Priority sportovní politiky EU a financování sportu / Priorities of EU sport policy and funding for sports

Title: Priorities of EU sport policy and funding for sports Objectives: The main objective is to describe the existing methods and the resulting possibilities for the sport funding EU-level scheme. This will result in presenting a comprehensive and clear picture of all EU funding mechanisms that could be beneficial for sports. The thesis also aims to describe the issue in the context of the EU sport policy priorities development and give an overview of the Council and Commission sport-related policy activities. Methods: In this thesis, a method of analysis of legislative and non- legislative texts was used. Other documents examined were further relevant studies, publications and strategic texts. A method of synthesis was also used when the partial information gathered during the relevant meetings of Council formations, conferences and seminars was formed into a comprehensive text. Results: The result is a text that captures the development of EU sport policy priorities and offers specific recommendations for area of sports that derive from the acquired information and from analysis of EU funding schemes. Strategie Evropa 2020: Jsou národní cíle přiměřené? / Europe 2020 Strategy: Are National Goals Reasonable?

The current economic strategy of the European Union - the Europe 2020 Strategy - has defined five measurable Headline Targets to enhance economic growth and allowed the Member States to set their own national numerical values for these targets. This thesis analyses quality of this target setting process. First, it tries to figure out whether the targets have been set better than in the preceding Lisbon Strategy. Second, it examines whether the National Targets have been defined clearly and unequivocally. Third and the most important, based on original empirical analysis, the thesis evaluates whether the National Targets have been determined reasonably with respect to general capacities of individual European economies. The main results reveal that some learning from the Lisbon Strategy has been made, but the quality of the National Targets is insufficient and should be increased. Union européenne : la fédération d'Etats-nations entre préférences nationales, jeux de puissance et coopération institutionnelle / The EU : Federation of Nation states, between national preferences, power politics and institutional cooperation

Au-delà du débat entre méthode intergouvernementale et méthode communautaire, le positionnement des Etats-nations par rapport à la construction européenne demeure une variable essentielle pour comprendre comment s’opère cette construction et à quels compromis elle parvient. Traditionnellement abordé sous l’angle de la puissance et de la géopolitique, le rapport entre les Etats de l’Union européenne, désormais réglé par la coopération institutionnelle, doit faire appel à d’autres grilles d’analyse issues de l’histoire et des différences culturelles, sociologiques, économiques, politiques entre les nations. Cette thèse, fondée à la fois sur une expérience diplomatique et sur des travaux de recherche et de réflexion, met en exergue le rôle central et systémique de la relation franco-allemande, à la lumière notamment de la rédaction du projet de Constitution européenne en 2002-2003, des positions actuelles de l’Union sur la politique d’élargissement et la relation avec la Russie, ou de la résolution des problèmes de l’union monétaire depuis 2010. La négociation du cadre financier pluriannuel de l’Union européenne montre comment les Etats-nations s’orientent à partir de la question des « soldes nets » qui oppose pays bénéficiaires et pays contributeurs. Une plus grande équité dans les dépenses et la répartition de la charge contributive pourrait être un moyen de dépasser ces négociations d’apothicaires. La politique étrangère européenne est encore plus l’exemple d’une politique contrainte par les différents intérêts nationaux, ce qui n’a pas empêché le développement de l’Europe de la défense dès lors que celle-ci restait adossée aux Etats-Unis et à l’OTAN. Revisitant la construction européenne en fonction des préférences nationales, cette thèse se conclut en posant l’articulation géopolitique entre Union européenne, « Europe espace » et « Europe puissance ». / Beyond the debate on intergovernmentalism and the “communautarian method”, the positioning of the “Nation States” in Europe is a key factor determining the European construction and its compromises. Traditionnally analysed through geopolitics and power politics, the relationship between the States of the European Union is nowadays ruled by institutional cooperation and must be addressed by new analytical schemes such as cultural, sociological, economical and political differences between the nations. This thesis, based on diplomatic experience and academic works, emphasizes the role of the franco-german relationship regarding in particular the negociation of the European constitution in 2002-2003, the EU positions on enlargement and the relationship to Russia, or the solution to the Eurozone crisis since 2010. In the negociation of the financial perspectives, the positions of Member States is determined by the question of budgetary balances in which contributors and beneficiaries of the EU budget face eachother. More equity in the sharing of expenditures and resources could be a mean to get out of these tough negociations. EU foreign policy is another example of a policy determined by national interests, which didn’t prevent the EU to develop a common defence policy as far as it remains compatible with NATO and the US Strategy. Having revisited the European integration through these national preferences, this thesis questions in conclusion the links between the EU, the European space and the European power.

