In this sense, this piece of research focuses on the still unexplored archive and with no archival organization of the researcher and plastic artist NivalsonFernandes de Miranda, aiming to prospect the social, historical and cultural trajectory of the life of that artist, through his personal private archive by understanding it under the perspective of a writing of self. For this reason, we adopted as methodological fundamentals the qualitative research of the documental type associated with the oral history with regard to the aspect of the theme history and, in some cases, the oral history of life. The survey, carried out in the artist´s archive as well as in the writings about him, enables us to affirm that the plastic artist´s archive is of great importance for society, considering the fact that it encompasses the historic heritage and it narrates through research, drafts and drawings a historical, social and cultural period. The artist still permeates his artistic works with the art of writing, once he is the author of a catalogue about the municipality of Areia and the surrounding towns as well as poems published in a women´s column in a printed newspaper in Paraíba. Therefore, while carrying out interviews with people who were connected with the researcher and examining documental genres that comprise Miranda´s archive, we perceived the importance and diversity that the archive presents, from textual, iconographic, cartographic documents up to the three-dimensional ones in which his artistic works are part of. We conclude, thus, that the plastic artist´s archive provides us the chance to know the life trajectory of its producer as well as it enables unveiling the legacy he left for us. / Perceber os arquivos privados e pessoais enquanto lugares de memória nos possibilita delinear a trajetória de vida de um indivíduo em meio às funções que exerceu ou exerce ao longo de sua vida e no meio em que está inserido, juntamente com as pessoas que convivem à sua volta. Nesse sentido, a presente pesquisa debruça-se sobre o acervo ainda inexplorado e sem uma organização arquivística do pesquisador e artista plástico Nivalson Fernandes de Miranda, com o objetivo de prospectar a trajetória sócio-histórica e cultural da vida desse artista, por meio do seu arquivo privado pessoal entendendo-o sob a perspectiva de uma escrita de si. Para tanto, adotamos como pressuposto metodológico a pesquisa qualitativa do tipo documental associada à história oral na vertente da história temática e, em alguns casos, da história oral de vida. A investigação, realizada no acervo do artista e nos escritos sobre ele, nos autoriza a afirmar que o acervo do artista plástico é de grande importância para a sociedade, tendo em vista o fato de abranger o patrimônio histórico e narrar por meio de pesquisas, rascunhos e desenhos um período histórico, social e cultural. O artista ainda permeia seus trabalhos artísticos com a arte da escrita, sendo esse autor de um catálogo sobre a cidade de Areia e as cidades circunvizinhas e de poemas publicados em caderno feminino de um jornal impresso paraibano. De tal modo, ao realizar entrevistas com as pessoas que tinham ligação com o pesquisador e analisando os gêneros documentais que compõem o acervo de Nivalson Miranda, percebemos a importância e diversidade que o acervo apresenta, desde documentos textuais, iconográficos, cartográficos até os tridimensionais em que são inseridos os seus trabalhos artísticos. Concluímos, então, que o acervo do artista plástico promove conhecermos a trajetória de vida do seu produtor, assim como possibilita desbravar o legado que ele nos deixou.

Caracterização geomorfológica do sistema deposicional do Rio Miranda (borda sul do Pantanal mato-grossense, MS) com base em dados orbitais /

