The dissertation deals with trafficking of foreigners for the purpose of forced labour and other forms of exploitation. The goal of the work is to evaluate measures taken by state authorities and nonprofit sector with regard to the original causes. The first part of the dissertation shows a brief aspect into the issue. Further follow specific causes of trafficking of foreigners in the Czech Republic. This part is concluded by analysis of individual measures, which are also divided into nonprofit sector and public authorities. The second part of the dissertation aims (through 10 case studies) to confirm or refute the allegations which were found in the first part of the work.

Friedrich Flick, a powerful German industrialist, and several high ranking officials of his firm were tried by a United States military tribunal for war crimes and crimes against humanity committed during the Third Reich. The proceedings and the decision itself are the subject of a critical examination, including an investigation of the factual and legal background. The trial will be regarded in the historical context of prosecutions against German industrialists after World War II. Seen from present-day perspective, the question will be raised whether any conclusions can be drawn from the Flick case in respect of the substance of present-day international criminal law. / South Africa

[pt] Este trabalho tem como objetivo evidenciar a relevância do Brasil no cenário internacional como reconhecido agente ratificador e internalizador de normas da Organização Internacional do Trabalho a respeito da erradicação do trabalho escravo, bem como destacar a fragilidade dessa posição alcançada diante de riscos existentes à política nacional de combate a essa prática ilegal. Para tanto, examina-se primeiramente a adesão brasileira ao corpo normativo da OIT. A partir da análise comparativa entre as iniciativas implementadas pelo Brasil para combater o trabalho escravo nos últimos 25 anos e as normas internacionais estabelecidas pelo Protocolo de 2014 adicional à Convenção do Trabalho Forçado número 29 da OIT (P29) – instrumento normativo vinculante mais recente e atualizado da organização a respeito do tema –, conclui-se que a política brasileira está contemplada em quase sua totalidade no referido documento. Portanto, sustenta-se que a resistência do Brasil em ratificar o Protocolo até hoje revela que o país se encontra em descompasso não só com o contexto internacional contemporâneo de enfrentamento ao trabalho escravo, mas sobretudo com o próprio histórico na OIT, apesar da influência brasileira na formulação do P29 e do prestígio internacional em torno da política nacional. Em seguida, a pesquisa aponta que o avanço brasileiro na erradicação do trabalho escravo ainda não está consolidado ao mapear uma série de obstáculos à política nacional que incluem tentativas de retrocesso, lacunas e falhas apontadas pela literatura especializada e por profissionais e pesquisadores ligados ao campo de pesquisa. Por fim, apresenta-se eventuais impactos econômicos e reputacionais para o Brasil diante do cenário de desmantelamento traçado. / [en] This dissertation aims to shed a light on Brazil s relevance in the international scenario as a recognised ratifying agent with a known path of internalisation of norms of the International Labour Organisation regarding the eradication of contemporary slave labour, as well as to highlight the fragility of this reached position in the face of existing risks to the national policy against this illegal practice. To this end, it is first examined Brazil s adherence to ILO s normative body. Based on a comparative analysis between the initiatives implemented by Brazil to fight slave labour in the past 25 years and the international norms established by the Protocol of 2014 to the Forced Labour Convention 29 (P29) – the latest and most up-to-date binding normative instrument within ILO regarding this topic –, it can be concluded that the Brazilian policy is almost entirely contemplated in the referred document. Therefore, it is arguable that Brazil s resistance to ratify the Protocol reveals that the country is out of step not only with the contemporary international context of confronting slave labour, but above all with its own historical stance within ILO, despite Brazilian influence in the formulation of P29 and international prestige around the national policy. The research, then, points out that Brazil s progress towards the eradication of slave labour is not yet consolidated by mapping a series of obstacles to the national policy that encompasses retrogression attempts, gaps and failures pointed out by specialised literature and professionals and researchers related to the field. Finally, it presents possible economic and reputational impacts for Brazil in view of the dismantling scenario outlined.

