從賓禮到禮賓—外使覲見與晚清涉外體制的變化 / From binLi to protocol: the courtesy ritual of enovys and the change of foreign-related system in the late qing dynasty

本論文為結合政治史、外交史及禮儀史的著作。以學界對晚清外交的研究為基礎,聚焦於「外國公使覲見禮」的制訂,並利用晚近整理出版的多國檔案、日記、回憶錄,及藏於中央研究院近代史研究所的總理各國事務衙門檔案、外務部檔案等資料,重新討論清代賓禮體制的原型、變體及其過渡到西式外交禮儀的過程,分析中、西禮制的衝突根源,進而探討「天下秩序」與中國近代政治文化的關聯。經本論文的考察,研究成果有四。 本論文先概論清代「賓禮體制」的運作過程,並說明康熙、雍正年間的「賓禮體制」具有相當大的彈性空間,其制禮原則不只是「朝貢禮」,還有用於不稱臣納貢者的「客禮」,作為「朝貢禮」的補充。 其次,說明咸豐君臣在《天津條約》的約束下,不得不允許公使駐京等條款。但總理各國事務衙門的設立,不完全是清政府因應對外交涉的新局面,更多是出於維護「賓禮體制」的考量,並延續過去「督撫外交」的成例,由三口通商大臣、五口通商大臣作為對外交涉的第一線。 再者,總理各國事務衙門援引康熙、雍正年間款待俄國使節團之事,重新提出「客禮」,讓「鞠躬禮」與「跪拜禮」不再是絕對的對立,反而有變通的空間,讓外國公使得行「鞠躬禮」。清政府利用「客禮」概念,以「天下秩序」包容歐美各國與中國的政治關係,再將外國公使定位為皇帝的「客臣」,並將「外國公使覲見禮」解釋為皇帝優禮外使的恩典,遂得到中國官民的認同,維護皇帝作為「天子」的至尊地位。 第四,《辛丑和約》簽訂後,清政府雖透過擯者轉譯的方式,讓外國公使仍是皇帝的「客臣」,不致出現君臣逆位的狀況,但清政府只能在形式上維持皇帝的權威。外務部不能再像過去那樣用「名分秩序」,作為涉外禮儀的制禮原則,「西禮中用」已是不可避免的趨勢,表示清政府無法再以「天下秩序」包容歐美各國與中國的關係,只能藉由「國際法」的慣例,利用條約去約束外國官民的行動,以挽回中國的利權。 最後,經本論文對「外國公使覲見禮」的考察,得知「賓禮」到「禮賓」的改變,並非一蹴而成的,也不是全出於外國公使的逼迫。清政府面對外來刺激時,自有其內部轉換的機制,不僅有外在形式上的變革,更有內在觀念的調整,故清政府提出「客禮」概念,作為中禮與西禮的過渡禮儀,也是「天下秩序」與「國際法」的思想銜接。當「客禮」無法再解釋公使請覲,清政府廢除禮部,「賓禮體制」宣告結束,「天下秩序」也不再是清政府對外關係的中心思想。

數位典藏是將物件以數位影像的形式進行典藏,並放置在網路系統供使用者瀏覽,能達到流通推廣與保存維護的效果。但在目前資訊爆炸的時代,數位典藏若僅透過詮釋資料描述是無法有效幫助使用者獲得內容資訊,唯有將之建置成全文檢索模式,才能方便使用者快速檢索到所需資訊,而光學字元辨識技術(簡稱OCR)能協助進行全文內容的輸出。 本研究藉由實際操作OCR軟體辨識明代古籍,探究古籍版式及影像對於軟體辨識結果之影響;藉由深度訪談訪問有實際參與數位典藏全文化經驗之機構人員,探究機構或個人對於計畫施行之觀點與考量。結果發現,雖然實際辨識結果顯示古籍版式與影像會對於OCR辨識有所影響,綜合訪談內容得知目前技術層面已克服古籍版式的侷限,但對於影像品質的要求仍然很高,意指古籍影像之品質對OCR的辨識影響程度最大;雖然OCR辨識技術已經有所突破,顯示能善用此技術協助進行全文資料庫的建立,但礙於技術陌生、經費預算、人力資源等因素,使得多數機構尚未運用此技術協助執行數位典藏全文化。 本研究建議,機構日後若有興趣執行數位典藏全文化計畫,首先,需要制定經常出適合機構執行的作業流程,並且瞭解自身欲處理物件之狀況,好挑選出適合的輸入處理模式;再者,需要多與技術廠商溝通協調,瞭解所挑選之物件是否符合處理上的成本效益;最後,綜合典藏機構與使用者之需求考量下,建議未來採取與OCR廠商合作的方式,由使用者自行挑選需要物件進行OCR辨識,校對完成後將全文內容回饋給典藏機構。這樣不僅能瞭解使用者需求為何,也能降低機構全文校對所耗費的成本。 / Digital Archives, placed in the network system for users to browse, change the collection into the digital images, and can help to preserve the collection and promote the content information. However, in the era of information explosion, Digital Archives can’t help users to retrieve the information in the collection by simply recording metadata. So, only when built into the full text retrieval can Digital Archives provide users with a quick retrieval of the information they want. And the Optical Character Recognition (OCR) can help to output the full text information. The study explores the ancient books’ format and impact of image quality on the recognition results by recognizing the ancient books of the Ming dynasty with the OCR software. The study also explores institutional as well as individual views and considerations by in-depth interviewing institutional staff with experiences in the full text of Digital Archives plan. From the result we can discover that though the ancient books’ format and image quality do have influences on the recognition results, the overall interview suggests that the technology has overcome the limitation of the format under the high requirement for the image quality; that is, the quality of ancient books’ images is the most influential factor in the recognition results. Although the OCR already has the breakthrough in assisting the establishment of the full text database, most institutions have not yet applied this technology to full-textualization of the Digital Archives due to technical unfamiliar, budget, human resources and other factors. The study suggests that if some day one institution