Esta dissertação tem como tema a guinada pragmática do juiz norte-americano Richard A. Posner e a aplicação de sua teoria da adjudicação pragmática aos casos difíceis. Para identificar o contexto em que se deu esta virada, apresentaremos em breve síntese a origem do pragmatismo nos Estados Unidos da América, suas implicações filosóficas e jurídicas para os paradigmas duais modernos, e sua influência no realismo jurídico. A virada linguística e da pós-modernidade darão forma a um neopragmatismo, cuja tônica será uma espécie de antifundacionalismo e antiteoria que será adotada por juristas a partir do final da década de 1980. Apresentado este cenário, adentrar-se-á ao trabalho de Richard Posner, destacando-se sua ascensão no movimento da Análise Econômica do Direito até que, influenciado por fragmentos das teorias enunciadas no primeiro capítulo e pelas críticas lançadas à redução do direito ao formalismo econômico, proporá uma releitura das possibilidades e dos limites da aplicação da economia ao direito, adotando uma abordagem mais abrangente e interdisciplinar, próxima ao pragmatismo jurídico. O pragmatismo de Posner terá como pilares a rejeição à autonomia do direito e a problemática da objetividade jurídica, fundamentada no consenso e na indeterminação mitigada do direito, que o levará a defender a impossibilidade de respostas certas aos casos difíceis e a incapacidade da filosofia moral auxiliar o direito. Posner oferecerá daí, uma visão própria de pragmatismo e razão prática, que constituirá o pragmatismo cotidiano e à teoria da adjudicação pragmática, sua relação com os métodos de outras áreas do conhecimento, com o formalismo e a concepção de razoabilidade, bem como a sua aplicação a um caso difícil. No terceiro e último capítulo deste trabalho, serão examinadas as dificuldades da proposta pragmática de Posner apontadas na crítica de Ronald Dworkin, sobretudo sobre o papel da objetividade no direito, a importância da filosofia moral na definição dos fins jurídicos e o perigo da transformação do empreendimento jurídico em um consequencialismo de regras. / This work proposes de analysis of the pragmatic turn of the American judge, Richard A. Posner and application of his theory of pragmatic adjudication to difficult cases. To identify the context in which this turn is given, we present in brief outline the origins of pragmatism in the United States of America, its philosophical implications and legal paradigms for modern dualisms, and its influence on legal realism. The linguistic turn and postmodernism will form a neo-pragmatism, whose keynote will be a kind of antifoundationalism and anti-theory that will be adopted by jurists from the late 1980\'s. Presented this scenario, we will enter into the work of Richard Posner, highlighting its emergence as a pioneer of the movement of Economic Analysis of Law until, influenced by fragments of the theories set out in the first chapter and reviews posted by the reduction of the right to economic formalism, propose a review of the possibilities and limits of application of economics, law, adopting a more comprehensive and interdisciplinary approach, the next legal pragmatism. The pillars of Posner\'s pragmatism will be the rejection of the autonomy of law and legal issues of objectivity, based on consensus and mitigated indeterminacy of law, which will lead to the adoption of the no-right answers thesis to difficult cases and the inability of moral theory to provide a solid basis for legal judgments. Posner then, offer a particular vision of pragmatism and practical reason, which constitute the everyday pragmatism and the theory of pragmatic adjudication, its relation with the methods of other areas of knowledge, with legal formalism and the concept of reasonableness, and its application to a difficult case. In the third and final chapter of this study will examine the difficulties of Posner\'s pragmatic proposal outlined in the critique of Ronald Dworkin, especially on the role of objectivity in the law, the importance of moral philosophy in defining the legal purposes and the danger of transformation of the enterprise legal in a rule-consequentialism.