Este trabalho tem por fim construir uma história, fundamentalmente com base em fontes primárias, da formação dos engenheiros militares na primeira metade do século XVIII em Portugal e no Brasil, no que se refere principalmente aos conteúdos estudados, com destaque para a álgebra. O tema escolhido deriva do trabalho de iniciação científica que posteriormente teve continuidade na dissertação de mestrado intitulada: A Obra Lógica Racional, Geométrica e Analítica (1744) de Manoel de Azevedo Fortes (1660-1749): um estudo das possíveis contribuições para o desenvolvimento educacional luso-brasileiro, orientada pelo professor Sérgio Roberto Nobre e defendida em 2003, no Instituto de Geociências e Ciências Exatas, da UNESP, campus de Rio Claro. Para a presente investigação, foi fundamental a busca em arquivos, indícios e pormenores das fontes. Por isso, todo esse estudo tem como fundamento essa proximidade com as fontes, documentos manuscritos da administração pública da coroa portuguesa e textos caracterizados como notas de aula ou teóricos, ou seja, produção de alunos e professores, impressos ou manuscritos. O contato com as fontes permitiu contribuir para perspectivar o campo econômico, político e cultural do reino português, no tempo estabelecido, nomeadamente no reinado de D. João V. Nesse contexto, estudou-se a atividade profissional de engenheiro militar, as condições de acesso à profissão e o seu enquadramento institucional, as aspirações de ascensão social e as relações com os superiores hierárquicos. Pode-se entender melhor as circunstâncias da formação do engenheiro militar, estudando o quadro dos alunos que frequentaram a Academia Militar de Lisboa e dos professores dessa instituição. Assim, foi possível perspectivar como se teriam dado as Aulas de formação dos engenheiros militares nas capitanias brasileiras, identificando-se os professores e alunos da época. Por fim, apresentam-se alguns textos que serviram à formação dos engenheiros militares desse tempo, especialmente à formação matemática, procurando entender como foram produzidos, as circunstâncias dos seus usos e os conteúdos neles veiculados. / This paper studies the historical construction, based on primary sources, of military engineers background in the first half of XVIIIth century in Portugal and in Brazil, according to the studied contents, focusing on algebra. The chosen subject is based on a scientific work that became a dissertation named as: A Obra: Lógica, Racional, Geométrica e Analítica (1744) of Manoel Fortes de Azevedo (1660-1749): a study of possible contributions for the education development between Portugal and Brazil, advised by professor Sergio Roberto Nobre and presented in 2003, at the Geoscience and Exact Sciences Institut, of UNESP, in Rio Claro. The search in files and details of sources were essential for this research. Therefore, this study looked for those sources, manuscripts of the public administration from portuguese crown as well as notes of lesson or theoretical documents, which mean, the students and professors production, printed papers or manuscripts. The contact with the sources allowed predicting the economic, political and cultural fields from the portuguese kingdom, in that period, during D. João V reign. In this context, military engineer professional activity, conditions of access to the profession and their institutional adequation, social ascension aspiration and their relationship with hierarchic superiors were studied. It was possible to better understand the military engineer backgraund, studying the students and professors who made part of Lisbon Military Academy. So, it was possible to predict how they would have taught the Lessons for the military engineer background in the Brazilian captainships, in order to identify the professors as well as the students who attended the classes. Finally, some texts that were used to prepare the military engineers of that time are presented, mainly the mathematical background, looking for understanding how the circumstances of their uses and their contents were produced.

