La finalité du droit international économique contemporain est en principe de réaliser une meilleure harmonisation entre l’expansion du commerce d’une part et la croissance des pays en développement (PED) d’autre part. Cette harmonisation n’est pas toujours évidente dans certains domaines du droit international économique notamment les services. Les rapports juridiques entre un accord multilatéral comme l’AGCS (Accord général sur le commerce des services) et les PED représentent en effet, une dialectique tant au niveau du statut des PED dans le cadre de cet Accord que de ses conséquences juridiques à leur égard. L’étude s’inscrit dans le cadre de cette dialectique et tente de cerner la dimension juridique et les enjeux de développement de ces rapports. Elle se place dans ce contexte à montrer la flexibilité formelle de l’AGCS à l’égard des PED dans un premier lieu et la relativité de ses effets dans un second lieu. / The aim of the contemporary international economic law is in principle to achieve a better harmonization between the expansion of trade and the growth of the developing countries. This harmonization is not always evident or clear in some areas of the international economic law particularly in the services sector. The legal aspects of the relationship between a multilateral Agreement such as the GATS (General Agreement on Trade in Services) and developing countries are indeed dialectic especially in the context of their status in the framework of this Agreement on the one hand and its legal consequences on the other hand. The study takes its place in this dialectic and attempts to identify the legal dimension and the development challenges of this relationship. It is within this context that the research will present the formal flexibility of the GATS against the developing countries in the first place and the relativity of its effects in a second.

國內規章之規範工作在服務貿易總協定第六條第四項即表明須加以進行,且此類貿易障礙確有處理之必要。本論文鑑於規範國內規章之必要性以及談判上之困難,擬探討服務貿易總協定第六條第四項就資格要件、程序、技術標準與核照條件等措施擬定必要規範之可行性。
為減少資格要件與核照要件不必要之貿易障礙,各會員國在就此等要件作規定時,最重要的就是必須將對外國服務供給者或廠商的一切要求予以具體明文化,而這些要求只須確保達到服務品質即可,而不必過於苛刻、意圖阻礙貿易。在國內規章規範中要求會員國去除與服務品質無關且會造成服務供給限制之規定,並可鼓勵會員國間簽定相互承認協定或單方自主給予認許,另外也應鼓勵會員國參考相關國際機構所制定之標準。
在資格程序與核照程序方面,國內規章規範中應要求會員國將資格程序與核照程序事先設立、公開可取得、客觀、去除與服務品質無關且會造成服務供給限制之程序規定,並鼓勵各國主管當局推動簡化的行政程序,減少不必要之人力、物力浪費。
在規範技術標準上,可要求會員參考相關國際組織所發展出來的國際標準,或鼓勵會員間簽定相互承認協定就彼此採用之技術標準予以承認,並要求會員客觀考量其他會員採用的技術標準,若不准許該項標準應提出拒絕理由以避免會員採取之規章措施不合理而造成貿易障礙。此外,在國內規章規範中要求會員公布有關之技術資訊。
有些貿易障礙並不顯見於國內規章上,無法透過查看他會員之法令規定就足以斷定有阻礙貿易之嫌,況且,有時情況國內體制僵化無法立即作出改變,或國家資源與財力有限無法作出變革,而非會員故意藉此來阻撓貿易,這些障礙並無法單靠規範國內規章就可以解決,往往須配合政府體制之革新,以達成去除不必要障礙之目的。故,規範國內規章與政府國內規章革新應是相輔相成的。
由本論文的討論可知規範國內規章基本上是可行的,只是在談判上須兼顧各國面對的困難及國家間的利益衝突,才可很快地制定出國內規章規範,而規範之具體成效的展現,尚須各國政府內部國內規章革新之配合,才能去除不必要之貿易障礙,早日達成服務貿易真正的自由化。

The academic debate initially focused on whether regulatory competition or cooperation constitutes the better model. However, the debate seems to have evolved to adopt a hybrid model combining the virtues of these two approaches. ‘Harmonization’ constitutes the dominant hybrid model. Nevertheless, the implementation of the harmonization model has barely received any attention in the literature.
