Previous issue date: 2015-12-15 / The present dissertation looks into the use of measures as the automatic enrolment in the pension funds regulation from the perspective of the loosening of the concept of rationality, based on the Law and Behavional Economics. The work is initiated by the historical evolution of Brazilian pension funds’ regulations. It analyzes the systemic impacts created by changes to the pension pillars, particularly to the first one (public pension). In view of these changes and the increasing relevance of the second pillar (occupational pension) to ensure the welfare, this dissertation aims to analyze the possibility of occurrence of cognitive biases in complementary pensions-related decisions. Those cognitive biases can lead individuals to choose options that do not maximize their welfare, for reasons such as inertia, procrastination and optimism, unlike the predicted by the rationality assumption of the neoclassical economic theory. The outcomes analyzed indicate the necessity of regulatory measures to mitigate these cognitive biases, which should be mainly the adoption of a choice arquitecture that can induce the welfare maximization, without limit the individual freedom of choice. Those measures, however, specially the automatic enrollment, are intended to alleviate the cognitive biases, being censurable its adoption in pension plans with predominance of other reasons to the low levels of enrollment, as distrust in the fund administration. Moreover, is needed to respect certain criteria in the automatic enrollment implementation, in order to ensure that this instrument is used only when cognitive biases that reduce the welfare are observed, as well that the option that people are being nudged to is a gainful option, at least most of the times. At end, it is verified the legality of these measures using the standard of proportionality, which allows to identify the limits to the regulatory intensity. / A presente dissertação investiga a utilização de medidas como a adesão automática pela regulação da previdência complementar fechada a partir da flexibilização do conceito de racionalidade, tendo como base a Análise Econômica e Comportamental do Direito. Inicia-se o trabalho pela evolução histórica da regulação da previdência no Brasil, avaliando os impactos sistêmicos das alterações ocorridas no primeiro pilar previdenciário (regimes básicos). Em virtude dessas alterações e do crescimento da relevância do segundo pilar de previdência social (Previdência Complementar Fechada) para a manutenção do bem-estar, analisa-se a possibilidade de ocorrência de vieses cognitivos que implicam desvios de racionalidade dos indivíduos nas decisões relativas à previdência complementar. Esses vieses cognitivos podem fazer com que indivíduos escolham alternativas que não maximizam seu bem-estar, por razões como inércia, procrastinação e superotimismo, ao contrário do que aponta o pressuposto de racionalidade da Economia Neoclássica. Os resultados analisados conduzem à necessidade de adoção de medidas regulatórias capazes de mitigar esses desvios de racionalidade, na forma de adoção de arquitetura de escolhas que induzam à maximização do bem-estar individual, sem limitar a liberdade individual dos envolvidos. Essas medidas, entretanto, especialmente a adesão automática aos planos de benefícios, destinam-se à mitigação de vieses cognitivos, sendo criticável sua adoção em planos de previdência onde observa-se predominância de outras razões para baixos níveis de adesão, como desconfiança em relação à gestão do plano. Ademais, faz-se necessário respeitar certos critérios para sua implementação, a fim de garantir que esse instrumento somente seja utilizado quando se observar vieses cognitivos que prejudiquem significativamente o bem-estar, bem como que a opção à qual os indivíduos estão sendo induzidos é vantajosa, ao menos na grande maioria das vezes. Ao final, verifica-se a juridicidade dessas medidas, à luz da proporcionalidade, norma que permite identificar os limites para a intensidade regulatória.

The main objective of the thesis was to investigate the feasibility of accurately and precisely fore-
casting the number of both national and provincial bene ciaries of social security grants in South
Africa, using simple autoregressive integrated moving average (ARIMA) models. The series of the
monthly number of bene ciaries of the old age, child support, foster care and disability grants from
April 2004 to March 2010 were used to achieve the objectives of the thesis. The conclusions from
analysing the series were that: (1) ARIMA models for forecasting are province and grant-type spe-
ci c; (2) for some grants, national forecasts obtained by aggregating provincial ARIMA forecasts
are more accurate and precise than those obtained by ARIMA modelling national series; and (3)
for some grants, forecasts obtained by modelling the latest half of the series were more accurate

made in terms of improvements in working conditions and profitability of individual microentrepreneurs policy beneficiaries to judge the appropriateness of the policy for Addressing the "structural informality." Had as objectives: rescue in a theoretical and historical perspective the main determinants of informality of labor relations;characterize and measure the phenomenon of informality in Brazil; investigate the
phenomenon of micro-enterprise from a critical approach in the current scenario of globalization flexible accumulation of capital and to characterize the policy of Micro Single, indicating the legal framework and its implications on coping with informality.
It was concluded that the approach of the policy of Micro Single from the point of view of coping with structural informality of small farms is inadequate. In this sense,
the effects that the policy aimed to cause about working conditions and income of the beneficiaries are not able to characterize a breakthrough in dealing with the

