Inappropriate or Unlawful Strikes. Are they Strikes? / Las Huelgas Improcedentes o Ilegales ¿Son Huelgas?

The constitutional right to strike in Peru is developed by a very strict policy that determines the origin of the measure to a view of the administrative labor authority that may be issued in two instances. However, there are rules that allow understand the existence of the strike despite not having the decision of that authority as they prevent the employer to freely exercise its disciplinary powers to an improper or illegal paralysis. With regard to recent decisions of the labor inspection, this article analyzes this situation and seeks to present some solutions consistent with the essential content of this constitutional right. / El derecho constitucional a la huelga es desarrollado en el Perú mediante una normativa muy estricta que condiciona la procedencia de la medida a una opinión de la autoridad administrativa de trabajo que puede ser emitida en doble instancia. Sin embargo, existen normas que permitirían entender la existencia de la huelga a pesar de no contar con la aprobación de dicha autoridad dado que impiden al empleador poder ejercer con libertad su facultad disciplinaria ante una paralización improcedente o ilegal. A propósito de recientes decisiones de la inspección de trabajo, el presente artículo analiza esta situación y busca presentar algunas soluciones coherentes con el contenido esencial del derecho constitucional.

"Not just supporting but leading" : the involvement of the women of the South Wales Coalfield in the 1984-85 miners' strike

The 1984-85 miners’ strike dramatically changed the face of the South Wales Valleys. This dissertation will show that the women’s groups that played such a crucial supportive role in it were not the homogenous entity that has often been portrayed. They shared some comparable features with similar groups in English pit villages but there were also qualitative differences between the South Wales groups and their English counterparts and between the different Welsh groups themselves. There is evidence of tensions between the Welsh groups and disputes with the communities they were trying to assist, as well as clashes with local miners’ lodges and the South Wales NUM. At the same time women’s support groups, various in structure and purpose but united in the aim of supporting the miners, challenged and shifted the balance of established gender roles The miners’ strike evokes warm memories of communities bonding together to fight for their survival. This thesis investigates in detail the women involved in support groups to discover what impact their involvement made on their lives afterwards. Their role is contextualised by the long-standing tradition of Welsh women’s involvement in popular politics and industrial disputes; however, not all women discovered a new confidence arising from their involvement. But others did and for them this self-belief survived the strike and, in some cases, permanently altered their own lives. The activities of the women’s support groups confirmed changes in the social role of women that had been occurring since the 1960s in the coalfield communities of South Wales, and thereby contributed to a revision of the traditional notion of ‘communities’ which were changed by the very process of being defended.

The requirement of notice of industrial action in South African labour law

This dissertation is a critical analysis of the provisions of sec 64(l)(b) and (c), 66(2)(b) and 77(l)(b) and (d) of the Labour Relations Act 66 of 1995 which prescribe notice of industrial action as a requirement of protected industrial action in South Africa. It traces the historical background of the requirement. It also addresses issues such as the purpose(s) of the notices, their scope of application, meaning, implications, who must give notice, to whom must notice be given, timing, computation, their duration, the consequences of failure to comply with them and various potential difficulties in the practical application of the notice requirement as well as the unintended consequences flowing from the provisions. Recommendations are made for the amendment of the Act in certain respects. The dissertation concludes that there is no justification for the inclusion in the Act of this requirement. Stratigraphic Record of Pliocene-Pleistocene Basin Evolution and Deformation Along the San Andreas Fault, Mecca Hills, California

Sedimentary rocks in the Mecca Hills record a 3-4 Myr history of basin evolution and deformation within the southern San Andreas fault (SAF) zone. Detailed geologic mapping, measured sections, lithofacies analysis, and preliminary paleomagnetic data indicate that sedimentation and deformation in the Mecca Hills resulted from evolution of local fault zone complexities superimposed on regional subsidence and uplift. Sediment was derived from sources northeast of the SAF and transported southeast along the fault zone in large rivers, alluvial fans, and a smaller fault-bounded lake. Inversion of the Painted Canyon fault from oblique SW-side down to SW-side up slip was the main control on local deposition and deformation. Regional controls are suggested by an angular unconformity observed in the Mecca and Indio Hills along ~50 km of the SAF and synchronous post-740 ka uplift northeast of the SAF along ~80 km of the fault zone.