The aim of this thesis is hence two-fold: first, justify why harmonization should be the preferred model for the regulation of international securities markets; and second, develop, applying an international trade regulation perspective, a regulatory framework to implement the harmonization model using the World Trade Organization and General Agreement on Trade in Services (WTO/GATS) framework.

世界貿易組織協定之整體架構,其內容涵蓋了關稅暨貿易總協定、修正1947年關稅暨貿易總協定的瞭解書,以及規範貨品貿易、服務貿易,與智慧財產權的多邊貿易協定等。世界貿易組織協定中的附件1B,即是為規範服務貿易所訂之服務貿易總協定(General Agreement on Trade in Services,以下簡稱GATS)。由於服務貿易相關議題的起步與發展相形較晚,因此各國就世界貿易組織協定達成協議時,GATS中許多議題仍不成熟也缺乏共識,難以有具體之處理與規範。但是為了能在日後繼續處理這些未完成的議題,因此,乃在GATS條文中分別規定相關文字,要求會員在WTO成立生效後應繼續這些議題的討論與處理。
GATS中這些要求留待日後處理的內建(built-in)議題,分別規定在第6條第4項(國內規章)、第10條第1項(緊急防衛措施)、第13條第2項(政府採購)、第15條第1項(補貼)、以及第19條(特定承諾之談判)。其中,關於特定承諾談判的要求是屬於漸進式自由化的議題,其餘四項議題則是關於GATS規則之議題。由於GATS各項內建議題均頗為複雜與困難,對GATS整體架構都有一定程度之影響,其發展具有相當之重要性,從而本文期望能針對GATS規則制定的議題進行整理與分析,並在相關資料評估的基礎之上,提供若干之建議以供參考。惟鑑於時間與篇幅的考量,本文將限縮著重在緊急防衛、政府採購以及補貼等三項內建議題的討論上。
由於發展程度與個別國家的考量有所差異,已開發國家以及開發中國家對於此等議題的主張不盡相同,本文嘗試就此三項議題依序以第二章、第三章、第四章分別加以探討,透過整理、瞭解此三項談判的基本發展、重要爭議與相關之討論意見,就此三項談判的相關資料、重要爭議或討論意見予以扼要分析與適當論述,同時在目前的談判進度下,本文嘗試從開發中國家與已開發國家之不同立場為討論之出發點,並以前者立場作為我國之談判基調,並視我國實際情況作出調整,進而提出對此三項議題之評估與分析,以瞭解個別議題目前討論的進展,以及相關主張可能產生之影響。
最後,本文在前述各章的評估與分析的基礎之上,在第五章分別就此三項議題提出本文之建議,期望能提供相關研究人員以及有關當局作為參考。 / This thesis focuses on the three ongoing issues of the GATS built–in agenda - the negotiations on emergency safeguard measures, government procurement, and subsidies. These three issues were too complicated to be dealt with properly in the Uruguay Round, so the issues left were regulated in Articles X, XIII and XV of GATS, which mandates members to resolve the issues in the future.
Because each country’s developments and considerations are widely different from one another, developed and developing countries did not achieve consensus on these issues. This thesis attempts to introduce and analyze the different discussions and opinions on these three issues.
Besides the introductory Chapter, the thesis consists of another four parts. Chapter 2 first introduces and clarifies controversial issues on emergency safeguard measures, and then analyzes the three main proposals about ESM (emergency safeguard mechanism) and estimates the most recent status of the issue.
Chapter 3 deals with government procurement under the GATS. After reviewing the history of the negotiation, attention is paid to the proposal from the European Community (hereafter “the EC”). Because the proposal involved with a fierce debate over market access, the EC proposal on a framework for rules for government procurement of services could not be accepted by most developing countries. Therefore, the issue has made little progress in the past years. Chapter 3 concludes with some commentaries on the issue.