Aucun cap clair n’a été fixé par les pouvoirs publics européens s’agissant du droit de la protection sociale complémentaire. La contribution du droit européen en la matière est toutefois majeure. Les opérateurs spécialisés chargés de la gestion des régimes institués ont fait l’objet de nombreux textes, quoique non axés spécifiquement sur le droit de la protection sociale complémentaire et ne tenant pas toujours compte de l’originalité du modèle économique et social de certains d’entre eux. Les intérêts des bénéficiaires des dispositifs établis ont été pris en considération davantage en raison de l’extension du rôle du droit du travail au sein de l’Union européenne que des dispositions adoptées en droit de la protection sociale. Située au croisement de plusieurs domaines du droit, de l’économie et de la politique sociale, la protection sociale complémentaire cherche toujours, dans le concert du droit européen, à faire entendre une voix qui lui soit propre. Il est cependant permis d’espérer qu’un fil conducteur soit un jour plus clairement adopté, plaçant l’entreprise, qui constitue le socle du droit de protection sociale complémentaire, au coeur des réflexions et des réformes. C’est en effet au sein des entreprises, et en Europe, qu’est née la protection sociale complémentaire. Il serait cohérent que, deux siècles plus tard, les pouvoirs publics européens reviennent aux origines de celle-ci pour en déterminer l’avenir. / No clear direction has been set by the European authorities regarding complementary social protection law. However, European law still makes a major contribution on the subject. The specialized operators in charge of administrating complementary schemes have been the subject of numerous laws, but not specifically focused on complementary social protection law and not always taking into account the originality of the economic and social model of some of them. The interests of the beneficiaries were more taken into consideration because of the employment law growing position within the European Union than because of the measures adopted on social protection law. Complementary social protection happens to be right at the crossroads of several areas of law, economics and social policy. It is therefore still trying to have its own voice heard in the concert of European law. However, we can hope that a common connecting thread will be more clearly adopted, which will put the company, as the foundation of complementary social protection law, at the heart of debates and reforms. It isindeed within companies, and in Europe, that complementary social protection was born. It would make sense that, two centuries later, European authorities return to the roots of the latter to set a course for the future.

The thesis deals with the topic of employee benefits in the Czech Republic. At first, the thesis sets employee benefits to specific area of the company, which is an in-house social policy of the company. Following part deals with the legislative framework, which regulates the providing of these benefits in 2015. The thesis includes a chapter describing the employee benefits, their structure and their various distribution systems. Analysis of the trends in the provision of employee benefits creates another part of the thesis. Three types of employee benefits are analyzed in detail: meal allowances, educational allowances and contributions to employees' pension savings. In the conclusion of thesis is explored the whole system of employee benefits used in the company Siemens Ltd., where are analyzed its individual benefits and includes evaluation of a questionnaire.

Both countries are not only geographically close to each other, they also have a common history and cultural traditions. Therefore, a comparison of their pension systems, healthcare and ethnic compositions is included in this thesis.

