The legal regime governing the economic situation of married women in Iran : a dialogical view from QuebecZeynodini, Fateme 01 1900 (has links)
Family is the basic unit of society, and is grounded upon social, legal, religious and economic constructs. Depending on cultures and societies, and the often differential treatment they apply to men and women, entering into marriage may deteriorate women’s economic situation. The gender-based division of labor within family, which disproportionally burden women, notably through childcare responsibilities, causes a substantial decline in women’s income and interrupts their education and employment. This makes it difficult for women to have a career for themselves after a separation or divorce. Therefore, there is a general belief that legal principles and laws governing the marital relationship and property rights should be structured to protect women’s economic interests.
To establish an equitable economic framework between spouses, the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) opts for an egalitarian regime which asks for equal rights and responsibilities for both men and women, during and after the marriage. It rules in favor of a partial community of property between spouses according to which all economic advantages and disadvantages arising from a marriage and its dissolution should be borne equally by both parties.
However, legal regimes differ in outlining the method of contribution each spouse must commit to the household, financial maintenance, and the division of property after a separation or divorce. Some legal regimes, following the CEDAW, emphasize formal equality and grant similar rights and responsibilities to both parties, while establishing a partial community of property. Another group of legal regimes establish the separation of property as the guiding principle for marital economic relationships, wherein the expenses should be borne by men as the heads of the household, whereas women should be compensated for their unpaid contributions to the household.
As a country with a Sharia-based Civil law system and a specific cultural background, Iran has its own special matrimonial regime and does not follow the CEDAW’s approach to women and men’s rights and responsibilities. Iran’s matrimonial regime bases itself on Sharia’s approach to men and women, and is anchored in Iranian culture. This accounts for a legal matrimonial system that is different from laws existing in Western countries. Under this system, the husband and wife have different economic responsibilities.
This thesis examines Iran’s matrimonial regime and compares it to the Quebec matrimonial regime. While Quebec family law espouses a contributory approach for both spouses in marital life, all economic institutions under Iranian family law are designed to enforce a compensatory approach toward the spouses’ economic relation. The compensatory approach of Iranian law to the financial aspects of marital life causes some difficulty for the wife, which is exacerbated at the time of the termination of the marriage. Such a comparative study hopes to bring some novel suggestions aiming at correcting certain deficiencies in the current Iranian matrimonial regime.
Besides assessing the issues with Iran’s marital regime, this research seeks to propose legal solutions for enhancing the economic rights of women. A holistic approach will therefore be adopted, which will lead us to take into consideration certain cultural and religious specificities which have become mandatory rights in Iran. The reform proposals put forward in this thesis will thus seek to respond to Iran’s current social context.
This study will examine women’s economic situations in marriage, separation, divorce and upon the death of their spouse. It will argue that the cultural specificities of Iranian society and Islamic law must be examined and assessed. It will also analyze women’s economic situation in marital relationships in Iran and Quebec. The study of these two different civil law jurisdictions will focus on the principle of equality and examine related arguments and ideologies regarding women’s rights and responsibilities.

Retraite et risque financier / Pension Plan RiskPradat, Yannick 04 July 2017 (has links)
Chapter one examines the long run statistical characteristics of financial returns in France and the USA for selected assets. This study clearly shows that the returns’ distributions diverge from the Gaussian strategy as regards longholding periods. Thereafter we analyze the consequences of the non-Gaussian nature of stock returns on default-option retirement plans.Chapter two provides a reasonable explanation to the strong debate on the Efficient Market Hypothesis. The cause of the debate is often attributed to small sample sizes in combination with statistical tests for mean reversion that lackpower. In order to bypass this problem, we use the approach developed by Campbell and Viceira (2005) who have settled a vectorial autoregressive methodology (VAR) to measure the mean reversion of asset returns. The third chapter evaluates the speed of convergence of stock prices. A convenient way to characterize the speed of mean reversion is the half-life. Comparing the stock indexes of four developed countries (US, UK, France and Japan) during the period 1950-2014, we establish significant mean reversion, with a half-life lying between 4,0 and 5,8 years. The final chapter provides some results from a model built in order to study the linked impacts of demography and economy on the French pension scheme. In order to reveal the risks that are contained in pension fund investment, we use a Trending Ornstein-Uhlenbeck process instead of the typical GBM for modeling stock returns. We find that funded scheme returns, net of management fees, are slightly lower thanthe PAYG internal rate of return.