De todos os sistemas deposicionais do Pantanal, o do Miranda é um dos menos conhecidos. O presente trabalho tem por escopo a caracterização geomorfológica do sistema deposicional do rio Miranda, bem como o reconhecimento de feições indicativas de mudanças paleoambientais e paleohidrológicas. Para alcançar tais objetivos, as seguintes etapas foram desenvolvidas: 1) processamento digital de dados orbitais, como imagens de satélite e dados SRTM; 2) delimitação e compartimentação geomorfológica do sistema deposicional do rio Miranda; 3) integração e interpretação dos dados obtidos, com identificação de geoformas deposicionais, atuais e relictas; 4) reconhecimento de evidências de mudanças ambientais. Foram reconhecidos e delimitados três compartimentos: uma planície fluvial confinada, um lobo deposicional atual e um lobo deposicional antigo. O processamento de Análise das Principais Componente (APC) foi aplicado nas de imagens dos satélites, Landsat-7 ETM+ e ASTER, e resultou em realce das feições de relevo contidas na imagem. A utilização de dados SRTM possibilitou o reconhecimento de geoformas deposicionais pouco evidentes na planície. Diferentes estágios de construção e abandono de cinturões de meandros, bem com paleolobos distributários de um possível leque fluvial foram reconhecidos / Abstract: The Pantanal depositional tract has several fluvial megafans created by rivers with drainage basins in the adjacent plateaus. The Miranda's is one of least known among all the depositional systems in the Pantanal. The scope of this study is to characterize the Miranda river geomorphology and to recognize evidence of paleoenvironmental and paleohydrological changes. To reach these objectives, the following steps were developed: 1) digital processing of orbital data, such as satellite and SRTM data; 2) delimitation and geomorphological subdivision of the depositional system of the Miranda river; 3) integration and interpretation of data, with identification of current and relict depositional landforms; 4) recognition of environmental changes. Three zones were recognized within the system: a confined river plain, an active depositional lobe and an abandoned depositional lobe. The Principal Components Analysis (PCA), applied to the images of satellites, Landsat-7 ETM + and ASTER, resulted in enhancement of relief features. Representações das identidades nacionais argentina e brasileira nas canções interpretadas por Carlos Gardel e Carmen Miranda (1917-1940)

Na presente tese de doutorado focalizamos as músicas gravadas por Carlos Gardel (1917 a 1935) e por Carmen Miranda (1930 a 1940), articulando-as com a imagem e a performance dos artistas, as quais podem ser observadas na audição das gravações, nos filmes dos quais participaram e em fotos divulgadas em revistas da época, para analisar as representações das identidades nacionais argentina e brasileira do período. Considerando que tal período é, exatamente, o de emergência de determinados meios de comunicação de massas (a indústria fonográfica, o rádio e o cinema), observa-se que estes dois artistas tornaram-se ídolos nacionais através destes meios e foram mediadores na construção das identidades nacionais. Desta forma, estabeleceram, nas representações contidas em suas músicas, imagem e performance, relações entre a identidade nacional e outras identidades já existentes anteriormente entre seu público. Neste trabalho, analisamos também estas relações, especialmente da identidade nacional com as identidades populares e de elite, com as identidades étnicas e regionais. / In this doctorate thesis we remarked the music recorded by Carlos Gardel (1917- 1935) and Carmen Miranda (1930-1940) matching image and performance of these artists, which can be look on hearing recorded, in the movies that both played a part in and in the photos published in magazines in that time, to analyze the Brazilian and Argentine national identity. Regarding that epoch exactly the development of the mass media (phonografic industry, radio and cinema) we can realize these artists became national idols by these communications and they were mediators that national identity form. By this way, they established, in their musics, images and performances representations relationship between national identity and others identities just extant before among their public. In this thesis we analyze these relationship especially of national identity with popular and elite identity, with ethnic identity and regional identity.

The Effects of Suggestibility, Compliance, and Situational Stress on Miranda Abilities, Waiver Decisions, and False Confessions

Miranda abilities, individual characteristics, and contextual factors are critical elements to evaluate in determining the validity of Miranda rights waivers and confessions. Research indicates that many individuals waive their Miranda rights without adequate comprehension or reasoning. In addition, personality characteristics of suggestibility and compliance are key factors influencing waiver decisions. Furthermore, scholars found that situational anxiety likewise impairs Miranda abilities and waiver decisions. Previous research has investigated the effects of Miranda abilities, individual characteristics, and contextual factors on Miranda waivers and confessions by utilizing confession paradigms. A methodological limitation of these paradigms is the lack of volition and autonomy in committing the accused acts of wrongdoings. The current study of undergraduate students advances previous research through examining the detrimental impact of false accusations of wrongdoings committed independently and intentionally using a novel paradigm. This thesis sought to further the understanding of the effects of Miranda abilities (i.e., comprehension and reasoning), personality characteristics (i.e., suggestibility and compliance), and situational factors (i.e., false accusation) in relation to Miranda waivers and confession decisions. The final sample included 87 undergraduate students, of whom approximately 97% waived their rights and 40% falsely confessed to the wrongdoing. The results indicate that Miranda reasoning, suggestibility, and compliance significantly predict the likelihood of false confession. These findings can be used to inform policy changes as well as the evaluations of the validity of Miranda waivers and confessions.

