Les interventions diminuant l’usage du temps supplémentaire obligatoire : une revue narrative de la littérature

Le contexte de pénurie de personnel infirmier doublée d’une organisation du travail sous optimale a pour conséquence d’augmenter le risque d’un bris de service qui est souvent contré par l'usage du Temps Supplémentaire Obligatoire (TSO). Cette méthode de gestion impose des pressions grandissantes sur les infirmières. L’usage du TSO entraine des effets néfastes pour les usagers, les infirmières ainsi que les organisations de santé. Le but de cette étude est d’identifier des interventions ayant le potentiel de réduire l’usage du TSO et faire une analyse critique des effets potentiels ou démontrés de celles-ci. Méthode Une revue narrative de la littérature a été réalisée afin d’identifier les interventions présentées comme ayant le potentiel de réduire l’usage du TSO. La revue narrative a suivi le modèle Scale for the Assessment of Narrative Review Articles. Nos recherches ont permis d’identifier 12 interventions rapportées pouvant réduire l’usage du TSO. Elles sont applicables à l’un ou plusieurs de 4 différents niveaux dans l’organisation des services de santé, soit le niveau législatif, le niveau systémique, le niveau organisationnel ainsi que le niveau d’une unité de soins. Cette étude permet de mettre en lumière plusieurs interventions ayant le potentiel de réduire le TSO, mais il existe peu de données probantes les appuyant. Il semble que plusieurs interventions concomitantes pourraient avoir un effet plus fort sur le TSO. D’autres interventions ayant un effet sur des facteurs déterminants du TSO pourraient également avoir un effet potentiel sur celui-ci. Notre étude met en évidence le besoin de recherches étoffées sur les interventions pouvant enrayer le TSO des systèmes de santé. / The context of nursing staff shortage added to a sub-optimal management of resources has the consequence of increasing the odds of a break in service which is often countered by the use of mandatory overtime. This management method places increasing pressure on nurses. The use of mandatory overtime has harmful effects on patients, nurses and healthcare organizations. The aim of this study is to identify and critically analyze interventions that reduce mandatory overtime. Method A narrative review of the literature was performed to identify interventions used to reduce the use of mandatory overtime. The narrative review followed the Scale for the Assessment of Narrative Review Articles (SANRA) model. Our research identified 12 interventions that were reported as having the potential to reduce the use of mandatory overtime. They are applicable at 4 different levels in the organization of health services, namely the legislative level, the systemic level, the organizational level as well as the level of a care unit. Among these interventions, some seem to stand out, but few have been the subject of rigorous studies. We found several interventions that seem to have the potential to reduce mandatory overtime, but there exists very little evidence-based literature to support them. It seems that multiple concomitant interventions have a greater effect on mandatory overtime. Other interventions having an effect on determinant factors of mandatory overtime could have a potential effect on mandatory overtime. Even so, a need for studies showing the impact of interventions on mandatory overtime seems evident in light of our review.

Analyse rétrospective du changement dans les pratiques évaluatives d’enseignants de la 6e année au primaire, à la suite de la mise en place de la Réforme et de ses nouveaux outils d’évaluation

