The impact and constitutionality of delayed trials on the rights of a suspect or accused person during criminal proceedings

The Constitution of the Republic of South Africa guarantees every person a fair trial; the right to a fair trial right trial must begin and conclude within a reasonable time and without undue delay. Internationally the same guarantees and protections are available to unconvicted suspects. However, the South African criminal justice system lacks behind internationally and falls short of promoting these guarantees. Investigation was done on delays in commencing and finalising trials in light of constitutional provisions, the consequence and the impact of the delay with discussion on prison conditions and overcrowding with reference to the Constitutiton, legislation and case law. Delayed trial, prison overcrowding and poor prison conditions are still an issue in South Africa and there needs to be positive change to enforce and practice prescribed directives. Summaries in English and Afrikaans / In the following theoretical study the phenomenon of boot camps is described within a penological perspective, as it has originated and developed and is applied in the United States of America. The primary aim of this study is to obtain the Magister Artium degree. Secondly, it sheds light on an alternative method of dispensation of offenders, more specific juvenile offenders, in the criminal justice system. The investigation is intended to make a modest contribution to the content of penology. Knowledge and insight obtained can serve as guidelines for future research in respect of and application of boot camps in South Africa. The planning and functioning of boot camps is taken into account and the rationale behind boot camps as an effective institution of punishment is investigated. This was done against the background of the elements of punishment, over-population of prisons, cost-effectiveness, residivism and rehabilitation. The study is of importance for South African circumstances, because of the increasingly over-population of prisons and the negative effect of imprisonment, especially on juveniles. / In die hieropvolgende teoretiese studie word die verskynsel van boot camps soos wat dit in die Verenigde State van Amerika ontstaan en ontwikkel het en toegepas word, binne 'n penologiese perspektief beskryf. Die beskrywing het in die eerste plek ten doel om die graad Magister Artium te verwerf. Ten tweede werp dit Jig op 'n alternatiewe beskikkingsmetode vir oortreders, veral jeugoortreders, in die regsplegingstelsel. Die doel van die ondersoek is om 'n beskeie bydrae tot die vakinhoud van die penologie te lewer. Kennis en insig wat ingesamel is kan as rigtingwyser dien virtoekomstige navorsing met betrekking tot en toepassing van boot camps in Suid-Afrika. Die beplanning en funksionering van boot camps word in oenskou geneem en die rasionaal van boot camps as 'n effektiewe strafinrigting is ondersoek. Dit is gedoen teen die agtergrond van die elemente van straf, gevangenisoorbevolking, koste-effektiwiteit, residivisme en rehabilitasie. Dans la gestion des systèmes de soins, la maîtrise des flux hospitaliers et l’anticipation des tensions sont des enjeux majeurs. Le but de cette thèse est de contribuer à l’étude et au développement d’un Système Collaboratif d’Aide à l’Ordonnancement et à l’Orchestration (SysCAOO) des tâches de soins à compétences multiples pour gérer les tensions dans les Services d’Urgences Pédiatriques (SUP) afin d’améliorer la qualité de prise en charge des patients. Le SysCAOO intègre une approche Workflow collaboratif pour modéliser le parcours patient afin d’identifier les dysfonctionnements et les pics d’activités du personnel médical dans le SUP. L’aspect dynamique et incertain du problème nous a conduits à adopter une alliance entre les Systèmes Multi-Agent (SMA) et les Algorithmes Evolutionnaires (AE) pour le traitement et l’ordonnancement des tâches de soins en tenant compte du niveau d’expérience des acteurs du SUP et leurs disponibilités. En cas d’aléas dans le SUP, une coalition d’agents se forme pour collaborer et négocier afin de proposer des décisions d’orchestration du Workflow et minimiser le temps d’attente des patients en cours de leur prise en charge. Les résultats expérimentaux présentés dans cette thèse justifient l’intérêt de l’alliance entre les SMA et les Métaheuristiques afin de gérer les tensions dans le SUP. Les travaux de recherche présentés dans cette thèse