Public contracting performance measurement: a study of social relations

This research questions whether there is evidence that contract performance measurement is influenced by the social structure in which it is embedded. I question whether the strong ties between a prime contractor and its subcontractors lead to higher performance scores in public contracting. I also question if prior relations between a Georgia Department of Transportation (GDOT) manager and the private firm project manager whose work is being evaluated lead to higher performance scores.

Att köpa kvalitet : En studie över upphandlingen av äldreboenden i Uppsala Kommun

När det offentliga väljer att upphandla välfärden och köpa in tjänsteutförandet från fristående vårdbolag följer ett behov av nya verktyg för att driva välfärden i önskad riktning. Den här uppsatsen söker beskriva hur kommunala tjänstemän bemöter konsekvenserna av trenden att omvandla de byråkratiska välfärdssystemen till marknader för välfärdstjänster och utvecklar nya verktyg för styrning. Utgångspunkten för undersökningen är de förfrågningsunderlag tjänstemännen formulerar och som utgör grunden för upphandlingsprocessen. Fördjupad kunskap om hur upphandlingsprocessen utformas i praktiken samlas genom intervjuer med ansvariga tjänstemän vid Uppsala Kommun samt marknadschefen vid ett av kommunens utförarbolag. Undersökningen visar att tjänstemännen lägger stor vikt vid formuleringen av obligatoriska krav som utförarna måste leva upp till för att maximera de boendes välmående. Dessa krav utformas för att stärka tydlighet, uppföljningsbarhet och standardisering. Detta görs genom att öka mängden krav, använda och skapa normer för hur verksamheten bör bedrivas och att stärka professionella yrkesgruppers roll.

À l’issue de la Révolution, la rationalisation de la politique architecturale opérée au moyen d’une centralisation des affaires qui s’appuie sur un découpage administratif très hiérarchique allait permettre, en moins d’un demi-siècle, de fournir aux nouvelles institutions les édifices nécessaires à leur exercice et d’inscrire leur existence symbolique dans le bâti. Comme commission consultative établie auprès du ministre de l’Intérieur en 1795, le Conseil des bâtiments civils fut appelé à se prononcer sur l’ensemble des questions relatives à l’architecture que lui soumettait le ministre. Ses compétences portaient tout autant sur l’examen sous le rapport de l’art de tous les projets d’architecture construits aux frais de l’État que sur des sujets aussi divers que le règlement des honoraires, les alignements de voirie ou la liquidation des sommes dues aux entrepreneurs. Principal outil de la politique architecturale de l’État, le Conseil des bâtiments civils allait être à l’origine d’une pratique encadrée de l’architecture. En commandant l’accès à la commande publique la plus rémunératrice et la plus importante pour la notoriété de l’architecte, et par la normalisation du processus de production architectural, le Conseil et l’administration des bâtiments civils furent à l’origine, selon le mot de Georges Teyssot, d’un véritable « système des bâtiments civils » dont le rôle fut sans doute plus déterminant encore que celui de l’École et de l’Académie des Beaux-Arts dans la première moitié du XIXe siècle. / At the end of the Revolution, the rationalization of the architectural policy that engendered a centralisation based on a strict hierarchical administrative division would, in less than a century, allow to give to the new institutions the buildings they needed and to inscribe their symbolic existence in the built. Orientador: Luiz César Ribas / Resumo: Avançar de uma cultura consumista para uma sustentável e passar a adotar políticas socioambientais representa atualmente, além de uma necessidade, um desafio global. Dentre os desafios da sustentabilidade encontra-se a proposta de contratação pública sustentável, pelo que se pretendeu analisá-la em conjunto com as políticas públicas de incentivo a ela, com foco no caso concreto do Tribunal de Justiça do estado de São Paulo (TJSP). Em legislação recente, com a Lei n. 12.349, de 15 de dezembro de 2010, foram introduzidas algumas alterações no Estatuto da Lei n. 8.666/93. No caput do artigo 3º desta lei, passou a constar a obrigatoriedade de se buscar, além da seleção da melhor proposta, a promoção do desenvolvimento sustentável nas contratações da Administração Pública. Entende-se que é possível, por meio do procedimento licitatório, contribuir para assegurar o constitucional direito ao meio ambiente ecologicamente equilibrado e incrementar políticas públicas sociais. A partir da hipótese de que há desafios que dificultam a implementação das contratações públicas sustentáveis, a pesquisa teve como problemas identificá-los e propor formas de encaminhamento para sua superação. Para tanto, foi utilizada metodologia com base qualitativa que, em um primeiro momento, concentrou-se em pesquisa exploratória, bem como teórico-bibliográfica, com reunião e revisão de literatura doutrinária e legislação correlatas, além de buscas (com análise) de documentos públicos oficiais, disponíveis e... Among the challenges of sustainability is the proposal of sustainable public procurement, which is why it is intended to analyze it together with the public policies that encourage it, focusing on the concrete case of the Court of Justice of the state of São Paulo (TJSP). In recent legislation, Law n. 12,349, dated December 15, 2010, introduced some changes in the Statute of Law n. 8.666/93. As determined in the caput of article 3 of this law, it became necessary to seek, in addition to selecting the best proposal, the promotion of sustainable development in the hiring of Public Administration. It is understood that it is possible, through the bidding procedure, to contribute to ensure the constitutional right to the environment ecologically balanced and to increase public social policies. In the Brazilian State, Law 8.666 of 21 June 1993 and further norms regulate the necessity of a formal process, usually licitation. Given the importance of this subject to public and private spheres, one of the prerequisites of these formal contracting rules is the openness of public acts, and society s knowledge and accompaniment. The objective of this study is to investigate society s participation in public contracting, with the aim of debating theories surrounding the state/society relationship proposed by public political thought and authors in relation to legal aspects involving licitations. The principal question of this research is: despite the possibility of society s participation being predicted in the legal frameworks which orientate licitations, why is this social control not carried out? Why does it only occupy a secondary position to both individual and collective agents? In order to test some of this study s hypotheses, field research was carried out in the Coqueiral community in Aracaju, Sergipe, in relation to public acquisitions of goods and services during the period of May to September 2009. Research involved observation visits and guided interviews with the relevant community and public sector representatives. Concerning the entry into force of the Law 30225, new Public Contracting Law, and its rules of procedure, in this article, the author analyzes the institution of the right to challenge arbitrators in the field of public contracting. In his analysis, the author examines the right to challenge arbitrators as is set forth in other legal bodies, taking note of the issues that may be present with its transfer to the public contracting area –given its particularities–, and finally concludes that an urgent reform in this matter is needed. / A propósito de la entrada en vigencia de la Ley 30225, nueva Ley de Contrataciones del Estado, y su Reglamento, en el presente artículo, el autor analiza la institución del derecho de recusar árbitros en el ámbito de la contratación pública. En su análisis, el autor examina el derecho de recusar árbitros tal como está plasmado en otros cuerpos normativos, observando los problemas que puede plantear su traslado a la órbita de las contrataciones del Estado –dadas sus particularidades–, para finalmente concluir que hace falta una reforma urgente en esta materia.