Le passage d’un programme de formation par objectifs à une approche par compétences, au début des années 2000, au Québec, a généré son lot de changements dans les pratiques d’enseignement ainsi que dans les pratiques évaluatives des enseignants, lesquelles se devaient d’être au service de l’apprentissage (MÉQ, 2003). Cette étude rétrospective vise à faire état des changements dans les pratiques évaluatives d’enseignants de 6e année pouvant témoigner de l’appropriation de l’approche par compétences et des orientations relatives à l’évaluation préconisées. Plus précisément, la recherche tente de répondre à la question : « Comment les enseignants de la 6e année se sont-ils appropriés de nouvelles pratiques évaluatives dans le contexte de la réforme de l’éducation au Québec ? » Notre recherche de type exploratoire et descriptive, réalisée à partir d’une méthodologie à la fois quantitative et qualitative, nous a permis de recueillir les données pour répondre à notre question de recherche, via un questionnaire en ligne auquel 57 enseignants ont répondu ainsi qu’une entrevue semi-dirigée à laquelle 16 d’entre eux ont participé. Il appert que les enseignants ont adapté à divers degrés leurs pratiques évaluatives à la suite de la réforme. Cela s’est traduit, chez une proportion importante d’enseignants, par la mise en place de pratiques qui, sans être entièrement exemplaires, sont enlignées sur les orientations visées par le PFÉQ et les fonctions de l’évaluation indiquées dans la PÉA, bien qu’un certain nombre d’entre eux maintenaient, près d’une décennie après la mise en place de la réforme au primaire, des pratiques plus traditionnelles ne témoignant pas d’une appropriation des nouvelles orientations relatives à l’évaluation des compétences. Ces résultats permettent de faire le constat que l’appropriation d’un tel changement nécessite beaucoup de temps et qu’il faudrait probablement que les décideurs mettent en place des pratiques d’accompagnement à long terme pour assurer une appropriation optimale des changements souhaités. / The transition from an objective-based education program to a competency-based program in the province of Quebec in the early 2000s led to changes in teaching practices as well as in teachers' evaluative practices, which had to become assessment for learning (MÉQ, 2003). This retrospective study aims to report on changes in the evaluative practices of Grade 6 teachers that may reflect the appropriation of the competency-based approach and the recommended assessment orientations. Specifically, the research attempts to answer the question: "How did teachers adapt their evaluative practices as a result of the reform?" Our exploratory and descriptive research, based on both quantitative and qualitative methodology, allowed us to collect data to answer our research question, via an online questionnaire to which 57 teachers responded as well as a semi-structured interview in which 16 of them participated. It appears that teachers have partially adapted their evaluative practices following the reform. This has resulted in the implementation of practices for a significant proportion of teachers that, while not entirely exemplary, are aligned with the orientations of the PFÉQ and the evaluation functions indicated in the Politique d’évaluation des apprentissages although a number of them maintained, almost a decade after the implementation of the reform at the primary level, more traditional practices that do not reflect an appropriation of the new orientations related to competency assessment. These results make it possible to note that the appropriation of such a change requires a lot of time and that it would probably be necessary for decision-makers to put in place longterm support practices to ensure optimal appropriation of the desired changes.

Le droit international privé français des contrats est très avancé, la richesse de la jurisprudence et la doctrine font une bonne preuve de l’évolution du droit français en la matière. Ses conceptions sont répandues et admises par d’autres États, européens en premier lieu, puis dans le monde entier. Le système de droit français et celui de droit communautaire sont complémentaires l’un et l’autre. Pour cette raison l’étude de droit international privé français ne peut plus être restreinte uniquement dans le cadre de droit international commun. Dés lors le droit international privé communautaire devrait aussifaire l’objet de cette étude. Quant au droit international privé des contrats thaïlandais, il est en cours de développement et a besoin de grande réformation urgent pour la coopération juridique dans l’ASEAN. L’étude comparative en cette matière permettrait donc de trouver la bonne solution et d’apprendre l’application de règles conflictuelles ainsi que d’autres mécanismes du droit international privé pour régler les problèmes dans l’ordre juridique thaï. Donc les questions de la loi applicable et le règlement des différends font l’objet principal de cette étude. / The French system of Private International Law of Contract is highly developed, evidenced by a rich jurisprudence and doctrinal system. One of the leaders in the field, many of their legal concepts were widely accepted and adopted by other legal systems, first by European countries and then worldwide. However, because of their complementary and intertwined nature for each other, the French legal system cannot be studied apart from the European system. For this reason, this study covers not only an in depth examination of French Private International Law but also a general look at European Private International Law. The Thai system of Private International Law of Contracts, in comparison, is developing and needs significant legal reform, as soon as possible, in order to cooperate with other contracting States in ASEAN. Thus, this comparative study responds to the needs, and shows how to correctly apply the conflict of laws’ rules, including their exceptions, which could solve many problems occurring in the Thai legal system. Therefore questions on the applicable laws of contract and the settlement of disputes which derive from international contract law are objects of this study.

Human capital disclosure in corporate annual reports

It is generally acknowledged that human capital intangibles are major value drivers in the new economy characterised by information and technology. The main purpose of this study is to examine the extent to which companies listed on the Johannesburg Stock Exchange disclose information on human capital related issues. The study combined both qualitative (literature reviews and content analysis) and quantitative (survey questionnaire) methods to collect data of 60 corporate annual reports (CARs) of listed companies in South Africa from survey questionnaires administered on various categories of preparers and users of these CARs. The study made use of 91 human capital disclosure checklists developed from literature reviews for the purpose of data collection. The data analysis was done with the aid of Atlasti-a qualitative data analysis software and SPSS- a quantitative data analysis software. The findings show that majority of the items on the disclosure checklist are not yet disclosed in the CARs even though most of the items on the checklist are adjudged to be useful for organisational value creation. In view of the initial findings of this study, a human capital disclosure framework is recommended. / Business Management / D. Accounting Science

