Sedan outsourcing blev vanligare på den svenska marknaden har det även blivit vanligt att i förvaltning upphandla sin drift i konkurrens. I ett mycket tidigt skede uppmärksammandes en problematik med samarbetet mellan beställare och driftentreprenör som innebar att fakturahanteringen mellan parterna var omfattande och tidkrävande. För att bland annat minska administrationen upprättades en självriskmodell som många beställare idag tillämpar i kontrakten, vilken innebär att driftentreprenören ersätter felavhjälpande underhållsåtgärdskostnader upp till ett visst gränsbelopp.  Syftet med fallstudien är att undersöka modellens uppbyggnad och tillämpning samtatt analysera vad beställare och entreprenör anser om självriskmodellen. Studien bygger främst på primär insamlad data genom ett antal intervjuer med främst en beställare, Locum samt en sekundär datainsamling i form av en enkätundersökning besvarad av verksamma entreprenörer inom branschen. För att bibehålla det offentliga fastighetsbeståndet och för att se till brukarens bästa måste en förståelse finnas mellan beställare och entreprenör. Den lösningen som idag finns för att upprätthålla kvalité och service i en funktionsupphandling är att använda självriskmodellen. För beställaren fungerar modellen som ett incitament att funktionskraven uppnås och för att minska fakturahanteringen. Hur modellen uppfattas på marknaden med positiva och negativa aspekter skiljer sig markant beroende på vilka personliga erfarenheter en part har av den. / Since outsourcing became more common in the Swedish market, it has also become common for the management to procure its operation competitively. In a very early stage there was a problem recognized, the invoice between client and contractor was extensive and time consuming. Partly to reduce administration a deductible model was established which many clients today applies to the contracts. This means that the operating contractor himself may replace corrective maintenance action costs up to a certain amount. The purpose of this case study is to examine the model's structure and implementation, as well as to analyze clients and contractors consider of the deductible model. The study is based on primary data collected through a number of interviews with primarily client and a secondary data collection in the form of a questionnaire answered by contractors within the industry. In order to maintain the public housing stock and to ensure the patient's best interests there must be an understanding between the client and the contractor. The solution to maintain quality and service in a procurement function the client uses today the deductible model. The model serves as an incentive for the client to make sure the functional requirements are achieved and to reduce invoice processing. <p>U ovoj tezi dokazane su teoreme o nepokretnoj tački koje predstavljaju jednoznačna i vi&scaron;eznačna uop&scaron;tenja Banahovog prin&shy;cipa kontrakcije u verovatnosnim metričkim i fazi metričkim pros&shy;torima. Dokazana je teorema koja predstavlja uop&scaron;tenje teoreme o nepokretnoj tački za verovatnosnu ^-kontrakciju / :&nbsp; S &mdash;* S,gde je&nbsp; ( S ,&nbsp; J7, T ) kompletan Mengerov prostor. Uveden je pojam jake (6n)-kontrakcije i dokazana je teorema koja predstavlja uop&scaron;tenje teoreme Sehgala i Bharuche-Reid kada je preslikavanje / :&nbsp; S &mdash;&gt; S jaka (6n)-kontrakcija. Teorema Caristija, koja predstavlja jedan od najvažnijih rezultata za teoriju nepokretne tačke i nelinearnu analizu uop&scaron;tena je u kompletnom Mengerovom prostoru&nbsp; (S ,&nbsp; F , T ), gde je t-norma&nbsp; T H -tipa. Kako Mengerovi prostori pripadaju klasi kvazi-uniformnih prostora dokazana je teorema o nepokretnoj tački tri preslikavanja u jednoj specijalnoj klasi kvazi-uniformnih prostora. Dokazana je teorema o nepokretnoj tački koja predstavlja verovatnosno uop&scaron;tenje Nadlerove g-kontrakcije za tri preslikavanja kao i uop&scaron;tenje Hiksovog principa kontrakcije za tri preslikavanja. The<br />theorem which presents generalization of fixed point theorem for<br />probabilistic g-contraction / :&nbsp; S &mdash;* S is proved, where ( S ,&nbsp; J7, T ) is<br />complete Menger space. Many industries are today facing the possibilities and challenges arising with an increasingly digitalised world. One such is the scantily studied industry of earth-moving contractors that today stands in front of an increasing amount of digital technologies, which may have the possibility to assist firms in their earthwork operations. However, there are indications that many firms tend to experience difficulties to beneficially adopt or see the potential of utilising these digital technologies. Hence, many firms tend to undertake an adoption approach that