Αντικείμενο της διδακτορικής αυτής διατριβής είναι το πρόβλημα περί της ελεύθερης βούλησης του ανθρώπου, σε σχέση με την παρουσία της θείας προνοίας στη ζωή του όπως διατυπώνεται από τον Μάξιμο τον Ομολογητή (580-662), οπότε αναγκαίως εισήχθη στη συζήτηση και το μεταφυσικό στοιχείο με τις γενικές οντολογικές προκείμενες που το διέπουν και τις ειδικές κοσμολογικές που το ακολουθούν. Τα κύρια σημεία που επιχειρούμε να αναδείξουμε, ως ερευνητικά προς εξειδίκευση ζητήματα, με συνοπτικό τρόπο είναι τα εξής: α΄. Ο άνθρωπος έχει τις προϋποθέσεις να φέρει στο προσκήνιο με ποιοτικούς όρους την ύπαρξή του υπό την οπτική του προσώπου, κατ’ αναλογίαν με τα Πρόσωπα της τριαδικής θεότητας, να πραγματοποιήσει δηλαδή τη ζωή ως αγάπη, δηλαδή ως ελευθερία και όχι ως φυσική αναγκαιότητα. β΄. Ο Θεός ελεύθερα δημιουργεί τον κόσμο και ανάγει το είναι στην ελευθερία, θέτοντας νέα δεδομένα στην οιονεί λογοκεντρική αναγκαιότητα που κατά περιπτώσεις παρουσιάζεται στην αρχαία ελληνική διανόηση της κλασικής περιόδου, παρά το ότι δεν πρέπει να μάς διαφεύγει ότι ο Δημιουργός στον πλατωνικό Τίμαιον διέπεται από προκεχωρημένο βαθμό ελεύθερων προσωπικών επιλογών. Γίνεται λόγος από τον Αθηναίο φιλόσοφο για ένα θείο πρόσωπο που βούλεται, βουλεύεται και κινείται με αισθητικά κριτήρια, τα οποία δεν υποτάσσονται σε αναγκαιότητες. Σημειωτέον μάλιστα ότι και ο νεοπλατωνικός Πρόκλος (412 - 485) επιμένει έτι περαιτέρω στις εν λόγω καταστάσεις. Η χριστιανική θεώρηση όμως της δημιουργίας διευρύνει σε μέγιστο βαθμό το βουλητικό και το βουλευτικό περιεχόμενο της θείας ενέργειας. Το κεφαλαιώδες μάλιστα μυστήριο της ενσάρκου οικονομίας και ενανθρωπήσεως του θείου Λόγου, δηλώνει ακριβώς τη μεταμόρφωση του αιτιατού υπό τους όρους του αιτίου του. γ΄. Ο άνθρωπος διαθέτει φύσει – οντολογικά – ελευθερία βουλήσεως, και έτσι ενισχύεται εξ ορισμού το δικαίωμα της προσωπικής ελευθερίας του και διασφαλίζεται το αυτεξούσιό του, ανεξάρτητα από το πώς θα το κατανοήσει και θα το προβάλει. δ΄. Η ανθρώπινη φύση φθάνει στην πληρότητά της ή στο καθ’ ομοίωσιν, διά της ελευθερίας του προσώπου, εφ’ όσον το ίδιο χρησιμοποίησε το αυτεξούσιον του προς την πραγμάτωση του αγαθού. Πρόκειται για μία ρήτρα που κινείται στον άξονα μιας απόλυτης συμμετρίας, καθότι η μία έννοια (αγαθόν) θέτει δι’ αμέσου συνεπαγωγής και την παρουσία της δεύτερης (ελευθερία) ή και αντιστρόφως. Τέλος, προκειμένου να αναδείξουμε ευρύτερα την σχέση ελευθερίας –αναγκαιότητας, επιχειρήσαμε σε ορισμένες περιπτώσεις να την εντοπίσουμε, στις γενικές διατυπώσεις της, και στον χώρο του Νεοπλατωνισμού, και ιδιαίτερα στον Πρόκλο, ο οποίος έχει επεξεργασθεί συστηματικά το ζήτημα στα σχόλιά του στους Πλατωνικούς διαλόγους Αλκιβιάδης Α’, κυρίως, Πολιτεία και Τίμαιος, στα οποία μάλιστα αναπτύσσει μία γενικευμένη ανθρωπολογία. Μέσα από τις εν λόγω αναφορές, άλλοτε ρητά και άλλοτε υπόρρητα, επιχειρήσαμε να διατυπώσουμε εκτιμήσεις για το φιλοσοφικό βάθος του στοχασμού του Μαξίμου, ο οποίος κινείται κυρίως στον θεολογικό άξονα έρευνας. Σε ορισμένα, επίσης, σημεία εξετάσαμε και τις σχέσεις του με την ηθική του Αριστοτέλη, κυρίως ως προς την έννοια της προαίρεσης. Τέλος οι αναφορές μας στους Στωικούς κυρίως είχαν ως βάση τις ανθρωπολογικές –ηθικές κατηγορίες του «ἐφ’ ἡμῖν» και του «οὐκ ἐφ ἡμῖν». / The subject of this doctoral dissertation is the problem of human free will in relation to the presence of divine providence in human life as is formulated by Maximus the Confessor. In this discussion the metaphysical element was necessarily introduced, together with the general ontological premises pertaining to it and the particular cosmological premises following it. The main points we attempt to illuminate, as particular research topics, are concisely the following: (a) A human being has the