Les ressorts littéraires de la pensée philosophique dans les Essais de Montaigne / Montaigne's Philosophical Ingenuity

Nombreux sont les travaux consacrés aux Essais à avoir embrassé d’un seul regard les caractéristiques littéraires et la teneur philosophique du livre de Montaigne. Mais la nature philosophique de la prose d’idées des Essais restait une évidence inquestionnée ; c’est ainsi que s’est constituée une représentation opaque de l’œuvre selon laquelle l’ensemble réputé inextricable de ses aspects ne pouvait être pensé qu’à travers la catégorie doxographique du scepticisme. Enquête méthodologique et critique, la présente thèse vise à dissiper cette opacité en dégageant spéculativement les fondements d’une manière alternative de rendre compte de la philosophie dans les Essais à partir de son articulation avec les propriétés du texte. L’expérience que le lecteur des Essais peut faire de la philosophie montanienne est spécifique : cette philosophie se manifeste comme détermination. Est ensuite démontrée la nécessité méthodologique de localiser la philosophie à sa juste échelle dans le texte pour pouvoir rigoureusement l’identifier. Il apparaît alors que ce n’est qu’à la faveur d’une compréhension poïétique des ressorts textuels de la pensée montanienne que devient véritablement pensable la philosophie des Essais. La description de la philosophie des Essais sur laquelle débouche cette investigation permet enfin de prendre la pleine mesure de l’inventivité d’une pensée tributaire d’une écriture, aux sens matériel et stylistique du terme. / It is common practice for works pertaining to Montaigne's Essays to embrace in a single glance its literary characteristics and its philosophical content. But the philosophical nature of the Essays' non-fictional prose has yet remained unchallenged, crystallizing an opaque representation of the text that precludes its supposedly inextricable aspects from being thought outside the doxographic category of skepticism. A methodological and critical enquiry, the present thesis intends to dispel this opacity by speculatively unfolding the fundamental principles for an alternative construal of the Essays' philosophical content, rooted in its articulation with the properties of the text. The way in which the reader of the Essays shall experience Montaigne's philosophy is specific: this philosophy emerges as semantically determined content. From this ensues the methodological imperative to localize philosophy at its legitimate scope of focus within the text in order to allow for its rigorous identification. It then appears that philosophy of the Essays can only be truly thought through the lens of a poietic understanding of the textual elements of Montaigne’s thought. Finally, the description of the philosophy of the Essays brought about by this enquiry sheds light on the full extent of the ingenuity of Montaigne's thought, tributary of his writing in both the material and stylistic senses of the term.

Stratégie de lutte contre les catastrophes pétrolières et risque environnemental associé : évaluation de la toxicité d’un dispersant en milieu côtier chez Liza sp / Response technique for oil spill and environmental risk : toxicity of dispersant application in nearshore area upon Liza aurata