is interested in working on the the full text of the Digital Archives project, it firstly needs to develop a proper SOP and needs to understand the conditions of their ready-to-be-textualized collections so that it can adopt a suitable input mode. Secondly, this institution needs to communicate with the OCR company more so that it can realize whether the chosen collection fits the cost-effectiveness. Finally, under the considerations of both the institution and users, the study suggests that institutions can cooperate with OCR companies in the future, so users can choose collections for OCR recognition on their own and give the full text to the institutions as feedback after proofreading. This can not only understand users’ needs but also reduce the cost of the proofreading for the institution.

Tension in 18th century Chinese painting

In Western scholarship, eighteenth century Chinese paintings have consistently been seen as playful, eccentric, and odd. This characterization has been based on the formal qualities of some of the paintings. At the same time, Chinese scholars have written of the scholarly virtues and ambitions of the painters producing the works. The contradiction between these two interpretations is in part consistent with the Western and Chinese approaches generally. But it also stems from the mixed signals and information generated in the eighteenth century. The nature of painting, not just formally, but socially has yet to be explained in a way which takes into account some actual historical contradictions of the eighteenth century. In order to explain these historical tensions, I combine a biographical (Chinese) approach with a contextual approach (Western) in a study of two different scholar painters, Zheng Xie and Li Shan. I juxtapose biographical sources with artworks, and less official writings relating Zheng Xie and Li Shan, in order to describe the tensions involved in painting for the literatus within the merchant culture of Yangzhou. These tensions existed between the literatus' expected status and that granted him, between his ideal of the role of painting in the scholar's life and the implications of commercial painting, and between his emphasis upon poetry and his popularity as a painter. In all cases, the tensions in eighteenth century literati painting arise from the difficult relationship between the painter and patron, and between the painter and the ideas of a broader public. The lack of a clear definition of "scholar" and "scholar painting" amongst literati illustrates the literatus' loss of control over the definition of his lifestyle. / Arts, Faculty of / Art History, Visual Art and Theory, Department of / Graduate

La bureaucratie impériale chinoise sous le regard jésuite aux 16e et 18e siècles

Les missionnaires jésuites établissent une présence en Chine de 1579 à 1773 dans l'intention de convertir l'empire chinois au christianisme. Leurs efforts apostoliques les mènent en contact étroit avec la bureaucratie impériale chinoise par l'entremise des travaux scientifiques qu'ils accomplissent pour les empereurs et les relations qu'ils tissent avec l'élite politique et culturelle de l'empire, les lettrés. Les jésuites témoignent de leurs expériences à leurs supérieurs, amis, collègues et mécènes en Europe par le biais d'une imposante correspondance et d'ouvrages portant sur l'empire chinois. Ces documents servent de sources aux premiers