Characteristics of corporate social responsibility assurance practices

As stakeholders start holding companies accountable for the non-financial impacts of their operations, it is increasingly recognised that the parties to whom companies are accountable extends beyond shareholders to include other stakeholders as well. Around the world, companies are responding to stakeholder demands by voluntarily reporting on their corporate social responsibility (CSR) performance. Unscrupulous companies may however, be tempted to use green-wash to make false claims relating to their CSR performance in order to reap the associated benefits. This information risk may be ameliorated through the independent assurance of CSR disclosures, enhancing the confidence of stakeholders in its veracity. Reporting companies usually voluntarily obtain independent assurance on their CSR performance. However, in South Africa, independent CSR assurance is a regulatory requirement for all JSE-listed companies, albeit on an ‘apply or explain’ basis. This thesis, which utilises a mixed methods research approach incorporating both qualitative and quantitative components, seeks to identify and understand the characteristics of the emerging independent CSR assurance phenomenon. In this regard, the empirical component of the study was conducted in three phases: in the first phase companies’ CSR disclosures and assurance reports are examined; in the second phase survey responses from companies are reviewed; and in the third phase interviews with CSR assurors are analysed. In this thesis, the extent to which companies provide independent assurance on their CSR disclosures is established; the providers of independent CSR assurance are identified; the reasons that companies select certain CSR assurance providers are explored; the reasons that companies provide independent assurance on their CSR disclosures are determined; the CSR assurance practices of the various CSR assurors are reviewed and compared; and the primary standards and/or frameworks used in CSR assurance engagements are identified. A conclusion is reached that although independent CSR assurance is a de facto mandatory requirement for JSE-listed companies, only 26% of the companies had their CSR disclosures independently assured. Despite its de facto mandatory nature, the study found that South African CSR assurance practices remain largely unregulated, resulting in a diversity of CSR assurors; utilising various assurance approaches, standards and practices. In this thesis, it is argued that these inconsistencies undermine the purpose of CSR assurance and reduce stakeholder confidence. It is accordingly proposed that the identified deficiencies could be addressed through the regulation of CSR reporting and assurance. An oversight/regulatory body should be established to prescribe the competencies that CSR assurors should possess; to develop appropriate CSR assurance engagement standards; and to clearly articulate the scope that CSR assurance engagements should cover; with which all CSR assurors should comply. / Auditing / D. L’hypothèque légale de la construction — Un outil de protection des créances des sous-traitants toujours efficace?

L’hypothèque légale de la construction est le principal mécanisme de protection des créances des intervenants de l’industrie de la construction. Par l’adoption de ce régime, le législateur a voulu protéger l’intégrité économique de cette industrie. Par contre, l’utilisation de notions mécaniques plus ou moins efficaces dans la mise en œuvre de l’hypothèque légale, la prolifération d’outils de contournement contractuels et les mécanismes de protection des propriétaires nuisent à l’efficacité du régime légal à protéger les créances des sous-traitants. Des correctifs pourraient néanmoins être apportés pour restaurer l’équité du régime légal. Par ailleurs, lorsqu’un immeuble appartient à l’État ou l’un de ses mandataires, il devient pratiquement impossible pour un sous-traitant d’exercer ses recours hypothécaires compte tenu des privilèges et immunités dont jouissent l’État et de ses mandataires. Les biens affectés à l’utilité publique des personnes morales de droit public non-mandataires de l’État jouissent également d’une grande protection, surtout dans le domaine municipal. Ceci rend bien illusoire tout recours hypothécaire intenté par un sous-traitant malgré le fait le législateur cherchait justement, par le maintien d’un régime légal, à protéger leurs créances. / The construction hypothec is the main mechanism for the protection of the claims of every participant in the construction industry. With the adoption of this legal regime, the Quebec legislator tried to protect the economic integrity of this industry. However, the use of notions more or less efficient for the execution of this legal regime, the increase of contractual mechanisms which avoid the application of the legal regime and legal dispositions which protect the owners harm the efficiency of the legal regime to correctly protect subcontractor's claims. Nevertheless, some correctives can be found to restore the legal regime's equity. Moreover, when a immoveable is owned by the State or any of its agents, it is practically impossible for a subcontractor to exercise his hypothecary rights because of the State's privileges and immunities. The property appropriated to public utility of the legal persons established in the public interest which are not agents of the State enjoy also a strong protection, particularly in the municipal sector. In any case, it is rendering illusory the exercise by a subcontractors of any of his hypothecary rights despite the fact that the legislator's goal, by maintaining this legal regime, was precisely to protect their claims.