Lors de catastrophes pétrolières, l’utilisation de dispersant est une stratégie de lutte qui permet le transfert de la nappe de pétrole de la surface vers la colonne d’eau, sous forme de gouttelettes d’hydrocarbure. En milieu côtier, la dispersion d’une nappe de pétrole est une mesure controversée car la faible profondeur de la colonne d’eau ne permet pas une dissémination rapide des gouttelettes d’hydrocarbure et expose ainsi les écosystèmes aquatiques à de fortes concentrations de contaminant. Afin d’évaluer la toxicité de l’application de dispersant en zones côtières, une approche expérimentale a été menée chez des juvéniles de Liza sp. en considérant trois scenarii : (i) la dispersion mécanique de la nappe simulant une dispersion naturelle due aux conditions météorologiques ; (ii) la dispersion chimique de la nappe simulant l’application de dispersant ; (iii) l’absence de dispersion de la nappe simulant son confinement avant récupération. La toxicité de chaque condition a été évaluée au travers d’une mesure de la mortalité sur un groupe d’individu, par l’estimation des performances de nage et de la capacité métabolique au niveau de l’organisme, et par une approche multimarqueur au niveau de l’organe.La comparaison entre une nappe de pétrole non dispersée et une nappe de pétrole dispersée chimiquement montre que l’application de dispersant entraine une augmentation des phénomènes de mortalité et une diminution, au niveau hépatique et branchial, des capacités de défense contre les xénobiotiques. A l’inverse, la comparaison entre une nappe de pétrole dispersée mécaniquement et chimiquement montre que, lorsque l’agitation de la mer est importante, l’application de dispersant ne semble pas potentialiser la toxicité du pétrole.Ces résultats suggèrent que (i) la récupération de la nappe de pétrole devrait être considérée comme une technique de lutte prioritaire sur l’utilisation de dispersant ; (ii) l’application de dispersant pourrait être considérée lors de conditions météorologique appropriées. / Dispersant application is an oil spill response technique which accelerates the dispersion of petroleum from the sea surface into the water column by inducing the formation of oil droplets. In coastal areas this response technique is controversial since the low water depth reduces the dissemination of oil droplets and by the way increases the exposure of aquatic ecosystems to petroleum. To evaluate the toxicity of dispersant application in nearshore areas, an experimental approach was conducted. Juvenile of Liza sp. were exposed to three scenarios of contamination: (i) to chemically dispersed oil - simulating, in vivo, dispersant application ; (ii) to mechanically dispersed oil - simulating, in vivo, natural dispersion due to meteorological conditions ; (iii) to an undispersed oil slick simulating, in vivo, oil slick confinement as a response technique. Toxicity of each condition of exposure was evaluated through the mortality upon a group of individuals, through the swimming performance and the metabolic scope at the organism level, and through the measurement of biomarkers at the organ level.Comparison between an undispersed oil slick and a chemically dispersed oil slick shows that dispersant application induces an increase of the mortality and decreases the ability of the animal to cope with environmental contaminants (deduced from gill and liver total glutathione rate). Conversely, comparison between both a mechanically and a chemically dispersed oil slick, suggests that, when sea water is under mixing processes, dispersant application does not enhance petroleum toxicity. Taken together these results suggest that (i) an oil slick must not be dispersed when recovery can be conducted; (ii) dispersant application could be considered as a response technique when meteorological conditions are appropriated.

Rezultativní diskurzní konektory v odborném textu / Result/inference discourse connectives in academic texts

The present thesis compares the use of result/inference discourse connectives in two corpora compiled by the author. The student corpus consists of 43 literary essays by Czech university students of English and American studies and the reference corpus contains 34 journal articles written by native expert writers. The main objective of the thesis was to determine to what extent students resemble professional writers in their use of result/inference connectives with respect to the frequency, position and scope of the connectives. The thesis revealed a strong overall overuse of result/inference connectives by students as well as overuse and underuse of individual connectives. It was also found that both types of writers generally prefer initial to non-initial placement of result/inference connectives; however, students more frequently use the connectives with the immediate scope.

Private copying in the digital environment

Digitalisation and the internet have enabled ordinary individuals to make copies of copyrighted content easily, costlessly and with no degradation in terms of quality. While digital private copying is permitted in Europe under Article 5(2)(b) of Directive 2001/29/EC, it represents a major challenge to the interests of the copyright owners and a thorny issue in the context of digital copyright. Despite the fact that all EU Member States, with the exception of Ireland and the UK, have incorporated a statutory limitation for acts of private copying in their national statutes, there is legal uncertainty as to the scope of this limitation. To be permitted, the use of copyrighted content ought to be private and non-commercial; these concepts, however, do not translate well in the digital environment. For instance, one can only wonder whether facebook friends qualify as a private circle and whether downloading works for free from file-sharing networks is a non-commercial act. This thesis provides answers to these questions and determines the actual scope of the private copying limitation. Yet, perfectly lawful private uses of copyrighted content may have an aggregate impact on the interests of the rightholders in the digital environment, where these activities are more widespread. To deal with the digital impact of private copying, Directive 2001/29/EC sets forth a twofold approach; while private copying is premised on condition that the rightholders are compensated for the unauthorised uses of their works, at the same time, the application of technological protection measures is rigorously protected. We examine the efficacy of these approaches in dealing with digital private copying and their adequacy for policy reasons. This thesis concludes that, even though private copying is permissible under the set of conditions laid down by Article 5(2)(b) of Directive 2001/29/EC, its legitimate exercise is jeopardised in the digital environment due to the fact that this limitation is not mandatory. This means that the ability of end users to make private copies may be either technologically or contractually restricted. Yet, the private copying limitation is a manifestation of the fundamental right to privacy, which prevails over copyright enforcement. We therefore urge for an explicit declaration of the imperative status of the private copying limitation against technological or contractual constraints.

