Foi criada em 1831. Trata-se, portanto de um órgão da administração pública com competência constitucional para desenvolver serviços de policiamento ostensivo. É composta por agentes públicos chamados de servidores públicos militares que desenvolvem atos no sentido de promover a segurança e a ordem pública. O tema O princípio da legalidade no controle dos atos administrativos na Polícia Militar, amparado pelo Direito Administrativo, tem como objetivo demonstrar como o princípio da legalidade, exerce papel limitador dos atos administrativos, colaborando com o fortalecimento e concretização dos postulados do Estado de Direito. Estudou-se o início histórico da sociedade e conseqüente evolução até origem do Estado, demonstrando-se a sua finalidade e suas funções, numa evolução do Estado de Polícia no rumo do Estado Democrático de Direito. Da estrutura do ordenamento jurídico, diante de toda a Administração Pública, emergem os princípios constitucionais como marcos necessários a serem observados por todos os agentes públicos. Ao longo dos anos, a corporação foi criticada por entender-se que seus administradores exerciam suas atividades conforme suas vontades. Propugna-se no sentido de que esse entendimento apresente-se submetido à legislação vigorante. Na conclusão, demonstrou-se que a Polícia Militar exerce sua atividade amparada pela Constituição e pela lei. O presente trabalho pretende ser suscetível de causar efeitos no meio acadêmico como também no âmbito corporativo, contribuindo assim com uma reflexão eminentemente teórica com forte sentido na vida prática. / Abstract: The Military Police of the State of São Paulo is an institution hierarchically organized, according to military discipline criteria. It was created in 1831. It is, therefore, an organ of public administration with constitutional competence to develop ostensive policing services. Public agents, called military public employees, who develop acts in order to promote the public security and public order, form it. The theme: The legality principle in the control of administrative acts in Military Police, supported by Administrative Law, has as its purpose to demonstrate how the legality principle performs a limiting function in administrative acts, collaborating with the strength and concretion of the postulates of the State of Law. The historical beginning of the society and the consequent evolution to the origin of the State were studied, demonstrating their purposes and functions in the evolution of the State of Police towards the Democratical State of Law. The constitutional principles, as essential signs to be observed by every public agent, emerge from the structure of juridical ordering, in the face of public administration as a whole. The corporation was criticized along the years because it was understood that its administrators performed their activities according to their will. It is advocated that this understanding is submitted to the effective Law. In conclusion, it was demonstrated that the Military Police performs their activities supported by the Constitution and the Law. The present paper intend to be susceptible of causing effects in the academic as well as in the corporative spheres, contributing to an eminently theoretical reflection with a strong meaning to practical life. / Mestre

We live in the twenty-first century in increasing changes and accelerated by economic and technological development, by engendering the environmental crisis and risk society facility. In this scenario, the state and the law must manifest in order to try to solve or at least develop possible solutions to combat the effects of risk society, fighting for the survival of mankind and ensure for future generations. The Brazilian environmental law is considered one of the most advanced in the world regarding environmental legal protection. However, the struggle for a state of effective environmental law, ie, the actual implementation of rules that change the existing social and environmental facts, are several limits. Then comes the central issue of this research project: what is the scope and what are the limits of environmental legal norm by a State Environmental Law? In trying to find answers to such a complex question, it was used in this work, as methodology, eminently literature, with the compass the fact that the struggle for a State Environmental Law comes necessarily from the existing dilemma between the depletion tax threshold the known economic models and the desired scope for environmental protection. Such a dilemma goes beyond the rule of law, since it necessarily involves great environmental importance of awareness of not only the State as a legal entity, but for all its members, ie the community which seamlessly must participate responsibly and ethics, realizing the desired range by environmental legal standard, that is, the effective protection of the environment. / O presente trabalho de pesquisa tem por objetivo discorrer sobre a luta pelo Estado de Direito Ambiental, trazendo consigo uma reflexão do alcance e do limite da norma jurídica ambiental. Vivemos no século XXI em transformações crescentes e aceleradas pelo desenvolvimento econômico e tecnológico, pelo engendramento da crise ambiental e instalação da sociedade de risco. Neste cenário, o Estado e o Direito precisam se manifestar com a finalidade de tentar resolver ou pelo menos elaborar possíveis soluções para combater os efeitos da sociedade de risco, lutar pela sobrevivência da humanidade e garantir a das futuras gerações. O ordenamento jurídico ambiental brasileiro é considerado um dos mais avançados do mundo quanto à tutela jurídica ambiental. No entanto, a luta por um Estado de Direito Ambiental efetivo, isto é, a aplicação real de normas que mudem os fatos sociais e ambientais vigentes, encontra vários limites. Surge, então, a problemática central do presente projeto de pesquisa: qual o alcance e quais os limites da norma jurídica ambiental por um Estado de Direito Ambiental? Na tentativa de encontrar respostas a tão complexa indagação, utilizou-se neste trabalho, como metodologia, a pesquisa eminentemente bibliográfica, tendo como bússola o fato de que a luta por um Estado de Direito Ambiental nasce necessariamente do dilema existente entre o limite imposto pelo esgotamento dos modelos econômicos conhecidos e o alcance pretendido pela proteção ambiental. Tal dilema vai além da norma jurídica, posto que passa obrigatoriamente pela tomada de consciência da grande importância ambiental não só pelo Estado como ente jurídico, mas por todos os seus integrantes, ou seja, a coletividade, que de forma integrada deve participar com responsabilidade e ética, concretizando o alcance pretendido pela norma jurídica ambiental, ou seja, a efetiva proteção do meio ambiente.

