt. Friskolorna bygger sina ramavtal på en kostnadsorientering där relationen till leverantören ligger i fokus. De kommunala skolorna har istället en prisorientering vid val av produkt. / Background and problem: The drawn much attention to that community schools' have 7000 Swedish Crowns higher cost per pupil than independent schools', published by Statistics Sweden, is the background to this study. One of the contributing factors to the fact that the cost is lower in independent schools' may be that they have a more efficient purchasing process. Previous studies describe the independent schools' situation more flexible, while the municipal schools' are characterized by bureaucracy. The issue to relate to was: What is the difference in the purchasing process at the municipal and independent schools, which leads to the municipal schools have a higher cost per pupil? Purpose: The purpose of the study is based on a comparative case study to find the similarities and differences found in the purchasing process of the independent school operations and the activity in municipal schools, to consequently analyze purchases related causes to differences. Method: We have made a comparative case study of the purchasing processes in secondary schools' run by the public sector and private operators. Our empirical data is collected through semi-structured interviews with key people involved in the purchasing process. Empiricism: The empiric results show that the activities that differ in the purchase process are supplier selection and contract award. The independent school has a relationship focus in its work with suppliers, something that public schools' do not have the option to create because they are forced to follow the Public Procurement Act. The independent schools' are more flexible in the choice of provider as their framework agreement is not binding. It may also be noted that the independent school has a greater focus on keeping down their costs since they have a profit with their business while municipal schools' only need to strive to keep their budget and to pursue good education. Conclusions: The biggest noticeable difference we have been able to identify in our comparative study of independents schools' purchasing process and the municipal schools' purchasing process is that independent schools' are working in a more flexible way. Independent schools are building their framework agreement on the modern approach of purchasing theory, that is through a cost-orientation, where the relationship with the supplier is in focus.

Exploateringsavtal : Samverkan mellan kommun, lantmäterimyndighet och exploatör

En lagändring trädde i kraft i plan- och bygglagen den 1 januari 2015 för att förenkla och effektivisera detaljplaneprocessen. Lagändringen innefattade en ny roll för lantmäterimyndigheten i planprocessen samt nya regler för exploateringsavtal. Studiens syfte var att beskriva hur samverkan mellan kommun, lantmäterimyndighet och exploatör fungerar gällande exploateringsavtal samt hur lagändringen i plan- och bygglagen angående exploateringsavtal påverkat dessa parter. För att besvara studiens frågeställningar sändes en webbenkät till Sveriges alla kommuner för att erhålla en överskådlig bild av lagändringens påverkan över landet. Det genomfördes även semistrukturerade telefonintervjuer i fem kommuner med antagna riktlinjer för exploateringsavtal. Exploateringsingenjörer, lantmäterichefer och exploatörer intervjuades för att erhålla olika perspektiv på samverkan och hur lagändringen påverkat dessa parter. Studiens resultat visade att förhandlingen mellan kommun och exploatör gällande exploateringsavtal har påbörjats tidigare i processen efter lagändringen i plan- och bygglagen. Kommunen måste även efter lagändringen betala ersättning när de tar mark i anspråk för allmän plats. Lantmäterimyndighetens mer aktiva roll har bidragit till att oklarheter och brister kan korrigeras i exploateringsavtalen. Emellertid har det gått för kort tid för att helt kunna avgöra vad lantmäterimyndighetens roll bidragit till i exploateringsavtalen. Exploatörerna har fått större möjligheter att påverka exploateringsavtalen. Samarbetet mellan kommun, lantmäterimyndighet och exploatör har blivit tydligare och till viss del förbättrats, men i det stora hela är uppfattningen att samarbetet är oförändrat. På sikt finns det möjlighet till en förbättring. / On January 1st 2015 an amendment passed in the Planning and Building Act in order to simplify and rationalize the detailed development plan process. The amendment includes a new part for cadastral authority in the plan process and new rules for development agreement. The municipalities should adopt guidelines for these agreements. The aim of this study was to describe how the collaboration between municipality, cadastral authority and developer works when it comes to development agreement and how the amendment in the Planning and Building Act concerning the development agreement has affected these participants. To answer the thesis a web survey was sent to all municipalities in Sweden to get an overview of how the amendment has influenced the country. Semi-structured telephone interviews were also performed in five municipalities that have adopted guidelines for the development agreements. The interviews were performed with land development engineers, cadastral supervisors and developers to receive their perspective of the collaboration and how the amendment has affected them. The results of the study have shown that negotiations have started earlier between municipalities and developers after the amendment in the Planning and Building Act passed. The municipalities also need to pay compensation when they take land for public places after the amendment. The cadastral authority’s more active part has contributed to assure that ambiguities and shortcomings might be solved in the development agreement. However, it is still too early to tell what the cadastral authorities part has contributed in the development agreements. The developer has got a major opportunity to influence the development agreements. The collaboration between municipalities, cadastral authorities and developers has become clearer and improved but overall it is unchanged. There are opportunities for improvement in the long term.

