Reflexões críticas acerca do papel e significado do interesse público no direito administrativo brasileiro

A investigação proposta no trabalho foi estimulada pela reduzida preocupação doutrinária e jurisprudencial em compreender o efetivo papel e o atual significado do “interesse público” no âmbito do Direito Administrativo Brasileiro, dúplice escopo do presente estudo. Estabelece-se, em um primeiro momento, breve análise dos fundamentos político-normativos que legitimam a atuação dos agentes públicos, reforçando a relevância das normas jurídicas produzidas por autoridades democraticamente investidas na construção das finalidades estatais que acabam por configurar o interesse público em perspectiva constitucional ou política. Como decorrência, aborda-se a necessária vinculação da atuação administrativa à lei e ao Direito no âmbito do Estado Democrático, condição imposta pelo princípio da legalidade para que a Administração Pública tenha sua atuação delimitada juridicamente, o que indica que no processo de concreção do interesse público (passando para uma perspectiva administrativa ou jurídica do conceito) a função da autoridade pública é integrativa, condicionada à concessão de certa margem de liberdade pelas normas jurídicas, por meio do emprego de conceitos indeterminados ou mediante asseguramento de discricionariedade. O trabalho ocupa-se, ainda, em ressaltar que o Direito Administrativo teve sua origem na busca pela regulação do conflito dialético entre as prerrogativas assecuratórias do exercício da autoridade estatal e as garantias de liberdade e direitos individuais dos cidadãos, o que acaba levando à abordagem do aventado caráter “supremo” do interesse público e sua contraposição aos interesses privados. Dessa forma, é feita a interpretação do polêmico “princípio da supremacia do interesse público sobre o interesse privado” em conformidade com a Constituição Federal de 1988, de modo a evidenciar que a função dessa norma-princípio acabou sendo incorporada na ordem constitucional atual por meio dos princípios apresentados no caput do art. 37, especialmente da legalidade e da impessoalidade, os quais atuam como parâmetros para o controle jurisidicional do interesse público, já que condicionam a atividade administrativa ao respeito dos limites formais impostos pela regra de competêcia (legalidade na forma da reserva legal) e à observância da espécie e grau de interesse público incorporado na previsão legal, evitando-se um possível desvio de finalidade (impessoalidade) no agir dos agentes da Administração Pública, imbricação que, inclusive, vem reconhecida no direito positivo pátrio, conforme se constata na redação dos arts. 1º e 2º da Lei nº 9.784/99. / The research was stimulated by the reduced concern of doctrine and jurisprudence in understanding the actual role and the current meaning of "public interest" under the Brazilian Administrative Law, wich is the twofold scope of this study. It’s established, at first, a brief analysis of the political-normative elements that legitimize the actions of public servants, reinforcing the relevance of the legal standards produced by democratically invested authorities on the State’s purposes definition that shapes the public interest in constitutional or political perspective. In consequence, it’s analized the necessary linkage of administrative action to the rules and the Law in a Democratic State, condition imposed by the principle of legality to juridically limitate Public Administration’s activities, indicating that the fuction of administrative staff in the concretion of public interest (in administrative or legal perspective) is posterior and integrative, especially in situations wich the rules allows a certain margin of freedom, like when there is an indeterminate concept to interpretate or the administrative discretion needs to be use. The dissertation seeks, furthermore, to emphasize that the Administrative Law had its origin by searching for the regulation to pacify the dialectical conflict between the prerogatives that ensure the authority’s exercise and the guarantees of freedom and individual rights, imposing the analisis of the alleged “supreme” character of the public interest and its opposition to private interests. So, it’s enphasized the controversial “principle of the supremacy of public interest over private interest” and its normative interpretation under the Brazilian Constitution of 1988 in order to show that the function of this principle was incorporated in the current constitutional order through the principles presented in the chapeau of article 37, specially the legality and impersonality, which act as parameters for the public interest’s judicial review, since they affect the administrative activities to respect the formal limits imposed by the rule that delegates power (legality in the legal reserve form) and the observance of the kind and degree of public interest incorporated into the legal provision, avoiding a possible deviation of objective (impersonality), overlapping that comes recognized in national positive law, as noted in articles 1 and 2 of Brazilian Statute Law n 9.784/99.

