DIPLOMA THESIS Denisa Budilová : Institutional framework of alternative dispute resolution in sport ABSTRACT The aim of this thesis is description and analysis of institutional framework, through which sport disputes are solved outside the State courts' jurisdiction. The thesis also delimits mutual relation between jurisdiction of sport organisations' bodies on one hand and State courts' jurisdiction on the other hand. The text is divided into seven chapters. A brief introduction is followed by second chapter, in which I focus on sport in general, its relations to law, I am exploring relations that may arise within the sport, and outlining on several examples what disputes may arise from those relations. Separate subsections are devoted to normative regulation of sport's relations and question of sports law. Third chapter is focused on Czech legislation on alternative dispute resolution in sport. I particularly deal with possibilities of alternative dispute resolution according to the Czech Arbitration Act (1994). The following section deals with dispute resolution based on sport associations' autonomy; I focus on current legislation and related case-law, as well as on proposed legislation to be enacted with respect to ongoing recodification of Czech private law. The 2014 Brazilian World Cup: Consequences and Legacies

Sport is often not a topic one contemplates of when thinking of global and national narratives. For many it is not a valid or significant tool to study race or development. Sport has been minimized to an after school activity or a distraction, but sport crosses many spheres including, but not limited to, politics and identity. It has the capability of influencing people’s histories and growth as an individual. Many scholars have in recent years used the politics of sport as a legitimate way to understand race and global history. The 2014 World Cup presented itself as the perfect subject to analyze various meanings driving the political, economic, and global significance of mega sports events. Brazil’s history with football and the inter-connectedness with politics, nationalism, and racial identity provide an interesting platform to dissect this information and place it in a larger scope within the values of the World Cup. Upon exploration of this topic and several meetings with Professor David Goldblatt, author of the must-read soccer Bible The Ball is Round, I found that the World Cup was exuding with political, economic, and social implications. A few main issues caught my attention: The massive corruption and lawlessness with which FIFA elites seem to operate under, the unbelievable accounts of housing and human rights violations done in the name of football by the Brazilian government, and the inefficient and slow progress of infrastructure preparations.

South Africa 2010 and beyond : A study of how the 2010 FIFA Soccer World Cup affects South Africa's environmental efforts

<p>The study investigates South Africa’s actions and efforts within environmental and climate issues in relation to the country’s hosting of the 2010 FIFA Soccer World Cup. The investigation is conducted by applying idea analysis on the empirical material in order to highlight what ideas South Africa might have when it comes to environmental and climate related measures in connection to the World Cup. The two theories of Behavioralism and Rational Choice are to be compared in order to reveal the true reasons for South Africa’s environmental actions. In addition, an own-formulated hypothesis which claims that measures within environmental issues are improved due to the 2010 World Cup is tested against the empirical material. Results are presented as a review over what is being done today within environmental and climate issues in South Africa and these answers are then connected to the World Cup as it is analyzed concerning how the event affects the country’s policies and efforts within these areas. Finally, a concluding discussion states what role environmental and climate issues have in connection to a major sporting event such as the 2010 FIFA World Cup and how South Africa administers this opportunity to act accordingly and present itself to the rest of the world.</p>

Sport and the Making of World Cities: A Case Study of South Africa

This thesis explores two distinctive ways in which sport is deployed as a development strategy in South Africa, and specifically considers how sport may play a role in the configuration of the nation’s cities. First, a case study of the sporting mega-event, the 2010 FIFA World Cup, is presented. It is posited that this tournament was a speculative world-making strategy aimed at elevating host cities and the nation to world-class status. Second, a discourse analysis of South African policy documents regarding the reintroduction of physical education is performed. It is argued that despite the fundamental neoliberal elements of physical education, there is a possibility that if the government maximizes certain opportunities, it could be a way of forging ordinary cities that are based upon equitable access to sport for South African children. These assessments suggest that sport can play a role in both the spatial and symbolic development of cities.