A Comparative Study of Strength and Stiffness of Thin-Walled Specimens Fabricated By FDM and 3D Printing Technologies

Rapid Prototyped part failure constitutes a major issue for both RP providers and customers. When parts fail the reputation of the vendor is heavily deteriorated, customer dissatisfaction increase and replacement of the broken parts is often necessary to avoid the loss of future business. Product design teams often run into situations where Rapid Prototyped parts are not able to withstand shipping and handling and delivered broken or while demonstrating and examining the parts. When done in the face of customers this builds a perception of poor quality and lack of aptitude on the design group as well as the RP processes. The rapid advance of the RP industry and technology has led users to employ RP parts for structural applications where the need to understand in great detail and accuracy the mechanical behavior of the product and its individual components is greater than ever. Models built on Rapid Prototyping (RP) equipment are most often made from polymers which frequently have mechanical properties that are inferior to those manufactured by traditional methods such as thermoforming or injection molding. Not only are the mechanical properties of RP models typically low, they are usually, at least in thin sections, directly dependent on the section or wall thickness of the models. This dependence of strength on wall thickness makes it difficult to predict a proper wall thickness for RP models, even when nominal values of material strength are known. The purpose of this work is to present and compare measured values of tensile strength and stiffness as a function of wall thickness for three RP processes and materials. These properties will assist designers estimating adequate minimum wall thicknesses for models built by the three processes. The three RP technologies included in the scope of this research are: Z Corporation (powder with polymer binder layup), Fuse Deposition Modeling and PolyJet Layup (Objet). The findings of this study establish that tensile strength and stiffness values are dependent upon wall thickness, building orientation and direction of the applied force of specimens created with the methods in consideration. It was also determined that the correlation between thickness and strength for all processes is non-linear. Due to these results a single tensile strength and modulus value for each material and all wall thicknesses do not accurately represent their behavior. However, these results will allow a designer to understand the relationship between the wall thickness and using the data provided in this work be able to model and then fabricate adequate 3D prototypes.

The comparative method was used to promoving a dialogue between brazilian and portuguese literature. The authors made a History s critical revision, when through fiction, anonymous and stranger people had opportunity to show a new version of facts. In this way, the forgetful people and everyone who were quiet or had kept in silence by oficial history for years earned voice. The fictional procedures and organization of narratives reveal ideological marks of past that contrast with present, we have the time of history in direct confront with time of writing. Feminine characters are agents of social transformation, too. They keep themselves an ideological speech which approach them to the present. They look into their reality, and thought acute sense show us aspects of nature and human relationship had never seen before. The sensibility, capacity to appreciate the world and years of repression make the feminine characters a spokeswomen of excluded people such as poors, women and jewish beyond all persons who had an inadequate behaviour to pattern of period. Therefore, our purpose was reveal the manner as writters articulated literature elements mixing ideological aspects of present and past, history and fiction to build a ficcional universe which destroy the dominant ideology / Neste trabalho fizemos uma análise da estrutura narrativa dos romances Desmundo de Ana Miranda e Memorial do Convento de José Saramago e das respectivas personagens Oribela e Blimunda. Utilizamos o método comparativo como instrumento de análise com o propósito de promover o diálogo entre as literaturas brasileira e portuguesa. Os romances fazem uma revisão crítica da história ao dar voz aos esquecidos, àqueles que foram calados pela História oficial. A organização estética, os procedimentos literários comuns ao corpus evidenciam marcas ideológicas de um tempo histórico que se contrapõem ao tempo da escritura. Por outro lado, a construção de personagens femininas que se destacam pelas atitudes e pela forma diferente de pensar e enfrentar a realidade, tornam-nas agentes de transformação social, portadoras de um discurso ideológico que as aproximam da contemporaneidade. É por meio da agudeza do olhar que essas personagens conseguem apreender o real em todas as suas nuanças e perceber aspectos da natureza e das relações humanas, impossíveis de serem captadas por indivíduos cuja visão é embotada pelo processo de automatização social. A sensibilidade, a capacidade de apreensão do mundo e o fato de ter sido calada durante tanto tempo, faz da personagem feminina uma espécie de porta-voz dos excluídos, seu discurso ganha uma dimensão que extrapola os limites do próprio romance. Sua perspicácia e agudeza, assim como a forma como penetra e revela a natureza e as relações humanas materializam-se esteticamente na narrativa. Nosso objetivo, portanto, foi mostrar como os escritores articularam os elementos literários absorvendo traços ideológicos do presente e do passado e revelar de que maneira as protagonistas femininas se desenvolveram como agentes de transgressão social por meio de um discurso literário que esfacela a ideologia dominante