presuppositions to bring to the fore his existence in qualitative terms under the perspective of the person, in a way analogous to the Persons of the triadic God, so as to realize life as love, i.e. freedom, and not as a natural necessity. (b) God freely creates the world and reduces being to freedom, thus imposing a new frame to the virtually rationalistic necessity which in certain cases appears in the ancient Greek thought of the classical period, even though it should not escape our notice that the Demiurge in the Platonic Timaeus enjoys freedom of personal choice to a greater degree. The Athenian philosopher discusses a deity who wills, deliberates and moves by means of application of aesthetic criteria, which are not subject to necessities. It should be noted that the Neoplatonist Proclus (412-485) insists further on these conditions. However, the Christian consideration of creation enhances to a maximum degree the presence of will and deliberation in the divine energy. The mystery of the incarnated economy and of the human form of the divine Word, which is of utmost importance, exactly declares the transformation of the effect in terms of its own cause. (c) The human being by nature - ontologically -possesses freedom of will, and thus by definition the right of personal freedom is reinforced and secured, independently of the way it will be comprehended and projected, (d) Human nature reaches its completion or the likeness to God by means of the freedom of person, since the latter itself used its free will for the realization of the Good. This is a clause which moves within the frame of an absolute symmetry, even though the first concept (Good) directly entails as well the presence of the second (Freedom) and vice versa. Finally, in order to show the wider relation between freedom and necessity, we attempted to identify its general formulations in certain cases in the field of Neoplatonism, as well, and particularly in Proclus, who systematically dealt with this topic in his commentaries on the Platonic dialogues Alcibiades I, mainly, Republic and Timaeus, where he develops a generalized anthropology. Throughout these references, either clearly or indirectly, we attempted to formulate evaluations as to the philosophical depth of the thought of Maximus, who mainly moves within the frame of theological research. In certain cases we also examined his relation with Aristotelian ethics, mainly concerning the concept of choice. Finally, our references to the Stoics were mainly based on the anthropological - moral categories of that which is in our power (ἐφ’ ἡμῖν) and that which is not (οὐκ ἐφ’ ἡμῖν).

Die Tätigkeiten im Notarzt- und Rettungsdienst sind häufig mit persönlichen Gefährdungen verbunden. Im Raum steht aber auch immer die Problematik von Gefährdungssituationen, die durch den Notarzt "nur" als solche wahrgenommen, sozusagen "empfunden" werden. In dieser Arbeit wird v. a. vor dem Hintergrund der Erforderlichkeit und Zumutbarkeit die Frage prinzipiell diskutiert, ob und inwieweit ein Notarzt zum Handeln verpflichtet ist. Im Ergebnis ist objektiv-typisierend auf den Facharztstandard bzw. den Indikationskatalog für den Notarzteinsatz in Kombination mit arzt-/berufsrechtlichen Gesichtspunkten im engeren Sinne (z. B. Freiberuflichkeit) abzustellen. Es wird sich jedenfalls immer um eine Einzelfallbetrachtung und um eine individuelle, fallbezogene Entscheidung handeln. Bei seltenen, sehr unwahrscheinlichen Situationen mit relativer Ermangelung von objektiv-typisierbaren Gesichtspunkten werden die Anforderungen, aber auch die Chancen, an die "höchstpersönliche" Berufsausübung, an die Persönlichkeit des Arztes (v. a. in der Entscheidungsfindung) umso größer werden.

