The individual and the social order in Mill and Hegel : seeking common principles in liberal and communitarian ancestry

This thesis seeks to establish a significant commonality and compatibility between the principles underpinning the political and social philosophies of GWF Hegel and John Stuart Mill. The role of the individual and the social order in both their theories is discussed and assessed separately and in turn in reference to their respective seminal works on the proper structure, principles and function of modern political infrastructure. Through an interpretation of the fundamental tenets and goals of their theories of the social order I argue for a coherent modern reconstruction of their doctrines, within which I locate parallels and contrasts as they apply. Both theorists as ultimately put forward similar arguments for freedom as an intersubjectively·developed capacity, the ideal social order as rational framework for the management of ethical and political engagement, linked to a social holism that ties individual and social progress inextricably. A respect for individual particularity of perspective and practice is integral both of their social frameworks, but that such a space must be harmonised within a rational political community worthy of individual obligation. Finally their social and political theories can be understood as complementary, each providing insights which the other lacks. Mill suffers from an insufficient regard for the social basis of identity and interconnected nature of the modern institutional framework, while Hegel displays an insufficient regard for Mill's caveats concerning the repressive potential of institutional structures and the dangers of overly empowered bureaucracies. In conclusion key elements of the two theorists' projects stand as separate but not in any way fundamentally opposed to each other. This points to the possibility of a via media between a politics of individualism and a politics of community, suggesting strong potential for reconciliation between liberal and communitarian perspectives.

Facultad de Filosofía y Humanidades / Tesis para optar al grado de Magíster en Filosofía mención Axiología y Filosofía Política / El presente trabajo, representa un estudio sobre la idea de opinión pública en la propuesta política de Mill bajo una mirada que gira en torno a sus alcances y aplicaciones en el sistema político liberal asociado al capitalismo. El objetivo central de esta propuesta, está fijado en la revisión del rol que el filósofo le da a la prensa, proponiéndola como instrumento político que permite la expresión del colectivo de opiniones. El carácter instrumental que toma la prensa viene a determinar que, a través de ésta, tenemos noticia de sucesos relevantes a la hora de tomar decisiones políticas en la actividad ciudadana por lo que, se transforma en la herramienta de sostenimiento del debate político. Sin embargo, quienes manejen los medios de comunicación de masa, manejan la distribución de una u otra opinión; por lo tanto, manejan la posibilidad del asumir una u otra preferencia ya sea potenciando una idea u omitiendo otra. Simultáneamente, se produce el detrimento de la división entre la esfera pública y la esfera privada generando una frontera nebulosa donde lo público es manejado desde lo privado con la creciente evaporación de espacios de deliberación y de acción intercomunicativa reemplazados por un espacio virtual. De esta manera, se verá como los medios de comunicación de masa se transforman en el lugar donde se aloja el poder y que incluso, podrían reconocerse como un mecanismo de control o aparato ideológico y, además, vienen a constituir el elemento de pérdida de la actividad de la polis.

Patient autonomy and evidence-based choice – philosophical and ethical perspectives

