Previous issue date: 31 / Nenhuma / Com o advento da nova Doutrina da Proteção Integral, plasmada, no plano nacional, na Carta Política de 1988 e no Estatuto da Criança e do Adolescente, ocorreu forte mudança do paradigma referente às questões da Infância e da Juventude, tornando as crianças e adolescentes sujeitos de direitos e não meros objetos de providências de cunho assistencial. Aboliu-se a antiga Doutrina da Situação Irregular, redundando na redução dos limites de atuação do Juiz da Infância e da Juventude. No entanto, identifica-se um movimento de negação do novo ordenamento, que se reflete em decisões voltadas, ainda, para o sistema jurídico revogado. Nesse cenário, o princípio do melhor interesse da criança, previsto na Convenção Internacional Sobre os Direitos da Criança, tem servido de instrumento para a adoção de decisões judiciais discricionárias e alheias à nova ordem vigente. Essa realidade é percebida e exemplificada em precedentes da Justiça Gaúcha, exigindo a construção de alternativas para que os direitos e garantias fundame / The new Integral Protection Doctrine, constituted nationally in the 1988 Constitution and in the Child and Adolescent Act, a sound paradigm change occurred concerning the childhood and youth issues, in which children and adolescents became subjects of right instead of simple assistance objects. The former Irregular Situation Doctrine was revoked, causing, as a result, a reduction of the limits to the Childhood and Youth Judge actions. However, it is possible to identify a denying move towards to the new determination, reflecting on decisions directed to the former juridical system. In this situation, the best interest of the child principle, foreseen in the Convention on the Rights of the Child, is being used for discretionary decisions, disregarding the new valid order. This reality is perceived and exemplified in precedent situations of the Justice in Rio Grande do Sul, demanding alternatives in order to protect the fundamental rights and guaranties of children and adolescents. This paper has concluded that the Diaspora contribute to the development of social, economic and political fields, which also means a high level of poverty reduction. This has been largely possible not least because of developments in computing and telecommunications, but also through the Diaspora's grassroots involvement. By being the only player who can get access to specific locations, and through their local knowledge the Diaspora can easily be seen as legitimate actors and therefore also play a unique role in peace processes. They are also not tied to bureaucratic structures on which they can act with direct effect. For example, they can assist quickly to different kinds of crisis situations, such as environmental disasters. Many governments and organizations are interested in cooperating with the Diaspora, but they also see many challenges with it. Further on, Diaspora can feel that their voices are not always heard. The essay has also reached a conclusion that a balance between the UN's two main conventions International Convention on Economic, Social and Cultural Rights and the Covenant on Civil and Political Rights increasingly may arise. This is thanks to the co-operations between liberal organizations and the Diaspora whose efforts may be in the private markets to create jobs and development, and their contributions in construction of social infrastructure. Other impacts on the organizational level may be towards more complex models of organization and partnerships, where not least the private sector may be included to a greater extent, which also demonstrates the enhanced globalization trends, where the private market is seen to be the answer to the solution of poverty. As regards to States and the role of various actors in these somewhat newer landscapes, they can also be a result from the processes of globalization and shifts in power from the state to the different levels at which non-state actors gets a stronger role. These processes may also have contributed to greater regionalization; forces which this paper found over time may be a competitor to a weak UN (and the EU) and therefore attract the Diaspora who also may find themselves to be better received there.

The regulation of the removal of hazardous shipwrecks in South African waters and a discussion on the adoption of the Nairobi International Convention on the Removal of Wrecks, 2007.Ramsakkan, Yinita. 12 August 2014 (has links)
International trade in large amounts of commodities resulted in the recent growth of the shipping
industry. With larger ships being constructed to meet land based demands for various types of
commodities combined with the unpredictable and often perilous conditions at sea, the risk of a
shipwreck arising becomes more likely. Not only do these wrecks pose a danger to the
environment and to navigation but also, in the event of the shipowner escaping liability by
abandoning the wreck for instance, the state affected by the wreck finds itself financially
burdened by the costs involved in having the wreck removed. Moreover, an affected state cannot
intervene and impose conditions to the shipowner to have a wreck removed if it occurred in its
exclusive economic zone because the state’s jurisdiction is limited to preserving natural
resources. Thus, despite drifting cargo and the ship itself posing a hazard to coastal states, they
had no authority to intervene and issue a wreck removal notice.