From the content analysis of the textual material published on the site and from the observation of the writing routine, it was possible to verify what kind of journalism is practiced by the state body and how the portal approaches the characteristics of public communication. ln addition to the content analysis of news and official documents, and the application of interview, it was observed the work done in journalistic writing in order to evaluate how the portal works and is managed by the state public administration. The theoretical proposal presupposed the bibliographical research about the communication practiced in the public sector, exploring the concepts of public and governmental communication, public and private interest, patrimonialism and webjournalism. The research also looked for in the origin of the formation of the Brazilian State and of the political system in the interior of the country variables that allowed to approach the private appropriation of the activities promoted in public sector organs. The study worked with the concepts of newsmaking; public interest; state communication. This dissertation also rescued the origin of the communication activity in the public administration and described how this activity finds beacons in the Federal Constitution of Brazil and other legal norms. The purpose of this study was to verify the extent to which management favors or impedes the practice of a communication that interests the whole community, or if, on the contrary, it has as prerequisite the attendance of the interests of the political group in power. The results obtained from the triangulation of collection techniques have shown that there is a long way to go so that the theory and principies of public communication become a reality in practice. / O trabalho consiste em um estudo de caso sobre o portal de notícias Goiás Agora, veículo da internet produzido pelo poder executivo do estado de Goiás, e tem a intenção de investigar em que medida o referido site atende ao interesse público. A partir da análise de conteúdo do material textual publicado no site e da observação da rotina de produção da redação, foi possível verificar que tipo de jornalismo é praticado pelo órgão estatal e de que modo o portal se aproxima das características da comunicação pública. Além da análise de conteúdo de notícias e de documentos oficiais, e da aplicação de entrevista, foi realizada a observação do trabalho realizado na redação jornalística a fim de avaliar como o portal funciona e é gerido pela administração pública estadual. A proposta teórica pressupôs a pesquisa bibliográfica acerca da comunicação praticada no setor público, explorando os conceitos de comunicação pública e governamental, interesse público e privado, patrimonialismo e webjornalismo. A pesquisa também buscou na origem da formação do Estado brasileiro e do sistema político no interior do país variáveis que permitiram abordar a apropriação privada das atividades promovidas em órgãos do setor público. O estudo trabalhou com os conceitos de newsmaking; interesse público; comunicação estatal; comunicação governamental. Esta dissertação resgatou ainda a origem da atividade de comunicação na administração pública e descreveu como essa atividade encontra balizas na Constituição Federal do Brasil e em outras normas jurídicas. O trabalho teve a intenção de verificar em que medida a gestão favorece ou prejudica a prática de uma comunicação que interesse a toda a coletividade, ou se pelo contrário, tem como pré-requisito o atendimento dos interesses do grupo político no poder. Os resultados obtidos a partir da triangulação de técnicas de coleta permitiram constatar que há um longo caminho a percorrer para que a teoria e os princípios de comunicação pública sejam uma realidade na prática.

O objetivo desta tese é analisar de que forma a Comunicação na perspectiva da Comunicação Pública poderá assumir a articulação e o debate para promover um novo paradigma em torno da sustentabilidade e de que forma o capital social está presente neste contexto. Adotamos como proposta para este estudo o pensamento complexo de Edgar Morin, que propõe uma abordagem transdisciplinar, propondo ver o mundo como um todo indissociável, no contexto, com traços inquietantes do emaranhado, da desordem, da ambiguidade, da incerteza, que para nós define as questões atuais referentes à Sustentabilidade. A pesquisa etnográfica nos permitiu observar no campo a presença de pressupostos da comunicação pública e de capital social e analisar as dinâmicas interativas e comunicativas no fato mais óbvio: o encontro e o relacionamento. Através da observação participante e de outros instrumentos de pesquisa aplicados com integrantes da OSCIP Rede Nossa São Paulo, foram colhidos os dados a fim de analisarmos a sua efetividade. A partir da constatação de que a problemática da sustentabilidade é de natureza políticoeconômica, acreditamos que a Comunicação Pública, regida pela força de múltiplos atores, se apresenta como uma nova proposta em torno da palavra-problema \"sustentabilidade\" e para a proposição de novas políticas públicas em torno dos problemas ou soluções concernentes a ela. O estudo pretende trazer contribuições para o avanço da área do conhecimento, prenchendo lacunas, a exemplo de novos estudos em torno do conceito de Flourishing, com o objetivo de ampliar as possibilidades de entendimento, crítica e alternativa diante do olhar reducionista e simplificador de como o problema da sustentabilidade vem sendo apresentado, além de trazer a possibilidade de