L'émergence du principe de nécessité dans l'action normative pénale au niveau de l'Union européenne / The appearance of the principle of necessity in the legislative action of the European Union in the field of criminal law

La thèse a pour objet de démontrer l'émergence du principe de nécessité dans l'action normative au niveau de l'Union européenne. Après une partie concernant la notion générale de nécessité et le rôle des principes dans l'ordre juridique de l'Union, le cadre juridique des traités est examiné à l'aune du principe de nécessité. L'analyse est faite sur base des dispositions pertinentes des traités ainsi que des actes législatifs adoptés par le législateur de l'Union et des critères qui ressortent de la jurisprudence de la Cour de justice en matière pénale. Une distinction est opéré entre (1) les dispositions concernant la coopération judiciaire en matière pénale et la procédure pénale (article 82 TFUE), (2) le droit pénal autonome (article 83, paragraphe 1, TFUE), et (3) le droit pénal accessoire (article 83, paragraphe 2, TFUE) de l'Union. Des documents concernant les prises de position de certaines institutions de l'Union sont également examinés. À l'issue de l'analyse, l'on conclut à l'émergence d'un principe de nécessité, à la lumière aussi de l'évolution de la pratique législative. / This thesis has as its purpose to demonstrate the appearance of the principle of necessity in the legislative action of the European Union in the field of criminal law. After a first part which concerns the general notion of necessity and the role of principles in the Union's legal order, the legal context of the EU Treaties is examined in the light of the principle of necessity. The analysis is made on the basis of the relevant provisions of the Treaties as well as on the basis of the legislative acts adopted by the Union's legislature and takes into account the criteria coming from the case law of the Court of Justice in criminal law related matters. A distinction is made between (i) the provisions concerning judicial cooperation in criminal matters and criminal proceedings (Article 82 TFEU), (ii) autonomous criminal law (Article 83(1) TFEU), and (iii) ancillary criminal law (Article 83(2) TFEU) of the European Union. A number of documents concerning the positions taken by some Institutions of the European Union are also analysed. In the final analysis, it is concluded that the principle of necessity appears in the Union's criminal law, also in the light of the evolution of the legislative work.

Questa tesi di ricerca si occupa del ruolo rivestito dai parlamenti nazionali italiano, britannico e tedesco. Analizza il modo in cui questi parlamenti partecipano al processo decisionale ed implementano il diritto dell'Unione europea dopo il Trattato di Lisbona. La ricerca si concentra su un'analisi comparata delle leggi, delle procedure e consuetudini parlamentari al fine di esaminare il ruolo rivestito dai parlamenti nazionali nel contesto europeo. Il nuovo quadro giuridico previsto dal Trattato di Lisbona promuove la creazione di un sistema parlamentare integrato, basato sulle istituzioni europee e sui parlamenti nazionali cui è attribuito un ruolo più incisivo nel processo decisionale europeo, nella convinzione che un loro maggiore coinvolgimento possa contribuire a garantire un livello più efficace di democrazia nel funzionamento complessivo dell'Unione. I parlamenti nazionali possono contribuire a rendere l'U.E. più o meno efficiente. Essi sono chiamati a svolgere un ruolo rilevante nel processo legislativo europeo, in particolare nella fase di formazione delle politiche e del diritto dell’Unione europea (c.d. fase ascendente) e nel monitoraggio dell'esecuzione del principio di sussidiarietà. Il Trattato di Lisbona introduce norme di partecipazione diretta dei parlamenti nazionali nel processo legislativo europeo, trasformandoli in "guardians of subsidiarity". Il Trattato di Lisbona e i relativi Protocolli riconoscono il ruolo della cooperazione interparlamentare, affidando ai parlamenti nazionali il compito di promuovere e organizzare la sua realizzazione all'interno dell'Unione europea. In questa prospettiva le competenze delle commissioni specializzate in affari europei e della COSAC (Conference of Parliamentary Committees for Union Affairs of Parliaments of the European Union) sono ulteriormente potenziate. / This research thesis deals with the role of national parliaments in Italy, United Kingdom and Germany. It analyses the way in which these Parliaments participate in the European Union and implement the Law of the European Union after the Treaty of Lisbon. The research focuses on a comparative analysis of parliamentary procedures, instruments, and practices in order to examine the respective roles of the European Institutions and the national parliaments within the European framework. The new legal framework laid down the Treaty of Lisbon encourages the creation of an integrated parliamentary system, based on the European Parliament and on the national parliaments which are assigned a more incisive role in the European decision-making process, in the belief that these innovations may contribute to guaranteeing a more effective level of democracy in the overall functioning of the Union. The national parliaments can contribute to making Europe more or less effective. They will be called on to play a more important role in the European law-making process, specifically in the pre-legislative dialogue with European institutions and particularly in the monitoring of the enforcement of the subsidiarity principle in European legislation proposals. The Treaty of Lisbon regulations introduce direct participation of national parliaments in the European law-making process, transforming them into the "guardians of subsidiarity". The Treaty of Lisbon and the related protocols recognise and encourage interparliamentary cooperation, entrusting national parliaments with the task of promoting and organising its achievement within the European Union. In this perspective, the competences of the Conference of Community and European Affairs Committees of Parliaments of the European Union (COSAC) are further enhanced. In this thesis, the reasons for overall inclusion of national parliaments in the European Union activities are analysed. The role of national parliaments in the EU according to the specific provisions of the EU treaties is also discussed and the largest part of the work is devoted to the ex ante subsidiarity principle control mechanism (the Early Warning System), which gives the right for the national parliaments to influence the EU legislative process.