Recognising these safety concerns and lacunae in international law, the International Maritime
Organisation formulated the Nairobi International Convention on the Removal of Wrecks, 2007,
(“Nairobi Convention”) which was aimed at governing the regulation of removing wrecks whilst
imposing strict liability on the shipowner, subject to the other liability Conventions and
limitation of liability. However, after a survey was conducted by the Comitè Maritime
International it was also established that national laws of many states such as the United
Kingdom (“UK”) and South Africa were inadequate to enforce liability claims for costs incurred
in removing a wreck. As a result, the Convention allows contracting states to apply the
provisions of the Convention to their territorial sea.
This dissertation will discuss relevant provisions of the Nairobi Convention and illustrate how it
has been implemented and consequently reformed the law of the United Kingdom. The
dissertation will then analyse the implementation strategy which enforces the Convention in the
UK, with the aim of providing a suggestion of how South Africa should enforce the Convention
into its national laws. This will lead to an assessment of the current legislative framework
governing wreck removal in South Africa with the aim of establishing whether the law is need of

The primary goal of this study was to identify key success factors for the management of a
conference centre in South Africa. This goal was achieved by firstly portraying an overview
of the conference industry in South Africa. Secondly, a literature study was conducted in
order to determine the aspects in the literature that are regarded as of vital importance in
managing a conference centre. Thirdly, the results of the empirical research were
discussed. Lastly, conclusions were drawn from the research and recommendations were
made with regard to further research.
From the literature study, aspects of strategic management, financial management,
marketing management, human resource management and management of operational
aspects were identified as being important in the management of a conference centre.
These aspects were used to compile a questionnaire. The objective of the questionnaire
was to measure the importance that conference centre managers attach to the identified
elements. Questionnaires were e-mailed to 250 conference centres. A total of 100
questionnaires were received back. The study population consisted of a database as
compiled by the researcher from the Direct Access Conference Handbook (2004) and the
Africa Conference Directory (2006/7). Questionnaires were also handed out personally to
exhibitors at the INDABA Tourism Exhibition (2006).
From the responses to the questionnaire it can be deduced that conference centre
managers regard the aspects of strategic management, financial management, marketing
management, human resource management and management of operational details as
important to very important.
A factor analysis was done to determine the key success factors in managing a conference
centre. The following factors were identified, namely to: • Provide a conference centre with a functional layout and the correct variety of activities; • perform marketing management; • ensure that operational aspects are in place; • do proper planning; • provide an attractive venue and conduct a post-conference evaluation; and • perform human resource management.
Conference centre managers have to apply the above-mentioned key success factors to

O presente trabalho objetiva o estudo dos aspectos legais pertinentes à entrega vigiada, vista como meio de investigação. A escolha do tema surgiu da preocupação com o avanço do crime organizado, que ganhou contornos transnacionais, e a necessidade de adoção de novos métodos de investigação, capazes de refrear este tipo de criminalidade. Cada vez mais os Estados percebem que os meios ordinários de investigação tornaram-se obsoletos e ineficazes para fazer frente ao avanço das operações desenvolvidas pelas organizações criminosas, porquanto se utilizam de modernos artifícios para perpetrar suas práticas delitivas. Tratar-se-á da entrega vigiada propriamente dita, técnica que permite que remessas ilícitas ou suspeitas circulem de forma monitorada, sob controle das autoridades competentes, conceituando-a e apresentando suas características e peculiaridades, bem como procurando delimitar sua natureza jurídica. Também será examinado o tratamento conferido à entrega vigiada na legislação alienígena. Ademais, como instrumento de cooperação internacional, a entrega vigiada tende