sinologues européens, stimulant le débat et la discussion sur les mérites de la société impériale chinoise. Dans ce mémoire, nous examinerons une sélection de l'importante production littéraire des jésuites en Chine afin de dresser un portrait de la bureaucratie impériale chinoise. Le premier chapitre est une mise en contexte afin de placer l'oeuvre des jésuites dans le contexte changeant de la Chine du 16e au 18e siècle. Notre second chapitre aborde la question de l'organisation gouvernementale et son système de recrutement. Le troisième chapitre touche au personnage du mandarin, son statut particulier et son éducation morale. Nous terminons ce mémoire en étudiant le caractère sacré de l'empereur et les limites de son pouvoir.

Chapter 1 reviews the background to the rise of art patronage studies and their development and its influence on studies of Chinese art history. It also provides alternative approaches to studying activities related to patronage and their influence and role in Chinese art history by criticising traditional analysis of Chinese art based on social and economic theories. / Chapter 2 examines the life of Wang and explores the intentions and meaning to his patronage activities through studying his political involvement, literary activities and his social background and connections. / Chapter 3 discusses how Wang, given his knowledge in history and passion for art and its collection, reinterprets art history with reference to his private collection of art, and thereby consolidating his status as a leading figure of literary and cultural circle of his time. / Chapter 4 explains and reflects on the formation of the "artist-patron" relationship through examining the relationship and interaction between Wang and the literary circle and by appraising the financial background and standing of artists and calligraphers at the time. / Chapter 5 examines the direct impact that Wang, as a literary leader and patron of the art, has on the styles and subject matter of art work by examining and decoding several pieces of art commissioned by himself, thus revealing a distinct mechanism in which art was produced at the time. / Chapter 6 discusses the "artist-patron" relationship and the "trading of cultural resources" by examining diverse pieces of art work given to Wang as gifts by different individual artists and calligraphers. / Chapter 7 analyses the significance of the patronage activities of Wang and provides a new approach to understanding the issue of traditional Chinese art patronage in Chinese art history. / Through a case study of the life of Wang Shizhen, this research attempts to analyse the influence of literary leader and patron of the arts on the development of painting and calligraphy during the mid-Ming period. By analysing the "artist-patron" relationship, this paper attempts to explain alternative mechanism through which traditional Chinese art was produced. The thesis also examines art patronage activities in Suzhou during the sixteenth century and thereby attempts to examine these activities from the broader cultural and historical context at the time. 學研機構研發成果商業化可行性評估機制之探討-以生物科技領域為例 / Feasibility Evaluation Mechanism for Commercialization of R&D Achievements in Academic and Research Institutes --- Focus on Biotechnology Field

