Propõe, com este objetivo, três questões: a) qual a legitimidade de uma instância psíquica moral como conceito de uma teoria que tem como fundamento o determinismo inconsciente? b) qual a pertinência da comparação, por Freud, do superego com o imperativo categórico kantiano? c) qual a utilidade da filosofia moral de Kant para o entendimento da teoria freudiana do superego? O trabalho procura demonstrar a limitação da comparações, por Freud, entre o superego e o imperativo categórico, considerando que tais comparações ocorrem em momentos em que o conceito de superego estava em elaboração. Procura também destacar a raiz comum do pensamento de ambos os autores no conceito iluminista de razão, e as decorrências disto para a teoria freudiana do superego, em especial no sentido de responder à pergunta: é possível um superego a / This work intends to make use of Kant’s moral philosophy, specially the concept of autonomy, in order to get a better unsderstanding of Freud’s moral phenomenon theory, what means the superego theory. Práticas de assédio moral no trabalho : perspectivas do judiciário, sindicato patronal e sindicato dos trabalhadores

O presente trabalho tem como objetivo identificar as práticas de assédio moral mais recorrentes no mundo corporativo. Verificou-se a forma que o judiciário, os sindicatos patronais e os de trabalhadores entendem sobre essa prática, em especial no que se refere às diferenças de tratamento entre homens e mulheres e às diferenças de entendimento entre o primeiro e segundo grau de jurisdição, com relação a procedências e improcedências das respectivas demandas judiciais. Trata-se de pesquisa qualitativa exploratória, realizada com a análise de 85 (oitenta e cinco) processos judiciais, através da qual se averiguaram as decisões tanto de 1º (primeiro), quanto de 2º (segundo) grau, o que totalizou 170 (cento e setenta) decisões prolatadas desde o ano de 2005 até o ano de 2012. Fez-se, igualmente, coleta de dados por meio de oito entrevistas semiestruturadas, cujos sujeitos são membros do judiciário e também líderes sindicais, tanto dos sindicatos dos empregados, como dos patronais. A posterior análise dos dados coletados foi feita baseada na literatura tida como referencial teórico. Os conceitos de Freitas, Hirigoyen, Barreto e Soboll são utilizados no fundamento do assédio moral. A análise da pesquisa demonstra divergências não apenas entre o entendimento do judiciário e dos administradores e líderes sindicais, mas também entre estes, dentro de suas próprias categorias. Considerando-se, ainda, os resultados encontrados, observa-se a evolução em espiral das práticas de assédio, onde se mantêm basicamente as mesmas práticas, porém com evolução na forma de aplicá-las. Evidenciou-se a dificuldade não somente na identificação e demonstração do assédio moral, como também na parametrização do valor de seu ressarcimento, de modo a compensar o lesado e, ao mesmo tempo, inibir a repetição da conduta. / The objective of the work here presented is to identify the most frequent ways in which moral harassment occurs in a work place, verifying and comparing the different understandings, regarding this practice, of the judiciary (both in the first and in the second degree of jurisdiction), the labor union and the employers associations, especially regarding how different men and women are treated in the working place. It is a exploratory qualitative research, more precisely, the analysis of 85 lawsuits, examining their decisions both at first (1st) as well as at the second (2nd) degree, totalizing 170 judicial decisions handed out from 2005 to 2012. Data was also collected by performing eight semi-structured interviews, whose respondents were members of the three classes whose understanding about moral harassment I was comparing, i.e., members of the judiciary, union leaders, and employers association. Posterior data analysis was made based on the theoretical framework given by leading dominant literature on the subject. The concepts of Freitas, Hirigoyen, Barreto e Soboll are used to characterize moral harassment. The analysis shows divergences on the understating and how the subject is dealt not only between the classes analyzed, but also among members of the same class. The results also show that occurred a spiral evolution of the moral harassment practices, i.e., the same harassments still happens, only the way they are inflicted changed/evolved. From our research, it became evident the difficulty not only in identifying and demonstrating moral harassment, but also in stipulating the amount of the compensatory damages to be paid, so that this kind of practice in inhibited.

Desenvolvimento moral e a questão das trocas simbólicas : um estudo de epistemologia genética com crianças de bairros marginalizados /

Orientador: Adrián Oscar Dongo Montoya / Resumo: Este trabalho tem como principal objetivo o estudo do desenvolvimento moral e da troca simbólica junto à crianças de bairros marginalizados, ou seja, crianças que vivem na pobreza e sofrem opressão social. Por serem crianças que vivem essa condição social, sofrem relações de opressão e vivem uma "cultura do silencio" que dificulta o desenvolvimento das suas capacidades cognitivas e dos seus sentimentos morais. Deste modo, nos perguntamos: de que modo esse meio social influi no desenvolvimento moral dessas crianças, particularmente dos seus julgamentos morais? Para responder a essa questão, estudamos as relações de crianças de 7 a 12 anos com os membros que as rodeiam. A pesquisa se cumpre em uma instituição social localizada em um bairro de periferia da cidade do interior de São Paulo. Por meio de entrevistas, verificamos os julgamentos morais em função da mentira das crianças, a partir de histórias elaboradas por Piaget e levantamos as trocas simbólicas no seio familiar e institucional. No ambiente familiar, estudamos o seu cotidiano onde se produz o cumprimento de obrigações e deveres, brincadeiras, conflitos com autoridades e iguais. No ambiente institucional, estudamos o modelo de relação existente, se há a possibilidade de trocas simbólicas e reflexão sobre as atividades feitas. For being children living under this social condition, they suffer opression relationships and abide by what they call "Culture of the Silence", making things harder for the development of their cognitive abilities and their moral feelings. Thus, we ask ourselves: in which way this social enviroment influences these children moral development, particularly their moral judgement? To answer that question, we have been studying the relationships of children from 7 to 12 years old among the members surrounding them during daily life. The survey has been acomplished in a social institution located in a suburban neighborhood of a city in the countryside of São Paulo state. Through interviews, we have verified the moral judgements in function of the children's lies, as of histories elaborated by Piaget; we were able to bring up the symbolic exchanges among the family and institutionally. In the family enviroment, we have study their daily life where the acomplishment of obligations and chores, children's play, conflicts towards authorities and equals could be seen. Lost in Translation: A History of Moral Rights in Australian Law