is associated with high client dependency and a less beneficial unsustainable subordinated position within the industry’s value chain. The purpose of this study has thus been to explore how the technological, organisational and external elements affect earth-moving contractors’ opportunity to adopt and utilise digital technologies in their operations. Moreover, the study has aimed to contribute with the understanding and knowledge of how the adoption of digital technology can be used to strengthen Swedish contractors’ position in the earth-moving industry’s value chain and in the end, aid the country’s sociotechnical development. The findings of the study are based on an explorative multiple case study approach and extensive review of literature. The results suggest that the extent to which adoption and utilisation of digital technologies differs among different earth-moving firms. Three of the five studied companies are considered as digital forerunners which have been able to leverage digital technologies to increase efficiency in their operations. In the case of two of these firms, the adoption of digital technology has enabled them to transform their whole businesses and partake in an increased and more beneficial role within the value chain. Further, the analysis of the findings indicates that the difference in adoption is affected by several factors related to a continuous interaction between (1) the internal aspects of the organisations, (2) the external context of the firms and (3) if the technical features of the digital technologies are perceived as compatible and beneficial for, the current business process and strategy. The thesis contributes to academia with explorative findings within a scarcely studied industry in general and, regarding digital technology adoption in particular. Additionally, the study provides examples of the previously unrecognised industry-dynamic phenomena of value chain integration by earth-moving contractors. These findings could have implications for the whole construction sector in Sweden. Lastly, the study exemplifies opportunities and barriers crucial for the adoption and implementation of digital technologies within smaller project-based organisations. / Många branscher och industrier idag står inför utmaningarna och möjligheterna som uppstår i en allt mer digitaliserad värld. Ett tydligt exempel är maskinentreprenadsbranschen som idag ställs inför valet att införa nya och alltmer avancerade digitala verktyg som har möjlighet att främja deras operativa verksamheter. Dock finns indikationer att många företag har svårigheter att tillämpa och anamma dessa verktyg på ett gynnsamt sätt och är beroende av deras kunders agerande för aktivering av dessa. Studiens syfte har således varit att undersöka hur relationen mellan teknologiska, organisatoriska och externa faktorer påverkar maskinentreprenörernas möjligheter att aktivera och nyttja digitala teknologier i deras operativa verksamheter. Vidare har studien varit ämnad åt att bidra till en ökad förståelse och kunskap för hur digitala teknologier kan användas för att stärka maskinentreprenörernas position i värdekedjan för att slutändan främja Sveriges sociotekniska samhällsutveckling. Rapportens resultat bygger på en explorativ flerfallsstudie samt en gedigen litteratursökning. Resultaten visar på skillnader i hur digitala tekniker har tillämpats och används bland olika maskinentreprenörer. Tre av studiens fem fallföretag är digitalt framstående och har strategiskt tillämpat digital teknik som gett upphov till kraftig effektivitetsökning. Två av dessa företag har dessutom lyckats med en gynnsam ompositionering i värdekedjan som dessa befinner sig i, som ett resultat av anammandet av ny digital teknik. Vidare påvisar studiens analys av resultaten att möjligheten för aktivering av digitala teknologiska innovationer påverkas av ett kontinuerligt förändrande samspel mellan (1) maskinentreprenörernas organisatoriska egenskaper, (2) externa omständigheter samt (3) huruvida den digitala teknologins tekniska attribut uppfattas som kompatibla och fördelaktiga med nuvarande affärsverksamhet och strategi. Rapporten bidrar akademiskt med värdefull och explorativ empiri till en industri med en bristande mängd av forskning generellt, och i synnerhet gällande utnyttjandet samt tillämpandet av nya digitala teknologier. Dessutom bidrar studien med exempel och insikter om ett industridynamiskt fenomen, som tidigare ej uppmärksammats, i form av maskinentreprenörers förmåga att förflytta sig i värdekedjan. Dessa strukturella förändringar kan få konsekvenser för den svenska byggindustrin. Slutligen exemplifierar studien avgörande möjligheter och barriärer för införandet av digitala teknologier i mindre projektbaserade organisationer.