Implementación de oficinas integrales en las municipalidades provinciales como órgano de apoyo para garantizar la eficiente ejecución presupuestal de obras públicas en las municipalidades distritales

En los últimos tiempos la ejecución del presupuesto público asignado a cada uno de los gobiernos locales, para la contratación de obras públicas, ha presenciado una serie de deficiencias a causa de los actos de corrupción cometidos por las autoridades, la falta de personal capacitado para la elaboración de los expedientes técnicos de contratación y la falta de capacidad de gasto. Esta realidad viene generando una mala inversión de los recursos públicos asignados a cada municipalidad, recursos que tienen la finalidad de promover y mejorar el desarrollo social y la calidad de vida de las personas. Aunque los gobiernos locales cuenten con presupuesto para desarrollar tales fines, estos no logran concretizarse, desperdiciándose la oportunidad de invertir correctamente el presupuesto asignado. Si bien es cierto, el Estado, ha venido implementando medidas que permitan el buen desarrollo de los procesos de contratación de obras públicas, estas no vienen dando los resultados esperados. Por las razones antes expuestas, la presente investigación tiene como finalidad proponer la implementación de oficinas orgánicas en las municipalidades provinciales, las cuales servirán de apoyo a las municipalidades distritales, para revisar y constatar que los expedientes técnicos no presenten irregularidades, y así garantizar la eficiente ejecución presupuestal de obras públicas. / In recent times, the execution of the public budget assigned to each of the local governments, for the contracting of public works, has witnessed a series of deficiencies due to acts of corruption committed by the authorities, the lack of trained personnel for the preparation of technical contracting files and lack of spending capacity. This reality has been generating a poor investment of public resources assigned to each municipality, resources that have the purpose of promoting and improving social development and people's quality of life. Although local governments have a budget to develop such goals, they fail to materialize, wasting the opportunity to correctly invest the allocated budget. Although it is true, the State has been implementing measures that allow the proper development of public works contracting processes, these are not giving the expected results. For the reasons stated above, the purpose of this research is to propose the implementation of organic offices in the provincial municipalities, which will serve as support to the district municipalities, to review and verify that the technical files do not present irregularities, and thus guarantee the efficient budget execution of public works.

The case study focused on the Tribunal de Contas do Distrito Federal - TCDF, an autonomous organization of the direct public administration of the Distrito Federal. The survey data were based on documents and legislation related to the organization under study and interviews with managers linked to public procurement. The analysis was performed in a exploratory and descriptive way, with a qualitative approach. The collected data brought the characterization of the organization and presented information on changes in internal procedures related to procurement, in addition to the effects of these changes for the organization. The study showed how the institution was receptive to changes and administrative innovations. Among the factors that caused the changes, stand out the flexibility that the organization has to adapt itself to external changes imposed with the laws and regulations and above all the need there is for change. Confirming the systemic character of the organizations, we can see that many changes that occurred brought good results. / O objetivo desta pesquisa foi conhecer como ocorreram as mudanças no planejamento da contratação em uma organização pública. O estudo de caso concentrou-se no Tribunal de Contas do Distrito Federal-TCDF, um órgão autônomo da Administração Pública direta do Distrito Federal. Os dados da pesquisa foram baseados em documentos e legislações relacionados ao órgão em estudo e em entrevistas com as chefias vinculadas à contratação pública. A análise foi efetuada de forma exploratório-descritiva, com abordagem qualitativa. Os dados coletados trouxeram a caracterização do órgão e apresentaram informações sobre as mudanças de procedimentos internos relacionadas à contratação pública, além dos efeitos dessas mudanças para a organização. O estudo demonstrou o quanto a instituição foi receptiva às mudanças e inovações administrativas. Dentre os fatores que ocasionaram as mudanças, destacam-se a flexibilidade que a organização apresenta em adaptar-se às variações externas impostas pelas legislações e normativas e, sobretudo, a necessidade da mudança. Confirmando o caráter sistêmico das organizações, detecta-se que muitas mudanças ocorridas geraram bons resultados.