Tufting of complex composite structures

This study focuses on the effect of tufting on the mechanical and electrical properties of carbon composites using a variety of tuft materials, such as aramid, steel and copper. Several configurations were investigated based on a case study, involving the reinforcement of stiffener-to-skin interfaces of a tail cone. The effect of tuft and base composite material, tufting depth and inclination on the delamination resistance in mode I was evaluated, the associated bridging laws were determined and the failure mechanisms were identified. A simplified superposition model of the delamination response of tufted composites was developed. The electrical performance of tufted composites was determined in simulated lightning strike tests and set against the through-the-thickness electrical conductivity of the materials. The results of mechanical testing showed that the delamination performance depends strongly on the material response of the tufts, with both the bridging behaviour and final toughness levels influenced directly by the strength, ductility and ultimate strain of the tufts. Interactions between the tufts and the surrounding composite, such as interfacial shear and bridging induced by tuft pull-out, play a significant role in the overall behaviour generating a deviation from a simple superposition of the base material and tuft response. The balance between interfacial shear and tuft elongation results in a decreasing trend of delamination toughness with increasing tufting depth for low ductility materials, whilst the trend is reversed for the high ductility copper tufts. This balance is also affected by the properties of the base material, with tougher matrices leading to dominance of shear effects and a weaker enhancement introduced by tufting. Inclination of tufts leads to an increase in crack energy release rate due to the activation of a ploughing mechanism. Metallic and carbon tufts have a positive effect on lightning strike response, with copper tufting offering strike protection at an improved level compared to standard copper mesh solutions.

Développement d'une approche de paléosismologie géophysique par imagerie Géoradar. Applications aux failles décrochantes actives de Nouvelle Zélande / Developping a novel GPR-based paleoseismology. Case studies on the active strike slip faults in New Zealand

