E-crimes and e-authentication - a legal perspective

E-crimes continue to generate grave challenges to the ICT regulatory agenda. Because e-crimes involve a wrongful appropriation of information online, it is enquired whether information is property which is capable of being stolen. This then requires an investigation to be made of the law of property. The basis for this scrutiny is to establish if information is property for purposes of the law. Following a study of the Roman-Dutch law approach to property, it is argued that the emergence of an information society makes real rights in information possible. This is the position because information is one of the indispensable assets of an information society. Given the fact that information can be the object of property, its position in the law of theft is investigated. This study is followed by an examination of the conventional risks that ICTs generate. For example, a risk exists that ICTs may be used as the object of e-crimes. Furthermore, there is a risk that ICTs may become a tool in order to appropriate information unlawfully. Accordingly, the scale and impact of e-crimes is more than those of the offline crimes, for example theft or fraud. The severe challenges that ICTs pose to an information society are likely to continue if clarity is not sought regarding: whether ICTs can be regulated or not, if ICTs can be regulated, how should an ICT regulatory framework be structured? A study of the law and regulation for regulatory purposes reveals that ICTs are spheres where regulations apply or should apply. However, better regulations are appropriate in dealing with the dynamics of these technologies. Smart-regulations, meta-regulations or reflexive regulations, self-regulations and co-regulations are concepts that support better regulations. Better regulations enjoin the regulatory industries, for example the state, businesses and computer users to be involved in establishing ICT regulations. These ICT regulations should specifically be in keeping with the existing e-authentication measures. Furthermore, the codes-based theory, the Danger or Artificial Immune Systems (the AIS) theory, the Systems theory and the Good Regulator Theorem ought to inform ICT regulations. The basis for all this should be to establish a holistic approach to e-authentication. This approach must conform to the Precautionary Approach to E-Authentication or PAEA. PAEA accepts the importance of legal rules in the ICT regulatory agenda. However, it argues that flexible regulations could provide a suitable framework within which ICTs and the ICT risks are controlled. In addition, PAEA submit that a state should not be the single role-player in ICT regulations. Social norms, the market and nature or architecture of the technology to be regulated are also fundamental to the ICT regulatory agenda. / Jurisprudence / LL. D.

Physical interaction with electronic instruments in devised performance

This thesis describes how I took part in a series of collaborations with dancers Danai Pappa and Katie Hall, musician George Williams and video artist Julie Kuzminska. To realise our collaborations, I built electronic sculptural instruments from junk using bricolage, the act of subversion, skip diving and appropriation. From an auto-ethnographic viewpoint, I explored how collaborations began, how relationships developed and how various levels of expertise across different disciplines were negotiated. I examined how the documentation of the performances related to, and could be realised as, video art in their own right. I investigated the themes of work, labour and effort that are used in the process of producing and documenting these works in order to better understand how to ‘create’. I analysed the gender dynamics that existed between my collaborators and myself, which led to the exploration of issues around interaction and intimacy, democratic roles and live art. The resulting works challenged gender stereotypes, the notion of what a musical instrument can be and how sound is produced through action/interaction. I found that reflective time was imperative; serendipity, constant awareness of one’s environment, community and intimate relationships greatly enhanced the success of the collaborations. Instruments became conduits and instigators with shifting implied genders based on their context or creative use. As well as sound being a product of movement, effort and interaction, I realised it was also an artefact of the instruments.

The Secret Writer

This essay reflects a particular method and way of working that I employ when undertaking artistic research. My artworks are rooted and develop from the situation I find myself in as an artist, the very context I exhibit the work within. I do this by trying to understand this position, both on the micro and macro scale. As an artist currently studying at—and subsequently exhibiting in relation to— Konstfack, I base my research with the physical manifestation of the school. An imposing building that was part of a huge headquarters and factory site for the telecommunication company, Ericsson, in south Stockholm. The title of my essay is from the translation of a unique German cipher machine, the Geheimschreiber, made known to me through enquiry into this site. Throughout the Second World War the German army used this machine to send highly encrypted military messages across Swedish telephone cables. Following one of the greatest accomplishments in the history of cryptography, a Swedish mathematician broke this German code and subsequently assisted in designing a deciphering machine on behalf of the Swedish Intelligence branch. This device, known as the App, was secretly developed and manufactured by Ericsson, possibly where I now study. In exploring the theme of secrets, this essay originates from an underpinning desire and subject of my work to reveal what is concealed or overlooked. Through researching and writing this essay I attempt to have a better understanding on the notion of secrets, in both the private and public realms. Introducing the artistic process and situation I am working from, I explore the central role that secrets play within society. In order to understand secrecy today I introduce the intertwined and associated contemporary debates of privacy, (both private and public) and transparency through such subjects as Google’s new privacy policy, mobile phone hacking, WikiLeaks and offshore banking.

Legal and regulatory aspects of mobile financial services

The thesis deals with the emergence of bank and non-bank entities that provide a range of unique transaction-based payment services broadly called Mobile Financial Services (MFS) to unbanked, underserved and underbanked persons via mobile phones. Models of MFS from Mobile Network Operators (MNOs), banks, combinations of MNOs and banks, and independent Mobile Financial Services Providers are covered. Provision by non-banks of ‘bank-type’ services via mobile phones has been termed ‘transformational banking’ versus the ‘additive banking’ services from banks. All involve the concept of ‘branchless banking’ whereby ‘cash-in/cash out’ services are provided through ‘agents.’ Funds for MFS payments may available through a Stored Value Product (SVP), particularly through a Stored Value Account SVP variant offered by MNOs where value is stored as a redeemable fiat- or mobile ‘airtime’-based Store of Value. The competitive, legal, technical and regulatory nature of non-bank versus bank MFS models is discussed, in particular the impact of banking, payments, money laundering, telecommunications, e-commerce and consumer protection laws. Whether funding mechanisms for SVPs may amount to deposit-taking such that entities could be engaged in the ‘business of banking’ is discussed. The continued use of ‘deposit’ as the traditional trigger for the ‘business of banking’ is investigated, alongside whether transaction and paymentcentric MFS rises to the ‘business of banking.’ An extensive evaluation of ‘money’ based on the Orthodox and Claim School economic theories is undertaken in relation to SVPs used in MFS, their legal associations and import, and whether they may be deemed ‘money’ in law. Consumer protection for MFS and payments generally through current statute, contract, and payment law and common law condictiones are found to be wanting. Possible regulatory arbitrage in relation to MFS in South African law is discussed. The legal and regulatory regimes in the European Union, Kenya and the United States of America are compared with South Africa. The need for a coordinated payments-specific law that has consumer protections, enables proportional risk-based licensing of new non-bank providers of MFS, and allows for a regulator for retail payments is recommended. This qualitative study uses narrative inquiry (Connelly & Clandinin, 1988, 1990, 2001) and self-study to investigate ways to further understand and facilitate the integration of holistic philosophies of education with media literacy pedagogies. As founder and director of the Youth Media Literacy Project and a self-titled Imagitator (one who agitates imagination), I have spent over 10 years teaching media literacy in various high schools, universities, and community centres across North America. This study will focus on my own personal practical knowledge (Connelly & Clandinin, 1982) as a culture jammer, educator and cancer survivor to illustrate my original vision of a ‘holistic media literacy pedagogy’. This research reflects on the emergence and impact of holistic media literacy in my personal and professional life and also draws from relevant interdisciplinary literature to challenge and synthesize current insights and theories of media literacy, holistic education and culture jamming.