Thesis (DPhil (Philosophy))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: This study involves a critically evaluation of evidence-based patient choice as partnership model in clinical decision making. It pays attention to the emergence of the concept of autonomy in modern moral philosophy and in particular to the pivotal contributions of Immanuel Kant and John Stuart Mill in this regard. Against this background, it elaborates on the ethical principle of respect for autonomy, informed consent as paradigm for patient autonomy in clinical decision making, the conflicts that arise between the ethical concepts of autonomy and beneficence, the dominance of paternalism in clinical decision making, the challenges posed to the dominance of paternalism, the resulting emergence of the concept of partnership in clinical decision making and evidence-based patient choice as partnership model in clinical decision making. Moreover, it provides an exposition of the context, nature and practice of evidence-based patient choice and of the four key decision making skills required from health care professionals to involve patients in clinical decision making, namely shared decision making, risk communication, decision analysis, and the use of decision aids. Against this background, it critically evaluates the effectiveness of evidence-based patient choice as partnership model in clinical decision making by judging it in terms of the ethical concept of patient autonomy as reflected in the informed consent elements of competence, disclosure, understanding and voluntariness and indicates that none of the key skills of evidence-based patient choice can be regarded as completely adequate in honouring the principle of respect for autonomy in clinical decision making and that consequently each of these four key skills leave evidence-based patient choice with a challenge that needs to be addressed from another angle in order to establish and maintain the ethical principle of respect for autonomy. In response to these challenges, the study makes three recommendations for the transformation of evidence-based patient choice to a therapeutic alliance health care, namely to review and further develop the philosophical foundations of evidence-based patient choice, to consider the continental philosophical perspectives of Edmund Husserl, Jean-Paul Sartre, Maurice Merleau-Ponty and Jürgen Habermas on the evidence-based patient choice challenges of the separate worlds of doctor and patient, the constitution of meaning in illness and the dangers of abstractions and informational manipulation in health care and to transform the practice of evidence-based patient choice to a therapeutic alliance in health care by individualising the provision of information by embedding it in the human processes of sense making, knowledge creation and decision making through which information is transformed into insight, knowledge and action. / AFRIKAANSE OPSOMMING: Die studie behels 'n kritiese evaluering van evidence-based patient choice as vennootskapsmodel in kliniese besluitneming. Dit verwys na die opkoms van moderne morele filosofie en in die besonder na die deurslaggewende bydraes van Immanuel Kant en John Stuart Mill in hierdie verband. Teen hierdie agtergrond bespreek dit die etiese beginsel van respek vir outonomie, ingeligte toestemming as paradigma vir pasiënt outonomie in kliniese bsluitneming, die moontlike konflikte tussen die etiese konsepte van outonomie en weldadigheid, die dominansie van paternalisme in kliniese besluitneming en die uitdagings wat dit ontlok het, die gevolglike ontstaan van die konsep van vennootskappe in kliniese besluitneming, asook evidence-based patient choice as vennootskapsmodel in kliniese besluitneming. Inicia pondo em evidência o interesse de Freud pelo método dos tipos, proveniente de Charcot, e relaciona essa metodologia com a atividade de inovação nosográfica realizada por Freud, mostrando que ela era orientada pela busca do caso único (Anna O., p. ex.) e pela identificação do mecanismo psíquico típico a cada quadro de neurose. A seguir, tenta mostrar como a teoria da classificação proposta por Stuart Mill, na qual defende-se a determinação empírica da noção de tipo e sua organização pelas causas, pode servir de fundamento para a metodologia fteudiana. Discute, também, a influência exercida pelas idéias de Mill sobre a formação científica alemã e mostra como elas já estavam presentes nas obras de Meynert e Exner. Sobretudo, mostra como a prescrição de Jackson sobre a necessidade de se ter uma distribuição empírica e uma classificação científica das doenças mentais, alicerçada nas concepções de Mill, constitui a base da metodologia fteudiana; sugere-se que esse modelo de ciência e método é capaz de justificar o caráter explicativo e o estatuto científico da metapsicologia fteudiana / Abstract: Restricted to Freud's texts produced between 1886 and 1896, the work tries to show that in the foundations of the Freudian methodology there are ideas originated in the British tradition, particularly the ones of Stuart Mill and Hughlings Jackson. It begins evidencing Freud's interest for the method of the types, originated from Charcot, and it relates that methodology with the activity of nosographique innovation accomplished by Freud, showing that it was guided by the search of the case unique (Anna O., for exemple) and by the identification of the- psychical mechanism utypical to each neurosis picture. Furthermore, it tries to show how the theory of the classification proposed by Mill, in which he defends the empirical determination of the type notion and its organization by the causes, can stand as foundation for the Freudian methodology. It discusses, also, the intluence carried out by Mill's ideas about the German scientific formation and it shows how they were already present in Meynert and Exner works. The second part discusses the place taken by Jackson's ideas in the Freudian psychoanalysis and shows how certain basic hypotheses of the eta psychology might have been appropriated from his texts. Above all, it shows how the prescription of Jackson about the necessity of having an empirical distribution and a scientific classification of the mental diseases, found in Mill's conceptions, constitutes the base of the Freudian methodology; it is suggested that this model of science and method is capable of justifying the explanatory character and the scientific statute of the Freudian metapsychology / Doutorado / Doutor em Filosofia

Indagación que tiene por objeto encontrar la contradicción que ambas posiciones, liberalismo y utilitarismo, conllevan una con otra. Sostiene que si uno optase por ser utilitario tendría limitaciones desde la perspectiva liberal del propio Mill, y si optara por su posición liberal se vería limitado a serlo desde la moral utilitaria de Mill. Por lo que su liberalismo es insuficientemente utilitario y su utilitarismo insuficientemente liberal. Dialogue et philosophies : l'exemple du débat sur le fondement de la morale entre le déontologisme kantien et l'utilitarisme de John Stuart Mill

La communication, souvent considérée de nos jours comme une solution à plusieurs problèmes philosophiques, constitue pourtant elle-même un problème de taille en philosophie. Les philosophes peuvent-ils se comprendre entre eux ou sont-ils condamnés pour toujours à travailler seuls? Quand on observe de plus près les «oppositions» philosophiques, même les plus connues, on constate qu'on ne peut pas parler de rencontre avec exactitude. Ce mémoire analyse plus spécialement sous cet aspect le conflit sur le fondement de la morale qui oppose traditionnellement déontologistes et conséquentialistes, où l'on pourra apprécier l'asymétrie des deux systèmes notamment en ce qui concerne la question de l'universalité du fondement et celle de l'autonomie de la morale. Cependant, l'étude des philosophes passés et présents constituant également un dialogue entre philosophes, toute conclusion déplorant l'état du dialogue entre les philosophes ne saurait être prise totalement au sérieux.