"A ver quem passa". O Rossio. Proceso social y dinámicas interactivas en una plaza del centro de Lisboa

Investigación histórica y etnográfica en el espacio simbólico y ceremonial más emblemático de la ciudad de Lisboa: O Rossio. Tratamos de agotar sus elementos físicos, relacionales y simbólicos, siguiendo varias escalas de análisis, en una interpretación general de la sociedad lisboeta. 1-(“Presentación del Objeto de Estudio”): se introducen las fuentes teóricas generales que atraviesan el texto, centradas en la antropología urbana y en la problemática del espacio en tanto que producción social. Asimismo, desarrollamos una breve historia de la Praça do Rossio para proporcionar la medida de su importancia y las funciones que desempeña en el marco de la ciudad. 2-(“Culturas de la Miseria, Miserias de la Cultura”): Empezamos con un primer ensayo etnográfico sobre las técnicas interactivas y las dramaturgias de la pobreza en Rossio. A modo de estudio comparativo, sigue una crítica a las políticas de governabilidad urbana en Barcelona, especialmente beligerantes ante la visibilidad de la miseria. Cerramos el bloque repasando las controversias relativas a la construcción identitaria portuguesa y su “excesso de diagnóstico”, donde creemos localizar el núcleo discursivo de una cierta familiaridad con la subjetivación de la pobreza. 3-(“Los Espacios y sus hombres”): Un pequeño capítulo sobre las metodologías y los protocolos etnográficos utilizados, da paso al análisis socioespacial “delimitado” de la Praça do Rossio. Se emprende aquí una revisión espacial de las 12 áreas en que dividimos la plaza, con el fin de conocer sus atributos en profundidad, descubriendo las relaciones que se establecen con su entorno constituyente -visible e invisible-, y dando lugar a las primeras reflexiones sobre el papel de Rossio en tanto que dispositivo sociourbano modular. Los mapas y diagramas ayudan a la comprensión microsocial de las trayectorias, las apropiaciones y las logicas socioespaciales que tienen lugar en la plaza. Profusamente conocido ya el espacio y sus derivaciones, en los bloques cuarto y quinto se tratan las profundas relaciones de la plaza con la evolución de la ciudad, tomando el terremoto de 1755 como acontecimiento sociourbanístico central. 4-(“La fisura pombalina I: la imaginación patrimonial”): Presentamos una breve etnografía del comercio informal en Rossio, descubriendo su estrecha vinculación con procesos de patrimonialización contemporáneos, especialmente la folclorización de Alfama y el proceso político de control sobre las festas de Lisboa. En él descubrimos que los erasmus de Alfama reproducen el imaginario pintoresquista de los estudios olisipográficos, en procesos que se operan a través de la sublimación del comercio informal. Las variaciones históricas en la adscripción topológica de las prácticas de mercadeo, así como las particularidades de su versión patrimonial reificada, nos conducen a la cuestión del terremoto, cuando en la Rossio del comercio informal tenga lugar la reconfiguración forzada de la ciudad entera. 5-(“La fisura pombalina II: la deriva urbana”): Nos centramos en las funciones morfológicas y simbólicas de Rossio en tanto que pieza articuladora del urbanismo lisboeta en general: siguiendo la pista anterior, ahondamos en el significado último de la intervención del Marqués después del seísmo de 1755. Un estudio de caso sobre la apropiación lusoafricana en una esquina de Rossio, nos permite profundizar en las consecuencias sociomorfológicas del terremoto: la “fisura pombalina” conduce, mediante dos “movimientos” simultáneos, a la bipolarización urbanística actual. Finalmente, analizaremos varios procesos recientes de capitalización en el centro de la ciudad, reconociendo asimismo el papel de diferentes actores sociales en la intervención urbana. ¿Sigue la Praça do Rossio conservando aquella inercia que la caracteriza más allá de “brechas” y “fisuras”?, ¿cuál es su papel en la articulación sociourbana de la ciudad?, ¿sigue siendo O Rossio un rossio, es decir, un espacio de apropiación colectiva marcado por la confluencia de las energías societarias? / The present historical and ethnographic research is focused on the most emblematic space in Lisbon's downtown, Praça do Rossio. The comprehension of its historical function and cultural significance is explored by the following arguments and study cases: 1- The state of art on urban anthropology and an introduction to the social and political history of this emplacement. 2- An essay about beggar's performance and poverty visibility on Lisbon's streets, regarded as a discursive effect based on Portuguese identity construction, in contrast to Barcelona's anti-poor governance strategies. 3- An in-depth description of every single material element and detail from square's morphological composition, that lead us to consider Rossio both as a relationship playground and as historical emplacement. Besides, this chapter includes maps and diagrams showing the complexity of appropriations and circulations, as well as ethnographic insights and cultural issues. With all morphological details displayed, and with a large cultural square's acknowledgment, chapters 4 and 5 introduce the core of interpretation, allowing us to comprehend the urban and social function of Rossio through the most critical urban event in Lisbon's history: The 1755 earthquake. First, in chapter 4, informal economy and its liturgical dramatizations on Santos Populares city feasts -stated by olisipography's nineteenth-century discourses- are analyzed as an heritagization process. Rossio was the heart of the historical street-vendor practices, symbolized in current hegemonic city representations. Secondly, in chapter 5 the daily Portuguese-Africans meetings on Rossio Largo's corner are analyzed and considered as a symbol of the preservation of square's communicative and political functions. Summarizing the urban history of the city -and the social characterization, problems and representations of different neighborhoods-, Rossio is found to be the center of the politico-cultural and socio-morphological phenomena which is called “pombaline's fissure”: the symbolic and material displacement caused by 1755 urban disaster and its later reconstruction, that reorganizes the axis between the bourgeois and the popular city. The theoretical and methodological approach of urban and social anthropology, as well as all this data collection, allow us to argue that Rossio performs a function as an urban hinge, articulating the city's sociospatial bipolarization and its symbolic representations.

