The Concept of'European Citizenship': National Experiences and Post-National Expectations?

The aim of this thesis is to interpret and understand the concept of citizenship in general, and the European citizenship in particular, placed within a broad theoretical framework. Furthermore, the purpose is to examine whether the development of a European citizenship indicates an emergence of a new ‘post-national’ model of citizenship, based on residence rather than nationality or place of birth. In order to address this, the status of third- country nationals (TCN’s), who are legally long-term residents within the Union, in relation to EU citizens has been analysed from the theoretical perspectives. Different models of citizenship provide the paper with a theoretical framework, through which the empirical data has been examined. The theoretical approaches dealt with in this paper are the liberal, the republican/communitarian and the ‘post-national’ models of citizenship respectively. Fundamental ‘key concepts’ have been derived from these different models of citizenship, which have facilitated the analysis by providing the interpretation of the EU citizenship with an analytical framework. To find answers to the initial research questions and fulfil the aim of the paper, a qualitative and hermeneutic study has been carried out, aiming at interpreting and understanding the European citizenship placed within its socio-political context. Text and language constitute the units of analysis and, hence, a textual analysis has been conducted of official EU documents. Following a conceptual history approach, concepts are not just reflections of historical processes, but can themselves contribute to historical change by making new things imaginable. As emphasised throughout the paper, concepts embrace at the same time a ‘space of experience’ and a ‘horizon of expectation’. The main conclusions drawn from the research can be summarised in a number of points. First, while the concept of European citizenship was originally connected to a formal and economic view upon citizenship, close to a liberal/neo-liberal notion of citizenship, the texts express an aim of a more active citizenship, emphasised in the republican/communitarian tradition. Secondly, despite a multicultural and post-national rhetoric concerning the status of long-term resident TCN’s, the gaining of ‘full’ EU citizenship can still only be attained through nationality in a Member State. Thirdly, the importance of interpreting a concept placed within its socio-political context has been clear from the study. The semantic analysis has showed a close link between the European citizenship andthe goal to create an ‘area of freedom, security and justice’ throughout the Union. This goal is interpreted as a response to recent occurrences in the world, but at the same time it expresses expectations about the EU citizenship, and it can thus itself affect future developments in this field. To sum up, while the concept of European citizenship is post-national to the extent that it applies to all EU citizens irrespective of where in the Union they live, it is still not completely based on the principle of residence. Only nationals of an EU Member State can obtain citizenship of the Union. Thus, the concept of European citizenship, while establishing a citizenship across national borders, is still based on nationality.

Moving west: German-speaking immigration to British Columbia, 1945-1961

Germans are among the largest ethnic groups, both in Canada as a whole and in British Columbia. Nevertheless, neither nationally, nor provincially, has this group received much academic attention, especially for the years between the end of the Second World War and the building of the Berlin Wall when about 200,000 German-speaking persons arrived in Canada. Based on the life stories of fifty German immigrants interviewed in British Columbia, published biographies, and archival records from Germany and Canada, this study reconstructs the conditions in interwar and postwar Europe that led to the mass-emigration of Germans in the late 1940s and the 1950s. It argues that this migration movement was not only influenced by government policies and the support of humanitarian organizations, but also by the existence of earlier settlement facilitating chain migrations to Canada. From the port of entry, the dissertation follows the immigrants’ adaptation and integration into Canadian society. Though the vast majority of them did not speak any English, or know much about their adopted country, except that it must be better than what they left in war-torn Europe, Germans are generally ranked among the best integrated ethnic groups in Canada. Yet, despite this assessment, the picture emerging from the sources strongly questions the existence of a singular German immigrant identity in Canada. The distinct self-perceptions of German nationals and ethnic Germans based on their experiences in Europe during the Second World War created striking differences in their patterns of immigration and adaptation to life in Canada which are still discernible after over half a century of settlement in North America.