Com realização da Copa do Mundo da FIFA de 2014, foi implementado um modelo de desenvolvimento por megaeventos que resultou na violação de direitos humanos de vários brasileiros, entre eles as baianas de acarajé. Inseridas nesse contexto, para fazer frente à coalisão FIFA, patrocinadores, elite nacional e Estado (denominada, aqui, de frente estatal-empresarial) e garantir a realização de seu ofício, as baianas de acarajé empreenderam várias estratégias de luta, da negociação à ação direita. Objetivando compreender, desde o ponto de vista das baianas de acarajé, o que significou esse conflito com a FIFA, fiz pesquisa de campo, realizada em Salvador em 2014, e pesquisa documental. A partir dessas investigações, identifico as estratégias e discursos da disputa, revelando uma tensão entre o desenvolvimento e a “diferença”, categorias que resumem as distintas visões em jogo. Assim, utilizando a metodologia da interseccionalidade e o marco teórico da (des)colonialidade, empreendo a discussão sobre a tensão entre direitos humanos universais – na figura do direito ao desenvolvimento – e direito à diferença. Uma discussão teórica sobre essas categorias desvela a realidade subjacente ao conflito e indica caminhos descoloniais para distender a tensão. ______________________________________________________________________________________________ ABSTRACT / This work investigates the conflict between Baianas de Acarajé against FIFA. With the realization of FIFA World Cup in Brazil a model of development through mega events was implemented, resulting in human rights violations of many Brazilians, including baianas de acarajé. In this context, to fight against the coalition of FIFA, sponsors, national elite and State (called here front of business and state) and to guarantee the realization of their job, baianas de acarajé used many strategies of struggle, from negotiation to direct action. In order to understand, from baianas de acarajé stand point, which meant this conflict with FIFA, did field research, held in Salvador in 2014, and documentary research. From these investigations, identify the strategies and discourses of the dispute, revealing a tension between development and the “difference”, categories that summarize the distinct views on the line. Then, using the intersectionality methodology and the theory of decoloniality, undertake the discussion of the tension between universal human rights – represented as development right – and right of difference. A theoretical discussion about these categories reveals the reality under the conflict and indicates decolonial paths to distend this tension.

Apesar da melhoria dos espa?os para fins tur?sticos, at? ent?o n?o ? poss?vel dimensionar se os investimentos realizados em fun??o do evento proporcionar?o o retorno que os justifique. / The presented study aimed to analyze the contributions provided by the holding of the FIFA World Cup 2014 for Natal/RN touristic destinations in Natal/RN. For that, it was analyzed the effectiveness of public management actions to provide a fitting infrastructure worthy of the event; it was measured which ways of State intervention contributed to the restructuring of urban places with touristic potential; it was identified which were the investments made by the touristic trade due to FIFA mega event; and which actions to professional qualification for the touristic sector that were promoted to meet the World Cup demand. Thus, the research justifies itself for filling a blank in the research about tourism when it comes to the investigation of how occurred the investments made by the State and the private initiative to the holding of the sportive FIFA mega event in Natal, showing its benefits to the city, its population and tourism. Therefore, the study had a qualitative approach, having a descriptiveexploratory character. As data collection instrument a semi structured interview schedule was developed, having as the study population elements in the private initiative and public organs members, besides secondary data usage. For this purpose, the use of content and documental analysis method was made based on data categorization. In the end, it was possible to realize that the FIFA World Cup 2014 made the State to invest a great amount of public resources in mobility, transport and tourism, which surpassed the amount of one billion reais, but all the interventions had as objective the making of the matches, despite the welfare these investments could have brought to the population. A local concentration of planned actions has happened. About tourism, it was concluded that the sportive mega event provided a reorganization of the activity in Rio Grande do Norte capital, mainly in the improvement of the beaches infrastructure; the increase of hotel rooms with the opening of new hotels and contributed with the increase of qualified hand work, in the same rhythm that courses for professional capacitation in tourism were offered. Besides the improvement of the places for touristic purposes, so far it is not possible to measure if the investments made for holding of the event will provide a feedback that justifies them.

