The desirability of consistency in constitutional interpretation

Globally, the justice system has set up courts to respond to complaints of a criminal and civil nature. Courts also respond to complaints which require swift relief by way of shortened procedures, in the form of motion proceedings. In all these complaints, courts have to respond in a manner that leaves litigants with a feeling of satisfaction that justice has been done. To the end of ensuring that there is legal certainty, justice systems in all jurisdictions have established a hierarchy of courts, with lower courts being bound by the decisions of higher courts in their jurisdiction. There has been no problem in the application of this principle called stare decisis, or judicial precedent, in disputes of law. However, in disputes of constitutional interpretation, courts have demonstrated a marked shift from observing the rule of judicial precedent. The disregard for this rule manifests itself particularly in the adjudication of cases surrounded by controversy. It is argued herein that constitutional interpretation is no different from legal interpretation, in that the rule of judicial precedent which characterises court decisions in legal disputes, should characterise court decisions in constitutional interpretation disputes. The Constitutional Court of South Africa itself, though it is the highest arbiter in constitutional matters, is bound by its own previous decisions, unless its previous decisions have become manifestly wrong. Three constitutional rights are analysed. The right to life in its three manifestations, namely, the right to life of the unborn child, the right to life of the convicted criminal not to be hanged, and the right of the terminally ill to continue living by receiving medical care at state expense. The other two rights are the right to privacy, and the right to culture. The right to privacy is the right that has been claimed in political controversies. In isolated instances, specifically mentioned herein, the Constitutional Assembly and the drafters of the Constitution have also contributed to the resultant inconsistency in constitutional interpretation. Besides, it intends to deepen the study concerning the applicability of that program to the Brazilian economy, estimating their potential target population in the country and the cost with the workers' remuneration. Essai de redéfinition du tourisme / Approche épistémologique et aménagement touristique du territoire

La question de l’aménagement du territoire est constitutive de toute étude portant sur le tourisme. Elle légitime d’une part la prise en considération d’un secteur sous-estimé, et ouvre par ailleurs à la recherche académique un champ d’application privilégié de par ses effets socioculturel, esthétique, technologique et économique tangibles, et sa portée géopolitique. Ainsi notre projet se situe à la confluence de deux orientations complémentaires. La première s’intéresse au développement des connaissances en tourisme, ainsi qu’à celle des schèmes qui progressivement les façonnent, et vise à en dégager un essai de redéfinition du tourisme, à la fois objet et outil de notre réflexion. Le second vecteur de notre recherche est l’application de cet essai de lecture épistémologique à l’étude des évolutions de l’aménagement touristique du territoire, issues des mutations de l’industrie du tourisme, réflexion en prise directe avec l’actualité touristique et aiguillage possible de politiques d’aménagement. À une synthèse des fondements de l’aménagement du territoire, succède une analyse de l’essor de clientèles émergentes dans le contexte positif du tourisme international. Cette occurrence se double de la mutation numérique du marché touristique qui, de par l’expansion des agences et comparateurs de voyages en ligne, réorganise et diversifie les rôles en redéfinissant la chaîne de valeur entre producteurs et distributeurs. Une analyse des évolutions de la station touristique et des stratégies des nouvelles métropoles touristiques finalise notre recherche. L’ensemble cible dorénavant une clientèle aisée, et requalifie le devenir de l’industrie touristique, activité de classe. / The issue of land-use planning is constitutive of any study on tourism. It legitimates consideration of an underrated sector on the one hand, and moreover opens up a field of application to academic research through its tangible sociocultural, aesthetic, technological and economic effects, and geopolitical impact. So our project is located at the confluence of two complementary orientations. The first focuses on the development of tourism knowledge as well as on the patterns that gradually shape them. It aims to highlight a redefinition attempt of tourism both subject and tool of our reflection. The second vector of our research is the application of this attempt of epistemological reading to the study of the developments in the tourist land-use planning, resulting from the changes in the tourism industry, a reflection in tune with the tourist news and possible switchpoint of land-use planning policies. An analysis of the rise of emerging clienteles in the positive context of international tourism succeeds to a summary of the basis for land-use planning. This instance is coupled with the digital mutation of the tourist market which, due to the expansion of agencies and online travel comparators, reorganizes and diversifies roles by redefining the value chain between producers and distributors. An analysis of the tourist resorts developments and of the new tourist metropolis strategies finalizes our research. The whole targets a wealthy clientele, and classifies the fate of the tourism industry as a class activity.

The aim of this thesis is to document the importance of liquidity resources of central banks during banking panics and financial crises and analysis of the development of LLR function. We examined three historical examples: the banking panic of 1866, the Great Depression and the current financial crisis, and we focused on the interaction between the demand for liquidity on the one hand and the supply of liquidity by central banks on the other. On the wide historical background we also analysed the changes in the function of LLR. We present that a restrictive monetary policy during financial market distortions may lead to further disturbances and cause serious recession. The analysis of the BoE during 1866 and of the FED between 2007 and 2009, on the contrary shows that the expansionary stance and considerably endogenous liquidity supply are able to reduce financial market's distortions and mitigate possible recession. Analysis of FED's reaction also indicated that should the LLR remain efficient, central banks must expand their instruments portfolio.