reflexão acerca das práticas utilizadas pelas organizações do terceiro setor, que a partir do pressuposto de que estas têm a missão de ocupar o espaço público e dada a sua importância na condução do advocacy, possibilitam o debate em construção coletiva para problemas ligados ao interesse público e ao bem comum para o desenvolvimento da sustentabilidade. Assim, na Rede Nossa São Paulo nos deparamos com um modelo de comunicação pública e de capital social legítimos, modelo que poderá inspirar novos atores, organizações, instituições a revitalizarem o espaço público aberto para mudanças concretas, a partir de uma comunicação pública transparente, que promova a confiança, a cooperação, a reciprocidade e a participação a fim de encontrarmos respostas às grandes questões e complexidade que o termo sustentabilidade carrega. / The objective of this thesis is to analyse how Communication in the perspective of Public Communication can assume the articulation and debate to promote a new paradigm around sustainability and the way social capital is present in this context. We adopt as a proposal for this study the complex thought of Edgar Morin, who proposes a transdisciplinary approach, proposing to see the world as an indivisible whole, in the context, with disturbing traces of the entanglement, disorder, ambiguity, uncertainty that defines us the current issues related to Sustainability. The ethnographic research allowed us to observe in the field the presence of the presuppositions of public communication and social capital, and analyse the interactive and communicative dynamics in the most obvious fact: the encounter and the relationship. Through participatory observation and other applied research instruments with the members of the OSCIP Rede Nossa São Paulo, we collected data with the objective of analysing its effectiveness. Based on the fact that the issue of sustainability is political and economic in nature, we believe that Public Communication, governed by the force of multiple actors, is presented as a new proposal around the problem word \"sustainability\" and the proposition of new public policies around the problems or solutions concerning it. The study intends to bring contributions for the advancements of the knowledge area, filling in gaps, as example of new studies around the concept of Flourishing, aiming at expanding the possibilities of understanding, critique and alternative towards the reductionists and simplistic view of how the issue of sustainability is being presented, besides bringing the possibility of reflection about the practices used by third sector organizations, based on the presupposition they have the mission of occupying public space and given its importance of leading the advocacy, enabling the debate under collective construction for problems related to the public interest and the common good for the development of sustainability. Therefore, at Rede Nossa São Paulo we faced an authentic model of public communication and social capital, model that can inspire new actors, organizations, institutions to revitalize the public space to concrete changes, having as starting point a transparent public communication, which promotes confidence, cooperation, reciprocity and participation in order to find answers to great questions and complexity that the term sustainability holds.

Os Conselhos de fiscalização do exercício de profissionais da área da saúde são órgãos públicos, e, como tais, devem ter suas ações de comunicação orientadas pelos preceitos constitucionais, que determinam as ações de publicidade (o tornar público) pautadas pelos princípios do interesse público. O trabalho investiga, por meio dos procedimentos de análise de conteúdo de Laurence Bardin, se os propósitos constitucionais são cumpridos pelos Conselhos estudados (Conselho Regional de Medicina de São Paulo, Conselho Regional de Enfermagem de São Paulo Conselho Regional de Fisioterapia e Terapia Ocupacional da 3ª região) em suas ações e políticas de comunicação. As inferências derivadas da utilização das técnicas de Análise Categorial do Conteúdo - aplicada sobre os editoriais das publicações dos Conselhos - e da Análise da Enunciação do Conteúdo - aplicadas às entrevistas dos presidentes dos três órgãos, permitem compreender o direcionamento das ações de comunicação dos três Conselhos voltado aos interesses privados, restando parcial ou totalmente ausente as abordagens de estrito interesse público. / The Boards of health responsible for inspecting the acts of healthcare professional are public organs, and as such, should have their communication actions guided by constitutional principles, which determine the actions of publicity (making facts public) guided by the principles of public interest. The paper investigates, through the procedures of content Analysis, by Laurence Bardin, if the constitutional purpose is fulfilled by the councils studied (Regional Council of Medicine of São Paulo, Regional Nursing Council of São Paulo Regional Council of Physical Therapy and Occupational Therapy of the 3rd region) in their actions and policies of communication. The inferences derived from the use of two techniques: Categorical Content Analysis - applied over the editorials of published advice - and the Enunciation of Content Analysis - applied over the interviews with the presidents of the three organizations, allow us to understand the direction of the communication actions of the three Councils aimed to private interests, and partially or totally absent approaches to strict public interest matters.