The Role of the 'Coordinating State' in the Protection of the Underwater Cultural Heritage: An analysis of the cooperative jurisdictional regime of the UNESCO Convention for the Protection of the Underwater Cultural Heritage (2001) including relevant state practice

The article at hand concerns itself with evaluating the impact the State Cooperation System has had on how underwater cultural heritage is dealt with in international waters. A total of six researched cases, including the infamous Titanic and the currently controversial San José, attest that the notion of the Coordinating State has yet to deliver a higher standard of protection for cultural assets underwater. Also, generic ramifications caused by the superficial configuration of the treaty, such as disregarding private stakeholders and elements of bureaucracy, are identified. The discontent with cooperative jurisdictional provisions seems to be omnipresent. This affirms the need for reforming the Convention itself, even in consideration of the sixth Meeting of State Parties’ Draft Ratification and Implementation Strategy. In order to provide a workable proposal for reform, the authors acknowledge the potential role model effect of existing systems of shared jurisdiction. In conclusion, it is suggested to upgrade the convention’s Scientific and Technical Advisory Body (STAB) and assign it the identification of underwater cultural heritage, notifying state parties with a verifiable link to the heritage site as well as taking emergency measures. This is consistent with missions the STAB has already deployed to assist state parties on-site and preliminary deliberations to strengthen the support and funding of the STAB in the aforementioned Draft Ratification and Implementation Strategy.

This is not put into question. Although what is the purpose of that work, or if there is any purpose at all, is a question that must be made ex ante any task. The answer resounds: all knowledge must be turned to the instrument, technology in order to improve people's lives. In legal terms, this should be put in technical terms: improving justice, democracy, human dignity, certainty. However, these basic elements - justice, democracy, human dignity, certainty - have great fluidity, which does not allow them to extract a precise meaning. Same phenomenon occurs in the large themes: people, society, State, Law, State of Law, and Democracy. Witch shall be studied in Unitarian philosophical view of the world. Therefore it is necessary to introduce certain methodological warnings, and it explains the option for analyzing these institutes under the attributes of form and function, starting from abstractions up to very precise and contextualized content of those institutes; in order to propose solutions for fighting crime in a democratic way, especially organized crime. And therefore it is to be studied the possibilities of negotiation within the police investigation in Brazilian Criminal Procedural Law / O trabalho científico visa produzir conhecimento. Isso não se questiona. Mas a que se voltará este conhecimento, ou mesmo se possui alguma finalidade, é pergunta que se deve ser feita ex ante qualquer atividade. A resposta ressoa: todo conhecimento deve ser voltado a dar instrumento, tecnologia para melhorar a vida das pessoas. Em Direito, põe-se em termos técnicos: é assistir a justiça, a democracia, a dignidade humana, segurança. Contudo, estes elementos básicos --justiça, democracia, dignidade da pessoa humana, segurança-- possuem grande fluidez, que não permite extrair-lhes um significado preciso. Fenômeno que se verifica nos grandes temas: pessoa, sociedade, Estado, Direito, Estado de Direito, Democracia. Sempre tomando visão unitarista de mundo. Por isso, necessário introduzir advertências metodológicas, e a opção por analisar estes institutos sob sua forma e função, para chegar-se, de abstrações até conteúdos muito precisos e contextualizados. E ao fim propor solução para combate democrático à criminalidade atual, em especial a organizada. E assim estudar as possibilidades de negociação no inquérito policial, principal meio de investigação no Direito Processual Penal Brasileiro