Thesis is focused on trading information systems in capital markets. The aim of this thesis is to analyze trading information systems and create model of hypothetical online trading platform. The model should consolidate the knowledge of the existing solutions for trading in the capital market. The thesis is divided into three parts. The theoretical part provides a basic description of trading information systems in the capital market. Second, analytic part of the thesis is focused on structure of brokerage trading information system. The first analysis is focused on analyze portfolio of the current trading platforms offered by brokerage. The second analysis is focused on analyze internal functionality structure of the selected group of trading platform. The aim of this analysis is to find and describe the portfolio functionalities of trading platforms and identified the basis or standard functionalities of trading platforms. Resulting data from second analysis are important for third part for this thesis. Third, main part of this thesis is devoted on creating model of hypothetical online trading platform. This part consist several sets of models and together created one complex model of hypothetical online trading platform.

Le droit "exclusif" de l'organisateur sportif / Sports organiser's "exclusive" right

L’organisateur sportif est investi en France d’une prérogative juridique singulière qui lui accorde une maîtrise souveraine de la commercialisation de ses événements sportifs. Organisée dans un premier temps autour d’un monopole de fait, cette réservation du spectacle sportif est aujourd’hui pleinement consacrée au sein de l’article L. 333-1 du Code du sport. Pourtant, en raison de l’assignation d’un régime juridique laconique, la réception légale de la patrimonialisation du fait sportif laisse perplexe et impose, pour en saisir parfaitement le sens, de devoir s’interroger sur sa nature. Ne se satisfaisant ni de la qualification doctrinale de droit sui generis, ni de la qualification doctrinale de droit voisin, le droit de l’organisateur sportif doit être alors appréhendé comme un nouveau droit de propriété incorporelle. En effet, la subjectivation du spectacle sportif se veut être l’aboutissement de la transposition du concept général de droit de propriété à la problématique de l’appropriation de la compétition sportive. En d’autres termes, l’article L. 333-1 du Code du sport institue un droit de propriété original qui, au-delà de l’incorporalité de son objet, fonde directement son régime à partir de ce qui est au cœur de la singularité de l’activité sportive compétitive, à savoir l’aléa sportif. Ainsi, au-delà des dispositions spécifiques du Code du sport, le droit « exclusif » de l’organisateur sportif doit-il directement s’inspirer des dispositions résiduelles du Code civil / The sports organiser has, in France, a singular legal prerogative that grants him a sovereign control over the marketing of its sports events. Organized initially around a de facto monopoly, this reservation of the sporting spectacle is now fully laid down in article L. 333-1 of the sport code. However, due to the assignment of a laconic legal regime, the legal reception of the patrimonialization of the sporting fact leaves perplexing and imposes, in order to seize perfectly its meaning, to have to determine its nature. Not being satisfied either with the doctrinal qualification of sui generis law, or with the doctrinal qualification of neighboring rights legislation, the right of the sports organiser must be then regarded as a new right of intangible property. Indeed, the subjectivation of the sporting spectacle is intended to be the culmination of the transposition of the general concept of property right to the issue of the appropriation of sporting competition. In other words, article L. 333-1 of the sport code establishes an original ownership right which, beyond the incorporation of its object, directly bases its regime on what is at the heart of the singularity of competitive sports activity, namely the sporting uncertainty. Thus, beyond the specific provisions of the sport code, the sports organiser’s “exclusive” right must be directly inspired by the residual provisions of the civil code

Dotation, travail d’équipe et étendue de pratique : une analyse de l’association avec la sécurité des patients dans le contexte de réadaptation

