Acordos incentivados: uma contribuição britânica nos caminhos buscados pelo Judiciário brasileiro / Incentives to settlements: a British contribution in the paths sought by the Brazilian judiciary

O presente trabalho propôs-se a investigar a conveniência e a possibilidade de introdução, no ordenamento brasileiro, de iniciativas à semelhança dos pre-action protocols (Protocolos) e da Part 36 Offer (Oferta) do direito inglês, em vigor desde o advento das Civil Procedure Rules, em 1999. Aqueles, uma espécie de procedimento que se desenrola antes do processo judicial, incentivando o diálogo e a troca de informações e produção de prova entre as partes, cujo descumprimento importaria a incidência de multa; esta, uma oferta de acordo cuja rejeição ou aceitação traria consigo conseqüências patrimoniais às partes envolvidas na controvérsia, também representada pela aplicação de uma (outra) multa. Embora não indissociáveis, acredita-se que, juntos, potencializam-se mutuamente. Observaram-se os efeitos práticos da experiência inglesa, contemplando seus pontos fortes e fracos, chegando-se a um balanço positivo. Justificados os méritos dos institutos, entendeu-se possível a implantação de sistemática semelhante no Brasil, feitos certos ajustes. Observou-se, ainda, que um dos grandes méritos dos protocolos é a promoção do acordo informado, não do acordo motivado principalmente pela ineficiência e pela demora na prestação jurisdicional. Assim, propôs-se a elaboração de protocolos, preferindo-se os específicos ao genérico, incutindo na população e nos operadores do direito a cultura do diálogo e da cooperação na troca de informações. Observaram-se, ainda, os efeitos que a conduta das partes no desenrolar do protocolo geraria dentro do processo. Propôs-se, ainda, a introdução do que se chamaria de OPAc Oferta Potencializada de Acordo, à semelhança da Oferta inglesa, mas com conseqüências patrimoniais (multa) calculadas sobre a diferença apurada entre a OPAc e a condenação final, no processo, como forma de criar incentivos suficientes, mas não opressivos. / This paper seeks to investigate the desirability and the possibility of introducing, in the Brazilian law, initiatives such as the pre-action protocols (\"Protocols\") and Part 36 Offer (\"Offer\") of the English law, in force since the advent of the Civil Procedure Rules in 1999. The former, a kind of procedure that takes place before the judicial proceedings, encouraging the dialogue, the exchange of information and the disclosure of evidence between the parties, and which failure results in the application of a fine; the latter, a settlement offer which rejection or acceptance would entail financial consequences to the parties to the dispute, also represented by the application of a (another) fine. Although not inseparable, it is believed that, taken together, Protocols and Offer enhance each others effects. The analysis of the practical results of the British experience, considering its strengths and weaknesses, led to a positive balance. Once the merits of those mechanisms have been justified, the implementation in Brazil of a similar systematic provided certain adjustments are undertaken was considered possible. It was also observed that one of the great values of the Protocols is promoting well-informed agreements, instead of settlements mainly motivated by the inefficiency and delay of adjudication. Thus, the drafting of protocols was proposed, preferably the specific over the generic ones, introducing to the people as well as to the legal community a culture of dialogue and cooperation in the exchange of information and evidence. The effects that the conduct of the parties while following the Protocol would generate in the judicial proceedings were also analyzed. Moreover, we proposed the introduction of the so-called OPAc - Oferta Potencializada de Acordo (Enhanced Settlement Offer) - similar, in its concept, to the British Offer, albeit bearing financial consequences (fines) calculated over the difference between the OPAc and the amount as per the decision handed down by the judge, in order to create sufficient - but not oppressive - incentives.

Web 2.0 tools integration in Online Public AccessCatalogue (OPAC) : users desires and motivation

This research aimed to investigate the desires of the users of the Greek public Library on Gender and Equality (LGE) about a future Online Public Access Catalogue (OPAC) containing Web2.0 functionalities. The concepts of participation, information pluralism and community building in relation with Web 2.0 tools in libraries’ catalogues were introduced under the theoretical approach provided by Social Critical Theory of Jürgen Habermas. Aqualitative research based on semi-structured interviews with users of the LGE wasconducted and the collected data that were analysed with the thematic analysis method,revealed positive users’ impressions regarding the introduction of Web 2.0 tools in theLGE’s OPAC. The research also disclosed users’ desires and suggestions regarding specific Web 2.0 features and their common motivation to participate and contribute to be the opportunity of communicating with like-minded people.