Por esse fato, a Constituição Federal brasileira de 1988 promoveu diversas mudanças na administração pública. Uma delas corresponde à transformação gradual da gestão burocrática para uma mais gerencial, na qual o estado centralizado é fragmentado, em escalas político-administrativas, possibilitando novas articulações e novos arranjos com diversos agentes institucionais, permitindo que a economia nacional se torne internacionalmente competitiva. Figura-se assim uma nova realidade na gestão pública, tendo como premissas melhorar seu desempenho e eficiência, evitar a corrupção, orientar as necessidades do tornar a administração pública mais transparente e idônea, identificar as competências e evitar desperdícios no gerenciamento das ações públicas, promover articulações entre diversas instituições em diferentes escalas geográficas (local, regional, estadual, nacional, internacional). Com esse novo formato constitucional, os governos locais/estaduais assumem um papel importante no gerenciamento, coordenação, liderança e tomada de decisão, mobilizando agentes institucionais governamentais (municipais, estaduais, federais e supranacionais) e não governamentais (empresas locais e globais, terceiro setor, entre outros) que têm como objetivo estabelecer processos de gerenciamento-atuação em diferentes focos da ação pública. Porém, esse novo cenário ainda possui problemas como, por exemplo, maior foco no mercado globalizado; falta de monitoramento/controle contínuo das ações/obras públicas; uma cultura política que entrava o gerenciamento das políticas públicas devido a condicionantes históricos, culturais, econômicos, políticos e sociais que vão promover distorções (positivas ou negativas) na tomada de decisão dessas ações públicas. Por isso, é verificado no Brasil que há um distanciamento, em alguns casos, entre os desenhos dos programas e dos projetos públicos junto às realidades das escalas político-administrativas que podem ser potencializados (positivamente ou negativamente) pela relação entre os diversos agentes (arranjos institucionais). Assim, busca-se compreender esses arranjos institucionais nessa nova dinâmica da administração pública gerencial, tendo como foco o desenvolvimento local-regional na gestão urbana recente, a partir do estudo de caso da cidade do Recife. Para tal, foram estudadas as ações públicas realizadas no Recife para a Copa do Mundo FIFA de 2014, utilizando o método hipotético-dedutivo tendo como premissa principal que “os arranjos institucionais são mais eficientes por conta da nova gestão pública”. O estudo teve como análise principal os documentos, contratos, disponibilizados pelo governo federal e estadual. Os resultados alcançados foram opostos ao da premissa, pois não há uma adequada eficiência em quase todas as ações relacionadas com a Copa do Mundo FIFA de 2014. Foram verificados problemas na gestão dessas ações públicas, repercutindo nos atrasos dos prazos de entrega, de finalização das obras e, principalmente, de inconsistências nos recursos públicos ao compará-los entre os sítios governamentais (transparência). Além disso, as obras/ações da Copa do Mundo FIFA 2014 em Pernambuco geraram transtornos na rotina da população que não obteve, ao final das obras, os efeitos positivos pretendidos com as mudanças. Portanto, pode-se concluir que os arranjos institucionais são maleáveis, adaptativos e podem levar a resultados oportunistas, ampliando assimetrias na gestão do território que não levam necessariamente a melhorias na eficiência da gestão pública. / The crisis of the Bureaucratic State has entailed the need to reform and rebuild it, since globalization has become an imperative act for the task of redefining its actions. Due to this fact, the Brazilian Federal Constitution of 1988 promoted several changes in the public administration. One of them corresponds to the gradual transformation of bureaucratic management into a more managerial one, in which the centralized state is fragmented in political-administrative scales, enabling new articulations and new arrangements with various institutional agents, allowing the national economy to become internationally competitive. This is a new reality in public management, with the premises of improving its performance and efficiency, avoiding corruption, guiding the needs of making public administration more transparent and appropriate, identifying skills and avoiding wastage in the management of public actions, promoting links among different institutions at different geographical scales (local, regional, state, national, international). With this new constitutional format, local / state governments play an important role in management, coordination, leadership and decision-making, mobilizing governmental (city, state, federal and supranational) and non-governmental institutional agents (local and global companies, the third sector, and others) that aims at establishing management-action processes in different focuses of the public action. However, this new scenario still has problems such as the greater focus on the globalized market; the lack of monitoring/continuous control of public actions/works; a political culture that impedes the management of public policies due to historical, cultural, economic, political and social constraints which will lead to distortions (positive or negative) in the decision making of these public actions. Therefore, it is verified in Brazil that there is a distancing, in some cases, between the structure of the programs and the public projects with the realities of the political-administrative scales that can be enhanced (positively or negatively) by the relationship among various agents (institutional arrangements). Thus, this dissertations aims on the understanding of these institutional arrangements in this new dynamic of managerial public administration, focusing on local-regional development in recent urban management, based on the study case of the city of Recife, Brazil. To this end, the public actions carried out in Recife for the 2014 FIFA World Cup were studied using the hypothetical-deductive method, with the main premise that "institutional arrangements are more efficient due to the new public management." The study had as main analysis the documents, contracts, made available by the federal and state government. The results achieved were opposite to the premise, as there is not an adequate efficiency in almost all actions related to the 2014 FIFA World Cup. Problems were verified in the management of these public actions, reflecting delays in the delivery deadlines, in the completion of works and, especially problems of inconsistencies in public resources when comparing them among other government sites (transparency). In addition, the works / actions of the 2014 FIFA World Cup in Pernambuco have generated disturbances in the routine of the population, which have not obtained at the end of the works the intended positive effects from the changes. Therefore, it can be concluded that the institutional arrangements are malleable, adaptive and can lead to opportunistic results, widening asymmetries in the management of the territory that do not necessarily lead to improvements in the efficiency of public management.