Previous issue date: 2016-02-15 / O propósito desta pesquisa é descrever e caracterizar a evolução do conceito de maximização da riqueza na obra de Richard A. Posner. Diversos trabalhos anteriores ressaltam a existência de "fases" no pensamento do autor paradigma, enquanto este trabalho busca encontrar um motivo condutor que permeie toda sua obra e que represente sua unidade. Para tanto, o trabalho acompanha a evolução do pensamento do autor-paradigma, usando o conceito de eficiência como chave para melhor compreensão de sua obra, desde a identificação deste como "pedra de Rosetta" para compreensão do common law, passando por sua utilização como critério normativo, até a sua acomodação no pragmatismo cotidiano proposto pelo autor. Por extrapolação, o trabalho dialoga diretamente com o movimento da Análise Econômica do Direito, da qual o autor-paradigma foi e continua a ser figura chave, procurando encontrar uma forma de racionalidade comum a todo movimento que pudesse ser utilizada para avaliação de políticas públicas. Por fim, trata da utilização da teoria macroeconômica como um novo vetor da Análise Econômica do Direito. / The purpose of this research is to describe the evolution of the wealth maximization concept by looking at the work of Richard A. Posner. Several prior researches emphasize the existence of "phases" in his work, while this research was designed to identify a "leitmotiv" that would pervade all his work and represent its unity. To that effect, this dissertation follows the evolution of Posner’s work, using the concept of economic efficiency as key to better understand his work, from the identification of such concept as a "Rosetta stone" of the common law, passing it as a normative criterion, to its accomodation in the everyday pragmatism put forth by the author. This dissertation, by extrapolation, opens a direct dialogue with the Law and Economics movement, of which the author was and continues to be a key figure, seeking a form of rationality that is common to all the movement e that could be used as a mean to evaluate public policy. At last, it focus on the usage of macroeconomic theory as a new vector for Economic Analysis of Law.

Microsaccades as a window to visuospatial attentionMeyberg, Susann 20 April 2017 (has links)
Die Erforschung visueller Aufmerksamkeit beruht auf verdeckter Aufmerksamkeit; das heißt, wenn der Fokus der Aufmerksamkeit trotz strikter Fixation ausgerichtet wird ohne größere Sakkaden auszuführen. EEG-Studien haben das neuronale Netzwerk identifiziert, dass verdeckte Aufmerksamkeit steuert. Diese Studien ignorieren jedoch unwillkürliche kleine Sakkaden während der Fixation - Mikrosakkaden (MS) genannt. Blickbewegungsstudien hingegen belegen einen Zusammenhang zwischen Aufmerksamkeit und diesen MS, beziehen ihre Resultate jedoch nicht auf etablierte EEG-Befunde. Um diese Forschungslücke zu schließen, zielt diese Dissertation darauf, den Zusammenhang zwischen Ereignis-korrelierten Potentialen (EKP) endogener Aufmerksamkeit und MS zu untersuchen. Folglich wurden drei Studien mit gleichzeitiger Erfassung von EEG und Blickbewegungen durchgeführt. In den Studien haben die Probanden ein „Posner Spatial-Cueing-Paradigma“ absolviert mit einem endogenen Hinweisreiz. Wir zeigen deutliche Zusammenhänge zwischen MS und neuronalen Korrelaten visueller Aufmerksamkeit. Erstens, MS und ein posteriores EKP reflektierten die Selektion visueller Reize basierend auf deren Merkmale. Dieses Ergebnis stärkt die Idee eines Netzwerkes, dass relevante Reize unter Distraktoren selektiert und zielgerichtetes Verhalten initiiert. Zweitens, MS erzeugten ein visuelles Potential, das verstärkte Potentialkomponenten für Reize zeigte, die im Aufmerksamkeitsfokus lagen. Dieses MS-evozierte Potential stellte einen zeitlich gut aufgelösten Aufmerksamkeitsindex dar. Drittens, MS erzeugten zudem ein in früheren Studien übersehenes, korneoretinales Artefakt. Dieses Artefakt kontaminierte die Messung eines frontalen EKPs, dass zuvor mit der Kontrolle von Aufmerksamkeit assoziiert war. Zusammenfassend zeigt diese Dissertation, dass die gleichzeitige Erfassung von EEG und Blickbewegungen bedeutsame Einblicke in den Zusammenhang von MS und visueller Aufmerksamkeit erlaubt. / Research on visual attention focusses on covert attention; that is, when attention is directed during fixation periods in the absence of larger saccades. While previous EEG research has provided insights into the neural network that controls covert attention, this field fails to account for the inevitable occurrence of miniature fixational saccades - called microsaccades (MS). In contrast, previous eye-tracking research has established links between MSs and covert attention, but has not directly related their findings to seminal EEG results. This thesis bridges this research gap by investigating the link between event-related potentials (ERPs) of endogenous attention and MSs. To this end, three studies were conducted with concomitant ERP and high-resolution eye-tracking recordings while participants performed a Posner spatial cueing task with an endogenous cue. Crucially, we show that MSs relate to neural correlates of visual attention. First, MS and an early posterior ERP reflected the top-down selection of a visual stimulus based on its features. This finding is consistent with the notion of a neural network that selects relevant stimuli from distracting ones and initiates goal-directed behavior toward selected stimuli. Second, gaze shifts from MSs evoked a visual potential in the EEG that was enhanced for stimuli in the focus of attention; a finding well-known for the visual potential measured after presenting a stimulus. Importantly, these MS-related potentials provided a fine-grained temporal index of the subject’s attentional state. Finally, MSs further evoked a corneoretinal artifact overlooked in previous EEG studies. This artifact contaminated the measurement of a frontal ERP previously associated with preparatory attentional control. In sum, this thesis provides first evidence for the benefits of using concomitant ERP and eye-tracking recordings to examine the link between MSs and visual attention.