Ondřej Krása, Causes of the Creation of the World in Plato's Timaeus Abstract of the Thesis The aim of the thesis is to explain the causes of the creation of the world in Plato's Timaeus. The causes of the creation of the world are manifold. The Demiurge created the world according to an eternal paradigm. The paradigm of the world is an intelligible animal that encompasses everything that is eternal. The Demiurge is the best of eternal beings and created the world as an image of the entirety of eternal beings. What is then the relationship between the Demiurge, who is reason, and the entirety of eternal beings, that reason can comprehend? Timaeus characterizes the eternal being as having no other relationships than those towards itself. On the contrary, the Demiurge is a being that has constitutive relationships towards the world. The entirety of being that consists of both the Demiurge and that, which is in itself, is therefore a being in which reason relates self-contained relationships of that, which reason can comprehend, towards something else, namely becoming. The world was created in a receptacle as an embodied soul. Each body is a regular geometrical figure with no "matter" inside. Bodies are both in space and they are modifications of space. Le principe de nécessité constitue incontestablement un des piliers de l’action pénale moderne. Ce principe fut essentiellement développé au cours des XVIIe et XVIIIe siècles, sous l’impulsion notamment de Cesare Beccaria dont la pensée fut influencée par celle des philosophes des Lumières. Ces auteurs, animés par l’idée de modération voire d’abolition des châtiments corporels, prescrivaient un recours mesuré au droit pénal. Ces développements philosophico-juridiques étaient précurseurs d’une reprise ultérieure du principe de nécessité en droit positif, au lendemain de la révolution de 1789. Inséré au sein de la Déclaration des droits de l’homme et du citoyen, ce dernier y a acquis le statut de principe fondamental et irrigue l’ensemble du droit pénal tant en ce qui concerne les incriminations (article 5) et les peines (articles 8) que la procédure (article 9). La présente thèse situe la réflexion quant au principe de nécessité dans le domaine bien défini du droit pénal des affaires. La question de la place du droit pénal dans la sphère économique et financière est une problématique constante pour le législateur. Elle requiert de ne pas s’arrêter au seul aspect traditionnel du principe de nécessité en tant que modérateur de l’action pénale, mais de dépasser cette vision pour étudier son côté positif et engager une réflexion globale sur les raisons d’un recours au droit pénal en matière économique et financière / The necessity principle undeniably represents one of the pillars of modern criminal law. This principle was essentially developed during the XVIIth and XVIIIth centuries, in particular by Cesare Beccaria, whose thought was influenced by the Enlightenment philosophers. Driven by ideas of moderation and corporal punishment abolition, they prescribed a restrained application of criminal law. These philosophical and legal developments reappeared in substantive law after the 1789 revolution. Embedded in the Declaration of the Rights of Man and of the Citizen, the necessity principle acquired the fundamental principle status and shapes incriminations (Article 5), punishments (Article 8) and criminal law procedure (Article 9). This work analyses the necessity principle within the area of criminal business law. The influence of criminal law in the economic and financial realm is a constant issue for the legislator. As the necessity principle involves more than the traditional aspect of moderation, its positive aspect will also be analysed in order to reflect on the rationale of its application in the economic and financial sphere

La raison d’État, concept clé de la modernité politique et de la pensée étatique du XVIIe siècle, est approchée à rebours dans cette étude, afin de mieux en saisir les origines, et de comprendre les conditions qui en permettent l’émergence. Par l’adoption d’une méthode généalogique, ce travail vise aussi à concilier l’école historique française des Annales et la tradition anglo-américaine de l’histoire des idées, et à traiter les théories politiques comme un objet historique à part entière. Chaque texte et chaque auteur est donc intégré dans un enchaînement d’influences et de relations sans dénier à chacun son individualité intellectuelle. Parmi les notions principales qui structurent toutes les définitions de la raison d’État, la nécessité, l’utilité publique, l’exception à la loi connaissent des évolutions profondes dès le XIIe siècle, sous l’effet de la redécouverte des Anciens par Jean de Salisbury et plus encore Thomas d’Aquin, du travail des juristes, tant en droit canonique que romain, ainsi que dans la pratique fiscale des XIIIe et XIVe siècles. Les progrès de l’idéologie royale, l’affirmation d’une nécessité spécifique à l’action politique chez Guillaume d’Ockham, et l’essor du concept d’État souverain sous l’influence particulière de Marsile de Padoue, participent aussi de cette élaboration à l’œuvre, notamment