Effects of Immaturity on Juveniles’ Miranda Comprehension and Reasoning

Over the last several decades, researchers have documented how impaired reasoning by adult offenders impeded the intelligent waiver of Miranda rights. Logically, it stands to reason that juveniles – who are developmentally less mature and have less life experience than their adult counterparts – would possess even greater impairment, thereby heightening their risk for invalid Miranda waivers. Juvenile Miranda research supports this notion; with some researchers finding that psychosocial maturity, among other factors, affect a juvenile’s understanding of their rights. Yet, relatively few studies have examined its relation to Miranda reasoning and decision-making. Thus, the current study investigated the specific role of maturity in juveniles’ Miranda comprehension and reasoning. Participants included 236 legally-involved juveniles recruited from either a juvenile detention center or a juvenile justice alternative education program. The effects of psychosocial maturity were examined on a variety of Miranda-related measures and assessed a broad range of Miranda abilities. It was found that, in general, immature juveniles performed more poorly on all Miranda measures as compared to their mature counterparts. However, the impact of maturity varied considerably depending on the ability. Specifically, maturity was most important in the context of Miranda reasoning. As a novel addition to the literature, the current study also investigated the effects of developmental timing on maturity (i.e., immaturity-delayed versus immaturity-expected) on Miranda abilities.

A Comparison of Miranda Procedures: The Effects of Oral and Written Administrations on Miranda Comprehension

Millions of custodial suspects waive their rights each year without the benefit of legal counsel. The question posed to psychologists in disputed Miranda waivers is whether this waiver decision was, knowing, intelligent, and voluntary. Mental health professionals must be aware of potential barriers to Miranda comprehension to provide expert opinions regarding a defendant's competency to waive rights. The current study examined how Miranda warning reading level, length, and method of administration affects Miranda comprehension. Recently arrested detainees at Grayson County Jail were administered oral and written Miranda warnings from the Miranda Statements Scale (MSS; Rogers, 2005) to measure their comprehension of the warnings. Surprisingly low levels of Miranda comprehension were found for most warnings. For all warnings at or above 8th grade, a substantial minority (27.1% - 39.6%) of defendants exhibited failed (i.e., < 50% understanding) Miranda comprehension. Regardless of other variables, oral administrations resulted in a substantially larger number of defendants with failed Miranda comprehension. Implications for public policy and clinical practice are discussed.

