A Comissão Interamericana de Direitos Humanos é uma instância jurídico política que integra o Sistema Interamericano de Direitos Humanos e é responsável pela análise de denúncias de violações a direitos ocorridos nos diversos países das Américas. A proposta deste trabalho é analisar as decisões de admissibilidade, mérito e acordos de solução amistosa publicadas pela Comissão e verificar a incidência de casos de violação a direitos humanos das mulheres. Mais do que simples casos em que a mulher é vítima, os casos objeto de análise deste trabalho apresentam situações em que justamente a violência ocorreu porque a vítima é do sexo feminino. Esta pesquisa congrega dados quantitativos e qualitativos sobre a ocorrência destas demandas no Sistema Interamericano de Direitos Humanos e os impactos que as decisões da Comissão trazem para a observância dos direitos humanos das mulheres na região, bem como para a própria reformulação do conceito de direitos humanos / The Inter-American Commission on Human Rights is a political and juridical instance which is part of the Inter-American Human Rights System and analyzes human rights violations reports in many countries in the American continent. This research evaluates the rulings of admissibility, merit and friendly solution agreements published by the Commission; it also verifies the frequency of womens human rights violation cases. More than just simple cases in which a woman is a victim, these analyzed episodes show that the violence took place precisely because the victim was a woman. This dissertation is based upon quantitative and qualitative data concerning the occurrence of these cases in the Inter- American Human Rights System and the impact that this decisions had on womens human rights observance in the region and on the re-formulation of human rights concept itself.

The intensification of the complexity of global society led to the need for development of new legal models for new cross-border problems. It seeks, in this work, display and critically analyze the multilevel constitutionalism, transconstitucionalism and interconstitucionality and approach these perspectives in relation to the Inter-American System of Human Rights Protection (ISHR) in order to try to understand the phenomena of constitutional integration and exchanges in Latin American countries. From this objective, it seeks to present the current Project of ISHR and in particular the Inter-American Court (IACHR).It is understood that jurisprudence built by the IACHR, as well as the "conventionality control”, represent new factors in the legal systems that undergo a process of integration and therefore are relevant to understanding the contemporary dynamic. It presents a brief statement about the ISHR's performance in the Brazilian context and its consequences, as the critical position of Brazil in relation to certain requests and determinations issued by the Commission and Inter-American Court, respectively. Through the exposure of the Inter-American Court jurisprudence in cases of amnesty laws, we intend to identify, in the current Latin American scene, the placement of this Court, I try to view the prospects discussed and delineate potential consequences of each of the three constitutional integration models analyzed with regard the hypothesis of functioning as theoretical references at the Latin American experience of human rights promotion. It is recognized that neither model completely correspond to legal or political dynamics of the ISHR, however, it is expected to identify the approach and the distance of this system about these new emerging constitutional models of Constitutional Law, considering the conceptual delimitation of Human Rights used for the construction of this analysis, that is, they are constituted as an open content class, which is incompatible therefore with a universal-abstract and unifying bias. / Desde a promulgação da Declaração Universal dos Direitos Humanos pelos membros da Organização das Nações Unidas (ONU) em 1948, grandes transformações históricas ocorreram no cenário internacional. A intensificação da complexidade na sociedade mundial acarretou a necessidade de elaboração de novos modelos jurídicos para os novos problemas transfronteiriços. Busca-se, nesse trabalho, apresentar e analisar criticamente o constitucionalismo multinível, o transconstitucionalismo e a interconstitucionalidade e a aproximação dessas perspectivas em relação ao Sistema Interamericano de Proteção dos Direitos Humanos (SIDH), com o fim de se tentar compreender os fenômenos de integração e intercâmbio constitucional no âmbito dos países latino-americanos. A partir desse objetivo, procura-se apresentar o atual projeto do SIDH e, em especial, da Corte Interamericana (Corte IDH), seu órgão jurisdicional. Entende-se que a jurisprudência construída por este Tribunal, bem como o “controle de convencionalidade” por ela exercido, representam fatores novos nos sistemas jurídicos que passam por um processo de integração e, por isso, são relevantes para entender a dinâmica contemporânea. Da América do Sul à América Latina: o Brasil e os Estados Unidos nas relações interamericanas (1933-1954) / From South America to Latin America: Brazil and the United States in Inter-American relations (1933-1954)