in English The main topics of my thesis are public law contracts. Public law contracts can be defined as bilateral or multilateral legal operations, which establish, change or repeal rights or duties in the area of public law. I tried to give a complete point of view on them, including their history, the actual legal regulation and I also tried to present the single types of public law contracts. Public law contract is one of the forms of public service. It is an institute, which was already commented by legal theorists in the period of Austria-Hungary and also in the beginning of 20th century. The importance of this institute was shaded during the Second World War and during the period of communism. The democracy and then the general legal regulation in form of the normative act No. 500/2004 called the Rules of Administrative Procedure give the institute importance again. Public law contracts can be considered as instruments, which help to involve private entities in the sphere of public services. The thesis is divided into chapters, but it is possible to say, it is divided into two big parts. This diploma thesis deals with the large water dams realization and their impact on the adjacent region and its development. The aim of thesis is to identify the most important effects associated with the construction of dams and analyze them. The theoretical part defines basic terms, categories of dams and the impacts of their construction, included the planning proces too. The problem is practically solved on the example of the Orlik Dam. The methods that has been used on this topic were literature review, data and available resources analysis and also there were used microhistorical approach. It can be assumed that dams have great impact on the surrounding environment, but the volume of the impact is always determined by many factors. Due to the amount of planned infrastructure projects is needed to pay extra attention for consequences of their realization considerable.

Comment le Droit peut-il définir le concept de Liberté ? De quelles manières la théorie du droit et le droit public appréhendent-ils la définition de la Liberté ? Défiant en effet toute entreprise de définition, la Liberté se dérobe immédiatement à toute contrainte. Pourtant, on le pressent, et on le vérifie au quotidien, la liberté des uns entrera fatalement en conflit avec la liberté des autres. Nous suggérons que l'intérêt général est l'élément de médiation indispensable à la coexistence de nos droits fondamentaux. La problématique de cette étude s'articule alors autour de la relation entre l'intérêt général et les droits fondamentaux. Cette relation prend successivement deux formes. D'une part, il ressort que les droits fondamentaux reçoivent l'intérêt général en tant qu'il est une notion politique et juridique destinée à définir les droits et libertés. Il s'agira d'apprécier la relation essentielle qui se noue entre intérêt général et droits fondamentaux. D'autre part, il importe de concilier l'intérêt général et les droits fondamentaux en conceptualisant l'intérêt général. Nous aborderons, cette fois, la relation existentielle entre les droits fondamentaux et l'intérêt général. Toutefois, l'analyse révèle que l'intérêt général demeure un concept politique auquel une fonction juridique est donnée. Il contribue cependant à la définition du concept de Liberté. Il démontre fondamentalement qu'un droit qui anéantirait, par principe, la Liberté, s'anéantirait en tant que Droit. / How can Law define the concept of Liberty? In which ways does the theory of Law and Public Law define Liberty? Being virtually impossible to define, Liberty eludes any constraints. Nevertheless, one can sense it and on a daily basis can verify that the Liberty of some will inevitably clash with the Liberty of others. We suggest that public interest is an essential means of mediation enabling our fundamental rights to coexist. What is at stake in this study is the relationship between public interest and fundamental rights. This relationship can be of two kinds. On the one hand, insomuch as public interest is a political and legal notion intended to define rights and liberties, it is deeply rooted in fundamental rights. We will analyze the essential relationship which links public interest and fundamental rights. On the other hand, it is important to reconcile public interest and fundamental rights by conceptualizing public interest. We will therefore examine the existential relationship between fundamental rights and public interest.However, this analysis reveals that public interest remains a political concept, which has been given a legal function. It nonetheless contributes to defining the concept of Liberty. It demonstrates that a Law which would annihilate Liberty on principle would annihilate itself.