Numerical analysis and multi-precision computational methods applied to the extant problems of Asian option pricing and simulating stable distributions and unit root densitiesCao, Liang January 2014 (has links)
This thesis considers new methods that exploit recent developments in computer technology to address three extant problems in the area of Finance and Econometrics. The problem of Asian option pricing has endured for the last two decades in spite of many attempts to find a robust solution across all parameter values. All recently proposed methods are shown to fail when computations are conducted using standard machine precision because as more and more accuracy is forced upon the problem, round-off error begins to propagate. Using recent methods from numerical analysis based on multi-precision arithmetic, we show using the Mathematica platform that all extant methods have efficacy when computations use sufficient arithmetic precision. This creates the proper framework to compare and contrast the methods based on criteria such as computational speed for a given accuracy. Numerical methods based on a deformation of the Bromwich contour in the Geman-Yor Laplace transform are found to perform best provided the normalized strike price is above a given threshold; otherwise methods based on Euler approximation are preferred. The same methods are applied in two other contexts: the simulation of stable distributions and the computation of unit root densities in Econometrics. The stable densities are all nested in a general function called a Fox H function. The same computational difficulties as above apply when using only double-precision arithmetic but are again solved using higher arithmetic precision. We also consider simulating the densities of infinitely divisible distributions associated with hyperbolic functions. Finally, our methods are applied to unit root densities. Focusing on the two fundamental densities, we show our methods perform favorably against the extant methods of Monte Carlo simulation, the Imhof algorithm and some analytical expressions derived principally by Abadir. Using Mathematica, the main two-dimensional Laplace transform in this context is reduced to a one-dimensional problem.

Law in 3-Dimensions2013 March 1900 (has links)
This project, overall, involves a theory of law as dimensions. Throughout the history of the study of law, many different theoretical paradigms have emerged proffering different and competing ways to answer the question ‘what is law’? Traditionally, many of these paradigms have been at irreconcilable odds with one another. Notwithstanding this seeming reality, the goal of this project was to attempt to take three of the leading paradigms in legal theory and provide a way to explain how each might fit into a single coherent theory of law. I set out to accomplish this by drawing on the field of theoretical physics and that field’s use of spatial dimensions in explaining various physical phenomena. By engaging in a dimensional analysis of law, I found that I was able to place each paradigm within its own dimension with that dimension being defined by a specific element of time, and in doing so much of the conflict between the paradigms came to be ameliorated.
The project has been divided into two main parts. PART I discusses the fundamentals of legal theory (Chapter 1) and the fundamentals of dimensions (Chapter 2). These fundamentals provide a foundation for a dimensional analysis of law which takes place throughout PART II. In Chapter 3, I argue that the three fundamental theses of Positivism coalesce with the 1st-dimension of law, which is defined as law as it exists at any one point in time. From there, I argue in Chapter 4 that the 2nd-dimension of law, being law as it exists between two points in time (i.e. when cases are adjudicated), is characterized by Pragmatism. I then turn, in Chapter 5, to argue that the 3rd-dimension of law, being law as it exists from the very first point in legal time to the ever changing present day, coalesces with the fundamental theses of Naturalism. Ultimately then, I argue that a theory of law as dimensions, through the vantage points of the specific elements of time, provides a more complete account of the nature of law.