學術研究機構向來是科技創新的主要動力來源,許多與人類生活息息相關的發明多半來自於學術研究機構此一孕育創新的搖籃。此外,一個國家的學術研究能量往往也反映了該國的技術能力與競爭力,因此世界各國無不投注大量資源於大專院校及研究機構,期望除了學術產出之外,亦能將原始的創新概念透過研發活動轉化為智慧財產,並進一步將其商業化,滿足市場需求,實現知識之最大價值。 我國之學術研究能量並不落於美、歐、日等主要技術領先國之後,從我國政府投注於學術研發活動之經費、歷年發表於SCI、EI等期刊論文以及取得美國專利之數量等科技發展成果指標便可說明此點,然我國於1999年通過與美國拜杜法案意義相當之科技基本法至今已滿九年,各學研機構之專利申請量雖有成長之勢,然而2007年實際之智慧財產權收益卻僅佔研發總投入費用的0.87%;2005年全國技術貿易額收支比僅達0.23,與美、日、英等國相較,實可謂差強人意,顯見我國在研發成果商業化上已面臨一定瓶頸。 在知識大爆炸方興未艾的二十一世紀,可以預見的是將有越來越多的研發成果持續產出,學研機構花費於取得並維護智慧財產之費用亦將持續提高,如何在產出的眾多研發成果及專利中,篩選出真正有商業化潛力之標的,以將有限的人力、時間、資金等資源投注於其上並轉化為實質的經濟效益,將是學研機構進行研發成果商業化時的重要課題;此外,在學研機構法人化之潮流下,若未來大學等學研單位須自行負擔大部份資金之籌措時,此一評估機制將更顯重要。另,在資訊高度不對稱的情況下,技術需求方難以辨認技術供給方之技術是否為適合之交易標的,因此若能建立一套商業化可行性評估機制,亦能使雙方間之資訊交流更為順暢,促進技術之移轉與商業化。 因此,本研究嘗試提出一研發成果商業化可行性評估機制,以供學研機構進行內部評估,使國內「悶住」的研發能量得以透過有效的評估機制而活化。又,由於不同科技領域所適用之商業化可行性評估方式將有所差異,而生物科技領域為二十一世紀科技發展中之重要領域,且列為政府政策下的重點發展產業之一,加以作者本身之相關學經歷背景,是以本研究選擇生物科技領域研發成果為討論之重點。 本研究分別從5W的角度來探討研發成果商業化可行性之評估機制,分別是進行商業化可行性評估之目的(Why)、進行商業化可行性評估之時點(When)、商業化可行性評估之執行者(Who)、評估所需資訊之取得(How)以及進行商業化可行性評估時所需考量之因素(What),最後建立一研發成果商業化可行性評估機制,作為本研究之核心概念以及後續個案探討之依據。 此外,本研究針對研發成果商業化可行性評估之各項構面進行介紹,並提出學研機構於進行評估時在各構面應考量之重要項目與問題。依所建立之評估機制與架構流程,將評估構面分為技術、智慧財產、市場、法規與財務五大構面,並以技術與智慧財產構面為探討之重點。 由於本研究之研究對象為學術研究機構,且以生物科技領域為重心,故由大專院校、基礎研究機構及應用研究機構中各挑選一具代表性之單位作為個案研究對象,分別為國立陽明大學、中央研究院以及財團法人工業技術研究院,透過與各機構之研發成果管理專責單位進行訪談,深入了解其運作機制與現況,以期綜覽各類型學研機構之研發成果商業化可行性評估機制,並得出研究發現及建議。 根據個案研究之發現,本研究對於國內學研機構之整體建議,主要包括:研發成果商業化可行性評估機制應依機構之目的、性質、智財管理現況加以擬定;研發成果商業化可行性評估之構面應配合研發成果之性質及開發階段而設定,並以技術構面為基礎,智財構面為樞紐連結市場與法規構面之評估,最後以財務構面進行統合;而學研機構若欲採外部審查方式執行評估工作,須考量可能之缺失;此外,研發成果商業化可行性之評估應由具備跨領域能力之團隊加以執行,並應使具備產業經驗與市場背景之人員有一定程度之涉入;再者,生物科技領域研發成果因其本質上之特殊性,故於進行商業化可行性評估時,有諸多因素需加以考量;最後,政府可主動協助建立專業之機構或團隊,提供學研機構進行研發成果商業化可行性評估甚至後續之技術行銷服務,以有效符合規模經濟、範疇經濟與專業、客觀之考量。 / Academic and research institutes are the origins of technology innovation. Many of the significant inventions were devised in these cradles of innovation. Academic and research power can often indicates the technology capability and competency of a nation. Every government invests vast resources to universities and research institutes in order not only to make academic publication but also to realize the maximum value of the knowledge through converting the innovative ideas into intellectual properties (IP) and further commercializing the R&D achievements to meet the market needs. The academic researches in Taiwan can compete with the technological leading countries such as the U.S, Japan, and E.U. countries, in terms of some science and technology indicators like R & D expenditure, SCI / EI publications, and the number of U.S. patent granted. Nevertheless, the actual revenue generated by IP in 2007 was only account for 0.87% of the total R&D input and the coverage ratio of technology balance of payments was only 0.23 in 2005. The fact indicates that there were some barriers on the path of R&D commercialization in Taiwan. In the 21st century of knowledge explosion, it is predictable that more and more R&D achievements will be generated from academic institutes and the expenses devoted to the acquisition and protection of IP will keep rising. Therefore, it will become a critical issue in academic institutes to sieve out the targets of the higher commercial potential from numerous R&D results and patents so as to concentrate the time, human and financial resources on those targets for its further commercialization. Moreover, under the highly asymmetrical information situation during the technology trading, technology buyers have difficulty in identifying whether the technology is a suitable trading target