COBOL-skills, Where art Thou? : An assessment of future COBOL needs at HandelsbankenKhatib, Samy January 2016 (has links)
The impending mass retirement of baby-boomer COBOL developers, has companies that wish to maintain their COBOL systems fearing a skill shortage. Due to the dominance of COBOL within the financial sector, COBOL will be continually developed over at least the coming decade. This thesis consists of two parts. The first part consists of a literature study of COBOL; both as a programming language and the skills required as a COBOL developer. Interviews were conducted with key Handelsbanken staff, regarding the current state of COBOL and the future of COBOL in Handelsbanken. The second part consists of a quantitative forecast of future COBOL workforce state in Handelsbanken. The forecast uses data that was gathered by sending out a questionnaire to all COBOL staff. The continued lack of COBOL developers entering the labor market may create a skill-shortage. It is crucial to gather the knowledge of the skilled developers before they retire, as changes in old COBOL systems may have gone undocumented, making it very hard for new developers to understand how the systems work without guidance. To mitigate the skill shortage and enable modernization, an extraction of the business knowledge from the systems should be done. Doing this before the current COBOL workforce retires will ease the understanding of the extracted data. The forecasts of Handelsbanken’s COBOL workforce are based on developer experience and hiring, averaged over the last five years. The forecasts take into consideration the age developers are hired, the age the developers exit, and their cumulative growing experience while in the skills pool. The state of COBOL in 2015 is used as a baseline of COBOL needs to forecast until 2060. I.e. the rate at which COBOL systems are developed stay the same. The forecasts show that if no developers are hired, most of their experienced developers will have left by 2030. To keep their current COBOL experience level, Handelsbanken needs to keep hiring over the coming 45 years. Handelsbanken has to hire on average 8.2 developers per year until 2030, and 6.5 developers per year until 2060. I.e. Handelsbanken has been able to keep a high average of 7.6 people per year for the last five years.

Poradní orgány a expertíza v české politice : epistémické komunity a jejich vliv na vysokoškolskou a důchodovou reformu / Advisory bodies and expertise in the Czech politics : epistemic communities and the influence on the reforms of higher education and pension systemMerklová, Kateřina January 2013 (has links)
Advisory Bodies and Expertise in the Czech Politics - Epistemic Communities and the Influence on the Reforms of Higher Education and Pension System Master thesis Bc. Kateřina Merklová The Master thesis Advisory Bodies and Expertise in the Czech Politics - Epistemic Communities and the Influence on the Reforms of Higher Education and Pension System concerns with the relation between politics and expertise. So-called epistemic community represents the knowledge interpreter that we consider an independent actor in the political process. In the theoretical part of the text, we have explained the original definition of the concept as well as its critics and case studies that cover various contexts. Following most of the authors, we have applied a looser definition of the concept and deconstructed its rigid criteria. The empirical part of the thesis presents a case study (N=4) based on comparative methods that analyzes variable influence of four particular epistemic communities (the authors of the White Paper on Tertiary Education, Bezdek's Committee, Bezdek's Committee II, and the National Economic Council) on policy-making process and its sources. Regarding our intention and research questions, we have chosen two qualitative methods - in-depth interviews and content analysis of relevant texts. We have...

This thesis demonstrates by theoretical, institutional and empirical analysis, which justice concepts are relevant in old-age provision, how specific institutional arrangements have to be evaluated in this context and which justice attitudes on that matter exist in the German population. Firstly, there is no a priori convincing theoretical concept of generational justice. Especially concepts based on generational equity that propose to solve the problem of intergenerational justice in old-age provision by generational accounting methods have to be considered with skepticism. For theoretical reasons, hybrid concepts that encompass universalistic as well as culture- and demo-sensitive aspects should be preferred. Institutional analysis shows furthermore that the central problem connected to generational justice has less to do with inequality between generations and more with growing inequality within cohorts in the generational succession. Finally, the empirical analysis of justice attitudes provides evidence for the relative priority of status conservation over input-equity in the determination of just old-age benefits. Primary notions of justice in old-age provision are strongly anchored in the institutional status quo and only marginally influenced by abstract generational equity concepts that also neglect widespread loss aversion among individuals. Heuristics and regime-specific socialization explain more variation in justice attitudes than particularistic economic or age-specific interests do. The general public does not neglect the problems of pension-systems in the wake of demographic changes however, but solutions are rather seen in family and education policies, while reforms in existing pension arrangements even amplify feelings of injustice in the short run.