a ser adotada paulatinamente entre os diversos países signatários das convenções internacionais nas quais previstas este meio investigativo. Para completa análise do instituto, indispensável enfrentar a árdua tarefa de ponderação da entrega vigiada à luz da eficiência e garantismo. Pretende-se apontar as possíveis ofensas aos princípios constitucionais e processuais penais que o meio investigatório da entrega vigiada pode acarretar, especificando os requisitos acreditados como indispensáveis para a regulamentação da entrega vigiada, de modo a delimitar sua atuação e, por conseguinte, evitar o cometimento de odiosos abusos por parte dos envolvidos no emprego desta técnica de investigação. Serão expostos aspectos positivos, falhas e críticas ao instituto em exame. Almeja-se, como contribuição desta dissertação, a apresentação de algumas sugestões para o escorreito e eficaz emprego da técnica da entrega vigiada, de modo a resguardar, obrigatoriamente, os direitos do investigado. / The present work aims the study of pertinent legal aspects of monitored delivery, as a means of investigation. The choice of the subject came from the concern of the organized crime increase, that reached international levels and the necessity of adoption of new methods of inquiry, enabling to reprimand this type of crime. The State has acknowledged that the usual inquiry has become obsolete and inefficient in face of the advance of the operations developed by the criminal organizations, which make use of advanced techniques to perpetrate illegal practices. It concerns the monitored delivery, a technique that allows illicit or suspicious packages to circulate freely, under control of the competent authorities, appraising them and presenting their characteristics and peculiarities, as well as their legal nature. Also the treatment to the monitored delivery in the foreign legislation will be examined. Furthermore, as an instrument of international cooperation, the monitored delivery tends to be adopted gradually entering the diverse signatory countries of the international conventions foreseen in this institute. For complete analysis of the institute, indispensable to face the arduous task of balance of the monitored delivery to efficiency and warranty. It is intended to point the possible offences of the constitutional principles of penal law that the inquiry of the monitored delivery can result in, specifying the requirements as indispensable with respect to the regulation of the monitored delivery, in order to delimit its performance and, therefore, to prevent hateful abuses involving the inquiry technique. Positive aspects, imperfections and criticism to the institute in examination will be exposed. It is intended, as a contribution of this dissertation, the presentation of some suggestions for the proper and efficient job of the technique of the monitored delivery, in order to protect, obligatorily, the rights of the investigated.

O grande avanço da era nuclear nas últimas décadas impôs novos paradigmas e a necessidade de atualização da filosofia em questão. O presente trabalho tem por objetivo apresentar uma análise da evolução da filosofia do sistema de limitação de dose, desde a década de 50 até os dias atuais. A primeira mudança de paradigma se deu com a criação dos Limites Anuais Máximos Admissíveis (LAMA), ainda vigentes. Por meio de um cuidadoso estudo das publicações do Organismo Internacional de Energia Atômica (OIEA) e das recomendações da CIPR, foi possível evidenciar e detalhar o processo de evolução dos LAMA ao longo das últimas décadas. A pesquisa aborda momentos-chaves que impulsionaram mudanças na filosofia do sistema de limitações de dose como, por exemplo, a crise internacional do petróleo e suas implicações no desenvolvimento da área nuclear. A comparação entre as diversas publicações das duas entidades (OIEA e CIPR) permitiu um estudo aprofundado desde o surgimento dessas filosofias até suas últimas publicações. Os resultados deste estudo apontam importantes informações que constam em publicações da CIPR, hoje consideradas \"superseded\", que não são encontradas nas publicações atuais. O OIEA, que elabora suas recomendações baseado na filosofia da CIPR, também não aborda as referidas informações. Por meio da presente pesquisa, foi possível evidenciar e detalhar valiosas informações que se perderam durante o processo de atualização das publicações e edição de recomendações de ambas as entidades. Proposed South African management framework for the implementation of the International Convention for the Control and Management of Ships' Ballast Water and SedimentsNolting, Janine January 2011 (has links)