s’intègrent dans le cadre du projet HOST (Hôpital : Optimisation, Simulation et évitement des tensions) (http://www.agence-nationale-recherche.fr/?Projet=ANR-11-TECS-0010). / Health care systems management and the avoidance of overcrowding phenomena are major issues. The aim of this thesis is to implement a Collaborative Support System for Scheduling and Orchestration (CSSystSO) of multi-skill health care tasks in order to avoid areas bottlenecks in the Pediatric Emergency Department (PED) and improve health care quality for patients. The CSSystSO integrates a collaborative Workflow approach to model patient journey in order to identify dysfunctions and peaks of activities of medical staff in the PED. The dynamic and uncertain aspect of the problem has led us to adopt an alliance between Multi-Agent Systems (MAS) and Evolutionary Algorithms (EA) for health care tasks treatment and scheduling taking into account the level of experience of the PED actors and their availabilities. In case of perturbations in the PED, a coalition of agents is formed to collaborate and negotiate in order to provide orchestration Workflow decisions to minimize the waiting time of patients during their treatment. The experimental results presented in this thesis justify the interest of the alliance between MAS and Metaheuristics to manage overcrowding phenomena in the PED. La tesi si occupa del concetto di “riflessione critica” dell’autore di reato sull’illecito commesso. Secondo l’art. 27 d.P.R. 30 giugno 2000, n. 230, essa consiste in una riflessione dialogica concernente le condotte antigiuridiche e colpevoli, le correlate motivazioni, le conseguenze che discendono per l’autore medesimo e le possibili azioni di riparazione attuabili nella fase di esecuzione. La ricerca si sviluppa in cinque momenti: il primo capitolo focalizza l’attenzione sullo studio di un fondamento costituzionale del concetto di “riflessione critica”, anche al fine di una rinnovata lettura del finalismo rieducativo; il secondo capitolo mette in luce i punti di intersezione tra “riflessione critica” sull’illecito commesso e “teoria generale del reato”; il capitolo successivo offre una panoramica degli ostacoli e dei problemi operativi che impediscono la piena predisposizione di un modello responsabilizzante e che sollecitano ipotesi di riforma del sistema penale e penitenziario; nel quarto capitolo ci si sofferma sull’approfondimento delle premesse di un modello dialogico e riparativo di giustizia; quindi, il capitolo conclusivo si dedica a un’esplorazione dei confini e delle congruenze dei concetti di “rehabilitation” e “restorative justice”, per muovere oltre verso la considerazione di un modello di giustizia ispirato all’idea di “responsività” [John Braithwaite] e di “restorative justice dialogue” [Mark S. In sostanza, lo studio mira a proporre un modello che faciliti, in modo dialogico e inclusivo, forme di responsabilità attiva nel settore penale. / The dissertation examines how offenders deal with “critical rethinking” on their crimes. According to art. 27 d.P.R. 30 June 2000, n. 230, it consists in a dialogical reflection on the wrongdoings they committed, their motivations, the consequences that follow on for the offenders themselves, and the possible reparations during the post-sentencing phase. The study is divided into five chapters. The first chapter focuses on the research for a constitutional basis of the “critical rethinking” and for a renewed understanding of the “finalismo rieducativo” (equivalent to the rehabilitative goal). The second chapter highlights the points of intersection between the “critical rethinking” and the “general theory of crime”. The third chapter summarizes the obstacles and the operative problems that hamper the implementation of this dialogical reflection and describes hints for a possible reform of the criminal justice system, particularly with regard to the post-sentencing phase. The fourth chapter proposes an in-depth analysis of some of the basic key-concepts for the introduction of a dialogical-restorative model of justice. Finally, the fifth chapter investigates the relationship between “rehabilitation” and “restorative justice” and takes into consideration a justice model that is inspired by “responsivity” [John Braithwaite] and “restorative justice dialogue” [Mark S. Umbreit]. By means of that, the study aims at providing a framework for an active assumption of responsibility in a more dialogical and inclusive culture.