La protection sociale de l'agriculteur victime d'accidents / The social welfare of the farmer victim of accidentsMeftah, Leïla 07 December 2018 (has links)
The study of the social welfare of the farmer victim of accidents reveals theexistence of disparities between the victims themselves and between the industrial accidentsand the common law. These disparities are inherent to farmer’s quality; whether he isemployed or not, the latter does not benefit from the same rights. In addition, the injuredfarmer in the course of his professional activity will have only a fixed compensation. Thelatter tends to compensate the loss of income and the professional incidence of the accident.Compensation for personal injury is excluded except in the hypothesis of unforgivablemisconduct of the employer. As for the victims of accidents of common law, their socialwelfare is only optimized if they possess a top up insurance plan that will completerepayments in cash and in kind of the agricultural system. Except the coverage of the basiclegal system, the compensation of accidents of common law tends to be complete. In order toensure that all accident victims are treated with equal manner by law and that compensationfor all their injuries can be achieved, we recommend solutions so that the disparities betweenthe farmers victims of accidents can disappear.

L'âge en droit social : étude en droit européen, français et allemand / Age in social law : study in european, french and deutsch lawRazé, Laetitia 09 December 2013 (has links)
To face this challenge, it is necessary for legislators to develop a dedicated protection policy for the young people in a business relationship context and, at the same time, to redefine age limits policy especially in business relationship termination situation.. The presented study focuses on the factuality of the « age » concept. Based on cultural history, confirmed by the legislator analysis of the physiological aging, « age » criterion is closely linked to general principles in E.U. legislation like, for example, the human dignity and the equal treatment. However, the « age » criterion still remains ambivalent which is underlined by the non-discrimination principle. This ambiguity is emphasized in business relationships which leads to the influence of the « age » in an ending working life situation. This intergenerational pact support, which influence the proceed of the pension liquidation, is currently experiencing a revival beyond E.U. member state boundaries. A converging point is achieved in old-age treatment which leads to new solidarity development schemes inside companies (like for example the company occupational scheme). An important objective is to promote the pursuance of a professional activity in order to retire later (increasing in the statutory retirement age, increment or reduce of the retirement pension, restriction of derogations, proscription of business relationship breaches if they are based on age, …) and to redefine the connection between age and business relationships (combined work and retirement, phased retirement, …). By this way, legislators promote a human longevity based age treatment in Europe

Pension Reform in Continental Europe : A comparative study of pension reform in Germany and France during the years ofausterity 1990-2010.Grönroos (fd. Johansson), Per January 2018 (has links)
As demographic and economic contexts have shifted, the need for pension systems to reform has increased. Often, however, these systems have proved difficult to change – especially in continental Europe. Despite this, Germany, by many considered particularly reform resistant, succeeded in reforming its pension system; while France, with its strong executive power, has not. As research has yet to find a consensus on what factors makes welfare retrenchment possible, this field requires more attention. Therefore, the aim of this thesis is to analyse the developments of the German and French pension systems, from 1990-2010, and to unearth what factors made successful reform possible in Germany while it failed in France. Using a comparative case study, all major pension reforms in the two countries during the time period, are analysed from four institutionalist perspectives. The results point to three main factors explaining Germany’s successful reform. Firstly, the shock brought on by the reunification of East and West Germany forced politicians to act. France on the other hand, experienced no such shock. Secondly, the subduing of the unions removed the main veto player against reform. In contrast, the French unions, whose political power lies in their ability to call for manifestations and shift public opinion, could not be outflanked. Lastly, the new liberal ideas that permeated German politics around the turn of the century provided a locus for change that was lacking in France. These results suggest the importance of external pressure, veto players and ideational factors to major welfare reform.