South Africa, strategically situated at the southern tip of Africa, is edged on three sides by almost 3000 km of coastline surrounded by the Indian Ocean and the Atlantic Ocean (South African Tourism, 2011). This vast ocean expanse is responsible for conveying approximately 96% of South Africa’s exports (Brand South Africa, 2011). Despite the positive economic effects of the shipping industry, translocation of harmful organisms and pathogens via ballast water and sediments inside ballast water tanks has far reaching global environmental (and economic) impacts (Oliviera, 2008:1; David and Gollasch, 2008:1966). Ballast water is the water that is taken on in order to manage the draft of the ship, to help with propulsion, manoeuvrability, trim control, list and stability (Oliviera, 2008:2). The discharge of ballast water into the world’s oceans has resulted in the transfer of ecologically harmful sea-life into non-native environments (IMO, 2011), resulting in major environmental threats to our oceans (Bax, Williamson, Aguero, Gonzalez and Geeves, 2003:313). Various international documents have been developed to deal with the ballast water issue, culminating in the introduction of the International Convention for the Control and Management of Ships’ Ballast Water and Sediments (“the Convention”) in 2004. The Convention aims at achieving a reduction in the transfer and subsequent impacts of aquatic organisms via the ballast water and sediment of ships. On a local level, South Africa does not have direct legislation or regulations dealing with ballast water (Duncan, 2007:34) and relies on the combination of a number of pieces of legislation relating to environmental management, coastal management, biodiversity, alien invasive species control, port control and ship safety (National Environmental Management Act, 1998, National Environmental Management: Biodiversity Act, 2004, National Environmental Management: Integrated Coastal Management Act, 2009, National Ports Act, 2005 and Merchant Shipping Act, 1951). Although the Convention was ratified by South Africa in 2008 (Department of International Relations and Cooperation, 2011) it is still not in force and there still exists no other consolidated legal mechanism through which ballast water is managed. This research has investigated the various roles, responsibilities and mandates of South African competent authorities under the aforementioned legislation in managing ballast water, and has determined that there is definite legislative and institutional fragmentation as well as overlaps. A comparative analysis of management frameworks developed both locally and internationally was conducted in order to develop a management framework for ballast water management in South Africa. Various legislative, institutional and functional aspects were identified and adapted for inclusion in a South African management framework. A co-ordinated approach to ballast water management has been developed in the management framework which is anticipated to result in more definitive roles and responsibilities of the various South African departments involved in the management of ballast water and implementation of the Convention.

有視於許多珍貴人類文化資產或因全球化導致文化均質化,或因武裝衝突、發展觀光及環境惡化等因素,面臨毀壞甚至消失的危機,聯合國教科文組織和許多國際組織透過制定及締結國際公約喚起國際社群的關注,凝聚國際間的集體力量,帶動國際文化保護保存的合作,以維護文化的多樣性、推動文化對話及族群相互尊重包容。基於全世界對於文化資產保護的文化共識,1954年《海牙公約》制定至今已逾一甲子,《保護世界文化和自然遺產公約》至今也邁向近半世紀之久,我國1982年公布實施《文化資產保存法》,至今亦已有卅餘年。
本論文研究目的在檢視國際公約有關文化保存保護的歷史發展,及我國現行文化保護保存法規與實務問題。採質性研究、個案研究法,將我國最高行政法院文化資產相關判決整理分析,期從研究發現中獲得文化保護行動的反思與我國修法的參考。
研究發現我國文化法規整體規範尚未包含無形文化遺產的保護保存,此一部分亟待未來立法。此外,現行法規內容及文物分類與國際公約所行方式不同,另一方面,我國文化事務主管機關執行政策時所遇困難,可參酌國際公約與他國現行方式,本於我國文化資產特性與文化整體特色因應調整。除立法修法建議之外,本論文亦從個案分析與比較研究發現,我國對於文化資產保存的概念採物質取向,衍生文化物私權凌駕公權之上的衝突情況,若期文化永續發展,宜將「文化資產」概念轉化為「文化遺產」觀點,從更高的文化哲學層面執行我國文化事務的全面保護保存政策。 / Regarding the destruction of many precious human culture, either due to globalization to cultural homogenization, or because of armed conflict, environmental degradation and other factors, the arouse concerns and collective strength of international cultural cooperation led to maintain cultural diversity, promoting cultural dialogue and mutual respect for ethnic coexistence. Based on the world's cultural consensus for the protection of cultural heritage, firstly the 1954 Hague Convention and consequently the Protection of the World Cultural and Natural Heritage Convention, both have built up a well-organised system for culture preservation and conservation. In Taiwan, The Culture Property Preservation Act has also been implemented in 1982.
