Role střední Evropy v bezpečnostně-politických vztazích na pozadí Visegrádu / The role of Central Europe in security-political relations on the background of the Visegrad Group

The topic of this thesis is the role of Central Europe in the security-political relations focusing on the Visegrad Group as a representative of Central European regional cooperation. The thesis first describes international regimes, which the Visegrad Group belongs to, the reasons of their origin and the functions, which they have been performing. The paper also deals with the region of Central Europe, with its definition and cooperation within it. The core part of the thesis is dedicated to the Visegrad Group, to its origin, to the relations between its members and above all to its activity within the European Union and the North Atlantic Alliance. The final part evaluates not only achievements and failures in security and defense aspects of Visegrad cooperation, but it also mentions new possibilities, which are currently offered to such cooperation.

A partir dos conceitos de regime internacional e de governança global, busca-se compreender a influência dos governos subnacionais no âmbito das negociações multilaterais intergovernamentais, no que diz respeito à efetividade do regime internacional da mudança climática. O indicador de influência foi desenvolvido levando em consideração a criação e implementação das agendas políticas domésticas. Dessa forma, destacam-se as grandes cidades como atores subnacionais públicos, reunidas nas Redes de Cidades líderes contra as mudanças climáticas, entre elas a Rede C40. A transformação de atores públicos locais em agentes de mudança no âmbito transnacional, por meio da constituição de uma rede, abre novas perspectivas teóricas para a discussão acerca do papel de atores subnacionais nas Relações Internacionais, o que deve repercutir sobre o debate a respeito das abordagens teóricas nas subáreas de regimes e de governança global. / Following the conceptual framework of global governance and international regimes, we tried to demonstrate the relevance of subnational governments towards the conclusion of the international negotiations and the effectiveness of the international regime on climate change. This influence can be measured by their role in the domestic agenda setting, in the decision-making process and in the implementation of public policies, as well as in the increase in cooperation agreements with non-state actors. The Climate Leadership Group, the C40 network, gathering the largest cities in the world, have become an important international player, transforming itself into a new transnational actor in the Climate Change arena, which is going to have a influence on scholars of international regimes and global governance.

A spaghetti bowl of preferences? : om preferentiella handelsavtals påverkan på WTO

The aim of this thesis is to clarify the affect that preferential and regional trade agreements have on the World Trade Organization (WTO), as being establisher of the international trading regime. The essay is an explanatory literature study, which strives to answer the following questions: Are regional and preferential trade agreements a threat or a complement to the WTO? Is an undermining of the MFN principle weakening the WTO? How do regional trade agreements made by the EU affect the future of the WTO? The empirical material is to be analyzed using an explanatory framework, which is based on neo-liberal instutionalism, theories on regime changes and a game theoretical approach, using prisoner’s dilemma. I will employ the EU-ACP relation, the Cotonou agreement to exemplify how an agreement of this kind can have an influence on multilateral trade. The result shows that preferential agreements do have an impact on the WTO, one that is fairly negative in scope. Preferential trade agreements do pose a threat to the WTO, in its current structure and may be harmful to the international trading regime. It is partly because the MFN is widely discouraged that PTAs are stumbling stones to the organization. By signing agreement that do not comply with WTO regulations and considering its role in international trade, EU does affect the future of the WTO.

