Legal issues of the Internet from the scope of international and national law Global internet network has changed the social, political and business life of most people in the World. Communication is much faster, the flow of information all around the World takes a few seconds. Exchange of political opinions, personal and business information, works protected by copyright and other information has become unstoppable. Members of the international community are trying to tackle this new challenge to their legal and political systems. This diploma thesis is describing some arreas of private law where Internet plays the most important role and has changed the scope and interpretation of many legal rules. The work is dividend into two main parts. The aim of this work was to bring the issue of mandatory confidentiality of health workers and the exceptions to this concept in the context of criminal law. In the first part of the thesis is generally defined by the Institute of mandatory confidentiality in health care, sources of legal regulation of this institute and its development in the Czech legal order. The work also deals with medical records and privacy of sensitive data in connection with the obligation of confidentiality of medical professionals. The next section is defined by breaking the confidentiality required the consent of the patient and also cases where the patient's consent to obtain information about his state of health is not required. The work also deals with criminal liability for breach of confidentiality and lists the offenses that can be committed in violation of this obligation. In the conclusion the work presents a brief comparison of the regulation of the Slovak Republic and in the Federal Republic of Germany.

THE MONITORING EMPLOYEES AT WORK The thesis deals with the legal protection of privacy and property in connection with the employees monitoring. The legal practice solves this problematic area in a different ways, which makes this topic highly actual. The thesis is composed of six chapters, each of them describes important aspects of the employees monitoring. First two chapters are introductory and define basic terminology and legal principles related to the personal data protection. Chapter Three focuses on the privacy as a fundamental human right and points out the issue of the confrontation with other values. Possibilities to enforce the right of privacy are outlined in the last part of this chapter. Chapter Four examines relevant Czech legislation concerning employees monitoring and personal data protection in labor law relations. The means of employees monitoring are analyzed in Chapter Five, which is subdivided into five parts - camera surveillance systems, correspondence confidentiality, internet use, GPS localization and biometric identification and authentication. Chapter Six seeks to describe the relevant Czech case law and illustrates the approach to decision-making by the administrative authority. of the Thesis This thesis deals with a problem of surveillance in public spaces. In the introduction it was specifies that the main aim of the thesis is to give a complex view on the topic of surveillance cameras in public areas from the constitutional law perspective. In the Czech republic, no further discussion has developer and legislatively, the issue is only regulated by the personal data protection law. And this regulation is not even complex, it only deals with CCTV kind of cameras, excluding the ones without storing the data. In the beggining of the thesis I explai right to privacy and under which conditions it can be limited. The core of the paper deals with camera systems themselves, their use, pros, cons and effecitivity. Later I describe opinions of some offices and states on the topic. Proportionality test of the constitutional court and the ECHR to balance right to privacy with the state responsibility for public safety was conducted in the last part of the thesis. The thesis consists of five chapters, introduction and conclusion. The author of the thesis deals with introduction to the problematics of personal data protection and its relevance in the contemporary world in the introduction of the diploma thesis as well as with demarcation of the aims of the work. In the first chapter, the basic sources of legislation in the area of personal data protection are demarcated, both in Czech and in European and international level. In the second chapter, the attention is paid to the basics of the legislation in the area of personal data protection, whereas the author deals with demarcation of basic concepts, in the second subchapter she gives an overview of basic principles of personal data processing and in the third subchapter she summarizes legal titles for personal data processing. The paper starts on the construction of the right to privacy and its mutations in face of technological advances, especially on the information and communication technologies. With that it faces from the firsts formulations of the right to privacy, as a right to be let alone, until it?s most recent formulations, as a right of each individual to control its own private information. After that, it analyses the north-american personal data protection system, housed on the figure of right to privacy, as well as the European personal data protection system, based on laws of European Union level. This analysis suits so that both systems can be used as reference for the study of the thematic on