This paper explores historical development of the relevant international conventions on cultural preservation and protection as well as the existing cultural legislation and practical issues in Taiwan. Drawing upon case studies as qualitative research method, the analysis of twelve cases selected from the highest administrative court judgments illuminates currently controvercial issues and leads to make suggestions of what action of amending should be considered to empower authorities and provide more effective administration to enhance domestic culture policies.
The result of analysis indicates that the intangible cultural norms and regulations have not been viewed as an important issue and legislation for intangible cultural heritage should be put on top priority in national culture development policies. The difficulties encountered while implementing policies of cultural affairs shed lights on central and local hieracheical institutions that the realm of autonomy should be distinctively clarified so that administrative agency could be helpful to solve conflicts and diversities. In addition, the case study and comparison also found that collective rights on the preservation of cultural assets were derived overriding private rights. However, if the sustainable development of culture would be expected then a balance between collective and provate rights on cultural affairs should be taken as legal norms

The Cape Town International Convention Centre : a positive economic impact created through the legalisation of gamblingVoges, Pierre 04 1900 (has links)
Thesis (MComm)--University of Stellenbosch, 2004. / ENGLISH ABSTRACT: The legalisation of gambling in South Africa was perceived by many as an
unnecessary vice that would bring social decay in a country that is already battling to
cope with a wide array of social woes, such as unemployment, crime, etc. Anti
gambling protestors argued that South African society is not sufficiently developed to
cope with an industry that diverts money from normal household budgetary
expenditure patterns to the many forms of gambling that suddenly became legal.
Protestors also argued that gambling tax is just another tax on an already overtaxed
society. Many of these arguments were justified and the legalisation of gambling was
clearly an issue, which had to be dealt with carefully.
Politicians, the custodians of a well-managed political system through pro-active
policies that will be to the benefit of a country and its people were in a particularly
difficult position with the creation of a legalized gambling industry and had to weigh
policy between the advantage of additional tax revenue and the disadvantage of
adding to the social ills of South African society. In terms of the Constitution of South
Africa gambling was a concurrent competence and the respective provinces had an
opportunity to develop gambling policy that will be beneficial to the relevant
province. Although the national Gambling Act provided the broad parameters in
which provincial legislation had to be developed, provinces had ample opportunity to
be innovative in respect of provincial gambling legislation.
After the legalisation of gambling provinces moved quickly to ensure that casinos
were developed, mainly to create a larger revenue base through gambling tax. Most
provinces were cash-strapped, as their share of the national budget was not sufficient
to deal with the long list of provincial development priorities. A way had to be found
to supplement the national government contributions and gambling tax was an
attractive option.
The Western Cape Province moved somewhat slower in the promulgation of
provincial gambling legislation. There was a clear realisation that gambling was going
to have a massive social impact on the population of the Western Cape and therefore
had a clear objective to find ways to develop casinos in such a way that it would
offset the negative impact of gambling.
This thesis did not place any emphasis on the quantification of the social impact (such
as lack of productivity, loss of employment, bankruptcy, domestic violence, divorce,
etc). The objective was to show that the allocation of a gambling licence could be
used to create infrastructure that is not linked or related to a casino. Such
infrastructure is normally in high demand in cities or regions, which are emerging as
tourist destinations, but the infrastructure would not be developed by the government,
as the capital cost is too high, nor by the private sectors as the profit margins are too
low.
The Western Cape used its allocation of five casino licences in terms of the National
Gambling Act to create an impact on the whole of the region by dividing the province
into five regions and allocating a casino licence to each of the regions. Since 1994 Cape Town and the Western Cape have gained prominence internationally
as a tourist destination. It was soon clear that the city and region would not be able to
cope with the influx of tourists due to a lack of hotel rooms and other tourism
infrastructure. It was also clear that the tourism industry would not show the required
growth without facilities, such as a convention centres. It is particularly a convention
centre that became an urgent element in Cape Town as convention business has
become a rapidly growing business with a potentially significant impact in terms of
convention expenditure and the resulting economic impact on a city.