This dissertation points out that the European position should be understood by two central dimensions. The first discusses the economic-energetic context of the bloc and suggests that the pro-Kyoto posture is influenced not only by the deepening economic integration, but also by the necessity of improving the security of energy supply in the European continent. The second dimension makes use of international political debates to demonstrate that this strategy could be perceived as a form to consolidate the Europeans´ international capacity to act as a bloc. Particularly, it is remarkable that the European leadership has been taking place especially in areas where the North-Americans have been progressively disengaged / Esta pesquisa analisa os fatores que levaram a União Européia a adotar uma estratégia de liderança nas negociações multilaterais sobre mudanças climáticas, principalmente após a recusa dos Estados Unidos em ratificar o Protocolo de Kyoto no ano de 2001. O trabalho aponta que o posicionamento da UE, aparentemente paradoxal, deve ser compreendido a partir de duas dimensões centrais. A primeira discute o cenário econômico-energético do bloco e sugere que esta postura pró-Kyoto sofre influência não só do aprofundamento da integração econômica, mas também da necessidade de garantir segurança energética no continente europeu. A segunda dimensão se utiliza de debates sobre política internacional para mostrar que esta estratégia pode ser interpretada como forma de consolidar a capacidade de atuação internacional dos europeus enquanto bloco. El comerç electrònic a internet està controlat essencialment per actors privats, en la seva majoria empreses i associacions empresarials dels sectors econòmics vinculats a les tecnologies de la informació i la comunicació. Aquests actors, en ocasions veritables autoritats, exerceixen el seu poder sobre els mercats electrònics a través de marcs normatius i de configuracions tècniques que els permeten establir les condicions de funcionament de les infraestructures, els codis i els continguts d'internet. El control de les estructures de poder al ciberespai per part d'actors privats es realitza amb l'aquiescència i el suport d'algunes autoritats públiques, especialment les d'Estats Units. Aquest control ha reduït els riscos que amenaçaven l'expansió dels mercats electrònics, però al mateix temps ha contribuït a que internet deixi d'ésser un espai predominantment públic, obert, lliure i gratuït per convertir-se en un espai predominantement privat, tancat, controlat i de pagament. / El comercio electrónico en internet está controlado esencialmente por actores privados, en su mayoría empresas y asociaciones empresariales de los sectores económicos vinculados a las tecnologías de la información y la comunicación. These actors, sometimes like true authorities, use their power on the electronic markets trough normative frameworks and technical standards allowing them to establish the rules of infrastructures, code and content of the Internet. Public authorities, especially in the United States, have offered the private sector their acquiescence and suport in order to control the power structures of the cyberspace. This control has reduced the risks threatening the expansion of the electronic markets, but at the same time it has contributed to the transformation of the Internet, so that a predominantly public, open, free and cheap space is becoming a predominantly private, restricted, controlled and expensive space.

[pt] O objetivo principal da presente dissertação é discutir a dinâmica dos relacionamentos entre estados, e entre estado e sociedade, que giram em torno da produção e do acesso ao conhecimento, entendido como o estado da arte, da ciência e da tecnologia e as crenças e idéias de cada época a esse respeito. O exame desses relacionamentos será feito através do estudo do regime da Propriedade Intelectual, o que torna necessário discutir as teorias de regimes a fim de entender sua importância nas relações internacionais. Trata-se, portanto,de duas discussões interligadas, cada uma em seus aspectos substantivos, que levam a conclusões tanto a respeito da importância dos regimes como a respeito da dinâmica dos relacionamentos que giram em torno da produção e do acesso ao conhecimento. Minha proposta é discutir os dois temas centrais desse trabalho através da análise de como aconteceram as mudanças no regime internacional da propriedade intelectual e a mudança de regime. As mudanças serão identificadas a partir dos instrumentos legais que constituem o regime, dos debates sobre a adoção de agendas de revisão desses instrumentos legais, e do exame das coalizões formadas em função dos interesses particulares dos atores em cada um dos diferentes foros de negociações. Outra contribuição que esse estudo pretende trazer é uma pesquisa da literatura sobre o tema da propriedade intelectual que adota abordagens teóricas e ferramentas analíticas da disciplina de Relações Internacionais. / [en] The proposal of this work is to discuss the dynamics of interactions between states and between states and society, in which the main object is the production and access to knowledge - here understood as the state of the art, science and technology, and the beliefs and ideas about it. This dynamics is analyzed through the study of the Intellectual Property International Regime, what makes it necessary to discuss also regime theories and the meaning of regimes to International relations. Two separate and interconnected discussions will be developed, each one with its own aspects, and will bring us to conclusions both about the importance of regimes and about the dynamics of interactions on production and access to knowledge. The two main discussions are advanced through the analysis of regime changing. The changes are identified on the legal instruments which constitute the Intellectual Property regime, through the analysis of the debates over the agendas of revisions on these legal instruments, and through the exam of the coalitions created around particular interests of the actors in each of the different forum of negotiations. Another contribution this study intends to bring is a research on the literature about Intellectual Property that takes a theoretical approach and uses analytical tools of the discipline of International Relations.