Mixed agreements in the legal system of the European Union / Mišrūs susitarimai Europos Sąjungos teisės sistemoje

The dissertation addresses mixed EU-Member States agreements with third parties. The first part of the dissertation unveils the legal basis of mixed agreements and their relation to the principle of conferred powers. The practices of their negotiation, conclusion and implementation, as well as the boundaries of the CJEU jurisdiction to interpret and apply them are addressed in the second and third part of the dissertation. The fourth part is devoted to the examination of particularities of international responsibility for breach of mixed agreements from the point of view of EU law. In the last two parts, the relevance of the duty of loyal cooperation to mixed agreements and future perspectives of these agreements in the context of the Lisbon Treaty are thoroughly assessed. It is concluded that the legal basis of mixed agreements is the principle of conferred powers. This principle affects all of their practice areas, but to a varying degree. The achievement of balance between this principle and the interests of integrity of mixed agreements is facilitated by the principle of loyal cooperation. The Lisbon Treaty establishes conditions for changes in the practice of mixed agreements and offers legal opportunities for their partial replacement with horizontal EU agreements combining elements of the CFSP and other EU policies. / Disertacijoje nagrinėjamas mišrių ES ir valstybių narių susitarimų su trečiosiomis šalimis institutas. Konstatuojama, jog mišrių susitarimų teisinis pagrindas yra ES kompetencijos suteikimo principas. Šis principas pasireiškia visose mišrių susitarimų praktikos srityse, tačiau nevienodai. Balansą tarp šio principo ir mišrių susitarimų integralumo interesų padeda užtikrinti lojalaus bendradarbiavimo pareiga, taikoma mišrios kompetencijos srityse. Galiausiai nustatoma, jog Lisabonos sutartis sukuria sąlygas pokyčiams mišrių susitarimų praktikoje, o taip pat teisines galimybes dalį mišrių susitarimų keisti horizontalaus pobūdžio ES susitarimais, apjungiančiais Bendrosios užsienio ir saugumo politikos ir kitų ES politikos sričių elementus.