Utilización de los mapas conceptuales como herramienta evaluadora del aprendizaje significativo del alumno universitario en ciencias con independencia de su conocimiento de la metodología

L'avaluació del coneixement dels alumnes universitaris en condicions de massificació té dos requisits: mesurar realment el que l'alumne sap, i fer-ho amb una eina que permeti una correcció ràpida. Els instruments que són capaços de recollir l'aprenentatge significatiu (entrevista personal, examen oral, carpetes de treballs,.) requereixen molta dedicació. Els que tenen una correcció ràpida utilitzant medis informàtics (proves objectives), no mesuren exactament el que l'alumne ha après de forma significativa. En aquest entorn, els mapes conceptuals, en ser una representació de l'estructura cognitiva de l'alumne, han demostrat la seva validesa i fiabilitat per a mesurar el que l'alumne sap. Tot i així, la seva aplicació en l'entorn universitari massificat no assoleix els dos requisits esmentats, amb la dificultat afegida de la necessitat de que l'alumne conegui la metodologia de creació de mapes. Aquest treball proposa una metodologia de creació de mapes, adaptada a profans, que permeti la creació d'un mapa lliure independentment del coneixement de la tècnica que tingui l'alumne. Aquests mapes es valoren de forma Holística (considerant la informació presentada sense parar atenció als detalls). Amb 16 alumnes de Biomecànica de segon curs de Fisioteràpia, es realitzen tres intervencions separades por 21 i 135 dies, en les que es pregunta sobre dos temes de coneixements específics de la assignatura i dos de coneixements generales (on es considera resident aquest coneixement). La persistència de las notes Holístiques entre las intervencions indica la validesa i fiabilitat de la metodologia i la seva puntuació. Alternativament, a partir de les dades de la Nota Holística, es calcula una Nota Pronosticada com una combinació lineal de dos paràmetres del mapa (enllaços vàlids i valoració de la jerarquia). D'aquesta expressió s'infereix per lògica una fórmula simplificada similar: la Nota Simplificada, que s'independitza de les dades de l'estudi i li confereix objectivitat. Ambdues notes (Pronosticada i Simplificada) presenten una persistència entre intervencions que dóna validesa i fiabilitat a les mateixes per a mesurar l'aprenentatge significatiu. L'elevada concordança, en condicions altament restrictives, i la correlació altament significativa d'aquestes notes amb la Holística permet la seva substitució. Resulta un instrument d'avaluació del aprenentatge significatiu de l'alumne, independentment del seu nivell de coneixement del mapes, que permet una valoració ràpida i objectiva aplicable a un entorn massificat. / La evaluación del conocimiento de los alumnos universitarios en condiciones de masificación tiene dos requisitos: medir realmente lo que el alumno sabe, y hacerlo con una herramienta que permita una corrección rápida. Los instrumentos que son capaces de recoger el aprendizaje significativo (entrevista personal, examen oral, carpetas de trabajos,.) requieren mucha dedicación. Los que tienen una corrección rápida utilizando medios informáticos (pruebas objetivas), no miden exactamente lo que el alumno ha aprendido de forma significativa. En este entorno, los mapas conceptuales, al ser una representación de la estructura cognitiva del alumno, han demostrado su validez y fiabilidad para medir lo que el alumno sabe. No obstante, su aplicación en el entorno universitario masificado no cumple los dos requisitos mencionados, con la dificultad añadida de la necesidad de que el alumno conozca la metodología de creación de mapas. Este trabajo propone una metodología de creación de mapas, adaptada a profanos, que permite la creación de un mapa libre independientemente del conocimiento de la técnica que tenga el alumno. Estos mapas se valoran de forma Holística (valorando la información presentada sin atender a los detalles). Con 16 alumnos de Biomecánica de segundo curso de Fisioterapia, se realizan tres intervenciones separadas por 21 y 135 días, en las que se pregunta sobre dos temas de conocimientos específicos de la asignatura y dos de conocimientos generales (cuyo conocimiento se considera residente). La persistencia de las notas Holísticas entre las intervenciones indica la validez y fiabilidad de la metodología y su puntuación. Alternativamente, a partir de los datos de la Nota Holística, se computa una Nota Pronosticada como una combinación lineal de dos parámetros del mapa (enlaces válidos y valoración de la jerarquía). De esta expresión se infiere por lógica una fórmula simplificada similar: la Nota Simplificada que se independiza de los datos del estudio y le confiere objetividad. Tanto la Nota Pronosticada como la Simplificada presentan una persistencia entre intervenciones que da validez y fiabilidad a las mismas para medir el aprendizaje significativo. La alta concordancia, en condiciones altamente restrictivas, y la correlación altamente significativa de estas notas con la Holística permite su sustitución. Resulta un instrumento de evaluación del aprendizaje significativo del alumno, independiente de su nivel de conocimiento de los mapas, que permite una valoración rápida y objetiva aplicable a un entorno masificado. / The assessment of the knowledge of university students in overcrowding conditions has two requirements: really evaluate what students know, and do so with a tool that allows fast correction. The instruments that are able of assess meaningful learning (personal interview, oral examination, job folders, ...) require a lot of dedication. Those with a computer based rapid correction (multiple choice tests), do not evaluate exactly what the student has learned in a meaningful way. In this environment, concept maps, to be a representation of the student's cognitive structure, have demonstrated its validity and reliability to assess what students know. However, its application in the crowded university environment does not meet the above two requirements, with the added difficulty of the need for the student to know the methodology involved in creating maps. This paper proposes a methodology for creating maps, aimed at those without prior knowledge, which allows the creation of a free map regardless of the knowledge of the technique that the student has. These maps are valued by Holistic marks (evaluating the whole information presented without regard to details). Sixteen students in Biomechanics in the second year of Physiotherapy attended this study. Three academic proceedings, at intervals of 21 and then 135 days, asked volunteers about two topics of special knowledge of the subject and two of general knowledge (the former considered as resident). The persistence of Holistic marks between interventions indicates the validity and reliability of the methodology and its punctuation. Alternatively, from the data of the Holistic Mark, a predicted one is computed as a linear combination of two parameters of the map (valid links and assessment of the hierarchy). From this expression, a simplified formula is inferred by logical process. This Simplified Mark becomes independent of survey data and gives it objectivity. Both the Predicted and the Simplified Marks show persistence between proceedings that give validity and reliability to the assessment of meaningful learning. The high agreement, in highly restrictive conditions, and the highly significant correlation of these marks with Holistic ones allows its replacement. It becomes a tool to assess meaningful learning of students, regardless of their level of knowledge of concept maps, which allows a speedy and objective assessment applicable to a crowded environment.