the Brazilian legal system, observed the due alterations to fit this legal system. In the end, the present paper faces the thematic of personal data protection on the Brazilian legal system, focusing on the profiling, with consists in a personal data treatment tool that figures between the ones that offers the hirer risk. Recognizing the fundamental character of the right to personal data protection, including in the Brazilian juridical system, the paper demonstrates the importance of the observation of personal data protection principles ? as the transparency, the purpose and the consent ? on the utilization of profiling mechanisms. Only this way it?s possible to conform the treatment of personal data with the rights of the data subject. / O presente trabalho busca enfrentar a tem?tica do direito ? prote??o de dados pessoais no ?mbito do ordenamento jur?dico brasileiro, enfocando a figura do profiling. O trabalho inicia na constru??o do direito ? privacidade e nas suas muta??es em raz?o dos incrementos tecnol?gicos, notadamente no que toca ?s tecnologias da informa??o e da comunica??o. Com isso, ele enfrenta desde as primeiras formula??es do direito ? privacidade, enquanto um direito a ser deixado s?, at? suas formula??es mais recentes, enquanto um direito de cada indiv?duo controlar suas pr?prias informa??es privadas. Depois, ele analisa o sistema norte-americano de prote??o de dados pessoais, albergado pela figura do right to privacy, bem como o sistema europeu de prote??o de dados pessoais a partir das normativas em n?vel de Uni?o Europeia. Coleta de dados pessoais e paradoxo da privacidade: um estudo entre usuários de aplicativos móveis / Personal data collection and privacy paradox: a study of mobile application users

Aplicativos móveis de celulares que coletam dados pessoais estão cada vez mais presentes na rotina do cidadão comum. Associado a estas aplicações, há polêmicas sobre riscos de segurança e de invasão de privacidade, que podem se tornar entraves para aceitação destes sistemas por parte dos usuários. Por outro lado, discute-se o Paradoxo da Privacidade, em que os consumidores revelam mais informações pessoais voluntariamente, apesar de declarar que reconhecem os riscos. Há pouco consenso, nas pesquisas acadêmicas, sobre os motivos deste paradoxo ou mesmo se este fenômeno realmente existe. O objetivo desta pesquisa é analisar como a coleta de informações sensíveis influencia a escolha de aplicativos móveis. A metodologia é o estudo de aplicativos disponíveis em lojas virtuais para celulares através de técnicas qualitativas e quantitativas. Os resultados indicam que os produtos mais populares da loja são aqueles que coletam mais dados pessoais. Porém, em uma análise minuciosa, observa-se que aqueles mais buscados também pertencem a empresas de boa reputação e possuem mais funcionalidades, que exigem maior acesso aos dados privativos do celular. Na survey realizada em seguida, nota-se que os consumidores reduzem o uso dos aplicativos quando consideram que o produto coleta dados excessivamente, mas a estratégia para proteger essas informações pode variar. No grupo dos usuários que usam aplicativos que coletam dados excessivamente, conclui-se que o motivo primordial para compartilhar informações pessoais são as funcionalidades. Além disso, esta pesquisa confirma que comparar os dados solicitados pelos aplicativos com a expectativa inicial do consumidor é um constructo complementar para avaliar preocupações com privacidade, ao invés de simplesmente analisar a quantidade de informações coletadas. O processo desta pesquisa também ilustrou que, dependendo do método utilizado para análise, é possível chegar a resultados opostos sobre a ocorrência ou não do paradoxo. Isso pode dar indícios sobre os motivos da falta de consenso sobre o assunto / Mobile phone applications with personal data gathering features are ubiquitous nowadays. On one hand, there are constant debates about privacy and security issues regarding such systems that inhibit user adoption. On the other hand, there are discussions about the tendency of consumers to disclose more personal information than their initial intentions. This phenomenon is also known as the Privacy Paradox. There is no agreement among researchers regarding the occurrence and the causes of this phenomenon. The aim of this research is to analyze how sensitive data collection can inhibit end user\'s application choices. It investigates products available to smartphone virtual stores with qualitative and quantitative research techniques. Data analysis indicates that top ranked products at the application store request the largest amount of sensitive data. However, this data disclosure is probably due to the fact that top ranked products belong to top rated developers and are feature-rich. The survey indicates that consumers reduce usage behavior in order to protect personal data but different protecting strategies are adopted. Users disclose their information probably because they value functionalities more than the data requested by the applications. This research also observed that user\'s expectation of the type of information that a particular application should collect is an alternative construct of measuring privacy concern, instead of examining only the permissions requested. This research process can also illustrate that the conclusions regarding the occurrence of the Privacy Paradox changes when a different analysis method is applied. On 25 May 2018 the