The effect brought about by the implementation of a compulsory competitive tendering policy on the administration of parks and recreation maintenance in Britain: 1988-1994

The aim of the study was to analyze the effect brought about by the promulgation of the British Local Government Act of 1988 on the maintenance of parks and recreational services. The Act made it compulsory to local authorities to expose the maintenance of parks and recreational services to a tendering process, commonly known as compulsory competitive tendering. The implementation of compulsory competitive tendering had to be done between the promulgation of the Act in 1988, and 1994. With regard to this period, a perception existed that the standard of the administration of the maintenance of parks and recreational services declined. The research was done to determine if the implementation of compulsory competitive tendering on the maintenance of parks and recreational services could have resulted in a decline in the standard of the administration of the services, and how it could have happened. It was determined that the motive of the British Government at the time of implementation of the compulsory competitive tendering was primarily to save money. The result of the implementation of compulsory competitive legislation on the maintenance of parks and recreational services were amongst other things: - low morale of staff who were pressured to change - culture changes necessary to comply to compulsory competitive organisational structures - legislation that influenced the lives of traditional local authority employees drastically, and - the development of a new approach to financial management to comply to the government's expectations of saving money. / Public Administration / M. The use of temporary employment services as a means to achieve flexibility in die labour market led to various complications due to a lack of proper regulation. The atypical formation of the triangular employment relationship, limited rights and less favourable employment conditions of the temporary employees, multiple authority figures and their liabilities under various circumstances and the impact thereof on such employee’ collective bargaining rights caused legal uncertainty in the absence of sufficient legislation to govern it. Temporary employment agencies developed certain methods in order to evade the restrictive labour legislation and employer duties imposed on them, namely by making use of automatic termination clauses (resolutive conditions) and by categorising the temporary employee as an independent contractor. Last mentioned would effectively exclude the temporary employee from labour legislation and the protection it provides. In reaction to abovementioned problems, trade unions have been objecting to the use of temporary employment agencies and went as far as demanding the total ban thereof. This raised the question in the South African Government whether said agencies should indeed be banned. The other option is a less restrictive approach and entails the attempt to regulate these agencies by amending the current labour legislation in order to accommodate temporary employment services. In light of the fact that various proposals to amend the current South African labour legislation (especially with regard to temporary employment services) have been published in the Government Gazette, it can be deduced that the social partners ultimately chose to regulate temporary employment agencies rather than ban them altogether. From an early stage the International Labour Organisation (ILO) provided rules and regulations for the management of employment agencies in general by way of conventions and recommendations. In 1997, in order to give effect to the labour standards identified by it, the ILO brought the Private Employment Agencies Convention into existence. This document could be applied to all temporary employment agencies on an international level. This document provides for administrative regulations, the duties of the agency and the client as well as the rights of the temporary employees concerned. The ILO recommends that all of its member states incorporate the principles contained within this document in their own legislation. Temporary employment services are also used in other legal systems. For purposes of this study, the English law (United Kingdom (UK)) and the Namibian law will be scrutinised. Similar issues to those recognised in the South African law have been identified in these countries. However, each has approached said problems in different ways. The Namibian Government banned the conducting and provision of these services by way of legislation in 2007. The constitutionality of the ban has however been questioned by the Supreme Court of Namibia, after which it had been found to infringe upon the fundamental freedom to carry on any business, trade or occupation. The ban was struck down as unconstitutional. The Namibian Government has since promulgated new legislation in which it removed the ban and replaced it with numerous amendments providing for the regulation of temporary employment services. Since 1973 the UK has been promulgating various instruments for the thorough regulation of temporary employment agencies. These instruments provide for the management of temporary employment agencies and the rights of the employees involved. The relevant legislative instruments have been updated regularly with the purpose of ensuring that the needs of all the parties concerned are met. The UK, as a member state of the European Union (EU), (which has also been providing for the regulation of temporary employment services in various directives), promulgated legislation specifically with the aim to give effect to the principles in the mentioned directives. By way of doctrines and the creation of a third category ―worker‖ the UK has been attempting to prevent any loopholes in their legal system with regard to temporary employment services and the rights of the employees involved. The aim of this study is to investigate all the important complications experienced with temporary employment agencies in order to indicate the impact the atypical circumstances have on the rights of the temporary employees. The degree to which, if at all, the South African law complies with the preferred labour standards identified by the ILO will be pointed out. A comparative study will be conducted, first by ascertaining in detail how the comparable issues in the UK and Namibian law are dealt with, and second by identifying which aspects in these legal systems could be of value to the South African law. Finally the potential effectiveness of the proposed amendments to the South African labour legislation will be analysed, during which recommendations for the unresolved issues will be provided.
