Orientador: Artur Marques da Silva Filho / Banca: Euclides Celso Berardo / Banca: Luiz Antonio Soares Hentz / Resumo: A partir do panorama geral dos chamados direitos fundamentais, o presente trabalho busca, com particular enfoque no princípio que estabelece o direito a processo em tempo razoável, examinar a possibilidade do uso da ação monitória como instrumento eficiente de coerção jurisdicional da Fazenda Pública a mais célere adimplemento de certas obrigações, representadas em documento desprovido de força executiva. Considera, inicialmente, que a garantia de integral observância dos preceitos constitucionais correspondentes àqueles, voltados à construção de uma ordem jurídica justa, constitui razão essencial do moderno Estado Democrático de Direito, cuja concepção importa em admitir, muitas vezes, o uso de mecanismos de defesa das pessoas contra a força do próprio aparelho estatal. Analisa, nesse quadro, a importância de assegurar efetivo acesso de todos à Justiça, bem como discorre sobre o papel exercido pela jurisdição e sobre a necessidade de haver um sistema processual eficaz à concreta realização de direitos. Refere o esforço mais atual de legisladores, administradores públicos e operadores jurídicos, no Brasil, para o desenvolvimento de meios eficazes à solução de litígios, notadamente no âmbito do processo judicial, mediante inovações diversas, incluída previsão de tutelas jurisdicionais diferenciadas, entre as quais se inscreve aquela propiciada pela ação de conteúdo monitório, introduzida em data relativamente recente na legislação brasileira. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: From an analysis of the fundamental rights, especially the right to a lawsuit within a reasonable length of time, this study aims to examine the use of the admonition action as an efficient instrument to compel the Public Treasury to carry out Court orders. The work ponders that the complete observance of the constitutional rules related to essential rights constitutes the main cause of the Democratic Constitutional State, whose conception sometimes involves the use of people's defense mechanisms against the State itself. In this sense the study analyzes the importance to assecure everyone's access to Justice and examines the necessity of a process system that guarantees concrete rights. It also mentions the present effort of the Parliament, the Government and the jurists in Brazil to develop effective ways to solve conflicts, especially in the lawsuit ambit. This objective is achieved by several innovations as differentiated jurisdictional tutelages such as the admonition action, which has recently been introduced in the Brazilian legislation. After insisting on the instrumental aspect of the process system, which must reach social pacification and constitutional aims, the work points out the admonition action characteristics and evaluates its possibility to fulfill certain credits within a reasonable period of time. Finally the study reflects on the peculiarities of the credits opposed to the Public Treasury and ponders the viability of the admonition action use against public entities, considering their process prerogatives and the public interest. / Mestre

El desarrollo doctrinal y jurisprudencial comparado de esta categoría es amplísimo. En el Perú, la doctrina nacional la ha estudiado apartir de casos concretos jurisprudenciales. A presente dissertação tem como objeto o estudo das obrigações propter rem e figuras correlatas. Os grandes civilistas dedicaram-se ao tema que será desenvolvido neste trabalho; o assunto não é inédito, muito ao contrário. Contudo, vários pontos permanecem controversos, até mesmo quanto à própria definição e alcance da noção de obrigação real. A importância da matéria não se resume a uma discussão acadêmica, meramente abstrata. Em realidade, o instituto é extremamente recorrente na doutrina e jurisprudência. Ocorre que, considerada a confusão conceitual que caracteriza essa espécie de obrigação, verifica-se que o instituto serve de fundamento a diversas decisões, muitas delas sem precisão técnica necessária. Decerto, criam-se vínculos e deveres sem que exista uma lei específica nesse sentido, sob o simples argumento de que se trata de uma obrigação propter rem. Não bastasse, são atribuídos determinados efeitos a essas obrigações, os quais não são necessariamente essenciais ao instituto. Nesse contexto, consideramos que uma releitura do conceito de obrigação real é oportuna e pode contribuir para um tratamento mais adequado de uma série de questões. / This dissertation discusses the propter rem obligations and related legal aspects. The propter rem obligations are not a new topic and it was studied by all main civil law scholars. However, there are a many unsolved matters related to such obligations, including its exact definition and extension. The relevance of propter rem obligations is not limited to an academic debate; in fact it is a recurring matter by commentators and court precedents. Due to the conceptual misunderstanding as to the correct definition of propter rem obligations, this concept has been mistakenly used in several court decisions. Courts are creating legal obligations without proper legislation, based solely on the argument that such obligations are based on the propter rem principles, including the attribution of supposed legal effects not related to these obligations. In this context, we believe it is important to revisit the concept of the propter rem obligations to promote a better understanding of several issues.