dans l’Italie des cités-États. Le parcours s’achève par l’exposition de trois différentes définitions de la raison d’État qui, d’abord chez Machiavel et Guichardin, puis chez Botero, puis enfin chez les juristes dont Ammirato et Canonhiero, ouvrent la voie au triomphe de l’étatisme et au renouvellement des questionnements politiques, à l’aube des Lumières. / This survey attempts to draw a new understanding of reason of State, as a key concept in modern politics and in 17th century State-centered thought. It is therefore studied backwards, in order to better describe its origins, and to understand what conditions enabled its formulation. The genealogic method is chosen as a way to conciliate the French school of the Annales and the anglo-american tradition of history of ideas, and to handle political ideas as historical artefacts. Every text and author is therefore apprehended as a part of a chain of influences and relationships, while intellectual singularities are preserved. Among the main concepts that participate in defining reason of State, necessity, public utility and legal exception evolve deeply from the 12th century, as a result of the rediscovery of ancient authors by John of Salisbury and still more by Thomas Aquinas, of recent developments in canon and roman law, and of new fiscal policies during the 13th and 14th centuries. The improvements of royal ideology, the new necessity specifically applied to political action in William of Ockham’s thought, and the rise of the concept of a sovereign State under the primary influence of Marsilius of Padua, also participate in this preparation, now centered on Italian city-states. The account ends with a view on three different definitions of reason of State, that correspond first to Machiavelli and Guicciardini, then to Botero, and finally to the legal thought of Ammirato and Canonhiero. This outcome paves the way to the triumph of Statism, and to the new developments of political theory during the Enlightenment.

A presente pesquisa tem o objetivo de estudar os princípios de investigação dos seres vivos tendo como parâmetro a concepção hilemórfica dos entes naturais em Aristóteles. Para tanto, em primeiro lugar, analisaremos o hilemorfismo tal como exposto no Livro II da Física, a fim de investigarmos a doutrina da matéria e forma, no contexto em que ela desempenha um papel fundamental para a elaboração de uma concepção que é capaz de mostrar os modos pelos quais os entes se constituem na natureza. Em segundo lugar, examinaremos os princípios de investigação dos seres vivos no Livro I das Partes dos Animais, de modo a identificar os fundamentos conceituais nos quais ele se sustenta. Assim, veremos em que medida a doutrina da matéria e forma desempenha uma função determinante na análise relativa aos organismos vivos. / The present research aims to study the principles of investigation of living beings, from hylemorphic conception as a parameter of explanation of natural beings in Aristotle. To do so, first, well analyze the hylemorphism as set out in Book II of Physics in order to investigate the doctrine of matter and form, in which it plays a key role in the development of a conception that is able to show the ways in which beings are formed in nature. Second, well examine the principles of living beings in Book I of the Part of Animals, in order to identify the conceptual foundations on which it holds. So we\'ll see how far the doctrine of matter and form plays a decisive role in the analysis relating to living organisms.

CIPESC® Curitiba: proposta de uma ferramenta re-leitora da face coletiva do processo saúde-doença / ICNPCH Curitiba: propose a re-reading tool of the collective side of the health-disease process

O projeto Classificação Internacional das Práticas de Enfermagem em Saúde Coletiva - CIPESC® , embasado nos princípios do SUS e da Saúde Coletiva, foi desenvolvido pela Associação Brasileira de Enfermagem, como contribuição brasileira à CIPE? – Classificação Internacional para as Práticas de Enfermagem. A Secretaria Municipal da Saúde de Curitiba adotou a CIPESC®, num sistema operacional informatizado, para registro da consulta de Enfermagem. O presente estudo interroga as potencialidades e os limites dos instrumentos de trabalho da Enfermagem em saúde coletiva para a captura da face coletiva dos indivíduos. Teve como objetivo geral formular as bases para a construção de uma ferramenta re-leitora do Processo Saúde-doença, com privilégio para a face coletiva, por meio da relação dialógica entre as categorias sociais e as variáveis funcionais contidas no sistema CIPESC® – Curitiba. Os objetivos específicos foram: reinterpretar a realidade objetiva da implantação do sistema; descrever o processo de implantação no município; levantar as variáveis funcionalistas do prontuário eletrônico e estabelecer relação dialógica entre variáveis e categorias sociais do Processo Saúde-doença. A Metodologia foi ancorada na Teoria da Intervenção Práxica da Enfermagem em Saúde Coletiva (Egry, 1996) e na hermenêutica dialética. A pesquisa foi aprovada pelos Comitês de Ética da Escola de Enfermagem, da Universidade de São Paulo e