or not. A well-established feasibility evaluation mechanism will also stimulate the interflow of information and promote the technology transfer and commercialization. Accordingly, this thesis will try to establish a feasibility evaluation mechanism (FEM) for commercialization of R&D achievements in academic institutes in order to activate the stuffy R&D energy in Taiwan. Biotechnology is one of the most important fields of technology in the 21st century and thus be the main concern of the discussion of this thesis. This thesis will investigate the feasibility evaluation mechanism for commercialization of R&D achievements on a “5W” basis, including the purposes of evaluation (why), the time of evaluation (when), the executives of evaluation (who), the information needed in the evaluation process (how), and the factors that should be taken into consideration in the evaluation process (what). Accordingly, a feasibility evaluation mechanism for commercialization of R&D achievements will be established as the central concept of this study and as the ground of follow-up case analysis. In addition, each aspects of feasibility evaluation as well as the significant issues and questions of each aspect will be illustrated in this study. According to the feasibility evaluation mechanism and framework established in this study, there are five main evaluation aspects including the technical aspect, intellectual property aspect, market aspect, legal aspect, and financial aspect. The main subjects of this study were the academic institutes in biotechnology field in Taiwan, the National Yang-Ming University, the Academia Sinica, and the Industrial Technology Research Institute (ITRI). These institutes are chosen as the subjects of case study standing respectively for the higher education institute, basic research institute, and the applied research institute. By way of interviewing the personnel of R&D achievements and IPR management department in the institutes in question, the feasibility evaluation mechanism implemented by different types of academic institutes was investigated to delineate the key findings, followed up with some practical advices. The overall advices proposed by this study for the academic institutes in Taiwan were summarized as follows: (1) The feasibility evaluation mechanism for commercialization of R&D achievements should be devised in accordance with the purpose, the nature, and the IP management status of each institute. (2) The feasibility evaluation should be set to match up the development stage of the R&D achievements and take the technical aspect as the groundwork, IP aspect as the pivot connecting to the market and legal aspect, and the financial aspect as an integrated result. (3) Evaluation executed by external parties may be of some defects that should be taken into consideration. (4) The feasibility evaluation for R&D commercialization should be executed by multi-disciplinary team and the industry-experienced or market personnel should as well participate in the evaluation process. (5) Due to the characteristics of biotechnology, many special factors should be involved in the evaluation process. (6) The government may actively assist in setting up a professional organization or team to provide feasibility evaluation and even the further technology marketing services to meet the consideration of economies of scale/ scope, specialty, and objectivity.