Impact of maternal psychological distress and parental bonding on mother-adolescent agreement about emotional problems

Objective. To explore the impact of parent psychological distress and parental bonding on agreement between informants about adolescent emotional functioning. Methods. The study employed an observational design in which 87 pairs of mothers and their adolescent sons or daughters aged 12-17 completed proxyand self-report ratings on the Strengths and Difficulties Questionnaire. Mothers also completed the Depression, Anxiety and Stress scale as a measure of their own psychological distress, and adolescents completed the Parental Bonding Instrument as a measure of their parenting experience. Moderation analyses using multiple linear regression were used to assess whether the association between maternal psychological distress and mother-adolescent agreement changed as a factor of parental bonding. Results. Kappa values indicated that mother-adolescent agreement was ‘fair’ for emotional problems. Mothers’ psychological distress and sub-optimal parenting were both associated with greater reporting discrepancies. Maternal psychological distress and perceived maternal were unique and combined predictors of reporting discrepancies. Perceived care moderated the relationship between maternal distress and agreement such that when care was rated as low, higher levels of maternal distress predicted poor agreement, but when care was rated as high no significant relationship was found between distress and agreement. Conclusions. Increased mother-adolescent agreement was associated with lower maternal psychological distress and higher ratings of perceived care. The effect of psychological distress on informant agreement varied as a factor of perceived maternal care. Results of this study support the need for multiinformant assessment and suggest that enquiry about mothers’ own psychological functioning could facilitate accurate assessment and intervention for adolescents who present at psychology services.

In December 2015, the world leaders gathered in Paris trying to address the urging challenges with climate change. The product of this meeting is called the Paris Agreement. Beforehand, many argued that another failure could not be accepted and the policymakers must let science influence the policy process. The aim of this study was to explore, through the epistemic community approach, in what way IPCC where able to influence the Paris Agreement. The results shows that the Paris Agreement was highly influenced under the topic sustainable development, while IPCCs assessments for mitigation and adaption was partly implemented.

The trade, development and cooperation agreement between the Republic of South Africa and the European Union : an analysis with special regard to the negotiating process, the contents of the agreement, the applicability of WTO law and the Port and Sherry Agreement

Thesis (LLM)--University of Stellenbosch, 1999. / ENGLISH ABSTRACT: This thesis deals with the Trade, Development and Cooperation Agreement (TDCA) between the European Union and the Republic of South Africa, which was concluded in October 1999. In particular, the agreement is analysed in the light of the negotiating process between the parties, the contents of the agreement, the applicability of WTO law and the compatibility of the agreement with it and the Port and Sherry Agreement. Since the EU emphasised its aim to commence economic and development cooperation with other African, Caribbean and Pacific (ACP) countries on a reciprocal basis during the negotiations for a successor of the Lomé Convention, the TDCA between the EU and South Africa had to be seen as a "pilot project" for future cooperation agreements between countries at different levels of development. The TDCA between the EU and South Africa is therefore not only very important for the two concerned parties, but could serve as an example for further negotiations between the EU and other ACP countries. Thus the purpose of this thesis is to examine the TDCA between the EU and South Africa from a wider global perspective. The thesis is divided into six Chapters: The first Chapter provides an introduction to the circumstances under which the negotiations between the EU and South Africa commenced. It deals briefly with the economic situation in South Africa during the apartheid era and presents reasons why the parties wanted to enter into bilateral negotiations. The introductory part furthermore presents an overview of the contents of the thesis. The second chapter contains a detailed description of the negotiating process that took place between the parties and shows why it took 43 months and 21 rounds of negotiations to reach a deal. South Africa's partial accession to the Lomé Convention and the conclusion of separate agreements such as the Wine and Spirits Agreement, are also analysed. Chapter three presents the various components of the TOCA and illustrates what the negotiators achieved. This chapter on the TOCA concludes with an evaluation of the Agreement and shows the potential benefits to South Africa and the EU. Since the Agreement had to satisfy international rules, the provisions of the General Agreement on Tariffs and TradelWorld Trade Organisation (GATTIWTO) were of major importance. The EC Treaty, however, does not contain any provision that indicates whether, or how, an international agreement like the GATTIWTO penetrates the Community legal order. In Chapter four, accordingly, questions are raised regarding the extent to which the bilateral agreement between South Africa and the EU was influenced by the GATTIWTO provisions and how these rules were incorporated into the agreement. Furthermore, since the parties agreed on the establishment of a free trade area, this chapter deals with the question of in how far the TOCA is in line with Article XXIV GATT. In addition to the GATT provisions, the TOCA is also affected by the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs). Therefore Chapter five deals with TRIPs in connection with the TOCA. The use of the terms "Port" and "Sherry" as the major stumbling block to the conclusion of the TOCA is analysed more closely. The final part, namely Chapter six, provides a summary of the results of the investigation. Minimal Interference from Possessor Phrases in the Production of Subject-Verb Agreement