Os conceitos geopolíticos elaborados, ou apropriados, e ressignificados pelas grandes potências moldam as relações internacionais. A partir desta tese, esta pesquisa versa sobre as relações internacionais entre os Estados americanos, que tiveram lugar no movimento panamericano de 1933 a 1954. Durante o período, no âmbito dos eventos continentais mais importantes (Conferências Pan-Americanas e Reuniões de Consulta aos Ministros das Relações Exteriores), destacaram-se dois conceitos geopolíticos levados a termos pelos Estados Unidos e que serviram de baliza para as relações interamericanas: América do Sul e América Latina. A primeira proposição, em vigência de 1933 a 1942, compreendia o conjunto das Américas como espaço formado pelos Estados Unidos, por Estados da América Central e por Estados diferentes e desenvolvidos que formavam a América do Sul. Após este período, uma nova proposição sugeriu que as relações hemisféricas eram constituídas, por um lado, pelos Estados Unidos e, por outro, pelos demais Estados americanos que passaram a compor a América Latina, sem distinção. Neste sentido, o objetivo geral deste trabalho é analisar a atuação da diplomacia dos Estados Unidos e da diplomacia do Brasil em relação aos conceitos de América do Sul e América Latina nas relações hemisféricas. Para tanto, procuramos identificar o que denominamos como demandas latino-americanas e que receberam destaque na documentação diplomática produzida e arquivada pelo Departamento de Estado e pelo Ministério das Relações Exteriores do Brasil. Buscamos, ainda, verificar o posicionamento dos Estados Unidos e do Brasil e qualificar a cooperação entre o ambos. A pesquisa levou-nos a atuar na intersecção de dois temas clássicos da história das relações interamericanas: a política da Boa Vizinhança e a Doutrina Truman de contenção ao comunismo. Concluiu-se que durante o período da Boa Vizinhança, a América do Sul emergiu tanto de uma crise de interpretação da sociedade (e da diplomacia) americana sobre o que havia ao sul do Rio Grande, quanto de uma crise do capitalismo mundial. A delimitação geopolítica e o prestígio atribuído à diplomacia brasileira foi ao encontro do interesse da política externa brasileira, cuja abrangência sul-americana há muito constava de seu horizonte de atuação regional. Neste sentido, no início da década de 1940, o Brasil vislumbrava que seria essencial para a política hemisférica dos Estados Unidos e para as relações interamericanas. No entanto, a perspectiva de um lugar reservado nas relações hemisféricas não sustentou-se no pós-guerra, especialmente nos eventos pan-americanos sob a Doutrina Truman. A proposição norteamericana de que havia igualdade entre os Estados da América Latina, composta por um grupo homogêneo de Estados, levou as diplomacias brasileira e americana a operar desde posições opostas. Paradoxalmente, o Brasil deu os primeiros passos rumo a aproximação com os demais Estados do subcontinente. As conclusões deste trabalho são relevantes e subsidiam a compreensão das relações internacionais americanas contemporâneas, sobretudo os processos de integração regional. / Geopolitical concepts elaborated, appropriated or reinterpreted by the great powers play a key role in shaping international relations. This thesis deals with international relations among the American states from 1933 to 1954, specifically in the Pan-American movement. In the major continental events (Pan-American Conferences and Consultation Meetings of the Ministers of Foreign Affairs) under consideration, two geopolitical concepts brought to terms by the United States served as a beacon for inter-American relations: South America and Latin America. The first proposition, in effect from 1933 to 1942, comprised the whole of the Americas as a space formed by the United States, by the Central American states and the different and developed states that formed South America. After this period, a new proposition suggested that hemispheric relations were established, on the one hand, by the United States and, secondly, by other American states that were included in Latin America without distinctions. In this sense, the aim of this study is to analyze the performance of the diplomacy of the United States and Brazil in relation to the concepts of South America and Latin America in hemispheric relations. Therefore, I try to identify what I call Latin American demands, which were highlighted in the diplomatic documentation produced and filed by the State Department and the Ministry of Foreign Affairs of Brazil. I also seek to trace the positions of the United States and Brazil and qualify cooperation between both countries. The research led me to explore the intersection of two classic themes of the history of inter-American relations: the Good Neighbor Policy and the Truman Doctrine to contain communism. It was concluded that during the period of the Good Neighbor Policy, South America emerged both as a crisis of the American interpretation of society (and diplomacy) about what was occurring south of the Rio Grande and a crisis of world capitalism. The geopolitical boundaries and prestige attributed to Brazilian diplomacy during this period was clearly in the interest of Brazilian foreign policy, whose South American horizon had long consisted only of regional operations. In this sense, in the early 1940s, Brazilian politicians envisioned that the country would be essential for the hemispheric policy of the United States and for inter-American relations. However, the prospect of a reserved place in hemispheric relations did not hold up after the war, especially in the Pan American events during the period of the Truman Doctrine. The United States proposition that there was equality among the homogeneous group of states led Brazilian and American diplomacies to stake out opposite positions. Paradoxically, Brazil took the first steps towards rapprochement with the other states of the subcontinent. The findings of this study subsidize the understanding of contemporary inter-American relations, particularly processes of regional integration.