Chapter 4 turns attention to subsidies in services. Article XV of GATS mandates members to enter into negotiations with a view to develop multilateral disciplines which would avoid the distortive effects that subsidies in services may have on trade in services. The negotiation on subsidies in services, however, involves many important issues, such as the necessity to regulate subsidies in services, the definition of subsidies in services, elements of rules, etc. Although members made efforts to address these questions, nothing concrete has been achieved. The last chapter consists of conclusions and recommendations.

Tal institucionalização, ao mesmo tempo em que caracterizou uma resposta dos negociadores americanos ao padrão institucional que estava sendo adotado no GATSRodada Uruguai, tornou-se um padrão que teve influência recorrente e amplamente determinante nas regras resultantes das negociações envolvendo Estados Unidos que surgiram a partir de então. Tais argumentos estão ancorados nos pressupostos da abordagem analítica institucionalista histórica e nos conceitos path dependence, conjuntura crítica, nos mecanismos feedback positivo, sequenciamento e nos conceitos de transformações graduais, que ajudam a identificar o desenvolvimento institucional. / The purpose of this thesis is to contribute to the understanding of the standards of service trade rules proposed and/or adopted by the United States in the context of international trade negotiations, verifying if there were changes, if there were repetitions of these standards and what would be the causes of a result or another. Trade in services, following an assertive strategy of American negotiators, entered the agenda of the Uruguay Round of Multilateral Trade Negotiations of the then GATT and came up with as the main topic in the negotiations of the major preferential trade agreements – notably TPP and TTIP – led by the American negotiators. The standards in question reflect a path traced from an aggressive campaign of organizations and other agents, led especially by the financial services sector, in defense of their interests. These actors, who were essential in launching this agenda, continued to support trade agreements throughout all these years, making them the largest demandeurs in favor of liberalization. However, the American negotiators, if on the one hand expressed full interest in making gains from such liberalization, by aligning themselves with these demandeurs, on the other, found themselves challenged from the outset by internal and external constraints. The central argument advocated here is that the trade rules proposed and/or adopted by the United States in the context of international trade negotiations on services – specifically financial services; telecommunication services; audiovisual services; maritime transport services – in the Uruguay Round GATS, but effectively institutionalized in NAFTA, due to the adverse circumstances faced by Mexico, resulted from the demands of several private and public actors and were shaped within the existing institutional limits. Such institutionalization, while that featured a response from the American negotiators to institutional standard that was being adopted in the GATS-Uruguay Round, became a pattern that had recurrent and largely determining influence on the rules resulting from the negotiations involving the United States that emerged thereafter. Such arguments are anchored in the assumptions of the historical institutionalist analytical approach and in the concepts of path dependence, critical juncture, in the positive feedback and sequencing mechanisms, and in the concepts of gradual transformations that help identify institutional development.

Deciphering Structure-Function Relationships in a Two-Subunit-Type GMP Synthetase by Solution NMR SpectroscopyAli, Rustam January 2013 (has links) (PDF)
The guanosine monophosphate synthetase (GMPS) is a class I glutamine amidotransferase, involved in the de-novo purine nucleotide biosynthesis. The enzyme catalyzes the biochemical transformation of xantosine (XMP) into guanosine monophosphate (GMP) in presence of ATP, Mg2+ and glutamine. All GMPSs consist of two catalytic sites 1) for GATase activity 2) for the ATPPase activity. The two catalytic sites may be housed in the same polypeptide (two-domain-type) or in separate polypeptides (two-subunit-type). Most of the studies have been performed on two-domain-type GMPSs, while only one study has been reported from two-subunit-type GMPS (Maruoka et al. 2009).
The two-subunit-type GMPS presents an example where the component reactions of a single enzymatic reaction are carried out by two distinct subunits. In order to get better understanding of structural aspects and mechanistic principle that governs the GMPS activity in two-subunit-type GMPSs, we initiated the study by taking GMPS of Methanocaldococcus jannaschii as a model system. The GMPS of M. jannaschii (Mj) is a two-subunit-type protein. The GATase subunit catalyzes the hydrolysis of glutamine to produce glutamate and ammonia. The ATPPase subunit catalyses the amination of XMP to produce GMP using the ammonia generated in GATase subunit. Since the two component reactions are catalysed by two separate subunits and are coupled in the way that product of one reaction (ammonia) acts as a nucleophile in the second reaction. The cross-talk between these two subunits in order to maximise the efficiency of overall GMPS warrants investigation. The GATase activity is tightly regulated by the interaction with ATPPase domain/subunit, in all GMPS except in the case of P. falciparum. This interaction is facilitated by substrate binding to the ATPPase domain/subunit. Though, the conditions for the interaction between two subunits is known in a two-subunit-type GMP synthetase from P. horikoshii, the structural basis of substrate dependent interaction is not known.