The purpose of this essay has been to compare different constitutions, and their outlook on citizenship, rights, obligations and natural duty. This has been done in the light of the political philosophy, in order to give the answer to four questions. These questions are: Which rights and obligations can be seen in the constitutions, and how can it be interpreted. Can there be signs of any political philosophy in the constitutions? Are there any differences between the constitutions regarding citizenship, rights, obligations and natural duty? If so, what are the differences? Can the rights be seen in a further extent than the obligations in the constitutions? I have conducted a qualitative comparision study and analyzed the political philosophers and made a classification scheme of their views. Further I made a comparison between the constitutions of the countries, and their view on citizenship, rights, obligations and natural duty. This was later inflicted in to the classification scheme, to see if the countries could fit in to the political philosophers views, and also to find out if there would be any differences in values between the countries constitutions. To bind together the outlook on citizenship, rights, obligations and natural duty between the citizen and the state, I have used a social contract theory, to get better understanding regarding the relationship between the legal system and the citizen. My conclusions of this essay is that the political philosophers views of citizenship, rights, obligations and natural duty was sometimes similar, but the differences were clear in the light of the classification scheme. The countries constitutions were also similar, but I found that the constitutions could fit in different places in the classification scheme, giving the result that citizenship and rights, were important in all of the constitutions, but obligations and natural duty was not.

Evidence itself occupies an important position in the civil procedure because it is a prerequisite for issuing a correct and fair court decision. The aim of this paper is to deal with the institutes of evidence procedure that lead the subjects of civil contentious proceedings for certain procedural activity in order to determine the facts and issue a decision in the case. The thesis is divided into six chapters, the first chapter includes an introduction and the last, sixth chapter includes the conclusion. The second chapter deals with basic questions of evidence in civil proceedings and is subdivided into four parts. The thesis focuses on the transfer of rights and obligations arising from employment relations. This legal institute is primarily aimed at the protection of employees during the transfer of undertakings, which can negatively affect their employment relations. The matter is regulated under the Transfers of Undertaking Directive 2001/23/EC. In addition, it is regulated under Czech law, mostly by articles 338-342 of the Czech Labour Code No. 262/2006 Coll. The thesis involves critical assessment of the EU and Czech regulation of the issue including relevant case law of the Supreme Court of the Czech Republic and the Court of Justice of the European Union(CJEU). Furthermore, it aspires to identify the possible problems arising from the current regulation and aims to find their possible solutions. Magister Legum - LLM / This paper analyses head of state immunity, a traditional rule of international law, in relation to the indictments by the International Criminal Court (ICC) in 2009 against the current Sudanese President Omar Hassan Ahmad Al Bashir. It can be agreed that the doctrine of immunity in international law attempts to overcome the tension between the protection of human rights and the demands of state sovereignty. The statutes and decisions of international criminal courts make it clear that no immunity for international crimes shall be attached to heads of states or to senior government officials. However, the case against the Sudanese President, where the jurisdiction of the ICC was triggered by the UN Security Council‟s referral of the situation in Darfur to the Court, represents the first case where a serving head of state has, in fact, been indicted before the ICC. From this case, a number of legal issues have arisen; such as the questions where the ICC‟s jurisdiction over an incumbent head of state, not party to the ICC Statute, is justified, and the obligations upon ICC state parties to surrender such a head of state to the requesting international criminal court.