da Secretaria Municipal da Saúde de Curitiba. As categorias interpretativas foram: Necessidade, Classe social, Gênero e Etnia. A ferramenta propõe um modelo analítico de apoio a tomada de decisão, permitindo que ao atender o indivíduo, o sistema desvele sua face coletiva, por meio da interligação de dados num banco denominado “data warehouse”. Para captar a face coletiva, o banco deve integrar dados das subcategorias: perfil saúde-doença, fração de classes sociais, sexo, faixa etária e raça. As subcategorias, quando associadas, formam diferentes grupos homogêneos na constituição interna, e heterogêneos em relação à vulnerabilidade. Visualizam-se quatro graus de vulnerabilidade: nula, baixa, média e alta, de acordo com a qualificação dada por onze marcadores, que se diferenciam conforme a localização do indivíduo em condições de vulnerabilidade distintas. Há marcadores que sozinhos podem localizar o grau de vulnerabilidade alta como: morar em área de risco, estar desempregado e não ter renda. Outros marcadores, se encontrados em conjunto com as outras condições, elevam o grau de vulnerabilidade, como ser adolescente ou negro. Conclui-se que o prontuário eletrônico do paciente é capaz de levantar características do espaço singular e, ao captá-las, relacionando-as às categorias, desvelar a face social e atribuir vulnerabilidade aos grupos sociais homogêneos. Apesar de existirem lacunas para contemplar a totalidade das categorias sociais, os instrumentos de base funcional, utilizados pela CIPESC, em Curitiba, permitem a reorganização de dados para indicar a face coletiva de indivíduos, famílias e grupos homogêneos. Um modelo teórico-informacional é apresentado para esta reorganização, constituindo-se, portanto na ferramenta re-leitora da face individual, com a finalidade de explicitar a face coletiva dos processos de saúde-doença da população / The ICNPCH – International Classification of the Nursing Practice in Collective Health, according to the principles of the public and collective health, was developed by the Brazilian Nursing Association, as a Brazilian contribution for the ICNP – International Classification to the Nursing Practices. The Municipal Health Secretary in Curitiba adopted the ICNPCH, in a computerized operational system, for the nursing visit records. The present study aims to question the potentialities and the limits of the tools for the nursing work in collective health to register the individual’s collective side. It aimed to formulate the bases for the construction of a re-reading tool of the health-disease process, granting privilege for the collective side, by means of the dialogical relationship among the social categories and the functional varieties that were in the ICNPCH system – Curitiba. The specific goals were: reinterpret the objective reality of the system implantation; describe the process of the implantation in the borough; establish the functional variables of the electronic records and establish the dialogical relationship among the variables and social categories in the health-disease process. The methodology was based on the Practical Nursing Intervention in the Collective Health Theory (Egry,1996) and on the hermeneutic dialectic. The research was approved by the Nursing School Ethics Committee from the University in São Paulo and by the Municipal Health Secretary in Curitiba. The Interpretative categories were: Necessity, Social Class, Gender and Ethnics. The tool proposes an analytic model to support the decision making, allowing the system to show its collective side, at the time of the practice, by linking the data in a database called “data warehouse” . In order to get the collective side, the database must have data from the subcategories: health-disease profile, social class fraction, sex, age and ethnics. The subcategories, when they are associated, make different homogeneous groups in the internal constitution, and heterogeneous according to the vulnerability. Four levels of vulnerability are considered: null, low, average and high, according to the qualification of the eleven indicators that are different according to the localization in distinct vulnerability conditions. There are some indicators that alone are able to localize the high vulnerability level such as: living in a risk area, being unemployed and without income. Other indicators, if they are found together with other conditions, increase the vulnerability level, as being a teenager or Afro-Brazilian. It was concluded that the patient’s electronic record is able to show characteristics of the singular space, so, according to the categories, it captures and reveals the social side and give vulnerability to the homogeneous social groups. Besides having gaps to consider the totality of the social categories, the functional base tools, used by the ICNPCH, in Curitiba, allow the reorganization of data to show the collective side of individuals, families and homogeneous groups. A Theoretical-informative model is shown to this reorganization, comprising the re-reading tool of the individual side, aiming to clarify the collective side in the health-disease processes of the population
