The Local Interest as a Consideration in the Planning of Highway Construction in the Canyonlands Region of Southeastern Utah

An examination was conducted of the potential of proposed highway construction for serving the needs and interests of the population of the Canyonlands Region of southeastern Utah. The history of the highway development issue in the region was first examined with special attention given to the local position on the issue as expressed by local government spokesmen. Next, the total system of development proposals for the region was divided into four sections using criteria of area served and degree of controversy. A map analysis was conducted to determine how these four separate proposals would serve transportation needs of the region. Travel data for 1971 Utah nonresident travelers were utilized to determine present tourism travel and expenditure patterns within the region. Projections were made as to how these patterns would be altered by the four proposals and of how such alterations would affect the tourism industry in the five Canyonlands counties. Region resident perceptions of how the proposals would serve transportation, tourism development, and general economic needs of the region, its counties, and communities were obtained from 231 questionnaires. The same instruments also examined resident preferences for route development. The analyses indicated that the proposed developments will have few effects on regional transportation needs, and that the impact on the tourism industry will be substantial in some areas within the region and negligible in others. Resident expectations of which proposals would best meet county, community, and household needs were generally realistic. Residents assigned priority for development to proposals anticipated to best serve needs at these levels. Regional needs were not clearly perceived and were not important in determining development preferences. The position on the highway development issue taken by local government leaders distorts the views of residents but does so in a way which generally serves the local interest.

Therefore, the approach examines the ramifications of Complementary Law No. 5.200/2006 with the declaration of unconstitutionality of Article 1 thereof , as well as the municipal competence, in order to understand the reason of legislative and legal disputes involving Federal, State and Municipalities in the context of agrarian and environmental issue . Thus , the aim is to raise the debate about the social function of property , federalism , municipal autonomy , and the blurring of boundaries of competence in editing standards by federal entities . From there , the research will conclude by the need to understand local interest , according to the environment protection and preservation of the economic development of the municipality of Rio Verde style. Finally , it will be evident that there is no invasion of legislative powers when the municipality acts in obedience to local interest and it will prevail in society. / A presente pesquisa tem por objetivo analisar a limitação do plantio de cana-de-açúcar no município de Rio Verde sob a ótica do interesse local e o avanço do setor sucroalcooleiro impulsionado pelo processo de expansão da fronteira agrícola. Para tanto, a abordagem analisa os desdobramentos da Lei Complementar nº 5.200/2006, alterada pela Lei Complementar nº 5.206/2006, com a declaração de inconstitucionalidade de seu artigo 1º, bem como a competência municipal, com vistas a compreender a razão dos conflitos legislativos e judiciais que envolvem a União, os Estados e os Municípios no contexto da questão agrária e ambiental. Assim, o que se pretende é levantar o debate acerca da função social da propriedade, do federalismo, da autonomia municipal, e da indefinição dos limites da competência na edição de normas pelos entes federativos. A partir daí, a pesquisa concluirá pela necessidade de se entender o interesse local, de acordo com a proteção do meio ambiente e preservação do modelo de desenvolvimento econômico do Município de Rio Verde. Por fim, será evidenciada a inexistência de invasão de competência legislativa quando o Município age em obediência ao interesse local e faz preponderar a vontade da sociedade.