Pour remédier aux nombreuses insuffisances et défaillances constatées dans le système de régulation et de surveillance du secteur financier, post crise, de nombreuses réformes institutionnelles ont été réalisées à l'initiative des organismes et autorités de régulation bancaire et financière aussi bien au niveau national qu'au niveau international. Le Royaume du Maroc, en vertu de son statut avancé, signé en octobre 2008, a fait un réel effort pour réduire les différences entre les législations marocaine et européenne. Il a consenti à se rapprocher des normes européennes sur le plan législatif et réglementaire avec l'objectif d'être intégré au marché intérieur européen et de disposer d'une économie plus efficace. Toutefois, le système bancaire marocain ne semble pas adhérer aux changements induits par ce travail de convergence, si non il y a encore du chemin à faire dans ce sens et une convergence totale demandera, incontestablement, "des années"! Cette thèse tente d'examiner les difficultés d'adaptation des techniques de régulation européenne au système financier marocain à travers notamment, le système de régulation des banques marocaines, l'encadrement des mécanismes relevant du shadow banking et des opérations du marché des produits dérivés. Elle met l'accent sur les nombreux défis que cette industrie aura à relever dans les années à venir. Après une analyse des principales difficultés d'adaptation des techniques de régulation européennes au système financier marocain (Partie I), quelques solutions sont proposées, à savoir la finance islamique comme une finance complémentaire à la finance conventionnelle, l'inclusion financière comme une solution ayant pour finalité la réduction de la pauvreté et la création de postes d'emplois et le crowdfunding comme moyen de financement par le public de projet de création d'entreprise et solution au resserrement de crédit constaté après la crise de 2008 (Partie II). / The extent of the 2008 financial crisis' diffusion gave rise to strenuous and far-reaching debates about international financial stability. In fact, the question of financial instituions' social responsability seen as a financial stability vector has become the center of every debate. Financial instituions' governance and risk management devices have not only highlighted the vulnerability of the banking system, but also its inability to deal with liquidity requirements. With no doubt,banks have not been cautions enough to evaluate the risks they were taking. After the crisis, many institutional reforms were carried out at the initiative of banking and financial regulatory authorities, both at national and international levels, to tackle the numerous shortcomings and deficiencies found in the financial sector's regulation and supervision system. Under the Advanced Status, signed in October 2008, the Kingdom of Morocco has tried hard to reduce the gap between the Moroccan and the European legislations. In fact, it has agreed to move closer to European standards on the legislative and regulatory level aiming to be more integrated into the European internal market and to have a more efficient economy. Nevertheless, the banking system doesn't seem to adhere to the changes that were induced by this convergence work. Thus, there is still some way to go in this direction, not to mention that such a total convergence would take "years"! This thesis attempts to examine the difficulties of adapting European regulatory techniques to the Moroccan financial system, particularly through the Moroccan banks' control system and the supervision of mechanisms that take place under the "Shadow Banking" and the derivative market. It emphasizes all of the challenges this industry will have to face in the coming years. After an analysis of the main difficulties of adapting European regulatory techniques to the Moroccan financial system (Part I), some solutions are suggested,namely Islamic finance as a complement to the conventional one, financial inclusion as a solution aiming to reduce poverty and create jobs, and "Crowdfunding" as a financing tool for the mass individual investors to back start up projects, and a solution to the credit tightening phenomenon after the crisis of 2008 (Part II).

The scope of this diploma thesis is design and processing of the project documentation of the guesthouse along with coffee shop. The proposed object of this thesis is located in the village Čeladná next to the golf course Prosper Golf Resort Čeladná, in the location designated for mixed constructions. One of the double-storeyed, non-cellular object with roofed surface and steep roof. The object is based on the base stripes made of plain concrete and on the reinforced concrete flaps. Carrying, perihepral and dividing walls are designed on the Velox systém. The same systém was used to design roof constructions. In the rooms with excessive width are filled with reinforced concrete columns. Part of the guesthouse and second floor of the coffee shop is designed with ventilated facade with wood paneling ThermoWood. The object is divided in two parts with common entrance section. One part of the coffee shop has ability to handle capacity of 70 guests. Part of the double-storeyed coffee shop is hygienic facilities, kitchen, room for employees, warehouse and mechanical ventilation. Second part of the object is the guesthouse with flat of the manager of the guesthouse. The guesthouse consists of room with hygienic facilities for 18 people, including barrier-free room. The rooms are divided in the first floor on separate units, the rooms with hygienic facilities and the apartments in the second floor has two rooms, kitchen and hygienic facilities. For the next parts of the guesthouse is warehouse clean and dirty laundry and shared kitchen. The whole first floor is designed as barrier-free. In front of the object is the parking lot for 21 cars, which 3 of the parking places are for the cars of the disabled.

The subject of my diploma thesis is the design documentation for the pension which is designed for the elderly and will be supplemented with a specialty from the air-conditioning branch. The building is situated in the western part of the town Bystřice nad Pernštejnem and it's located at 3058/3 about the total area of 8315,2m. The total footprint of the suggested building is 1161,2 m. The subject has got an irregularly-shaped floor plan. It is made of three subsequent triangels, it has got three above-ground floors with partial basement. The roof of the building is suggested as a warm flat roof with coating insulation. The structural system of a building is designed as longitudinal with shear walls. The exterior building masonry is suggested from sharpened clay blocks Heluz STI 40 with thickness 400 mm. The contact thermal insulation system ETICS with an insulant from EPS with thickness 100 mm is designed for all building. The building for the elderly is from its bigger part meant for citizens who are older than 65 years in the flats for one or two persons in 2FLR and 3FLR. The space for essential services to the residents is located on the 1st FLR. There are also a cafe and a surgery located in a smaller part of the 1st FLR, which are to be used both by the residents and the public.