The research is based on a case study of the Peruvian Social Fund, FONCODES, and utilizes a qualitative data collection approach. It mainly relies on semi-structured interviews with FONCODES' staff and community members, unstructured interviews with experts, and analysis of operational documents. The research concludes that several organizational and institutional characteristics affect community participation in FONCODES projects but the direction of this influence depends on how specific areas of the organization's context are structured as well as on political variables in the institutional environment. / South Africa

O objetivo desta tese é analisar como e por que a normatividade do sistema interamericano de direitos humanos sobre o tema da justiça de transição pôde exercer impacto sobre questões de direitos humanos no Brasil, Colômbia, México e Peru. Partindo da abordagem emergente na literatura de que os efeitos dos regimes internacionais de direitos humanos são condicionados por fatores domésticos dos países aos quais se dirigem suas normas e pressões, a pesquisa buscou delinear como a política doméstica influencia e medeia o impacto potencial dessas normas internacionais que compõem a cascata de justiça, salientando o papel de organizações não governamentais (ONGs) de direitos humanos e da cúpula do Judiciário local, já que tais atores são centrais tanto para o processo de justiça de transição quanto para a ativação e aplicação da normatividade do sistema interamericano. Nesse sentido, a partir de um desenho de pesquisa qualitativo que se baseou na realização de entrevistas semiestruturadas com atores da sociedade civil e magistrados envolvidos com a temática, além da consulta a fontes secundárias e sentenças judiciais, testamos a hipótese segundo a qual o sistema interamericano adquirirá aderência doméstica se e quando esses atores forem capazes de entendê-lo e instrumentalizá-lo como um mecanismo efetivo para o seu empoderamento. Assim, contrariamente à maioria dos estudos que privilegiam a ação do Executivo para explicar o impacto de normas e pressões internacionais de direitos humanos, nossas conclusões apontam para a necessidade de que as agendas de pesquisa sobre o regime internacional de direitos humanos e justiça de transição atentem mais para o papel e perfil dos atores judiciais e organizações litigantes de direitos humanos, pois os avanços em termos de direitos humanos passam muitas vezes pela mobilização de uma normatividade internacional que não pode ser entendida de maneira divorciada da agência de ONGs e magistrados. / The aim of this dissertation is to analyze how and why the norms of the Inter-American Human Rights System on transitional justice exerted an impact on human rights issues in Brazil, Colombia, Mexico and Peru. Based on the emerging theoretical approach according to which the effects of international human rights regimes are conditioned by domestic factors of the target-countries, our research seeks to unravel how domestic politics influences and mediates the potential impact of these international norms that comprise the justice cascade, highlighting the role of human rights non-governmental organizations (NGOs) and the local higher courts, since these actors are central both to the process of transitional justice and for the activation and enforcement of the Inter-American systems rules. In this sense, a qualitative research design based on semi-structured interviews with civil society actors and judges involved with the theme was adopted, in addition to the consultation of secondary sources and courts rulings. Then, from the analysis of this material, we tested the hypothesis that the Inter-American system will have a domestic impact if and when NGOs and local judges are able to understand and use it as an effective mechanism for their own \"empowerment\". Therefore, contrary to most studies that focus on Executives actions to explain the impact of international human rights norms, our conclusions urge the research agendas on the human rights international regime and transitional justice to pay more attention to the role and profile of judicial actors and domestic litigants, since human rights advacements are anchored on the mobilization of international norms that cannot be understood separately from the agency of NGOs and magistrates

The effectiveness and propriety of friendly settlements in the African regional system : a comparative analysis with the Inter-American and European regional systems