We explore the language production process by eliciting subject-verb agreement errors. Participants were asked to create complete sentences from sentence beginnings such as The elf's/elves' house with the tiny window/windows and The statue in the eirs/elves' gardens. These are subject noun phrases containing a head noun and controller of agreement (statue), and two nonheads, a "local noun" (window(s)/garden(s)), and a possessor noun (elf's/elves'). Past research has shown that a plural nonhead noun (an "attractor") within a subject noun phrase triggers the production of verb agreement errors, and further, that the nearer the attractor to the head noun, the greater the interference. This effect can be interpreted in terms of relative hierarchical distance from the head noun, or via a processing window account, which claims that during production, there is a window in which the head and modifying material may be co-active, and an attractor must be active at the same time as the head to give rise to errors. Using possessors attached at different heights within the same window, we are able to empirically distinguish these accounts. Possessors also allow us to explore two additional issues. First, case marking of local nouns has been shown to reduce agreement errors in languages with "rich" inflectional systems, and we explore whether English speakers attend to case. Secondly, formal syntactic analyses differ regarding the structural position of the possessive marker, and we distinguish them empirically with the relative magnitude of errors produced by possessors and local nouns. Our results show that, across the board, plural possessors are significantly less disruptive to the agreement process than plural local nouns. Proximity to the head noun matters: a possessor directly modifying the head noun induce a significant number of errors, but a possessor within a modifying prepositional phrase did not, though the local noun did. These findings suggest that proximity to a head noun is independent of a "processing window" effect. They also support a noun phrase-internal, case-like analysis of the structural position of the possessive ending and show that even speakers of inflectionally impoverished languages like English are sensitive to morphophonological case-like marking.

Further Evaluating the Effect of Behavioral Observability and Overall Impressions on Rater Agreement: A Replication Study

This replication study sought to analyze the effects of behavioral observability and overall impressions on rater agreement, as recently examined by Roch, Paquin, & Littlejohn (2009) and Scott (2012). Results from the study performed by Roch et al. indicated that raters are more likely to agree when items are either more difficult to rate or less observable. In the replication study conducted by Scott, the results did not support the relationship which Roch et al. found between observability and rater agreement, but did support the relationship previously found between item difficulty and rater agreement. The four objectives of this replication study were to determine whether rater agreement is negatively related to item observability (Hypothesis 1) and positively related to difficulty (Hypothesis 2), as well as to determine whether item performance ratings are closer to overall impressions when items are less observable (Hypothesis 3) and more difficult to rate (Hypothesis 4). The sample was comprised of 152 undergraduate students tasked with providing performance ratings on an individual depicted in a video of a discussion group. Results indicated that agreement was negatively correlated with both observability (supporting Hypothesis 1) and difficulty (not supporting Hypothesis 2), and that ratings were closer to overall impressions when items were less observable (supporting Hypothesis 3), but not when items were more difficult to rate (not supporting Hypothesis 4).