O Direito tem dificuldades para enfrentar o desconhecido e se adiantar às consequências de danos futuros. Isso ocorre porque a classificação do que é jurídico vem sempre atrás dos fatos, formalizada na regra jurídica. Esse cenário aponta à necessidade de uma ressignificação da concepção vigente sobre fato jurídico, conceito que no Brasil foi cunhado por Pontes de Miranda. Diante desse quadro, a tese propõe a ressignificação hermenêutica do fato jurídico ponteano com o objetivo de possibilitar a juridicização do fato nanotecnológico a partir da adoção de um novo modelo interpretativo e de uma nova concepção de regra jurídica e incidência. A juridicização aqui tem um sentido de preocupação e cuidado com o ser-humano, que é a essência do progresso nanotecnológico, diante dos possíveis riscos das nanotecnologias, em especial no tocante aos nanoalimentos. A hipótese inovadora é que essa juridicização pode ser viabilizada pela substituição do método pela filosofia, com base nos aportes da hermenêutica de Heidegger e Gadamer e com base na revolução normativa proposta como marco regulatório para as nanotecnologias por Engelmann. No que diz respeito ao método, é adotado o método de abordagem fenomenológico-hermenêutico, cuja investigação considera o sujeito no seu acontecer, e não separado como um objeto de estudo, analisado por um sujeito que não sofre as consequências destas transformações. Quanto aos métodos de procedimento, são utilizados o método histórico, comparativo e estudo de casos. Como técnica de pesquisa, utiliza-se a pesquisa bibliográfica, com análise e revisão de doutrina nacional e estrangeira sobre o tema. É realizada, ainda, pesquisa documental, que abrange as propostas de marcos regulatórios no Brasil, nos Estados Unidos e União Europeia, bem como iniciativas para redução de riscos propostas por organizações internacionais, governamentais e não governamentais. Utiliza-se ainda a coleta de dados sobre nanoprodutos, em especial produtos alimentícios com nanoprata já produzidos e comercializados no mundo. Para tanto, utilizou-se como recurso a ferramenta de pesquisa do inventário formado pelo Projeto sobre Nanotecnologias Emergentes, sendo que a pesquisa efetivada sobre a relação cadastrada até outubro de 2013 apontou 41 produtos da categoria "alimentos e bebidas" com "nanoprata". Como resultado da pesquisa verificou-se que é possível a ressignificação hermenêutica da concepção ponteana de fato jurídico sob algumas condições: a) a substituição do modelo subsuntivo-dedutivo da Teoria do Fato Jurídico pelo modelo circular proposto pela hermenêutica filosófica, que permite interpretação mais adequada a cada caso, abarcando assim as múltiplas facetas das nanotecnologias; b) a formação de uma pré-compreensão sobre o fato nanotecnológico, estruturada pela tradição já institucionalizada nos Direitos Humanos e Constituição Federal, e complementada por outros textos normativos e documentos internacionais que permitem o diálogo entre diversos intérpretes e atores que fazem parte da Revolução Nanotecnológica. Preenchidas as condições, a juridicização do fato nanotecnológico ocorre independentemente de um suporte fático previsto em uma regra jurídica, mas a partir de uma pré-compreensão que se forma para o ser-no-mundo quando, além de resgatar a tradição, consegue acessar o mundo nanotecnológico, transformando-se no ser-no-mundo-nanotecnológico. / The complexity involved in the nanotechnologies can separate this theme from the juridical area. Law has some problems to face the unknown and to foresee the consequences of the future damages. This happens, because the classification of what is juridical is behind the facts, which is based on legal principles. Therefore, the present scenario demonstrates the necessity of reframing the current conception of the legal fact, which is a concept that, in Brazil, was created by Pontes de Miranda. Thus, this thesis aims to suggest a hermeneutical ressignification of the legal fact, proposed by Pontes de Miranda, and to allow the jurisdicization of the nanotechnological fact, through the adoption of a new model of interpretation and a new conception of juridical rule and incidence. The jurisdicization, focused on this research, is related to the human being’s care, who is the essence of the nanotechnogical, considering its possible risks, particularly nanofoods. The brand new hypothesis is that this jurisdicization can be feasible through the substitution of the method by the philosophy, based on the hermeneutical bases of Heidegger and Gadamer as well as the normative revolution, as regulatory frameworks to nanotechnologies by Engelmann. Considering the method, it is adopted a phenomenological-hermeneutical approach, whose investigation considers the subject in this essence, but not, as something that is separated of the study, that is analyzed by a subject that is not affected by the consequences of these transformations. Taking into account the procedure methods, we used the historical, comparative, as well as case studies, and the technique, the bibliographical one, analyzing and reviewing the national and international doctrine about the theme. It was also carried out a documental research, which is centered on the suggestions of regulatory frameworks in Brazil, the United States of America and European Union, as well as the initiatives to