As a first step to understand the structural basis of interaction between the Mj GATase and Mj ATPPase subunits, we have determined the structure of Mj GATase (21 kDa) subunit using high resolution, multinuclear, multidimensional NMR spectroscopy. Sequence specific resonance assignments were obtained through analysis of various 2D and 3D hetero-nuclear multidimensional NMR experiments. NMR based distance restraints were obtained from assignment of correlations observed in NOE based experiments. Data were acquired on isotopically enriched samples of Mj GATase. The structure of Mj GATase (2lxn) was solved by using cyana-3.0 using NMR based restraints as input for the structure calculation. The ensemble of 20 lowest-energy structures showed root-mean-square deviations of 0.35±0.06 Å for backbone atoms and 0.8±0.06 Å for all heavy atoms. Attempts were also made to obtain assignments for the 69.6 kDa dimeric ATPPase subunit. Partial assignments have been obtained for this subunit.
The GATase subunit is catalytically inactive. So far, there has been only one published report on a two-subunit-type GMPS from P. horikashii. The study has shown that the catalytic activity of GATase is regulated by the GATase-ATPPase interaction which is facilitated by the
substrate binding to the ATPPase subunit. For the first time, we have provided the structural basis of interaction between GATase-ATPPase (112 kDa) in a two-subunit-type GMPS. Observed line width changes were used to identify residues in GATase residues that are involved in the Mj GATase-ATPPase interaction. Our data provides a possible explanation for conformational changes observed in the Mj GATase subunit upon GATase-ATPPase interaction that lead to GATase activation.
Ammonia is generated in GATase subunit and is very reactive and labile. Thus, the faithful transportation of ammonia from GATase to ATPPase subunit is very crucial for optimal GMPS activity. Till date, a PDB query for GMPS retrieves only one structure which belongs to two-subunit-type GMPS, where authors have determined the structures of GATase and ATPPase subunits separately. However, the structure of holo-GMPS is not determined yet. Using interface information from experimental data and HADDOCK, we have constructed a model for the holo-GMPS from M. jannaschii. A possible ammonia channel has been deduced using the programs MOLE 2.0 and CAVER 2.0. This ammonia channel has a length of 46 Å, which is well within the range of the lengths calculated for similar channels in other glutamine amidotransferase.
It had been suggested earlier that in addition to the magnesium required for charge stabilization of ATP, additional binding sites were present on GMPS. The effect of excess Mg2+ requirement on the GMPS activity has been studied in two-domain-type GMPS. However, the interaction between GATase and Mg2+ has been not investigated in any GMPS. This prompted us to investigate the effect of MgCl2 on Mj GATase subunit. For the first time, using chemical shift perturbation, we have established interaction between Mj GATase and Mg2+. The dissociation constant (Kd) of the Mj GATase-Mg2+ interaction was determined. The Kd value was found to be 1 mM, which indicates a very weak interaction.
The substrate of the GATase subunit is glutamine. The condition of the hydrolysis of the glutamine is known in GMPS. However, the binding of the glutamine and associated conformational changes in GATase have been not studied in GMPS. Furthermore, till date there is no structure available for the glutamine bound GMPS/GATase. Using isotope edited one dimensional and two-dimensional NMR spectroscopy; we have shown that the Mj GATase catalytic residues are not in a compatible conformation to bind with glutamine. Thus, a conformational change in Mj GATase subunit is a pre-requisite condition for the binding of glutamine. These conformational changes are brought by the Mj GATase-ATPPase interaction.
