L’adaptation des ports maritimes aux nouvelles donnes du commerce international, ne peut se réaliser sans une implication des opérateurs privés dans la gestion des activités portuaires. Cette participation exige que, les activités industrielles et commerciales des ports, leur soient confiées par le biais de montages juridiques efficients. Parmi ceux-ci, les concessions portuaires apparaissent comme les outils juridiques offrant un cadre d’accueil, en termes de performance et de rentabilité des activités économiques dans les ports maritimes. Or, aujourd’hui, le problème de la qualification juridique de ces concessions portuaires semble se poser dans la mesure où règne un désordre juridique en droit administratif. Cette thèse vise, ainsi, à apporter un éclairage à la question. Son introduction générale expose, d’abord, la notion de concession portuaire et aborde ensuite l’objectif de cette étude en mettant l’accent sur sa problématique : le contrat de concession dans les ports peut-il être classé dans une famille juridique préétablie et être rattaché à une catégorie juridique préexistante ? Pour répondre à cette question, la première partie de cette thèse s’est attachée à mettre en relief la diversité des éléments caractéristiques des concessions portuaires. Cette opération d’identification a mis l’accent sur les éléments essentiels et ceux qui sont non essentiels permettant la qualification juridique des concessions portuaires. Mais, cette qualification théorique ne peut être judicieuse et cohérente que si elle est confrontée à la constante évolution de la pratique des montages concessifs réalisés par les opérateurs économiques dans les ports. C’est à cette grille d’analyse que s’est livrée la seconde partie de cette thèse. Elle a, ainsi, porté sur la diversité de la pratique concessive dans les ports maritimes français et africains. Aussi, ont été examinés les montages concessifs dans les ports français en comparaison avec ceux utilisés dans les ports européens (Anvers, Rotterdam, Hambourg) et dans les ports de l’Afrique notamment en Côte d’Ivoire, au Sénégal, au Cameroun, en Algérie et au Maroc. Cette analyse comparative qui est illustrée par des documents professionnels montre, finalement, que la qualification juridique des concessions portuaires qui est l’axe central de cette thèse est un exercice périlleux. Elle ne peut se faire qu’au cas par cas, selon les pays et en tenant compte des efforts conjugués de la doctrine, de la jurisprudence, des textes législatifs et réglementaires. / The adaptation of sea ports to the new rules of international trade can only happen with the involvement of private port managing operators. This involvement requires the entrustment of ports industrial and commercial activities, through efficient legal devices/arrangements/frameworks. Among these, port concessions seem like legal instruments providing a good setting, in terms of performance and profitability for economic activities in sea ports. However, the legal qualification/classification/characterization of these port concessions can be an issue since a legal disorder is observed in administrative law. The thesis is thus aiming at sheding light on this matter. The introduction firstly exposes the notion of port concession and then adresses the objective of this study by outlining its problematic : can port concession contracts be classified into a pre-establisehd legal group and attached to a pre-existing legal category ? To address the question, the first section of this thesis highlights the diversity characterizing port concessions. This identification process outlines the essentiel and non-essential elements, enabling the legal qualification of port concessions. However, this theoretical qualificaiton can only be wise and coherent if it adapts to the constant evolution of the use of concessive framework by the economic agents in sea ports. The second section of the thesis thus tackles the issue, by considering the diversity in use of concessions in sea ports of France and Africa. The concessive devices of French sea ports have been compared to those of other European ports (Antwerp, Rotterdam, Hamburg) and African ports, in particular in Ivory Coast, Senegal, Cameroon, Algeria and Morocco. The comparative analysis illustrated through professional documents, shows that the legal qualification of port concessions, which is the center of this thesis, is a perilous enterprise. It can be done only on a case by cas basis, according to the various countries and taking into account the joint forces of doctrine, jurisdiction, as well as legal and regulatory texts.

Social consequences of the privatization in Bulgaria and socio-economic impact of the neo-liberal economic theory on the transition to free market and democracy in the period from 1989 to 2015