The Western Cape developed gambling policy determinations made it clear that in the
case of the five regions, casino bid companies were obliged to include tourism
infrastructure that would add value to a particular region. It was made clear that such
infrastructure should not necessarily be linked with a casino and could be off-site. The
policy determinations were clear in its stipulations that stand-alone casinos would not
be entertained in the adjudication process.
The development of an international convention centre became an important criterion
in the allocation of a casino licence in the Cape Metropole. Although casino bid
companies included different kinds of infrastructure in their bids (mostly projects that
would have a positive impact on tourism) the development of an international
convention centre became a strong factor and the casino licence for the Cape
Metropole was allocated to the company that included the development of an
international convention centre in the their casino bid application.
Although convention centers are rarely profitable they are known to change the face
of cities and regions in terms of their economic impact, not only the impact in terms
of urban renewal opportunity, but also attracting domestic and international
convention center delegate expenditure and the expenditure on hotels, food and
beverage, transport, and general tourism expenditure. The direct, indirect and induced
economic impact of this expenditure in the Western Cape and Cape Town result in the
off-setting of the negative social impact and ensure that the benefits of the legalisation
of gambling is extended to projects that would be unlikely developments in the
absence of a casino licence allocated.
The study undertaken demonstrates the economic impact (direct, indirect and
induced) of the Cape Town International Convention Centre. It also shows the impact
of the center on the promotion of tourism, including convention center delegates
returning to the Western Cape for leisure purposes in the future. It culminates in the
conclusion that the allocation of a casino licence should not only be the development
of a stand-alone casino, but also the creation of tourism infrastructure that offsets the

besteding na die vorme van dobbel wat gewettig is nie. Anti-dobbel
stemme het verder genoem dat dobbel net ‘n verdere belasting is in ‘n
gemeenskap wat reeds oorbelas is. Baie van hierdie argumente het gewig
gedra en die wettiging van die dobbelindustrie was duidelik ‘n kwessie
wat versigtig hanteer moes word.
Politici, die beskermhere van ‘n gesonde politieke bestel deur pro-aktiewe
beleidstappe wat tot voordeel van ‘n land en sy mense behoort te wees,
was in ‘n besondere politieke dilemma met die wettiging van die
dobbelindustrie en moes die voordele van verdere belastinginkomste in
ag neem saam met die sosiale nadele wat die industrie sou skep. Volgens
die Konstitusie van Suid-Afrika is dobbel ‘n konkurente
verantwoordelikheid en die onderskeie provinsies kon provinsiale
dobbelbeleid ontwikkel volgens provinsiale vereistes. Alhoewel die
nasionale wetgewing die oorhoofse raamwerk skep vir provinsiale
wetgewing, het provinsies die geleentheid gehad om innoverend te wees
met die ontwikkeling van provinsiale wetgewing.
Na die wettiging van die dobbelindustrie het provinsies vinnig opgetree
om casinos te ontwikkel, hoofsaaklik om ‘n groter belastingbasis te
ontwikkel deur die toepassing van wetgewing. Die meeste provinsies
ondervind ‘n tekort aan inkomste, aangesien die inkomstetoedeling vanaf
die nasionale regering nie genoegsaam is om aandag te gee aan ‘n lang
lys van ontwikkelingsprioritiete nie. ‘n Weg moes gevind word om
provinsiale inkomste aan te vul en dobbelbelasting was ‘n aantreklike
opsie.
Die Wes-Kaap Provinsie het ‘n meer geduldige pad geloop in die
promulgering van dobbelwetgewing. Daar was ‘n duidelike besef dat
dobbel ‘n massiewe negatiewe sosiale impak in die Wes-Kaap sou teweeg
bring en was daarvan oortuig dat ‘n weg gevind moes word om die
negatiewe sosiale impak minder te maak. Die tesis het nie die klem geplaas op die kwantifisering van die negatiewe
impak (soos byvoorbeeld die gebrek aan produktiwiteit, verlies aan
werkgeleenthede, bankrotskappe, huishoudlike geweld, egskeidings, ens)
nie. Die doel was om te demonstreer dat die toekenning van ‘n casino
dobbellisensie gebruik kan word om infrastruktuur te skep wat nie direk
verwant is aan ‘n casino nie. Sodanige infrastruktuur is gewoonlik in
aanvraag in stede en streke wat ontluik as toerismbestemmings, maar
hierdie tipe toerisme-infrastruktuur sal nie deur die regering ontwikkel
word nie weens ‘n tekort aan die nodige fondse, maar ook nie deur die
privaatsektor nie weens die gebrek aan aantreklike winsmarges.