According to our hypothesis, in opposition to an established interpretative tradition, Mill was responsible for significant theses, among others, in favor of the logicist efforts and anti-psychologists who marked most of the later discussions on the nature of logic. On the one hand, Mill´s criticism to the thesis according to which the significance of language terms are ideas (what he calls conceptualism), in addition to his clear view in distinguishing mental processes in the reasoning act of objective reasons involved in the inferences correction, constituted, according to our conclusions, important positive influence sources, not just to Frege´s philosophy, but to a whole philosophycal tradition that came to contemporary analytical philosophy. The work is divided in three chapters. In the first chapter, important elements of Mill´s logic and semantics are presented, such as: the definition of logic as a proof science, the relationship between logic and language, theory of connotation and some propositions. The second chapter deals with Mill´s criticism of the psychological semantic model represented by, among others, Locke. The third chapter aims to the question whether, from the point of view of Fregean logicism, Mill can be considered a psychologist / Este trabalho apresenta a lógica e a semântica de John Stuart Mill relacionando-as, por um lado, à tradição psicológio-nominalista representada pela teoria das idéias de John Locke e, por outro, aos desdobramentos das discussões lógico-semânticas do século XIX, sobretudo a partir da filosofia de Frege. De acordo com nossa hipótese, ao contrário do que toda uma tradição interpretativa estabeleceu, Mill, como que por detrás de algumas posturas ultrapassadas, foi responsável por teses significativas, entre outras coisas, em favor dos esforços logicistas e antipsicologistas que marcaram boa parte das discussões posteriores acerca da natureza da lógica. A crítica que Mill realiza à tese segundo a qual o significados dos termos da linguagem são idéias (o que ele chama de conceitualismo), aliada à sua clareza em distinguir processos mentais envolvidos no ato do raciocínio, das razões objetivas envolvidas na correção das inferências, constituíram, de acordo com nossas conclusões, importantes fontes de influência positiva, não só para a filosofia de Frege, mas para toda uma tradição filosófica que veio a desembocar na filosofia analítica contemporânea. A presente dissertação trata do problema dos direitos culturais sob a ótica do utilitarismo liberal de John Stuart Mill. Objetiva-se a inserção da filosofia política do autor nas discussões que vêm sendo travadas nas últimas décadas por liberais e comunitaristas a partir da colocação do problema filosófico da identidade. Para tanto, busca-se desfazer frequentes equívocos e apresentar uma leitura integrada da filosofia de Mill com base na análise criteriosa de seus escritos, auxiliada por seus mais eminentes intérpretes. Pretende-se demonstrar que é de uma fundamental e prévia compreensão utilitarista, bem como de uma particular posição acerca do modo de acesso à verdade, que decorrem as convicções liberais e a centralidade da autonomia individual em seu pensamento. Estabelecidas essas premissas, verifica-se que o estado milliano, ao dispensar a convicção na neutralidade da esfera pública que decorre do pensamento liberal contratualista usualmente professado, mostra-se compatível em tese com a tarefa de garantir direitos culturais. Ao mesmo tempo em que sua visão ampla acerca dos bens que contribuem para a felicidade é capaz de posicionar a cultura no cálculo hedonístico individual, com reflexos na quantificação da utilidade em vista da felicidade geral, a defesa de Mill da autonomia e da diversidade parece poder justificar uma especial atenção ao contexto social que sirva para a expressão máxima da individualidade. / This dissertation deals with the problem of cultural rights from the viewpoint of the liberal utilitarianism of John Stuart Mill. It intends to include the author‘s political philosophy in the debates that have been held in recent decades between liberals and communitarians starting from the approach of the philosophical problem of identity. To this end, we try to undo common misconceptions and provide an integrated reading of Mill's philosophy based on careful analysis of his writings, aided by his most eminent interpreters. We attempt to demonstrate that it is based on a previous fundamental adhesion to utilitarianism, as well as from a particular position regarding the access to the truth, that arise the liberal convictions and the centrality of autonomy in his doctrine. Given these premises, we could find that the Millian state, exempting the assumption on the neutrality of public sphere derived from the liberal contractarian doctrine usually professed, reveals itself theoretically compatible with the task of guaranteeing cultural rights. Whilst Mill‘s broad view regarding goods that contribute to happiness is capable of dragging culture into the hedonistic calculus, which affects the measurement of utility over general happiness, his defense of autonomy and diversity seems to justify a special attention to social context which maximize the expression of individuality.