Advancing an Academic Library's services through application of Soft Systems Methodology

The Master thesis focuses on the application of Information Systems in the field of Library and Information Science.  Within the context of organizational learning, a collaborative user-centered approach is used to produce desired system characteristics and future research suggestions. More specifically, this research study explores the library users’ and academic librarians’ perceptions of the current library discovery and access services as mediated through the Online Public Access Catalogue (OPAC) of the Academic Library of the School of Philosophy at Athens University in Greece. Additionally, it explores their desired characteristics for the ‘public facing’ Integrated Library System (ILS), of which the OPAC constitutes a module, in order to generate recommendations that guide the Academic Library staff members’ collaborative design of a more user-centered library information system. The study is built upon the systems thinking framework of Checkland’s Soft Systems Methodology (SSM). Applied theories and design processes guide research processes aimed at advancing both inclusive social learning and system improvements.

A Method to Derive an Aerosol Composition from Downward Solar Spectral Fluxes at the Surface

Aerosol properties are highly variable in space and time which makes the aerosol study more complex. The sources and production mechanism of aerosols decide the properties of the aerosols. Aerosol radiative forcing is defined as the perturbation to the radiative fluxes of the earth atmosphere system caused by the aerosols. High uncertainty in the aerosol radiative forcing values exists today due to the lack of the exact chemical composition data of the aerosols everywhere. There are previous studies which have introduced methods to estimate ‘optical equivalent’ composition of aerosols using spectral aerosol optical depth measurements at the surface. The impact of aerosols on the solar radiative flux depends on its size distribution and composition. Hence, measurements of downward solar spectral fluxes at the surface can be used to infer ‘optically equivalent’ composition of aerosols. Measurements of downward solar spectral flux at Bangalore were made on clear days using a spectroradiometer. This data has been used to infer the aerosol composition following an iterative method with the help of the Santa Barbara DISORT Atmospheric Radiative Transfer (SBDART). Aerosols have been classified as water soluble, black carbon and three types of dust. Influence of the different aerosol types on spectral down welling irradiance at the surface have been simulated using Optical Properties of Aerosols and Clouds (OPAC) and SBDART models. The strong spectral dependence influence of water soluble aerosols and the dust aerosols on the spectral irradiance is shown. Aerosol composition was inferred following least square error minimization principle. This method can be used to estimate near-surface aerosol concentration if the vertical profile of aerosols is known a priori. This method also enables derivation of spectral single scattering albedo. The aerosol spectral radiative forcing has been estimated using downward spectral flux at the surface and compared with modeled fluxes. The contribution to the total forcing by the wavelength band 360 – 528 nm is around 60% of the total forcing. The wavelength band of 453-518 nm contributes maximum to the total forcing and it is seen that the shape of the spectral forcing is a major function of shape of the incoming solar spectrum. Aerosol spectral radiative forcing from observations of radiative fluxes agreed with modeled values when derived aerosol chemical composition was used as input. This study demonstrates that spectral flux measurements at the surface are useful to infer aerosol composition (which is optically equivalent) when and where the conventional chemical analysis is unavailable.

Library automation as a prerequisite for 21st century library service provision for Lesotho library consortium libraries

Library automation is approaching its 90th birthday (deduced from Pace, 2009:1), and many librarians no longer remember the inefficiencies of the manual systems that were previously in place. For some, however, automation has not gone nearly far enough. In this second decade of the new millennium some libraries in Lesotho face multiple challenges in automating their services while libraries internationally are staying relevant by rapidly adapting their services to address the needs and demands of the clients. It was anticipated that full library automation is a prerequisite for delivering 21st-century library services and the researcher embarked on a process to establish whether libraries belonging to the Lesotho Library Consortium (LELICO) have automated to the extent where they will be able to provide the services that are currently in demand. The purpose of this study was to analysewhether full library automation is indeed a prerequisite for libraries to offer the services required in the current millennium. The study focused on LELICO member libraries. Benchmarking was done with selected South African academic libraries. Data were collected by means of interviews with all respondents, namely, LELICO member libraries, librarians from South African libraries and with international system vendors operating from South Africa. The study found that LELICO member libraries are indeed lagging behindin terms of service provision. LELICO member libraries do not appear to understand; which library services are possible when state-of-the-art technology is fully implemented. The study found furthermore that the laggard status is caused by factors such as a lack of funding, too few professional staff and ineffective support from management. These and other findings helped formulate recommendations that would underpin a renewal strategy for LELICO. The proposed recommendations include that LELICO should deliver a more meaningful service to its current members. LELICO member libraries should be using technology more effectively in their operations and good relationship between a system vendor and its clients should be seen as an asset that should be maintained.LELICO should be playing a key role in making change a reality. / Information Science / M.A. (Information Science)