När är gränsen nådd? : En kvalitativ studie om Barcelona

Syfte: Mot bakgrund kring en ökad turism i europeiska storstäder (Statista, u.å.) har syftet med studien varit att studera Barcelona som exempel för att bidra med en djupare förståelse kring hur turister och lokalbefolkning uppfattar varandra i stadsmiljöer med högt turistantal. Samt undersöka hur turismen har förändrat stadens stadskärna och miljö (Duran, 2005). Metod: I studien har ett kvalitativt tillvägagångssätt applicerats i form av semistrukturerade intervjuer och insamling av vetenskapliga artiklar till empirin. Tolv personer som har intervjuats som har koppling till Barcelona och det sammanfattas i empirin, tillsammans med de vetenskapliga artiklarna. Slutsatser: Den här studie har undersökt Barcelona som exempel för att belysa massturism som är ett omfattande problem som även går att finna i andra europeiska storstäder. Genom de insamlade intervjuerna och de vetenskapliga artiklar påvisades det att Barcelona har fått både positiva och negativa effekter av den massiva turism som finns i staden. Utifrån de insamlade intervjusvaren kunde slutsatsen dras att den sociala aspekten har störst negativ inverkan på lokalbefolkningen i staden. / Purpose: Against the background of increased tourism in European metropolitan areas (Statista, u.o.), the purpose of the study has been to study Barcelona as an example to contribute a deeper understanding of how tourists and locals perceive each other in urban environments with a high tourist number. As well as investigating how tourism has changed the city's city center and environment (Duran, 2005). Methodology: In this study, a qualitative approach has been applied in the form of semi-structured interviews and the gathering of scientific articles of empirical data. Twelve people interviewed who are connected to Barcelona and this is summarized in empirical section, along with the scientific articles. Conclusions: This study has explored Barcelona as an example to illustrate mass tourism, which is a major problem that can be found in other European cities. Through the collected interviews and the scientific articles, it was demonstrated that Barcelona has had both positive and negative effects of the massive tourism that exists in the city. Based on the collected interview answers, it could be concluded that the social aspect has the most negative impact on local people in the city.

Low-cost housing in Witzenberg local municipality

ABSTRACT The purpose of the study is to evaluate the housing process of Witzenberg Local Municipality and determine the involvement of the community and their perception regarding the whole process. The researcher is using a qualitative method to obtain the views, perspectives and feelings of the participants. For the purpose of the study is data collection limited to the sample population of people on the waiting list and those already in possession of low-cost house of the seven townships in the Witzenberg Local Municipality to. The researcher made use of questionnaires and interviews to collect data to make a profound finding and recommendation. In Witzenberg, 41% of households earn less than R30000 per annum (Witzenberg Local Municipality 2012: Online) which indicate that the Witzenberg Local Municipality has a high need for subsidized housing. The waiting list for low-cost housing in the Witzenberg Local Municipality currently stands at 6278 of which 1478 are a blocked housing project and a backlog of 4800 houses. The inhabitants of the Municipality received low-cost housing 8 years ago (Witzenberg Local Municipality 2012: Online). Witzenberg Local Municipality does has a housing problem, which stems from finance, affordability, insufficient land to erect housing projects, overcrowding, and quality of housing, staff shortage, unemployment, uncontrolled farm evictions and community involvement (Witzenberg Local Municipality 2007a:Online). Low-cost housing is in demand to address the challenges. Farm evictions, influx into the Witzenberg Local Municipality and forming of informal dwellings and increasing of squatter camps hold a serious threat to build sustainable, quality low-cost housing in the Witzenberg Local Municipality and with limit staff is in-flux control very hard to manage. Although the homeowners of the Witzenberg Local Municipality are happy to have received houses, they expressed much concern about the poor construction work, overall quality of the materials used as well as the housing process adopted by the Witzenberg Local Municipality. / Public Administration / M. Social control in the 20th century and its impact on households: A case study of disarticulation from Sophiatown to Meadowlands, Soweto