"Despite the apparent universal existence of the friendly settlement procedure it has not been extensively used in the African regional system. Against this background, this study is a comparative analysis of the provisions and application of the friendly settlement procedure in the African, Inter-American and European regional systems. The study further examines in detail the practice and jurisprudence of the three regional systems on a comparative basis. The comparative analysis is relevant for the following reasons. Both Africa and South America share common historical backgrounds in terms of socio-economic development and the nature of human rights violations. Europe has the oldest human rights system and if experience is anything to go by, then there might be lessons to be learnt by the younger counterparts. The establishment of the African Court of Human and Peoples' Rights (African Court) to complement the protection mandate of the African Commission on Human and Poeoples' Rights (The African Commission) further justifies the comparative analysis as the other regional systems also have regional human rights courts. ... Chapter 1 is an introduction of the study on the effectiveness and propriety of friendly settlements. The ensuing chapter traces the foundations and sets up the conceptual and theoretical framework of friendly settlements. Feminicidio jako alarmující problém mexické společnosti - analýza procesu u dvou vybraných případů / Feminicidio as an alarming problem of Mexican society: Process tracing of two selected cases

Gender violence in Mexico is a problem that affects its society on a long- term basis. Its most extreme form known as feminicide, that is a gender- based murder of women, appears with so much frequency that it can be considered a structural problem yet. Mexico is one of the countries with most cases in Latin America, however, insufficient and ineffective measures taken by the state facilitate their perpetration which is often immune from prosecution. This thesis aims to approximate the issue to the reader and explain the concept of feminicide in given context within its complexity. For that purpose, a process tracing analysis of two selected cases is done; starting from their perpetration to their sentencing by judicial instances. The sentences of both cases became very important milestones. The factors that contributed to the outcome are tracked and afterwards a comparison of tracked causal mechanisms is done. As it was already mentioned, the cases were not selected randomly. Not only are they important for their sentences, but moreover they took place in two Mexican states with traditionally high numbers of committed feminicides, that is in Chihuahua and Mexico State. [pt] Esta tese, por meio de autores decoloniais, pós coloniais e pensamento afrodiaspórico, principalmente os pensadores do sul, busca a compreensão da colonialidade do ser como mobilizador de opressões estruturais de raça, gênero, sexualidade e classe, apontando de que modo a justiça criminal e o sistema penitenciário, no decurso da história, são dispositivos centrais na perpetuação de violência sob os corpos e subjetividades daqueles e daquelas que foram binarizadas e racializadas de modo a serem subalternizadas e subalternizados em relação ao sujeito que trouxe para si os caracteres tidos como hegemônico impostos pela masculinidade, racismo e cisheteronormatividade. A partir dessas lentes, é feita uma releitura das decisões proferidas no sistema interamericano de direitos humanos para casos que versem sobre prisões no Brasil no período entre 1988 e 2018, para compreender os limites e potencias do litígio estratégico para a luta antipunitiva. Por fim, para entender o posicionamento dos diversos atores no combate ou reprodução da colonialidade racista de gênero no litígio, analisa-se todas as peças da Medida Provisória Pessoas Privadas de Liberdade no Complexo Curado vs. Brasil durante os anos de 2006 até 2014. / [en] This thesis, using decolonial authors, postcolonial and Afro-Diasporic thought, specially the thinkers of the south, seeks to understand the coloniality of being as a mobilizer of structural oppressions as race, gender, sexuality and class, pointing out how criminal justice and the penitentiary system, in the course of history, are central devices in the perpetuation of violence on the bodies and subjectivities of those who have been binarized and racialized in order to be subalternized in relation to the subject understood as hegemonic: male, white and hetenormative. Through these lenses, will be made a re-reading of the decisions pronounced by the inter-American human rights system on cases that deal with prisons in Brazil between 1988 and 2018, in order to understand the limits and potentials of strategic litigation for the anti-punitive struggle. Canada’s experience in the war against terrorism goes back to the seventies, and continues to develop nowadays, with the last direct terrorist activity in 2017. The Canadian Government reacted to these terrorist attacks by enacting a number of statutes that reflect a changing international paradigm in relation to the fight against terrorism. Fundamental rights and liberties such as the freedom of expression, the right to private life and to personal freedom have been curtailed by these legislative measures. The practical consequences of these measures are analyzed via a comparative examination of the Inter-American System of Human Rights. In general terms, the war against terrorism produces significant impacts over the human rights. / La experiencia de Canadá en la lucha contra el terrorismo se remonta a inicios de la década de los setenta y se desarrolla hasta la época actual (los acontecimientos más recientes han tenido lugar en el año 2017). Las medidas legislativas fueron la vía adoptada por parte de Canadá para contrarrestar los ataques y reflejar el cambio de paradigma político en la esfera internacional con relación al fenómeno del terrorismo.