The master thesis is focused on mapping of all the processes that customer goes through before achieving the skiing activity in ski resort Špindlerův Mlýn, currently operated by MELIDA, a.s. In the theoretical part services specifications, Six Sigma methodology and Key Performance Indicators basics are briefly described. The practical part consists of introduction of the ski area, measuring and mapping processes in combination with weak points identification. In order to eliminate weak points previously identified, the process of getting feedbacks from customers was introduced. As a result of this process, actions to eliminate the weak spots, were proposed and will be implemented. In order to maintain the appropriate structure of the thesis, Six Sigma methodology procedures and instruments, were used.

Les articles constitutifs de cette thèse analysent les défaillances des marchés financiers traditionnellement identifiées par les économistes (associées aux externalités, aux asymétries d'information et à l'incomplétude des marchés) et les réponses des pouvoirs publics. Une observation centrale est que les interventions publiques ne résultent presque jamais d'une analyse à froid de ces défaillances de marché, mais se décident dans l'urgence pour répondre aux dysfonctionnements les plus évidents observés lors d'une crise. Cette approche pragmatique et a-théorique conduit à des interventions mal calibrées. Ces articles s'attaquent notamment à la politique du prêteur en dernier ressort qui encourage l'endettement à court terme des institutions financières, et nourrit le risque systémique. Ils soulignent également les risques de certaines réformes décidées à la suite de la crise des « subprime ». Les pouvoirs publics devraient se concentrer sur la fourniture des biens publics clairement identifiés par l'analyse économique (contrôle des « agents » et information), et ne pas multiplier les interventions hasardeuses qui créent parfois plus d'imperfections de marché qu'elles ne prétendent en résoudre. / The constituent articles of this dissertation analyze the financial market failures traditionally identified by economists (associated with externalities, information asymmetries and incompleteness of markets) and the policy responses. A central observation is that public interventions have almost never resulted from a cold analysis of these market failures but are decided in a hurry to respond to the most obvious shortcomings observed during a crisis. This pragmatic and a-theoretical approach leads to poorly calibrated interventions. These articles are addressing in particular the lender of last resort policy that encourages the issuance of various short-term debts by financial institutions and feeds systemic risk. They also highlight the risks of certain reforms decided after the "subprime" crisis. Governments should focus on the provision of public goods clearly identified by economic analysis (control of "agents" and information), and should not multiply risky interventions that sometimes create more market imperfections than they claim to solve.

Why Be Friends? Amicus Curiae Briefs in State Courts of Last Resort

While there has been a substantial body of research on interest group activity in U.S. federal courts, there has been comparatively little analysis of interest group engagement with state courts. Given that state courts adjudicate the vast majority of cases in the American legal system and very few cases are appealed to the Supreme Court, understanding why organized interests participate in these courts is of great importance. The present study analyzes interest group involvement as amicus curiae in all state courts of last resort from 1995-1999 to examine what factors motivate organized interests to turn to the courts. The results indicate that interest groups are primarily motivated by their policy goals in deciding which cases to file amicus briefs in, but that they are limited in their ability to file by institutional constraints unique to state courts of last resort. This research provides insight into interest group behavior, state courts and the role organized interests play in influencing legal outcomes in the American states.

Subject of this diploma thesis is a design of a newly built accommodation and relaxation centre Resort Sázava. The structure is located on a sloping plot near town Sázava, in Kraj Vysočina. The locality is situated in preserved area Žďárské vrchy. The facility is divided into three buildings by their function. The buildings have rectangular shapes and have gabled roofing. The resort offers services of accomodation, boarding, conferences, relaxation and sports. The whole facility was designed in architectural study along with its functional linkups. Object SO 01 with restaurant and conference rooms was designed in detailed design documentation.

Přestavba Janečkova mlýna / Reconstruction of the Janeček mill

The task of this diploma thesis was the development of construction documents for the implementation of project, icluding project specialization. This is a rebuilding of the existing mill and it´s conversion to the object. Proposed reconstruction is solved with a sense of highlighting the exist building and expressing his dominance and function in an environment, where the building is located. From the original state was preserved only main building in historical style, and in contrast to this building were proposed two smaller objects with the background. The object is used as a pension for the accommodation for persons, restaurant and also provides rooms for seminars and meetings. Due to a brooklet flowing in front of the building and location of pension between the spa´s and city parks is the use of this building more than suitable.

This diploma thesis deals with the recreational activities of the inhabitants of Prague and their influence on the transformation of the suburban landscape at the time of industrialization. It characterizes the time period from the mid-19th century to the 40s of the 20th century. The thesis is divided into the theoretical and empirical part. In the theoretical part, it deals with the period of industrialization and, in connection with it, also with the industrial revolution. Further, the work is devoted to concrete manifestations of mass and individual recreation in the 19th century and consequently demographic growth of the inhabitants on the Czech territory, development of the middle class, establishment of the resort and the origin and importance of the Beautification Committee. The theoretical part ends with the characteristics of summer flats and other manifestations of individual and mass recreation until the middle of the 20th century. The empirical part deals with the characteristic, natural, geomorphological and historical development of Senohraby village. The main part of the work focuses on the development of recreational buildings from the 1918s to the 40s of the 20th century on the basis of archive materials.