Die Wes-Kaap Provinsie het die vyf casinolisensies wat aan die provinsie
toegedeel is in terme van die Nationale Dobbelwet gebruik om ‘n impak
in die hele Provinsie te maak deur die Provinsie in vyf streke te verdeel
met ‘n lisensie toegedeel aan elk van hierdie streke.
Kaapstad en die Wes-Kaap het sedert 1994 internasionale prominensie
verkry as ‘n internasional toerismebestemming. Dit was egter gou
duidelik dat die stad en die streek nie die verwagte stroom van toeriste sal
kan hanteer met die gebrek aan hotelkamers en ander toerismeinfrastruktuur
nie. Die toerismesektor sal ook in gebreke bly om te groei
sonder ander fasilitiete soos ‘n internasionale konferensiesentrum. Die
gebrek aan ‘n internasionale konferensiesentrum het gelei daartoe dat
Kaapstad konferensies begin verloor het weens die gebrek aan voldoende
fasiliteite. Die internasionale konferensie-industrie toon uitstekende
geleenthede vir ekonomiese groei deur die konferensieganger besteding
en die impak op die ekonomie van Kaapstad en die Wes-Kaap.
Die Wes-Kaap het dobbelkriteria ontwikkel wat dit duidelik gemaak het
dat casino lisensie-aansoekers daartoe verplig was om toerismeinfrastruktuur
by hulle aansoek in te sluit wat sou bydra tot die
waardetoevoeging in die onderskeie streke. Dit is ook duidelik gemaak
dat sodanige infrastruktuur nie noodwendig fisies aan ‘n casino gekoppel
hoef te wees nie en kon ook weg van die casino perseel ontwikkel word.
Die beleidskriteria het dit verder ook duidelik gemaak dat alleenstaande
casinos nie oorweeg sou word nie.
Die ontwikkeling van ‘n internasionale konferensiesentrum het ‘n
belangrike beleidsoorweging geword in die toekenning van ‘n
casinolisensie in die Kaapse Metropool. Alhoewel casino maatskappye ‘n
verskeidenheid infrastruktuurelemente in hul aansoeke ingesluit het
(meesal projekte wat ‘n positiewe impak op toerisme sou teweeg bring)
het die ontwikkeling van ‘n konferensiesentrum ‘n uiters belangrike oorweging geword in die toekenning van ‘n casino lisensie en die lisensie
vir die Kaapse Metropool is derhalwe toegeken aan die maatskappy wat
die ontwikkeling van ‘n konferensiesentrum in die suksesvolle aansoek
ingesluit het.
Alhoewel konferensiesentrums byna nooit winsgewend is nie, skep
sodanige sentrums die moontlikheid van stedelike vernuwing en ‘n
ekonomiese impak deur die besteding van konferensegangers op hotelle,
voedsel, drank, vervoer en algemene toerismebesteding. Die direkte,
indirekte en geleide ekonomies impak van hierdie besteding lei daartoe
dat die negatiewe sosiale impak afgeskaal word en lei derhalwe daartoe
dat die voordele van die wettiging van dobbel verder gevoer word deur
projekte wat onwaarskynlik sou wees in die afwesigheid van die
toekenning van ‘n casinolisensie.
Hierdie studie demonstreer die ekonomiese impak (direk, indirek en
geleide) van die Kaapse Internasionale Konferensiesentrum. Die studie
demonstreer verder die impak van die studie op die bevordering van
toerisme , insluitende konferensiegangers wat na Kaapstad terugkeer vir
vakansiedoeleindes. Hierdie impak kulmineer in die gevolgtrekking dat
die toekenning van ‘n casinolisensie behoort nie net te lei tot die
ontwikkeling van ‘n alleenstaande casino nie, maar ook die ontwikkeling
van toerismeinfrastruktuur wat daartoe lei dat die negatiewe sosiale
impak afgeskaal word.