Acquérir des informations sur les forts séismes passés est crucial pour anticiper les caractéristiques des forts séismes futurs. Une partie des traces laissées par les forts séismes passés sont enfouies dans les premiers mètres du sol et sont en général révélées par des tranchées de quelques mètres de profondeur ouvertes à travers les failles sismogènes. Bien que pertinente, cette méthode est destructive. L'objectif a été de développer une nouvelle forme de paléosismologie, non destructive, basée sur l'imagerie géoradar pseudo 3D, capable de retrouver ces traces enfouies des séismes passés. Dans ce travail, cinq sites d’étude sont présentés, situés le long de failles actives décrochantes de Nouvelle Zélande. Notre nouvelle approche débute, dans un premier temps, par l’analyse ‘classique’ de la morphologie de surface à partir de données LiDAR et de MNT GPS haute résolution. Ceci nous permet d’identifier l'ensemble des marqueurs morphologiques préservés à la surface et les déplacements horizontaux qu’ils ont enregistrés. Dans un second temps, l’analyse des profils GPR pseudo-3D acquis en chacun des sites révèlent des réflecteurs principaux dans les premiers 5-10 m du sol recoupés par un grand nombre de marqueurs morphologiques, partiellement ou totalement invisibles en surface. La plupart de ces marqueurs enfouis sont coupés et décalés par la faille considérée. Les mesures de ces décalages fournissent des collections denses de déplacements cumulés sur chacune des failles investiguées avec généralement un nombre de mesures effectués en sub-surface 10 à 20 fois plus important qu’en surface et couvrant une plus large gamme de valeurs. L’application sur la faille de Hope de cette approche a notamment permis de mettre en évidence un déplacement latéral caractéristique de 3.2 ± 1 m lors des 30-35 derniers forts séismes. Ce travail démontre le potentiel de l'imagerie géoradar pseudo-3D à détecter une partie de l'histoire sismique des failles et, ce faisant, à fournir des informations sur les caractéristiques des forts séismes passés. / Collecting information on past strong earthquakes is crucial to anticipate the characteristics of the future strong earthquakes that threaten us. A part of the traces left by the past earthquakes remains hidden in the first few meters of the ground. Until now, paleoseismological trenches across faults have been used to search for these traces. Though relevant, this method is destructive and allows, at best, detecting the few most recent events. The objective of my PhD work, done in the framework of the ANR project CENTURISK, was to develop a novel form of paleoseismology, of geophysical type, based on multi-frequency, pseudo-3D GPR surveys. The idea is to image at high-resolution the architecture of the first ≈ 10 m of the ground over wide areas along active faults, in order to detect the possibly buried traces, especially the offsets, produced by the last 10-20 strong earthquakes on the fault. We have first developed the approach by adapting the acquisition and processing of GPR data to the selected targets. We have then applied the approach on some of the largest active strike-slip faults in New Zealand, where sedimentation conditions are ideal. Twelve sites were investigated, 5 of them are presented in this work. At each site, we first analyzed the surface morphology in the greatest detail on LiDAR data and high resolution GPS DEMs. This analysis allowed us to identify all the morphological markers preserved at the ground surface, and being offset by the fault. We measured these surface offsets, doing so collecting a dense population of cumulative displacement values. We then surveyed each site with 40-60, 100 and 250 MHz, hundreds of meters long GPR profiles, parallel to the fault and regularly spaced by 5-10 m on either side of the fault trace. At each site, the processing of the GPR data revealed a large number of buried markers – palaeosurfaces and incision features, hidden in the first 5-10 m of the ground. Most of the buried markers were observed cut and laterally displaced by the fault, and these offsets could be measured. The measures provide a dense collection of cumulative offsets on each investigated fault, generally 10-20 times more than ever reported. To analyze these dense surface and sub-surface data collections, we used statistical methods made to define and retain only the best constrained offset values. These best values are separated by slip increments that are directly related to the successive coseismic slips that we search. The entire analysis revealed that the offsets measured in the sub-surface fill the gaps in the surface record, and that the surface offsets are systematically lower than those measured in the sub-surface on the same markers. Additionally, the buried record is longer than the surface record. Applied to the Hope Fault, our novel approach allowed identifying the last 30-35 strong earthquakes that broke the fault, each had produced a lateral offset at surface of 3.2 ± 1 m and got a magnitude ≈ Mw 7.0-7.4. Applied to the Wellington Fault (at Te Marua site), the approach allowed identifying a minimum of 15 past strong earthquakes, each had produced a lateral offset at surface of 3.7 ± 1.7 m and got a magnitude ≈ Mw 6.9-7.6. My PhD work thus confirms the great potential of pseudo-3D Ground Penetrating Radar survey to detect a significant part of the fault seismic history, and thus to provide critical information to determine the displacements and magnitudes of the past strong earthquakes on faults. Applied to seismogenic faults worldwide, in complement to surface approaches, the geophysical GPR paleoseismology should help better assessing seismic hazard.