Quand les gendarmes font la loi : la pénalisation du droit des réfugiés au Canada

La recherche analyse le traitement réservé aux demandeurs d'asile au Canada.Plus spécialement, elle se penche sur l'interprétation et l’application de l’article 7 de la Charte canadienne des droits et libertés. La réflexion observe que la mise en œuvre des droits fondamentaux des revendicateurs du statut de réfugié est affectée, selon les époques, par des considérations à dominance « humanitaires » [arrêt Singh, 1985] ou, comme cela est le cas depuis le 11 septembre 2001, par des impératifs allégués de sécurité nationale [arrêt Suresh, 2002]. D’un point de vue analytique, la thèse considère que lorsqu'il s'agit de protéger des populations vulnérables – ce que le Canada s'est juridiquement engagé à faire – le droit public ne peut pas se limiter à la communauté de ses propres membres, citoyens et résidents. D'ailleurs, la Charte reconnaît la protection de ses droits fondamentaux à « toute personne » du fait de sa seule qualité de personne, qu'elle soit ou non citoyenne et la garde des abus. Des exceptions aux droits reconnus à l’article 7 doivent être considérées à la mesure du principe démocratique qui guide nos sociétés. Sur ce fondement, l’analyse interroge l’argumentation et les motivations de certaines décisions judiciaires et législatives qui ont déconsidérées les implications de notions porteuses de valeurs impératives, telles que l'équité, la dignité humaine, la liberté et la sécurité de l'individu, en privilégiant les intérêts étatiques conforment à la conception classique de la souveraineté. / The research analyzes the treatment of asylum seekers in Canada. In particular, it focuses on the interpretation and application of Section 7 of the Canadian Charter of Rights and Freedoms. The analysis underscores how the implementation of refugee claimants’ human rights is affected, according to the times, by humanitarian considerations [Singh, 1985], or, as is the case since September 11, 2001, by the imperatives of alleged national security. [Suresh, 2002]. From an analytical point of view, the research considers that when it comes to protecting vulnerable populations - which Canada is legally bound to do- public law is not limited to the constituents of its own community, (members, citizens and residents), but also to strangers and more specifically, to refugees. Moreover, the Charter recognizes that “everyone” is entitled to the protection of his or her fundamental rights, including migrants and refugees. This protection prevents the state from acting against the life, liberty and security of the person. Exceptions to these rights recognized under Section 7 must be narrowed to the very essence of what a democratic society could allow. In this context, the research questions the arguments and justifications of some judicial and legislative decisions that have discredited the implications of carrying notions of mandatory values, such as equity, human dignity, freedom and the security of the individual, instead favoring state interests based on the classical conception of sovereignty.

A participação de um serviço público na atenção e implementação de ações à saúde do viajante no Brasil / The participation of a public service in attention and implementation of traveler health actions in Brazil