In South Africa, racial discrimination was witnessed through renowned segregationist acts including the Group Areas Act (No:41) of 1950, which forcibly displaced families from their homes and triggered significant social upheavals and the callous disintegration of long-established communities such as Sophiatown. The removals were a political strategy to relocate so-called “non-white” people from the inner city to townships such as Meadowlands explicitly chosen for their hazardous impure land known as mine dumps (Rodgers 1980:76). These displacements had a paradox of intergenerational homelessness triggered by instrumental racism that influenced politics of space and in effect, the disarticulation of the lives of black South Africans (Milgroom and Ribotc 2019:184). Therefore, it is important to undertake a study investigating the circumstances that gave rise to these forced removals, the subsequent breakdown of social order, a typical consequence of population relocation, which merits an examination of the contemporary implications and ramifications of disarticulation and highlights, in this regard, some significant shortcomings in post-Apartheid governance. / Anthropology and Archaeology / M.A. (Anthropology)

Le service des urgences est un important service de soins qui représente le goulot d'étranglement de l'hôpital. Les urgences sont souvent confrontées à des problèmes de tension dans de nombreux pays à travers le monde. L'une des causes de la tension dans les urgences est l'interférence permanente entre trois types de patients : les patients déjà programmés, les patients non programmés et les patients non programmés urgents. Le but de cette thèse est de contribuer à l'étude et au développement d'un système d’aide à la décision pour améliorer la prise en charge des patients aussi bien en mode de fonctionnement normal qu’en mode tension. Deux principaux processus ont été développé. Un processus d’ordonnancement à horizon glissant en utilisant un algorithme mimétique avec l’intégration des opérateurs génétiques contrôlés pour déterminer un calendrier optimal de passage des patients. Le deuxième processus d’orchestration dynamique, à base d’agents communicants, tient compte de la nature dynamique et incertaine de l'environnement des urgences en actualisant continuellement ce calendrier. Cette orchestration pilote en temps réel le workflow du parcours patient, améliore pas à pas les indicateurs de performance durant l'exécution. Grâce aux comportements des agents et aux protocoles de communication, le système proposé a établi un lien direct en temps réel entre les performances requises sur le terrain et les actions afin de diminuer l'impact de la tension. Les résultats expérimentaux, mis en œuvre au CHRU de Lille, indiquent que l’application de nos approches permet d’améliorer les indicateurs de performance grâce aux pilotage par les agents du workflow en cours exécution. / The emergency department is an important care service that represents the hospital's bottleneck. Emergencies often face overcrowding problems in many countries worldwide. One of the causes of the emergency department overcrowding is the permanent interference between three types of arriving patients: already programmed patients, non-programmed patients and urgent non-programmed patients. The aim of this thesis is to contribute to the study and development a decision support system to improve patient management in both normal and overcrowding situation. Two main processes have been developed. A rolling-horizon scheduling process using a memetic algorithm with the integration of controlled genetic operators to determine an optimal schedule for patient. The second dynamic orchestration process, based on communicating agents, takes into account the dynamic and uncertain nature of the emergency environment by continually updating this schedule for patient. This orchestration monitoring in real time the workflow of the patient pathway improves step by step the performance indicators during the execution. Through agent behaviors and communication protocols, the proposed system has established a direct real-time link between the required performances and the effective actions in order to decrease the overcrowding impact. The experimental results in this thesis, implemented at the Regional University Hospital Center (RUHC) of Lille, justify the interest of the application of our approaches to improve the performance indicators thanks to the agents driven patient pathway workflows during their execution.