Associação criada por professores secundaristas e normalistas com o objetivo de defender os interesses da categoria. Analisamos as diferentes formas de organização experimentadas ao longo dos anos, a partir de um duplo movimento. Externamente, provocado pelas transformações sociais, políticas, econômicas e culturais vivenciadas no Brasil e no mundo que interagiram na formação do campo educacional paulista. Internamente, decorrente de uma dinâmica própria, provocada pelas disputas travadas pelo comando das atividades e atitudes em relação aos seus representados, ao governo e ao conjunto da sociedade brasileira. Tais condicionantes teriam contribuído para mudanças na atuação dos professores em seu cotidiano, dando origem a movimentos de construção e reconstrução de sociabilidades, modificando padrões, identidades e ações desenvolvidas coletivamente. Esse processo, acompanhado de permanências e rupturas, apresentou três fases: 1945-1963, surgimento e estruturação, até a primeira experiência grevista dos docentes; 1963- 1978, anos de acomodações e resistências em meio à ascensão e crise do regime militar instalado a partir de 1964; e, por fim, 1978-1989, fase de reorganização da entidade com base em novas experiências no enfrentamento de problemas originados ou aprofundados pelas transformações vividas no país ao longo do período de redemocratização. Fase esta que assinalou a ascensão de grupos, projetos e ideologias acerca da organização de professores, criando ou reforçando estratégias de mobilização, consolidando ações e representações acerca do magistério e de sua entidade coletiva, culminando na obtenção do registro sindical em 1989. / Abstract: It was approached in the research the trajectory of the collective organization of the teachers from the official chain of education in the State of São Paulo, particularly from the one referring to "Apeoesp", association created by secondary teachers with the aim of defending the category's interests. It was analyzed the different forms of organization experimented through the years, starting with a dual process. Externally caused by social, political, economical and cultural transformation experienced in Brazil and around the world, that interacted with the making of the educational field of São Paulo. Internally, as a result of its own dynamics, caused by disputes for the activities and attitudes related to their representatives, the government and the whole Brazilian society. Theses facts contributed to the changes in the teachers's role in their daily routine, originating construction and reconstruction processes of socialization, modifying standards, identities and actions collectively developed. This process, followed by ruptures and permanences, presented three phases: 1945-1963, the emergence and organization, until the first strike experience; 1963-1978, the years of adaptation and resistances during the ascent and crisis of the Military regime adopted since 1964; and at last, 1978-1989, the reorganization of the institution phase, which was based on new experiences in the confrontation with problems originated or expanded by the transformation in the Country through the democratization period. Such phase marked the ascent of groups, projects and ideologies through the teacher's organization, creating or reinforcing mobilization strategies, establishing actions and representations in the teaching process and its collective institution, culminating in acquisition of the syndical register in 1989. / Doutor

The diploma thesis deals with labour market imperfections, specifically with trade union. The aim is to define the role and function of trade unions in the Czech republic. The theoretical part deals with economic terminology of the labour market. It explains the difference between the labour market in perfect and imperfect conditons and describes causes and effects of imperfections. Finally the theoretical part focuses on the issue of trade union, theirs economic status, legislation and applied strategies. The practical part describes the history of trade unions in the world, especially in the Czech republic. It offers insights into trade unions in the USA and Europe, which is accompanied by the development of trade unionists, including current data. With regards to the focus of the piece of work on the Czech Republic, it is continued the work with the largest organisation of trade unions ČMKOS, theirs goals and activities. The practical part has two parts to maintain objectivity, namely the part referring to the positive influence of trade unions and the part about their negative impact on the labour market. Finally the work outlines the trend of labour market and trade union organisation.

O objetivo principal consiste em identificar a natureza dos conflitos entre os trabalhadores e a Companhia, bem como, compreender o contexto, as circunstÃncias e os desdobramentos das lutas especificas, como o direito à sindicalizaÃÃo e o fim do trabalho aos domingos; e de aÃÃes coletivas de resistÃncia aberta, a exemplo da greve de maio de 1988 e a adesÃo à greve geral de 1991. The main inspirations of the study were founds in social work history, as also in both the studies of historians of metier, besides of anthropologists, sociologists and economists. The analysis were centered at the juncture of the policies of industrialization, that subsidized with public funds the manufacturing enterprises in CearÃ, when the textile factory in Cearà had a strong growth. In this proclaimed phase of the most productive and competitive in Brazil, of the point of the view of capital, the study examines the conditions of life and work: workers lose their hearing, tuberculosis was âcommon diseaseâ, and machines âswallowedâ employees and the mutilated body worker. When claiming rights, they were fired or they stayed marked in âblack listsâ, and criminalized your forms of organization. They went to fight. To guarantee and expand the social and political rights; of construction of a trade union movement of base, with strong reference class and more accustomed to collective actions, the textile workers of Fortaleza built strikes, they were justice, they negotiated directly with employers, they closed streets in manifestation; they spun and wove struggle for better conditions of life and work. âThe thread of the argumentâ is soaked of sensibilities, achievements, failures, struggles, outrage, anger, dream and hope, is the organization of this work.