The policing of undocumented foreign nationals in South Africa

The increasing numbers of undocumented foreign nationals in South Africa not only has affected the provision of services provided by the local municipalities and the Department of Home Affairs but is also a huge challenge to the services provided by the South African police. The aim of this study was to explore the police experiences of dealing with undocumented foreign nationals in South Africa. A literature review was conducted to provide an overview of this problem nationally and internationally. Interviews, observations and document analysis were also considered to explore police experiences of dealing with undocumented foreign nationals. The findings of this study show that the South African police are “caught between a rock and a hard place” when dealing with undocumented foreign nationals within the constitutional framework of this country. They receive little support from the government and the relevant stakeholders on this matter, while on the other hand they are exposed to constant threats and lack of compliance from the undocumented foreign nationals and the criminal syndicates that facilitate illegal cross-border movements and the pressure from advocates of human rights principles and the media. These factors lead to increased frustrations among police officials and self-protective measures such as turning a blind eye to this problem. To deal with the problem the Inclusive and Interactive Refugee Management Model, which focuses on constant interaction among stakeholders, is recommended. Inclusive strategies are also recommended for dealing with undocumented foreign nationals. Abstracts in English, Xhosa and Southern Sotho / This study critically explores the link between internationalisation theories and outward foreign direct investment (FDI) – a linkage which is well documented in the literature. Numerous studies have established that the internationalisation process recognises both firm- and market-specific aspects, which greatly determine the direction of outward FDI in terms of volume and pattern. In this interaction, path dependency is determined by the intensity of overlapping aspects or linkages, from firm-level heterogeneity and host market aspects that direct investment patterns in terms of the latter, to the volumes of firm-level adjustments. Firm-level heterogeneity comprises those traits, which enable an individual firm to make an investment decision, select a market-entry strategy and create the competitive advantages that will sustain its investments. Macro-level or country-specific aspects encompass those traits or characteristics of host markets, which encourage FDI on the part of multinational enterprises (MNEs). Most studies overlook the path dependency of country- and firm-specific aspects, which are crucial to the internationalisation processes of international business, economics and trade. Academic studies either focus on macro- or micro-level aspects, without paying specific attention to the path dependency of expansion strategies. The present study attempts to fill these gaps in the existing body of knowledge, by investigating international business in these contexts. The rationale for undertaking this study was two-fold: first, FDI holds proven benefits for host markets, which include economic growth, industry spillover, human capital development and transitory tacit knowledge. From a firm-level perspective, outward FDI largely enhances the capacity of MNEs, prompting an increase in asset accumulation, market share and human capital development, the more efficient utilisation of resources and return on equity. In this study, an argument is presented for measuring the variables of both firm- and market-specific aspects, since most existing studies in this genre focus either on micro- or macro-level determinants, or totally overlook the importance of linkages. Second, no documented research has investigated the path dependency of expansion strategies, especially in Africa. Crucially, the importance of path dependency of South Africa’s outward investment has not been documented either. Further, existing evidence on the role the path dependency of expansion strategies plays in outward FDI are scarce, with even fewer studies following a sectorial approach. This study attempts to fill these academic research gaps by reflecting both firm- and market-level data from various sources for the period 1995–2015, using panel dynamic regression models. The study found that the linkages between firm heterogeneity (firm-level evidence) and market-level aspects create a path dependency of expansion strategies. MNEs adopt either joint ventures or wholly owned subsidiaries (or both) as market-entry strategies, but the decision is informed by the intensity of those firm heterogeneity aspects that allow them to exploit opportunities and mitigate risk in host markets. Notably, the intensity of path dependency seemingly varies from one industrial segment to the next. The impulse response approach delivered evidence that one standard deviation shock of firm-specific variables led to a moderate improvement in firm-level capacities in the short run, but a significant improvement in the long run. The same result was recorded for market-level aspects, with the intensity of the results varying from one industry to the next. The causality test attempted to explore the causal relationship between the study variables in both firm- and market-level aspects. Empirical evidence from the study indicates that the size of the firm and its capacity to utilise its resources efficiently, influence their investment in host markets. As regards market-specific aspects, the size of the economy, levels of industry and trade openness were found to have a causal effect on the inflow of FDI in host markets. The intensity of causal aspects was also found to vary from one industry to the next, due to variations in firm-level heterogeneity and their linkage in terms of aspects related to the host market. Satisfaction with rehabilitative health care services among German and non-German nationals residing in Germany: a cross-sectional study

Objectives Rehabilitation following medical conditions is largely offered as in-patient service in Germany. Foreign-national residents use rehabilitative services less often than Germans and attain less favourable treatment outcomes. These differences are independent of demographic, socioeconomic and health characteristics. Satisfaction with different aspects of rehabilitative care presumably affects the effectiveness of rehabilitative services. We compared the degree of satisfaction with different domains of the rehabilitative care process between Germans and non-German nationals residing in Germany. Methods We used data from a cross-sectional rehabilitation patient survey annually conducted by the German Statutory Pension Insurance Scheme. The sample comprises 274 513 individuals undergoing medical rehabilitation in 642 hospitals during the years 2007–2011. Participants rated their satisfaction with different domains of rehabilitation on multi-item scales. We dichotomised each scale to low/moderate and high satisfaction. For each domain, a multilevel adjusted logistic regression analysis was conducted to examine differences in the levels of satisfaction between German and non-German nationals. Average marginal effects (AMEs) and 99.5% CI were computed as effect estimates. AMEs represent differences in the probability for the occurrence of the outcome. Results Turkish nationals had a higher probability for being less satisfied with most aspects of their rehabilitation, with AMEs ranging between 0.05 (99.5% CI 0.00 to 0.09) for ‘satisfaction with psychological care’ and 0.11 (99.5% CI 0.08 to 0.14) for ‘satisfaction with treatments during rehabilitation’. Patients from former Yugoslavia and from Portugal/Spain/Italy/Greece were as satisfied as Germans with most aspects of their rehabilitation. Conclusions Turkish nationals are less satisfied with their rehabilitative care than other population groups. This may be attributable to the diversity of the population in terms of its expectations towards rehabilitation. Rehabilitative care institutions need to provide services that are sensitive to the needs of all clients. Diversity management can contribute to this process.