Le système de santé actuel fait face à une augmentation du vieillissement et des maladies chroniques. Les professionnels de la santé doivent prodiguer des soins de plus en plus complexes. Il est ainsi nécessaire de disposer de personnel en quantité suffisante, utilisant toute l’étendue de leur pratique et opérant dans un environnement de travail favorable. Le but de cette étude est de décrire l’organisation des services (dotation, étendue de pratique et travail d’équipe) dans trois centres hospitaliers de réadaptation de la région de Montréal et d’examiner l’association entre l’organisation des services et la sécurité des patients. Un devis descriptif corrélationnel a été utilisé. En total, cinq unités de réadaptation ont participé à cette étude pour une période de 93 jours. L’unité d’analyse est le quart de travail pour un total de 1 395 quarts analysés. Cette étude originale indique que les unités de réadaptation examinées sont caractérisées par une dotation d’intensité modérée, un niveau relativement faible de soins manquants et une perception moyennement favorable du travail d’équipe. Une association directe et positive a été trouvée entre la sécurité des patients et l’intensité de la dotation, de la proportion d’infirmières bachelières et d’une façon inattendue, du personnel de la main d’œuvre indépendante. Par ailleurs, cette étude montre le rôle clé de la dotation en personnel (la quantité de ressources mesurée par le nombre d’heures de personnel par quart-patient et la composition de l’équipe mesurée par la prédominance d’infirmières bachelières par quart) dans la réduction du risque de survenue d’événements indésirables. / The current healthcare system is experiencing a growth of the aging population and the complexity of chronic diseases. Healthcare professionals must provide increasingly complex care. Therefore, it is necessary to have enough staff, using the full scope of their practice and operating in a favorable working environment. The aim of this study is to describe the organization of nursing services (staffing, scope of practice and teamwork) in three rehabilitation hospitals in the Montreal region and the association between the organization of services and patient safety. A correlational descriptive study was conducted. In total, five rehabilitation units participated in this study for a period of 93 days. The unit of analysis was the working shift for a total of 1 395 shifts analyzed. This original study indicates that the rehabilitation units examined are characterized by a moderate staffing intensity, a moderate favorable perception of teamwork score and a relatively low score of missed care. A positive and direct association was found between the staffing intensity, the proportion of nurses with bachelor’s degrees, and unexpectedly the proportion of agency staff and patient outcomes. It indicated the key role of the staffing (the quantity of resources measured by the staff hours per patient shift, and the team composition measured by the predominance of bachelor nurses per shift) in reducing the risk of occurrence of adverse events in rehabilitation.

Vyhledávání homologních enzymů / Detection of Homologous Enzymes

Tato práce se zabývá vyhledáváním homologních enzymů v proteinových databázích, jejímž cílem je navrhnout nástroj poskytující takové vyhledávání. Čtenář se seznámí se základní teorií týkající se proteinů, enzymů, homologie, ale také s existujícími nástroji pro vyhledávání homologních proteinů a enzymů. Dále je popsáno ohodnocení nalezených existujících nástrojů pro vyhledávání homologních enzymů. Pro potřeby vyhodnocení byla vytvořena datová sada spolu s algoritmem pro vyhodnocení vyýsledků jednotlivých nástrojů. Další částí práce je návrh a implementace nové metody pro vyhledávání homologních enzymů společně s jejím vyhodnocením. Jsou popsány dva algoritmy (One-by-One a MSA) pro vyhledávání homologních enzymů, jejichž porovnání ukazuje, že MSA algoritmus je zanedbatelně lepší z hlediska přesnosti než One-by-One algoritmus zatímco z hlediska rychlosti vítězí One-by-One algoritmus.

The ideal of an integrated national qualifications framework

This study deals with the extent to which the South African education and training system reflects in principle, perception and practice, the ideal of an integrated national qualifications framework. It examines the uses and meaning of ‘integration’ through a number of lenses. These lenses include policy symbolism and a guiding philosophy for the emerging system; pragmatic and technical considerations; communities of practice; the complementarity of education and training; and curricular integration. In relation to the first two lenses, it is evident that an integrated framework is a powerful symbol of the break from a past system characterised by inequality, unfairness and deliberate mediocrity, to the extent that ‘integration’ has become the underpinning guiding philosophy for a new education and training system. However, such socio-political aspirations tend to place unreasonable demands on the system. The second set of lenses indicate that the ‘comprehensiveness’ of the system could work against the notion of integration, and in South Africa, has led to acute paralysis of the system. The strongest evidence of integration emerges from the last set of lenses namely, the grounded, meaningful practice through principled partnerships, as reflected in the development of sub-frameworks and communities of practice and the necessary collaboration needed for curricular integration and education and training delivery. Thus, it seems, to make integration meaningful, the persuasive logic of innovative, grounded practice, could be enabled and facilitated by less, not more, regulation and could be enhanced by structures that reflect the grounded practice.