坑冶競利──明代的礦政、礦盜與地域社會 / Digging for profit: mining policy, mine pilfering, and local society in Ming China

明代礦業是中國礦業發展興衰成敗的關鍵期,在物質文化、商品經濟帶動下,此時各界都對工業原料的獲取感到興趣,明代官方與民間也不例外,官方政策無論是封禁或鼓勵開採,著眼點都是在確保「普天之下莫非王土」的礦利之權;而民間開採風氣亦屢禁不絕,亦即官民均在坑冶中進行活動,形同「坑冶競利」的較勁現象。 明代礦政發展可分三期觀察:(1)明初洪武至宣德年間(1368-1435)是明代礦業穩定發展期。朱元璋立國主張謹慎發展銅鐵開採事業,嚴禁金銀等貴重金屬的開採,但繼任者明成祖朱棣則支持開採弛禁,積極推動開礦事業,因此明代放寬對鐵冶開採的限制,不過對於金銀等貴重金屬開採則出現爭論,時開時禁,反倒成為明代礦業政策中最為鮮明的特色。(2)明正統至萬曆年間(1436-1620)是礦法與礦課調整時期。自明英宗朱祈鎮即位後,政府嚴格加強礦政管理,發布禁約,犯者即調軍剿捕,直到萬曆朝中期,官方還陸續針對《大明律》所欠缺的礦法,修改金銀銅錫等礦法條例細則,以因應社會的變遷。為求開礦增課,官方對於民間的非法採冶活動作了讓步,並改變明初定額課徵的規定,實施官三民七或官四民六的抽分制。但因皇室財政相當倚重礦銀收入,部分地區被強制改採官民對半抽分制,或實施「包派」、「包砂」、「包課」等名目不一的礦稅制度,弊端層出不窮,反而得不償失。(3)明天啟至崇禎年間(1621-1644)是封礦與開採弛禁時期。受到萬曆朝礦稅使事件影響,後來朝野各界均不主張開礦,但晚明財政的危機、邊鎮軍餉匱乏,急需鑄造錢幣礦料等因素,促使朝廷逐漸放寬採礦禁令,進而同意各地擴大開採貴重礦物,並翻譯頒布《坤輿格致》等礦書。 帶給明代礦政最致命的傷害,莫過於「礦盜」的活躍。自明初起,有關當局欲傾全力去圍堵防範,可是官方以暴制暴的鎮壓方式,反倒促成葉宗留等礦徒公開稱王造反,成為明代最為眾人所知的礦盜事件。為了穩定礦區生產與秩序,中央曾特派戶部官員、內臣與錦衣衛特使,以及巡按監察御史等專人留駐礦區監督;地方則派有按察僉事、副使、布政使參議等巡視礦場官員;軍事層級上又派任都指揮僉事管理礦區治安,並在礦場附近留有衛所、民兵戍守。 採礦所得誘惑甚高,礦冶業的蓬勃,多少也衝擊到地方社會的常態秩序。明代中期以後,原在浙江、福建交界等地活動的礦徒,逐漸轉往南直隸、浙江、江西交界等地發展;也有一些江西、福建等地的流民,因人口壓力下的生存競爭,陸續進入福建、江西、廣東交界,在粵東山區內進行季節性的採冶工作,形成獨特的地域社會。由於礦徒事件與倡亂區域明顯擴大,官方遂將地方礦政事權漸歸督撫來統籌管理,嚴格執行禁令,並且還特設總督處理浙直江西軍務事,以統攝三省礦防軍兵,清查轄區所有的礦場地點,以阻絕礦徒的活動。 另一方面,礦防兵力主要是借重地方民兵,甚至還招撫礦徒入營效力,但這項招募礦兵、採行招撫的作法,也帶給地方社會負面的影響。在浙江義烏,地方十室九空,成為地方上的一大隱憂。在廣東惠州地區,招撫未能得宜,礦徒事件有增無減,顛覆日常的社會秩序,地方士民不滿官方政策,激發民間的地域認同,出現了類似《定氛外史》等關心地域的作品,進而強烈抵制官府地方行政區劃的變動。 明代的礦徒問題,始終未能妥善解決,地方社會自然不願配合政府的開礦政策。明代官民在坑冶間相互競利,卻兩敗俱傷,沒有一方是嬴家。礦務執行的爭議、開礦引發的恐慌、礦徒倡亂事件的不絕,最終都讓明代礦政畫下了休止符。