Summaries in English and Afrikkans / The aim of this thesis is to investigate the labour law position of South African farm workers. For three and a half centuries farm workers constituted the most neglected group in the South African labour force. Consequently, an understanding of their present position can only be obtained by investigating their labour history. As in other parts of the world, farm workers in South Africa held a subordinate position to agricultural employers. Discrimination against black persons added to the inferior socio-economic and political position of South African farm workers. White farmers occupied a strong political position during most of the time under investigation, which enabled them to institute and apply discriminatory legislation and informal methods to overcome labour shortages. The freedom of movement of black people and their access to land were restricted to create a cheap immobile labour force. During the 20th century farmers prevented the inclusion of farm workers in labour legislation by exercising their political influence. Pressure by industrial trade unions and encouragement by the International Labour Organisation (ILO) resulted in the adoption of the Agricultural Labour Act which made labour legislation applicable to farm workers, but precluded them from striking and made allowance for longer working hours than for industrial workers. The new political dispensation facilitated the inclusion of farm workers in general labour legislation without any discriminatory exceptions and land reform legislation now protects farm workers against arbitrary evictions. A bill of rights furthermore guarantees the rights of farm workers which were previously violated. It would superficially seem that farm workers' problems are something of the past. Farm workers, however, remain handicapped in exercising their new rights by historical factors and circumstances peculiar to the agricultural sector. Legal comparison with Ontario and California confirms that legislation alone is insufficient to empower farm workers. It is recommended that the government amend existing legislation to accommodate the special needs of farm workers and that relevant ILO conventions, especially Convention 141 of 1975, be ratified to aid the development of unions for farm workers. The broad subject of this diploma thesis would be the Czechoslovak Secret Police (StB) during the years 1945-1969; and, more narrowly, certain aspects of its organization and activities in relation to the then applicable legislation. The overriding objective, which was reflected in this legislation, was the protection of the Communist political system, the regime. This regime protection goal clearly influenced the evolution and organization of the StB and the related policies on the imprisonment of those individuals that represented a threat to the State and the State System. Similar general principles and policies have basically remained in effect into the current period. The paper begins with an Introduction and Preface, which take a look at the events and nature of the society in this post-World War II period. This material is derived from an examination of historical source materials. The remainder of the paper is divided into four additional Chapters with related subsections. D’après la Convention n° 182 de l’OIT, toutes les formes d’esclavage ou pratiques analogues, telles que la servitude pour dettes et le servage, la traite, le travail forcé, ainsi que le recrutement obligatoire des enfants dans les conflits armés figurent parmi les pires formes de travail des enfants. Ledit instrument regroupe l’ensemble de ces notions dans une seule et même catégorie pouvant donner lieu à une possible ambiguïté. Le but de ce travail est de faire toute la lumière sur les nuances qui distinguent chacune de ces notions en droit international, européen (en particulier, le droit du Conseil de l’Europe) et iranien. Cette thèse se compose de deux parties. La première partie traite de l’évolution du cadre juridique international, européen et iranien dans la lutte contre le travail des enfants dans son ensemble. La deuxième partie, quant à elle, se penche sur les formes particulièrement graves de travail des enfants, d’ordre économique, qui nécessitent de ce fait un régime juridique spécifique. / Child Labour and Child Exploitation in International, European and Iranian law (a Comparative Legal Study): According to the ILO’s Convention No. 182, all forms of slavery or similar practices, such as debt bondage and serfdom, trafficking, forced labour and compulsory recruitment of children for use in armed conflicts appear among the worst forms of child labour. The aforementioned Convention classifies all these concepts into a singlecategory which may give rise to a possible ambiguity. The aim of this thesis is to shed light on the nuances of each of these notions in international, European (in particular, Council of Europe) and Iranian law. This thesis consists of two parts. The first part deals with theevolution of the international, European and Iranian Legal framework in the fight against child labour in general. The second part particularly focuses on grave forms of child labour of economic nature which require a specific legal regime.

Pohled českých studentů na problematiku totálního nasazení / The view of Czech students on issues of forced labour

The aim of this master's thesis is to ascertain knowledge of Czech students in secondary schools, or more precisely in Grammar school, about the issue of forced labour during World War II. The master's thesis is based primarily on literature and own research and is divided into two parts. The first part is the theoretical part where is briefly introduced the history of forced labour in the general level (definition, type of work, working conditions, division of workers, etc.) and the second part where is conduct social research which is oriented only to Czech students. This research is conducted through a questionnaire survey that has the form of mixed research (questions and its evaluation is both quantitative and qualitative). Based on this research is evaluated both the overall state of knowledge of this issue (it compares the first-years students and fourth -years students of secondary schools), and is also taken account of the issue of the topic processing in secondary school textbooks.

The submitted thesis focuses on the cooperation of the state and non-governmental non-profit organizations in fighting labour exploitation in the Czech Republic. It is one of the most frequent forms of the human trafficking in the CR. The thesis is based on several theories and concepts, such as the actor - network theory, the institutional theory, the Four "C" theory, the NNO theory or the dignified work concept. The thesis analyses the concept of the policy on labour exploitation in the Czech Republic with a focus on the cooperation of main actors from state and non-profit sectors in fighting labour exploitation and proposes how to improve this cooperation. The thesis defines different relevant terms as well as the term "labour exploitation". It also presents statistical data concerning this phenomenon. An analysis of policy documents on a transnational and national level is used to analyse the policy concept. The thesis also works with a quick analysis of actors and semi-structured interviews with eight experts from public and non-profit sector - specifically with employees of the Asylum and Migration Policy Department of the Ministry of the Interior, the Crime Prevention Department, the State Labour Inspection Office and with social workers of the non-profit organizations La Strada and...

The legal implications of harmonising labour laws in the Southern African Development Community (SADC) region

The purpose of this research is to explore the need for, and the legal implications of, harmonising labour laws in the Southern African Development Community (SADC). Chapter One highlights a number of factors that call for the harmonisation of labour laws in the SADC region and discusses some of the reasons why labour laws are not well developed in the region. The influence of globalisation on labour standards in southern Africa and the influence of regionalism on the harmonisation of labour laws are discussed at length. The inference that could be drawn from this discussion is that for a regionalisation process in southern Africa to be successful, there is an urgent need to harmonise the region’s labour law system. This thesis confirms that Southern Africa has many lessons to learn from the regional harmonisation of labour law in the European Economic Community and the current European Union. The implementation of international labour standards in southern Africa is investigated. The main areas examined include (1) freedom of association, (2) collective bargaining, (3) forced labour and (4) discrimination. The findings of this investigation show that there is no uniformity in the implementation of International Labour Organisation (ILO) standards in the SADC region and, therefore, it is recommended labour law should be harmonised in terms of ILO standards. In respect of the benefits to be derived from the harmonisation process, an empirical investigation was conducted in the SADC region and the following is recommended: the harmonisation of labour law in the SADC region will help with the implementation of ILO standards, protection of workers against the economic power of employers in the workplace and maintaining similar benefits for migrants in the region. / Mercantile law / LL.D.