A pesquisa parte temporalmente da década de 1990, tendo em vista a ascensão dos processos de Globalização após a queda do muro de Berlim, a multipolarização de atores no cenário internacional e o surgimento do conceito governança global. Sendo o esporte um mecanismo cultural utilizado ao longo do século como incentivo à paz e à união dos povos, a FIFA possui um papel fundamental na sua organização em escala mundial. Através de duas dimensões de análise - governança global e soft power – partindo do pressuposto que a FIFA é um ator da governança global, busca responder como ela se utiliza do soft power. A pesquisa baseia-se em fontes secundárias bibliográficas, documentais, sites e pesquisas já realizadas sobre o objeto. Os procedimentos metodológicos que norteiam a presente pesquisa são de caráter exploratório-descritivo, estudando-se o caso da FIFA com uma abordagem qualitativa, com o objetivo de identificar a FIFA como uma organização que possui o monopólio internacional do futebol, constituída juridicamente como uma ONG, cujo comportamento expressa características híbridas na dinâmica da governança global – ora como empresa multinacional, ora como organização do Terceiro Setor, ora como instituição internacional. Sob a ótica do soft power, percebe-se que o comportamento contemporâneo da organização procura alinhar-se a discursos democráticos e de accountability, utilizando estratégias de popularização do esporte, ampliando e diversificando as competições e os campeonatos regionais e internacionais, implementando projetos sociais, aumentando parceiros comerciais, entre outras. Para consolidar sua hegemonia internacional pelo controle da organização do futebol em escala global, a FIFA tem utilizado uma série de práticas, discursos e ações estimuladas e incentivadas pela lógica da governança global em geral e governança desportiva em particular. / This thesis analyzes the inclusion of FIFA on the international stage in the globalization context, observing the dynamics of global governance, relationships and disputes with other actors, using the soft power through its speeches and practices. The research begin temporally of the 1990s, in view of the rise of globalization processes after the fall of the Berlin Wall, the multi-polarization of actors on the international scene and the emergence of global governance concept. The sport is a cultural mechanism used throughout the century as encouraging peace and unity of peoples, and the FIFA has a key role in your organization worldwide. Through two dimensions of analysis - global governance and soft power - starting the assumption that FIFA is an actor of global governance, seeks to answer how she uses soft power. The research is based on secondary sources bibliographical, documentary, websites and research already carried out on the object. The methodological procedures that guide this research are exploratory and descriptive character, studying the case of FIFA with a qualitative approach, in order to identify the FIFA as an organization that has the international monopoly of football, legally constituted as an NGO, whose behavior expressed hybrid features in the dynamics of global governance - sometimes as multinational company, sometimes as Third Sector organization either as international institution. From the perspective of soft power, can see that contemporary performance of the organization seeks to align the democratic and accountability discourse, using popularization strategies of the sport, expanding and diversifying competitions and regional and international championships, implementing social projects, increasing trading partners, among others. To consolidate its international hegemony by controlling the football organization on a global scale, FIFA has used a number of practices, discourses and actions initiated and encouraged by the logic of global governance in general and sport governance in particular.