reduce the risks, suggested by international, governmental and non-governmental organizations. Data were collected about nanoproducts, especially food products, in which nanosilver is used that has already been produced and traded in the world. So, it was applied, as a resource, the inventory of the Emergent Nanotechnologies Project, and the research about the list, registered on October 2013, points out 41 products related to the following categories “food and beverage”, in which “nanosilver” was applied. Considering the result of the current study, we verified that it is possible to reframe the hermeneutic Pontes de Miranda’s hermeneutic, related to the conception of the legal fact, in the following aspects: a) the substitution of the subsuntive-deductive model of The Theory of the Legal Fact for the circular model, suggested by the philosophical hermeneutic, that allows a better interpretation of each case, taking into account the multiples aspects of nanotechnologies; b) the formation of a pre-understanding about nanotechnology, structured by the tradition of the Human Rights and Federal Constitution, can be complemented by other normative texts as well as international documents that allow the dialog between many interpreters and actors, who belong to nanotechnology revolution. The method of discourse analysis was used to evaluate the image of Carmen Miranda in the various existing media, highlighting its connection to Hollywood cinema, between 40 and 50, especially with regard to the construction of cultural identity. In order to complement the Discourse Analysis, we utilized the Depth Hermeneutics, with the aim to understand how different symbols were produced from the same image in different populations. We also checked the symbolic language and the representation of the figure of the actress to support the idea of audiovisual handling of latin and american viewers by cinema. The cinema had its cathartic role: the U.S. population wanted to watch "Bombshell" to forget about the war, whereas the Brazilian people felt accepted - recognized - before the figure of Carmen Miranda in foreign cinema. The Hollywood movies in which Carmen Miranda participated had great worldwide impact, marking the peak of her career. They pleased, a lot the U.S. mass. On the other hand, the Latin people did not like the way Carmen was shown in the movies, because they felt offended and poorly represented. This offense was overcome by changes in the script and the great international success of the actress, who kept the Bahia clothing, estabilishing her identity. Beyond Hollywood overproduction, the cinema has always aroused interest in Latin American society, who used to make the movies theater packed. Lay behind these films other Latino looks like "charm" of the big screen movie and disclosure of grand spectacles of Hollywood films which had not existed as a form of entertainment (film vehicle communication) in their societies. In Brazil, which had its fledgling movie theaters and movie productions sponsored and controlled by the United States, these effects were even greater. / Analisamos nesta tese a constru??o da imagem da atriz e cantora Carmen Miranda, principalmente pela ind?stria cinematogr?fica, e como essa artista, por sua vez, influenciou as atitudes e os costumes de algumas popula??es, sobretudo, dos brasileiros e norte-americanos. O m?todo da An?lise de Discurso foi usado ao avaliarmos a imagem de Carmen Miranda nos diversos meios de comunica??o existentes, destacando sua liga??o com o cinema de Hollywood, entre os anos 40 e 50, especialmente no que se refere ? constru??o da identidade cultural. Para complementar a An?lise do Discurso, utilizamos o uso da Hermen?utica de Profundidade, com o objetivo de entender como foram gerados s?mbolos diferenciados entre popula??es distintas diante de uma mesma imagem. Verificamos, ainda, a linguagem simb?lica e a representatividade associadas ? figura da atriz para sustentar a ideia de manipula??o audiovisual, pelo cinema, tanto dos espectadores latino-americanos quanto dos norte-americanos. O cinema tinha seu papel cat?rtico: a popula??o dos EUA ia assistir ? Pequena Not?vel para esquecer-se da guerra; j? os brasileiros se sentiam aceitos reconhecidos diante da figura de Carmen Miranda no cinema estrangeiro. Os filmes de produ??o hollywoodiana dos quais Carmen Miranda participou tiveram grande repercuss?o mundial, marcando o auge de sua carreira. Agradaram, e muito, ? massa norte-americana. Por outro lado, aos latinos n?o agradava a forma como Carmen era mostrada nos filmes, pois sentiam-se ofendidos e mal- representados. Ofensa esta que foi superada pelas mudan?as no roteiro e pelo grande sucesso internacional da atriz, que manteve a roupa de baiana, marcando sua identidade. Al?m da superprodu??o hollywoodiana, o meio cinematogr?fico sempre despertou interesse na sociedade latino-americana, que lotava as salas de cinema. Havia por tr?s desses filmes outros olhares latinos como o encanto da grande tela do cinema e a divulga??o dos grandes espet?culos dos filmes hollywoodianos que at? ent?o n?o existiam como forma de entretenimento (ve?culo de comunica??o cinematogr?fico) em suas sociedades. No Brasil, que teve suas incipientes salas de cinema e produ??es de filmes patrocinadas e controladas pelos Estados Unidos, estes efeitos eram ainda maiores.