The contemporary time, one of many dynamic changes, of conceptual, methodological and epistemology reviews and re-studies not only change the solidity of paradigms but also make emerge new subjects of concrete rights and new subjects of theoretical approaches. Culture, along with its many meanings, and the Cultural Estate expressing the process dynamics of historical identities of subjects and communities, are themselves in this dialectics of the contemporary. Through this paper: Cultural Estate, Local Interest and Legal Protection, it is intended to dialogue with approaches, principles and concepts of Culture and Cultural Estate, aiming to understand its historical and contemporary most appropriate meanings for the transforming understanding which they bring about and make possible. From this process understanding of Culture and Cultural Estate, it is aimed to establish an essential relation between the constitution legislation that defines the City as a federal entity which is competent to legislate about the Local Interest and this competence is inherent to it. Once this competence is established, it is attempted to locate this Local Interest as a cultural (local) interest once there must be physical and territorial spaces and human beings for these interests to happen, making people s lives and their communities more dynamic. Over these cultural, historical and physical spaces, the indicatives of Cultural Estate have responsibility. Finally, established the mutual inter- and intra- correlation among the meanings of Culture, Cultural Estate, a set of legal and administrative instruments that might help promote and protect the Culture Estate suitably and effectively are explored. / Os tempos contemporâneos, de muitas e dinâmicas mudanças, de revisões e reestudos conceituais, metodológicos e epistemológicos não apenas alteram a solidez de paradigmas, mas também fazem emergir novos sujeitos de direitos concretos e novos sujeitos de abordagens teóricas. A Cultura, na gama variada de seus múltiplos significados e o Patrimônio Cultural, expressando a dinâmica processual de identidades históricas de indivíduos e comunidades, inscrevem-se nessa dialética da contemporaneidade. Através deste trabalho Patrimônio Cultural, Interesse Local e Proteção Legal pretende-se dialogar com abordagens, princípios e conceitos de Cultura e Patrimônio Cultural, procurando compreender seus enunciados históricos e contemporâneos mais apropriados e consentâneos com o entendimento transformador que eles suscitam e possibilitam. A partir desse entendimento processual de Cultura e Patrimônio Cultural, quer se estabelecer a relação precípua existente entre a legislação constitucional que define o Município como ente federado e sua competência para legislar sobre o Interesse Local que lhe é próprio e inerente. Estabelecida esta competência, busca-se situar este Interesse Local como interesse (local) cultural na medida em que devem existir espaços físico-territoriais e seres humanos para que os interesses efetivamente ocorram e aconteçam, dinamizando a vida de indivíduos e comunidades que, sobre e nesses espaços físico-histórico-culturais, denotativos de Patrimônio Cultural, tem responsabilidade. Por fim, estabelecida a inter/intra correlação entre os significados de Cultura, Patrimônio Cultural, Interesse Local, Interesse Cultural Local, indicase, como resultado desta proposta do Mestrado Profissionalizante em Patrimônio Cultural, um conjunto de instrumentos legais e administrativos que podem ajudar a que se promova e se proteja, adequada e eficazmente, o Patrimônio Cultural.

La représentation d'un intérêt local autonome : le système de gouvernement municipal portugais / The representation of an autonomous local interest : the Portuguese municipal system of local government

La Constitution portugaise établit une vaste autonomie locale aux autarcies locales au sein de l'organisation étatique. Elle crée un intérêt local propre à chaque autarcie locale qui coexiste avec l'intérêt général car il bénéficie de la protection de la Constitution. L'intérêt local autarcique est un intérêt autonome. Sa représentation appartient à chaque autarcie locale. La municipalité se distingue parmi les autarcies locales par l'importance de ses compétences et par la singularité de son fonctionnement. Ses deux organes sont élus directement créant une tension quant à leur légitimité démocratique, bien que la Constitution établisse que la Chambre municipale répond devant l'assemblée. Selon la Constitution, l'exécutif municipal est un organe collégial élut proportionnellement et son président est le premier candidat de la liste la plus votée. Il est de fait un organe, bien que la Constitution de la loi ne le reconnaisse pas comme tel. Ses compétences propres sont vastes mais trois de ses compétences font la différence. Elles lui donnent une suprématie sur l'organe qui empêche son fonctionnement collégial. / The Portuguese Constitution grants a large autonomy to the local communities in the context of the State organisation. The Constitution recognizes a local interest regarding each local community, which exists alongside with the general interest and under the protection of the Constitution. The autarchy's interest is autonomous. The municipality bas a prominent role in the autarchy's organisation because of its competences and its singular functioning. Both organs are directly elected witch creates tension concerning their democratic legitimacy although the Constitution stipu1ates that the executive is accountable before the assembly. The Portuguese Constitution states that the municipal executive operates collectively, is elected by a proportional system and bas a president that is the first candidate in the most voted list. In fact, the Constitution and the law do not recognise him as an organ. Although he has vast competences, three of those competences make all the difference. They block the organ from operating collectively.