<p>This paper studies the structural issues concerning possible human rights violations found in the Dublin Regulation; An EU regulation aiming to allocate a responsible member state to a third-country-nationals asylum application. It is one of the criticized legal documents within the scholarly field of human rights. Hence, this study aims to study the details of the regulation to find out the elements of the regulation that are prone to human rights violations. Asking the question: What are some details of the Dublin Regulation that could potentially result in human rights violation of the third-country nationals seeking international protection within the territory of member states? Hence, exploring the gap found between the regulation and human rights of the asylum seekers. This was done by a normative legal analysis study of the law, studying the text of the regulation, relevant human rights law, and jurisprudence from two courts of law: ECHR and ECJ. The findings of the study highlights, first, the regulation upholds only the superficial elements of human rights law. Second, the regulation assumes that every member state is a safe country. Third, there is an imbalance of responsibility on either of the two or more member states involved. These are the details of the regulation highlighted in this study that is potentially the result of possible human rights violations and the criticism of the topic. </p>

The goal of this diploma thesis is to define, analyze and evaluate the most relevant areas related to the topic of European migration law and politics. Although the subject is quite broad, I try to focus on legal migration. Free movement of EU citizens could not be left out, however I concentrate mainly on position of migrating three country nationals within the EU. I compare the Czech legal system against the European legal system. The thesis has been divided into four chapters, which are further subdivided. In the first chapter the thesis brings a brief definition of the concept of migration in general, including a chronological historical excursion of the European norms connected to the migration law and a description of migration law, politics and the necessity of a suitable integration approach. The second chapter is devoted to create a characterization of the European migration legislation, competences in the field and a definition of fundamental human rights standards. This section also deals with theoretical and practical issues of European citizenship and the associated right of free movement. Imigrační krize v Řecku 1990-2012 / Immigration Crisis in Greece 1990-2012

The presented thesis deals with current immigration crisis in Greece, which has not been examined in the Czech Republic so far. The macro-level analysis elaborates process of immigration to Greece with emphasis on the period 1990-2012. Causation of the immigration is clarified through historical-demographical, sociopolitical and legislative point of view. Greece was hit by immigration wave due to the process of globalization framework and the crisis is not inflicted exclusively by the Hellenic state. This is demonstrated by the elaboration of the European legislative system and the EU policy towards immigration. Contrary to this, the Hellenic failure regarding management of immigration policy is made of insufficient complexity and flexibility of national legislation and its slow development especially in 1990s. The other specific issue is rise of racism among Hellenes. Roots of xenophobia are examined by the conception of Hellenic nationality and historical-demographical method natural history, through which statistical data are put in the chronological order. Exploring the impact of wellbeing and adjustment at a South African higher education institution

This study explored the lived experiences of foreign academics’ wellbeing and adjustment and the impact thereof on their job performance in a South African higher education (HE) institution. The qualitative interpretive study reviewed the literature on wellbeing, adjustment and job performance. It explored the impact of wellbeing and adjustment factors on performance, both personally and professionally. The job demands-resources (JD-R) model was applied in the study to demonstrate that when job resources are high, employee wellbeing, adjustment and job performance is enhanced. Purposive sampling was used to draw a sample of five foreign academics who were employed at the HE institution for more than one year and originated from different countries. Online video calling was used to gather data from the participants using semi-structured interviews. Content analysis was used to create themes and sub-themes from which the study findings were derived and conclusions, as well as recommendations, were made. The study revealed that the wellbeing and adjustment of foreign academics have a significant impact on their job performance. Recommendations were made to the HR managers, I/O psychologists, foreign academics as well as line managers on how to improve the wellbeing and adjustment of foreign academics at the HE institution. / Industrial and Organisational Psychology / M. The researcher conducted an in-depth analysis of the criminality and criminal behaviour of selected sample-specific, African, adult male Mozambican and Zimbabwean foreign offenders, incarcerated at South Africa’s Losperfontein Correctional Centre. The needs and risks of foreign offenders were found to differ from those of South African offenders significantly.