This thesis is a history of moral rights in Australian law. It traces the historical discourse about moral rights in Australian law and demonstrates how that discourse has shaped the meaning moral rights have come to assume in their current form under the current regime contained in the Copyright Amendment (Moral Rijghts) Act 2000. This history examines the reception and later production of a moral rights discourse in Australian law, and reveals that the historical discourse about Australian moral rights was dominated by the three themes; foreignness, international obligation and economic impact. I contend these three themes fundamentally shaped moral rights as they now appear in the moral rights regime. As the history unfolds, it will become clear that the moral rights regime was organised around a specific repertoire of arguments and imaginings, and it is this discourse that informs this thesis. My argument is pursued in three stages. Section One of the thesis provides the historical detail of the moral rights trajectory in Australian jurisprudence, and reveals, within that history, the emergence of three dominant themes, which are pursued in subsequent detail. In addition to the history, this section also provides detailed discussion of the legislative provisions in order to illustrate moral rights as a product of the history, and it highlights some of the shortcomings of the regime and provides some background for the case study in Section Two. Section Two of the thesis interrogates the structure of the moral rights regime by applying the Act's provisions to the case study of indigenous creators, thus providing a contemporary example of how these rights may work in practice, as the result of the historical discourse. Thus this section sets the scene for final part of the thesis, which delves further into the historical discourse. Section Part Three follows the themes of the moral rights debate as they emerged historically. Reconceptualizing the moral rights discourse in this way helps to explain why the debates about moral rights took a particular course and produced the outcomes it did. The starting point for these discussions is a detailed examination of the themes of foreignness, international obligation and economic impact, and follows these themes as they evolved chronologically. In particular, the discussion reveals that the debates about moral rights effectively fall into two eras. The first era (1928-1988) centred around the question of whether Australia should introduce moral rights and the debates about the appropriateness of the reception. At the commencement of the second era (1988-2000) the question shifted to what form moral rights should take. This then provides a backdrop with which to understand why specific discussions about moral rights were sidelined during the years of debates leading up to the legislation; in particular, the subject and the object; which form the fulcrum of a moral rights action. This is an essential part of the history because it explains why the subject and the object came to be imagined and constructed in such a narrow and limited way and clarifies why the moral rights provisions appear manifestly ineffective, particularly for indigenous creators and their communities. This thesis contributes to legal history in three important ways. First, it provides a detailed account of a discourse about moral rights in Australian law, and in doing so challenges the long held assumptions about their reception and production. Second, it highlights the importance of history to legal discourse. Just as regulatory regimes, institutions, and rules are integral to the law, so too are the informal practices, discourses and contexts on which they were based. Third, it reminds the reader that history is a signpost, and this history of moral rights demonstrates that the way this law was derived, imagined and constructed has significance for the social, cultural and legal context in which that process takes place.

Kant and Moral Responsibility

This project is primarily exegetical in nature and aims to provide a rational reconstruction of the concept of moral responsibility in the work of Immanuel Kant, specifically in his Critique of Pure Reason (CPR), Groundwork of the Metaphysics of Morals (GR), and Critique of Practical Reason (CPrR). It consists of three chapters – the first chapter interprets the concept of freedom that follows from the resolution to the Third Antinomy in the CPR. It argues that Kant is best understood here to be providing an unusual but cogent, compatibilist account of freedom that the author terms meta-compatibilism. The second chapter examines the GR and CPrR to interpret the theory of practical reason and moral agency that Kant develops in these works. This chapter concludes by evaluating what has been established about Kant’s ideas of freedom and moral agency at that point in the project, identifying some problems and objections in addition to providing some suggestions for how Kantian ethics might be adapted within a consequentialist framework. The third chapter argues that, for Kant, there are two necessary and jointly sufficient conditions (in addition to a compatibilist definition of freedom) that must obtain for an individual to qualify as responsible for her actions.

Denna uppsats syftar till att undersöka pengarnas möjliga negativa påverkan på studenter och hur studenter resonerar om pengarnas värde i vardagen. Empiriskt behandlar uppsatsen varför studenter skulle kunna försöka lura den statliga myndigheten Centrala studiestödsnämnden (CSN) på låne- och studiebidrag. Två fokusgruppsintervjuer har gjorts för att samla in material. Intervjuerna har kodats enligt grounded theory-metoden. Resultaten visar att pengar har en stor inverkan på informanterna – både på ett negativt och positivt sätt. Studenternas beslut ifall de skulle kunna tänka sig att lura CSN beror på ens egna omständigheter och vilka kan påverka deras moraliska principer. / This study aims to investigate the possibility of a negative impact of money on students, and how they reason in relation to the value of money in everyday life. Empirically, the purpose deals with interviews concerning why students might defraud the government authority the Central Study Aid Council (CSN) in loans and grants for their own profit. Two qualitative focusgroup interviews were conducted to collect materials. These have been encoded according to grounded theory method. The results show that money has a huge impact on the informants – both in a negative and positive way. Students' decision to deceive CSN depends on their own circumstances and thereby changed their moral principles.