A medicina de viagem (MV) surgiu em resposta ao crescente deslocamento populacional, com o objetivo de prevenir os agravos à saúde relacionados às viagens. No Brasil teve inicio no final da década de 90, momento em que reformas socioeconômicas levaram a melhorias das condições de vida dos brasileiros. O Núcleo de Medicina do Viajante (NMV), do Instituto de Infectologia Emilio Ribas (IIER), foi o primeiro serviço de atenção à saúde do viajante criado na cidade de São Paulo, em maio de 2000. O presente estudo visa: descrever a população de viajantes que procuraram orientação pré-viagem no Núcleo de Medicina do Viajante (NMV) do Instituto de Infectologia Emilio Ribas (IIER) no período de janeiro de 2006 a dezembro de 2010; descrever as medidas de prevenção recomendadas em relação às doenças infecciosas; descrever as atividades de ensino realizadas e a participação do serviço na discussão de diretrizes em políticas públicas em medicina de viagem. No período estudado, 2744 viajantes procuraram orientação pré-viagem no NMV do IIER. Foram realizados 2836 atendimentos de orientação pré-viagem, 92 viajantes procuraram o serviço mais de uma vez. A faixa etária entre 18 e 34 anos (54,2%), o sexo feminino (51,1%) e grau de educação superior (75,5%) foram as principais características demográficas desses viajantes. Os destinos mais procurados foram: África (24,5%), Europa (21,2%), Ásia (16,6%) e Brasil (19,2%). O turismo (35,7%) e o trabalho (35,7%) foram os motivos de viagem mais referidos. O tempo de permanência menor ou igual a 30 dias foi referido pelos viajantes em que o objetivo de viagem foi o turismo, enquanto os viajantes que referiram o trabalho ou estudo apresentaram maior tempo de permanência (p < 0,001). O meio de transporte mais referido foi o aéreo (62,8%). Os viajantes relataram durante a consulta pré-viagem dificuldade de acesso ao serviço. As fontes de informação mais referidas foram: informação a partir de amigos, indicação por profissional da saúde e mídia eletrônica. As medidas de prevenção recomendadas variaram conforme o destino. O tratamento autoadministrado para diarreia foi mais recomendado aos viajantes com destino à Ásia. As vacinas de febre amarela, poliomielite e antimeningocócica A e C foram mais recomendadas aos viajantes com destino à África, assim como a quimioprofilaxia para malária, que foi recomendada para 26,4% dos viajantes para esse destino. A quimioprofilaxia (QPX) para malária foi recomendada em 10,3% de todas as orientações. Houve diferença com significância estatística na recomendação segundo a finalidade (p < 0,30), o destino (p < 0,001) e a duração da viagem (p < 0,001). Das 422 orientações realizadas aos viajantes com destino ao Brasil, a QPX foi recomendada somente para 30 (7,1%). Dos 2744 viajantes atendidos, 664 (24,2%) relataram pelo menos uma morbidade prévia; 66 (2,4%) eram menores de 10 anos de idade; e 157 (5,7%) tinham 60 anos ou mais. Em relação às atividades de ensino, no período do estudo, 83 médicos residentes estagiaram no NMV e foram orientadas onze monografias de conclusão de residência médica. O NMV participou de 12 reuniões para discussão de diretrizes sobre a saúde do viajante e de iniciativas como a Carta de São Paulo (documento em defesa da saúde do viajante elaborado por acadêmicos e profissionais de saúde participantes do SUS). Da criação da Sociedade Brasileira de Medicina de Viagem e da criação do Comitê Estadual de Saúde do Viajante, pela Secretaria de Estado da Saúde de São Paulo. Essas atividades foram passos decisivos para corroborar a implementação de políticas públicas em saúde do viajante no Brasil / Travel medicine (TM) arose in response to the growing population displacement and its objective is the prevention of health problems related to travel. Began in Brazil in the in the late 1990s, at which socioeconomic reforms have led to improvements in of life of Brazilians. Travel Medicine Center (TMC) at \"Instituto de Infectologia Emilio Ribas\" (IIER) was the first health of traveler service created in São Paulo city in May 2000. The present study aims: to describe the traveler population who sought pre-travel guidance in TMC at IIER from January 2006 to December 2010; to describe the recommended preventive measures to travelers concerned with infectious diseases; to describe the teaching activities performed and the service involvement in debating guidelines about public policies in travel medicine. In the time period studied, a total of 2744 travelers sought pre-travel guidance in TMC of IIER, but 2836 assistances were provided for pre-trip orientation since 92 travelers sought the service more than once. The age group between 18-34 years (54.2%), female (51.1%), and university level degree (75.5%) were the main demographic characteristics. The more popular destinations were: Africa (24.5%), Europe (21.2%), Asia (16.6%) and Brazil (19.2%). Tourism (35.7%) and work (35.7%) were the main purposes of trip for travelers. For tourism purpose travelers would stay 30 or less days, while for work or study they stayed for a longer time (p <0,001). Commercial air travel was the preferred alternative (62.8%). The main sources of information were friends, health professionals, and electronic media. The recommended preventive measures varied according to the destination. The self-treatment for diarrhea was more recommended for travelers to Asia. Vaccination against yellow fever, polio, and anti-meningococcal (A and C) was more recommended for travelers to Africa, as well as chemoprophylaxis (CP) of malaria was recommended for 26.4% of travelers to the same country. The CP of malaria was indicated for 10.3% of all assistances. There was statistically significant difference in the recommendation according to purpose (p < 030), destination (p < 0.001) and trip duration (p < 0.001). From 422 assistances to travelers to Brazil, CP was only recommended for 30 (7.1%) travelers. From the 2744 travelers assisted, 664 (24.2%) reported at least one previous morbidity; 66 (2.4%) were under age 10; and 157 (5.7%) were 60 years or older. During the research period and relating to study activities, 83 residents were interns in TMC, and eleven monographs for completion of the Medical Residency were supervised. TMC participated in 12 meetings to discuss guidelines in travel medicine, and participated in initiatives such as \"Carta de São Paulo\" (a document in defense of traveler health prepared by academics and health professionals participating in the Unified Health System); in the institution of the Brazilian Society of Travel Medicine, and of the São Paulo State Travel Medicine Committee by the Secretariat for Health of São Paulo State. These were decisive steps to support implementation of public policies in traveler health in Brazil
