Mormons and the World's Fair 1893: A Study of Religious and Cultural Agency and Transformation

January 2012 (has links)
abstract: My dissertation project, Mormons at the World's Fair: A Study of Religious and Cultural Agency and Transformation looks at a pivotal period of transition within the American religious and political national culture (1880-1907). Using Mormonism as an important focal point of national controversy and cultural change, this dissertation looks at the interconnections between Mormon transitions and the larger national transformations then under way in what historians call the "progressive" era. Prominent scholars have recognized the 1893 World's Fair as an important moment that helped initiate the "dawning" of religious pluralism in America. This national response to American religious diversity, however, is limited to a nineteenth-century historiographical framework, which made real religious pluralism in the next century more difficult. Bringing together into one narrative the story of the anti-polygamy crusades of the 1880s, the ambivalent presence (and non presence) of Mormonism at the World's Fair of 1893, and the drawn-out US Senate Hearings and ultimate victory of Mormon apostle and Senator Reed Smoot in 1907, this dissertation offers new insights into the meaning and limitations of American religious liberty, the dynamics of minority agency, as well as a deeper understanding of America's developing national identity. / Dissertation/Thesis / Ph.D. Religious Studies 2012

Salvador

Direitos humanos, imigração e diversidade: um estudo de caso sobre o uso do véu na França / Human rights, immigration and diversity: a case study on the use of the veil in France

Camila Sombra Muiños de Andrade 13 March 2014 (has links)
Since 1989 France has seen the adoption of a set of laws that limit, either directly or indirectly, the wearing of the Islamic veil. Recently, through legislation against the dissimulation of face (n. 1192), adopted on October 11th 2010, the use of the full veil in public spaces has been forbidden. Focusing on the latter, this work aims to understand the arguments that make up the debate through the analysis of the legal opinions and decisions by the following instances: The National Consultative Commission on Human Rights, The National Assembly, The State Council and the Constitutional Council. On the one hand, the paper examines how human rights allegations are in opposition in this case. Indeed, it is based on gender grounds that this law is justified in political speeches, while its opponents claim the right to freedom of thought, speech and religion, as well as cultural freedom. In this sense, the work presents an analysis of how this struggle between rights has been resolved by the various levels of institutions of power in France. On the other hand, considering Frances stance on diversity (especially that resulting from immigration), it investigates how this measure is related to the controversy over the inclusion of immigrants and their descendants into French society. From these perspectives, the study illustrates that if Muslim women were initially put in the position of the victim in the political debate, ultimately they would be regarded as a threat. In this sense, human rights allegations, which boosted the controversy, were gradually replaced by allegations of public order. An innovative concept is that of immaterial public order, based on the assumption of the denial of reciprocity and ignorance of the minimum requirements of society by Muslim women, which justifies the analyzed legislation. Therefore, the objective of this study is to investigate the development of this controversy from the political discourse up to the legal justifications. In doing so, the challenges facing culturally diversified societies and the legitimacy of human rights discourse are highlighted.

While the Legislature is omitted on the scope and protection of religious rest day, the Judiciary Power come constantly creating and abridging rights making up clearly see through the case study of this work, which courts have diametrically opposed decisions, which sometimes they relate to the literalness of the law disregarding the fact that a fair decision must be based on arguments of principle that will make the decisions seek equality and justice. The example of the United States and European Union reinforce the discussion, since there are accommodation mechanisms that comply well with the role of mediators in the search for safeguarding the full exercise of religious freedom in those countries. It is not a perspective that goes against the pillars of formation of the secular State. Before, it is on a quest to give effect to the right of a minority that is still little heard.

Rights and Wrong(s): Theorizing Judicial Decisions as Normative Choices

Cherry, Keith 03 October 2012 (has links)
This thesis contends certain contentious court cases can be traced beyond their legal roots to deep, sometimes incommensurable philosophical disagreements. However, the unitary nature of the judicial system effectively forces the court to take sides, putting its institutional weight and moral authority behind one set of principles and not another. Following Cover, I contend that this encourages future litigants to rephrase their claims in the court’s preferred normative language, thus influencing our normative environment. The theories which guide judicial decisions, however, are generally insufficiently attentive to the court’s normative influence. In response, I attempt adapting Dworkin’s Law as Integrity around Cover’s more sociological view. Chapter 1 examines Cover’s view, Chapter 2 explores Syndicat Northcrest v. Amselem and Delmaagukw v. B.C. as case studies, and Chapter 3 adapts Dworkin around Covers view. My conclusions argue that further inspiration can be drawn from EU Coordinate Constitutionalism and Sui Generis aboriginal rights.

Religious autonomy and the personal law system

Ahmed, Farrah January 2012 (has links)
This thesis examines the Indian system of personal laws (‘the PLS’), under which the state applies a version of religious doctrine to the family matters of citizens whom it identifies as belonging to different religious groups. There has been a lengthy and persistent debate over the PLS, particularly in relation to its discriminatory effects upon women. However, another problem with the PLS has been little commented-upon. Supporters of the PLS emphasise its positive impact on religious freedom to such an extent that there is a pervasive assumption that the PLS is, indeed, good for religious freedom. But there has been surprisingly little critical assessment of the truth of this claim in either academic or political debates. This thesis, a work of applied normative legal theory, attempts to fill this important gap in the literature on the PLS. The thesis addresses the question of how the PLS affects one conception of religious freedom, namely religious autonomy. Its principal findings are that the PLS interferes with the religious autonomy of those subject to it by affecting their religious options (by interfering with their freedom from religion and their freedom to practice religion) and by harming their self-respect (by discriminating on the grounds of sex and religion, and by misrecognising their religious identities). Furthermore, the thesis finds that the PLS cannot be defended in the name of religious autonomy based on the possibility of exit from the system, the advantage of having the ‘option of personal law’, the power it gives people to bind their future selves, the expressive potential of the personal laws, the contribution it makes to membership in a religious community, the contribution it makes to religious group autonomy, or the recognition or validation it provides for religious identities. These conclusions imply that concerns relating to religious autonomy constitute an important set of objections to the PLS. The thesis then considers several reform proposals, including certain modifications of the PLS, a move towards a millet system, ‘internal’ reform of individual personal laws and the introduction of a Uniform Civil Code. It particularly focusses on one reform possibility – religious alternative dispute resolution – which has not been considered closely in the Indian context.

Náboženská svoboda - její ústavní a zákonná úprava a odraz v judikatuře Ústavního soudu / Freedom of worship - its constitutional and statutory regulation and reflection in the caselaw of the Constitutional Cour

Popelková, Martina January 2011 (has links)
This thesis aims to analyze legislation of the Czech legal order concerning religious freedom. The work is divided in two parts. The first part of the thesis deals with the definition of religious freedom in the first place. Afterwards the thesis describes the Constitutional law relating to the religious freedom (especially the Article No. 15 and No. 16 of the Charter of the Fundamental Rights and Freedoms of the Czech Republic), international conventions relating to the theme (e.g. The Universal Declaration of Human Rights, The International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights etc.) and further statutory provisions and legislative rules guaranteeing religious freedom in the Czech Republic. Major part of the thesis relating to the statutory provisions and legislative rules deals with the act No. 3/2002 Coll., on Freedom of religion and the status of churches and religious societies, as amended. The act No. 3/2002 Coll. constitutes basis of regularization of the freedom of religion in the Czech Republic. Various provisions of the act No. 3/2002 Coll. were subject to review of the Constitutional Court of the Czech Republic due to their unconstitutionality. The second part of the thesis discusses various decisions of the...