The applied methodology was based on analysis of specific bibliography and documental study of some courts of appeals decisions . It is displayed historical and legislative evolution of writ of suspension in Brazil and pointed out some similar remedies in the foreign laws. The doctrine's controversy about its judicial nature is confronted, emerging the conclusion as a type of procedural incidental decision. In the face of the Brazilian Federal Constitution, the writ of suspension has its validity recognized on juridical order as a form of public interest s supremacy above private interests. It is examined yet the legal proceeding, the practical consequences and who will be bound, emphasizing the legal standing, jurisdiction, time limits, appeals, the civil responsibility and the judicial decision effects. Furthermore, it is discussed the merits of writ of suspension and the vague judicial concept's problem, mainly relative to public order, health, security and economy. At the end, the work shows that the writ of suspension, as an essential instrument of protection to public interests, is harmonized with the access to justice / Este trabalho estuda os aspectos mais relevantes do instituto da suspensão de decisão judicial proferida contra o poder público, especialmente no tocante à proteção do interesse público e sua compatibilização com o amplo acesso à jurisdição. O método utilizado é a análise bibliográfica específica e o estudo documental de algumas decisões judiciais. Expõe-se a evolução histórica e legislativa do instrumento no Brasil, bem como a existência de estruturas semelhantes no direito estrangeiro. A natureza jurídica é debatida, admitindo-se a forte divergência doutrinária, mas concluindo-se pela natureza de incidente processual. Em confronto com a Constituição Federal de 1988, a suspensão é reconhecida como válida no ordenamento jurídico diante da supremacia do interesse público sobre o particular. Discute-se ainda todo o procedimento e conseqüências do pedido de suspensão, com destaque para a legitimidade, a competência, os prazos, os recursos, a responsabilidade civil e os efeitos da decisão. Não se passa ao largo, outrossim, do chamado mérito da suspensão, quando se debate um pouco os conceitos jurídicos indeterminados, especialmente no que se refere às expressões ordem, economia, segurança e saúde públicas. À l’origine, le droit administratif apparaissait essentiellement comme le droit applicable aux personnes publiques. Cette tendance imprégnait les catégories juridiques du droit administratif, marquées par la prédominance de l’élément organique, personne publique, dans l’assujettissement au droit administratif. Bien que le cadre conceptuel d’autrefois demeure aujourd’hui inchangé, il en va différemment désormais.La teneur des évolutions actuelles du droit administratif est remarquable. D’une part la participation croissante des personnes privées à l’action administrative, d’autre part l’interventionnisme des personnes publiques dans les sphères jadis réservées à l’action privée rejaillissent nécessairement sur les contours des catégories juridiques du droit administratif. Ces dernières doivent inévitablement refléter pareils changements. Deux tendances permettent d’en livrer témoignage. La première démontre que l’élément organique, la présence de la personne publique, perd de l’influence dans l’assujettissement au droit administratif. Il est, certes, toujours présent au sein des catégories juridiques, mais son rôle se transforme. La seconde conduit à observer que l’idée de fonction prend désormais la place de l’organe dans la logique de la soumission au droit administratif. Notre réflexion s’oriente ainsi vers la construction de la représentation de l’idée même de fonction et, plus spécifiquement, de la fonction administrative. Elle permet d’affirmer que la fonction administrative fournit une base explicative performante de l’assujettissement des catégories juridiques au droit administratif. C’est en effet la fonction d’intérêt général « caractérisé », dans le cadre de laquelle les catégories juridiques du droit administratif apparaissent, qui semble désormais déterminer et justifier leur statut juridique. Toutefois, cette tendance ne se manifeste pas uniformément au sein des catégories juridiques du droit administratif. Elle progresse néanmoins de manière constante et ne cesse de gagner de nouveaux terrains. / Originally, administrative law appeared essentially as the law applicable to public persons. This tendency permeated the legal categories of administrative law, marked by the predominance of the organic element, public person, in the subjection to administrative law. Although the conceptual framework of the past, unchanged today, it is different now.The content of current developments in administrative law is remarkable. On the one hand, the increasing participation of private persons in administrative action, on the other hand, the interventionism of public persons in the spheres formerly reserved for private action, necessarily affect the contours of the legal categories of administrative law. These must inevitably reflect such changes. Two trends are possible to set an example. The first shows that the organic element, the presence of the public person, loses influence in the subjection to administrative law. It is certainly always present in the legal categories, but its role is changing. The second leads to the observation that the idea of function now takes the place of the organ in the logic of submission to administrative law. Our reflection is thus oriented towards the construction of the representation of the very idea of function and, more specifically, of the administrative function. It makes it possible to affirm that the administrative function provides a powerful explanatory basis for the subjugation of legal categories to administrative law. It is indeed the 'specific' function of general interest, in which the legal categories of administrative law appear, which now seems to determine and justify their legal status. However, this trend is not uniformly reflected in the legal categories of administrative law. It is nevertheless progressing steadily and continues to gain new ground.