Objectifs : Le mémoire examine la privatisation en Bulgarie à partir d'une certaine distance historique de 25 ans, pour démontrer les conséquences sociales présentement visibles, entre autres les inégalités sociales par rapport au développement économique; l’impact démographique aussi que les nouvelles structures et valeurs sociales. Méthode: Nous utilisons une approche à deux volets. Pour le développement socio-économique, nous étudions six variables constantes pour la période, telles que le nombre de personnes en dessous du seuil de pauvreté, le PIB, l'indice Gini, les dynamiques démographiques, le taux de chômage et l'indice de développement humain; Pour les changements sociaux, les nouvelles structures et les valeurs, nous utiliserons une approche qualitative, basée sur des entrevues, des questionnaires, des études de terrain, etc. Résultats: Nous constatons que les résultats obtenus par les deux méthodes, ceci comprenant leurs limitations, correspondent plutôt à notre hypothèse : la privatisation en Bulgarie était économiquement nécessaire, mais socialement destructive et a entraîné des conséquences sociales dévastatrices à long terme, principalement en raison des politiques et des pratiques de privatisation défectueuses. La privatisation a émergé de la théorie néo-libérale économique prédominant à l'époque. Les pratiques spécifiques utilisées dans la privatisation Bulgare ont favorisé principalement à court terme certains petits groupes sociaux, mais pas la société dans son ensemble. Conclusion: Nous constatons que la façon dont la privatisation bulgare a été menée a été socialement et économiquement nuisible avec des conséquences continues. À long terme, l'économie s'est rétablie, mais les divergences sociales ont toujours une tendance à croître. / Objectives : We look at the privatization in Bulgaria as defined above from a certain historical distance of 25 years, trying follow the visible now social consequences of the privatization, such as social inequality vs economic development; demographic impact and new social structures and values. Method: We use a two-prong approach. For the socio-economic development we study six constant variables for the defined period such as number of people below poverty line, GDP, Gini Index, demographic dynamcs, employment rate, and Human development index; for the social changes, new structures and values we use a qualitative approach, based on based on interviews, questionnaires, field studies, etc. Results: We find that results by both methods, with all the limittaions they have, rather align with our hypothesis that privatization in Bulgaria was economically necessary, but socially destructive and led to devastating social consequences, mainly as a result of flawed privatization policies and practices. It did emerge from the predominant at that time neo-liberal economic view and the specific practices used in the Bulgarian privatization favoured mainly in short term for some small social groups but for the society as a whole. Conclusion: We find that the way Bulgarian privatization was conducted was socially and economically damaging with long lasting consequences. In the long run the economy has recoverd, however the social divergences tend to grow.

The impact of democratisation on state media system in Zambia : the case of The Times newspapers

This thesis explores the manner in which political-economic forces born of democratisation have shaped media developments in Zambia, affected the welfare of journalists and the viability of the state owned press epitomised by the Times Newspapers. The aim is to inform the privatisation policy discourse. Using a political economy analysis, the thesis unveils the historical intimacy between nationalist administrations and multinational business elites and how these forces - often working in collusion - influenced patterns of media ownership, inhibited labour rights and controlled communicative activity – indicative of how the state and markets can constrain freedom of expression and association, despite democratisation. The thesis contends that the uncertainty of neo-patrimonial conditions that characterised the post colonial era has not dissipated to a great extent and continues to undermine media and institutional reform in today’s liberally inclined Zambia. Pervasive clientelism has also compromised popular perceptions of state media systems, subverting competitiveness and the propagandist function of the Times Newspapers in the liberalised market, a point empirically illustrated through the analysis of market and public opinion data. / Communication Science / D. A subject of this diploma thesis is a role of private military companies (PMCs) in security sector reform (SSR) in Iraq in a period from 2003 to 2011. The first chapter of the thesis focuses on goals and process of post-conflict SSR from a theoretical point of view because of an involvement of PMCs in post-conflict reconstruction which was taking place in Iraq. Part of the theoretical chapter is a SSR and steps which is the SSR process composed of. The second chapter concentrates on definitions and typologies of PMCs. This part of the thesis makes a distinction between mercenaries and private military contractors and PMCs themselves. Last but not least the second chapter encompasses discussion about a role of PMCs in a process of SSR in post-conflict countries. The third chapter is dedicated to a historical development of cooperation between PMCs and the US; it analyses roots of the US dependence on services provided by PMCs. A case study of Iraq elaborates on a role of PMCs in a process of Iraqi security reform. Aim of this chapter is to define advantages and disadvantages of usage of services provided by PMCs. By taking into account disadvantages employment of PMCs represents, steps that could help to avoid those in the future are suggested.

The discontinuity between education policy and implementation in secondary school education in Zambia : 1964-1998

This dissertation focuses attention on the trends in secondary school education globally, with the Zambia backdrop providing a platform for a comparative study of the global scenario. Research results reveal that analysis of education planning and the process of policy formulation may be hinged on different ideological, economic, technological and social premises. Shifts in regimes and ideologies have often left behind paradigm shifts and discontinuities in the educational sectors of countries. The processes of globalisation and internal accommodation of national forces have conjoined to impact heavily on educational policies. Be it in commandist Russia or neo-liberal USA, there. has always been the felt need to use education planning as a leverage to score multiple points, including the gaining of national competitive advantage on the frontiers of knowledge and intelligence. Description and critical analysis of the management of road and transportation research in the Republic of South Africa

The dissertation gives the background to the need for management of roads and transportation research in the Republic of South Africa. The close co-operation between researcher and end-user of research findings in the above-mentioned fields and its application into practice, is described. The advent of autonomy of research institutions in 1986, highlighted the need for a structured approach for the management of road and transportation research. Tasks, previously undertaken mainly by the Division for Road and Transport Research of the Council for Scientific and Industrial Research on behalf of the South African road and transportation authorities, had to be taken over by the Department of Transport. A transition period of five years was given (from 1987 to 1992) to implement a suitable scientifically sound system.
