The study investigates the changes occurred in the right to image since its acclaim as a right of the personality and as autonomous of others rights until the present day. The research also seeks to present concepts that are not well known in the law, but which are fundamental to understand the dimension of new technologies and their supporting role in today's society. Through national jurisprudence, the present work demonstrates the importance of the right to the image within the context of social networks / Este trabalho analisa o tema do direito à imagem na perspectiva civilista, frente aos desafios impostos pela tecnologia e, principalmente, pelo advento das redes sociais. O estudo investiga as mudanças ocorridas no direito à imagem, desde sua consagração como direito da personalidade autônomo dos demais, até os dias atuais. A dissertação busca, ainda, apresentar conceitos pouco conhecidos do campo do Direito, mas que são fundamentais para entender a dimensão das novas tecnologias e seu papel como coadjuvante na sociedade atual. „Google Street View" atvejis: teisės į privatumą ir technologijų plėtros santykis / “Google Street View” case: relationship between the right to privacy and technology development

Šiandien gausu technologijų, kurios suteikia galimybę paprasčiau bendrauti, dalintis informacija bei įspūdžiais, kitos, tikėtina, atlieka prevencinę funkciją prieš nusikaltimus, apsaugant mus ir mūsų nuosavybę. Tačiau tokia technologijų plėtra iškėlė grėsmę pačiam asmeniui, sumažindama teisę išlaikyti savo privatumą. Konkrečiau kalbant, turima omenyje tik tas technologijas, kurios susijusios su asmens atvaizdu ir jo paviešinimu. Viena iš tokių technologijų yra 2007 metų gegužę Jungtinėse Amerikos Valstijose pristatyta Google Street View paslauga – jos pagalba galima virtualiai keliauti po pasaulį ir matyti aplinką 360 laipsnių kampu. Pasirodžius minėtai paslaugai kilo didžiulis sąmyšis dėl intervencijos į asmens privatumą, nes įgyvendinant užmanytą šio projekto tikslą, kartu su gatvių ir pastatų vaizdais buvo užfiksuoti ir žmonės. Todėl šiame darbe pateikiama minėtos paslaugos ir jos poveikio asmens privatumui analizė. Pagrindinis darbo tikslas – išsiaiškinti, ar Google Street View pažeidžia teisę į privatų gyvenimą. Siekiant minėto tikslo pirmoje darbo dalyje analizuojama teisės į privatų gyvenimą samprata pagal tarptautinę ir nacionalinę teisę, toliau analizuojamas minėtos paslaugos įgyvendinimo atitikimas valstybių iškeltiems reikalavimams. Antroje darbo dalyje analizuojami du privatumo pažeidimo atvejai: gatvėje ir privačioje teritorijoje. [toliau žr. visą tekstą] / Today there are numerous technologies, that allow to have easier communication with each other or to share information, the other part of them are likely to perform preventative function againts crimes, in order to protect person and his property. The advancement of new technologies is changing the world, however, it raises the threat to the person by reducing his right to maintain his privacy at the same time. More specifically are meant only technologies that deal with person’s image and its disclosure. One of such technologies is Street View project of Google, which was introduced in May 2007 in United States of America. Street View makes possible to take a virtual travel around the world and viewing and navigating within 360 degree scenes of street-level imagery. Its realization caused huge commotion because of intervention to privacy – the cameras of Google vehicles captured images not only of buildings, automobiles but even passersby. The aim of this thesis is to ascertain whether Google Street View violates the right to the private life. The work is devided into three chapters. In first chapter of thesis the conception of the right to privacy according to international and national law is discussed. The realization of Google Street View under the standarts defined by States is also included into this chapter. Le sportif professionnel employé par une entreprise sportive est aujourd’hui généralement considéré comme un véritable salarié, titulaire de tous les droits et débiteur de toutes les obligations découlant de l’existence d’un contrat de travail. Pendant longtemps, la qualification de contrat de travail a pourtant paru incongrue, en raison de l’originalité de l’environnement normatif propre au domaine sportif.Il est vrai que la situation juridique du sportif salarié est empreinte d’une grande originalité : les transferts et les prêts de joueurs entre clubs, la mise à disposition d’un sportif auprès d’une fédération et l’exploitation commerciale de l’image d’un sportif posent des problèmes qui sont parfois très éloignés des préoccupations classiques du droit du travail.Les apparences sont pourtant trompeuses. Le sportif professionnel est avant tout un salarié, placé dans une situation certes spécifique, mais qui justifie l’application du droit du travail. Le contrat de travail du sportif professionnel est soumis aux exigences du droit : seule une prise en compte des données sportives permet de les adapter.Ces particularités de la relation de travail sportive méritent d’être étudiées, car les questions relatives à la formation, l’exécution et la rupture du contrat de travail du sportif professionnel supposent des réponses adaptées à ses conditions d’emploi. / The professional sportsperson who is employed by a sporting firm is generally considered nowadays as a bona fide worker, legally entitled to all of his or her rights and debtor of all the obligations entailed from the existence of a work contract. Yet for a long time the term ‘work contract’ seemed incongruous, given the originality and the normative environment pertaining specifically to the sportsperson.Indeed the legal situation of the wage-earning sportsperson (that is to say all his or her rights and obligations) is very specific; the issue of the transfers and loans of players between clubs, that of the provisioning of an athlete to a federation or of the commercial exploitation of a sportsperson’s image can be far removed from the standard issues of labour law.Appearances are however deceiving. The professional sportsperson is first and foremost a worker, admittedly one who is in a specific situation, but one for whom the application of labour law is justified, except in the case of more favourable conditions. A professional sportsperson’s work contract is subject to the requirements of state law; only when sporting data is taken into account can these requirements be adapted.These specificities in the sporting work relationship deserve to be studied, for the issues concerning training, the implementation and the breach of a sportsperson work contract require answers that are adapted to his or her employment conditions.

Num mundo de difusão de imagens, por meios eletrônicos ou gráficos, onde conceitos, mensagens (publicidade comercial, estatal e política) e acontecimentos (por exemplo, no jornalismo) são mostrados, o direito humano à imagem é colocado à prova, pois detentores do direito reclamam do seu uso indevido. Para o Direito, algumas questões mostram-se relevantes, à medida que se busca a tutela do direito à imagem. O que é a imagem de uma pessoa? O que é imagem retrato e imagem atributo? Existe uma representação de grupo, imagem do grupo? Um determinado grupo pode reclamar direito à imagem? Quais as características de tal direito? Se imagens divulgadas (ex: imagens transmitidas pelas ondas eletromagnéticas) informam características fenotípicas de raça e cor, há uma imagem retrato das pessoas da cor/raça negra? Como os negros (as) querem ser representados na mídia? A pesquisa empírica mostra que as pessoas querem ser representadas na mídia com respeito. Tal postura comporta uma compreensão das pessoas como seres únicos, com suas próprias características. / In a world broadcast images, electronically or graphs, where concepts, messages (commercial advertising, political and state) and events (eg, journalism) are shown, the human right to the image is put to the test, as holders of rights complain about its misuse. To the Right, some questions show up relevant, as it seeks the protection of the right to the image. What is the image of a person? What is portrait image and image attribute? There is a group representation, group picture? A particular group can claim any rights to the image? What are the characteristics of such a right? If images released (eg images transmitted by electromagnetic waves) inform phenotypic characteristics of race and color, there is a portrait of people of color / black race image? How blacks want to be represented in the media? Empirical research shows that people want to be represented in the media with respect. This attitude involves an understanding of people as unique individuals with their own characteristics.