General Data Protection Regulation, GDPR, came into force in the EU. The regulation strengthened the rights of the data subjects’ in relation to the data controllers and processors and gave them more control over their personal data. The recitals of the GDPR state that it was the rapid development in technology and globalisation that brought new challenges for the protection of personal data. Private companies and public authorities where making use of personal data on an unprecedented scale in order to pursue their own activities. The protection should be technologically neutral and not dependant on the technique used. This leads to questions on whether the protection that is offered through the GDPR is de facto applicable on all technologies. One particular technology which has caught interest of both private companies and public authorities is the blockchain. The public distributed blockchain is completely decentralized, meaning it is the users who decide the rules and its content. There are no intermediaries in power and the transactions of value or other information is sent peer to peer. By using asymmetric cryptography and advanced hash algorithms the transactions sent in the blockchain are secured. Whilst the interest and use of blockchain is increasing and the GDPR attempting to be applicable on all techniques, the characteristics of the public blockchain must be analysed under the terms of the GDPR. The thesis examines whether natural persons can be identified in a public blockchain, who is considered data controller and data processor of a public blockchain and whether the principles of the GDPR can be applied in such a decentralised and publicly distributed technology. / Den 25 maj 2018 tradde den nya dataskyddsforordningen, GDPR, i kraft i EU vilken slog hardare mot personuppgiftsansvariga och personuppgiftsbitraden an vad det tidigare dataskyddsdirektivet gjort. Med reformen ville EU starka personuppgiftsskyddet genom att ge de registrerade mer kontroll over sina personuppgifter. I skalen till forordningen anges att det var den snabba tekniska utvecklingen och globaliseringen som skapat nya utmaningar for skyddet da privata foretag och offentliga myndigheter anvander personuppgifter i en helt ny omfattning idag. Skyddet bor saledes vara teknikneutralt och inte beroende av den teknik som anvands. Detta oppnar upp for fragor om huruvida skyddet som GDPR erbjuder faktiskt ar applicerbart pa samtliga tekniker. En sarskild teknologi som fangat intresse hos saval privatpersoner som foretag och offentliga myndigheter ar blockkedjan. Den oppet distribuerade blockkedjetekniken ar helt decentraliserad, vilket innebar att det ar dess anvandare som styr och bestammer over innehallet. Nagra mellanman finns inte, utan vardetransaktioner och andra overforingar av information sands direkt mellan anvandare. O estudo explora a questão de como o Direito do Trabalho brasileiro protege a informação pessoal do empregado perante o empregador e se essa proteção considera deliberadamente os riscos subjacentes ao uso da informação em ambiente de crescente processamento automático. No Capítulo I, apresenta-se no contexto internacional o problema da obtenção e do uso pelo empregador da informação relativa ao empregado em um ambiente de crescente automatização e justifica-se a necessidade de sua abordagem no Direito brasileiro. No Capítulo II é examinado o arcabouço da proteção de dados pessoais do empregado nas normas internacionais. No Capítulo III, buscam-se os fundamentos do conceito de dados pessoais no ordenamento jurídico brasileiro, principalmente na órbita constitucional, sob a fórmula do direito à autodeterminação informativa. O Capítulo IV traça um quadro geral da proteção da informação relativa ao empregado no Direito do Trabalho brasileiro, considerando os limites à obtenção e ao uso da informação pessoal, os deveres do empregador como responsável pelo acervo de informações pessoais que mantém e os direitos diretamente relacionados à autodeterminação informativa. O Capítulo V investiga as potencialidades do quadro normativo brasileiro atual para oferecer uma proteção ao empregado que se aproxime das finalidades almejadas nas normas internacionais setoriais. / The study is concerned with the question of how the Brazilian Labor Law protects the employees personal information from collection and use by the employer and whether it considers the threats to the employee that arise from increasing automatic processing. Chapter I presents, in the international context, the problem of the employers collecting and using the employees personal information in a world of increasing automation and justifies the need for its approach in the Brazilian Law. Chapter II presents the employees data protection framework proposed in international agreements. Chapter III discusses the fundaments of the concept of personal data and its formulation as informational self-determination in the Brazilian Law and in the Brazilian Constitution. Chapter IV offers a general picture of the protection of the employees information in the Brazilian Labor Law, considering the limits to its collection and use, the obligations of the employer as responsible for the retrieval of the stored data, and the employee`s rights regarding informational self- determination. Chapter V investigates the possibilities of the present Brazilian Legal framework in offering protection to the employee on the same basis as proposed in sectorial international agreements.