La question de l'aveu en matière pénale

Si l'aveu n'entretient pas de rapport obligatoire avec la vérité judiciaire, penser l'aveu en matière pénale renvoie à une question infiniment plus complexe qui excède le domaine exploré. Non seulement, en effet, il semblerait que l'aveu renvoie au réel critère d'appréciation en matière judiciaire mais également il repose sur une pratique qui concerne des éléments personnels vécus sur un mode négatif, en relation avec des valeurs et des normes acceptées au sein d'une société historique donnée. Car c'est dans le mystère de la conscience de l'auteur de l'aveu que le passage à l'acte est possible, donc dans une sphère qui a davantage partie liée avec son intériorité éthique qu'avec le caractère impératif d'une norme pénale. En même temps, l'aveu est le reflet de l'évolution de nos sociétés modernes. Si l'aveu devait être recherché hier inconditionnellement et constituait un impératif absolu même au détriment de la vérité, il s'est aujourd'hui banalisé comme d'ailleurs la mesure qui le rendait nécessaire, la garde à vue. Ce qui prévalait antérieurement, sous le règne de l'aveu traditionnel comme reine des preuves, c'était davantage une forme d'exigence éthique qui faisait de la vérité la norme. Cette conception absolue de l'aveu était également celle d'une société fondée sur la confiance, c'est-à-dire celle où précisément une vérité pouvait se manifester plus aisément car elle en constituait une valeur structurante. Il semblerait que cette société de confiance ait laissé place à une société de défiance dans laquelle la vérité n'est plus le référent essentiel, mais davantage l'efficacité ou la célérité des procédures / If a confession doesn't have a mandatory connection with legal truth, the mental conception of a confession leads to an infinitely more complex question which goes beyond the field under study. It would seem that, not only does the confession imply a real criterion in terms of legal appreciation, but is also based on practice linked to personal factors, stemming from negative experience, connected to values and standards prevailing within a given social history. For it is within the mystery of the subject's conscience that committing the act is possible; that is to say in a sphere more closely connected with his personal ethics, than with the constraints of legal norms. At the same time, the confession is a reflection of the evolution of modern society. If the confession was previously sought unconditionally, and represented an absolute imperative, even to the detriment of the truth, it has today been tendered mundane, as has moreover the measure which made it necessary, legal detainment. What was formerly prevalent, when the confession was considered as the ultimate proof, was more a form of an ethical requirement which made truth the standard. This concept of the confession as an absolute was also that of a society based on confidence, that is to say, one in which truth could effectively become known more easily, as it was a structural value. It would seem that this society based on confidence, has given way to a society based on mistrust, in which truth is no longer the essential reference but rather the effectiveness or the rapidity of procedures

This article focuses on the analysis of the literature produced by Robert Alexy, a renowned German jurist, focusing on the concept of fundamental rights, which are, in a constitutional state of law, the ultimate goal of the legal system. Thus, for Alexy the rights of people are not moral, but rather legal. It is in this sense and taking as a starting point the conception of fundamental rights that the author proposes a tentative reading from a moderate realistic perspective of some aspects of the theoretical position of Alexy. / El presente artículo se centra en el análisis de la literatura producida por Robert Alexy, reconocido jurista alemán, centrada en el concepto de los derechos fundamentales los cuales son, en un estado constitucional de derecho, el fin último del ordenamiento jurídico. Así, para Alexy los derechos de las personas no son de tipo moral, sino más bien, jurídico. Es en ese sentido y tomando como premisa de partida la concepción de los derechos fundamentales que la autora propone una lectura tentativa desde una perspectiva realista moderada de algunos aspectos de la posición teórica de Alexy.

The principle can be a synonym of stability, foreseeability and immutability of written legislation and decisions taken by judiciary power. It is through the respect towards the law and the sentences that the State maintains social order. With the respect of the law or, in another word, legal certainty, the State can assure life security and individual liberties to its citizens. Therefore, legal certainty is as assuring element of one of the main goals of the State – public security. In that manner it is justified the preoccupation of the law in maintaining and promoting the legal certainty principle. However, is it possible to verify that it exists in such terms of immutability and foreseeability? The initial response of this work agrees with the theoretical reference of Jerome Frank, to who law id ruled by uncertainty. The insistence on the idea of legal certainty has trained the experienced jurist to deal with the flexibility of reality using rational constructions that allow to ratify legal certainty so he corroborates it, and legal certainty helps maintaining social order itself. / O princípio da segurança jurídica é a expressão de certeza e ordem nas relações jurídicas. O princípio pode ser sinônimo de estabilidade, previsibilidade ou imutabilidade da legislação escrita e das decisões tomadas pelo poder judiciário. É através desse respeito às leis e decisões que o Estado mantem a ordem social. Com o respeito à norma ou, em outras palavras, a segurança jurídica, o Estado consegue garantir a segurança da vida e liberdades individuais dos cidadãos. Assim, a segurança jurídica é elemento assegurador de um dos principais objetivos do Estado – a segurança pública. Dessa forma, justifica-se a preocupação do direito em manter e promover o princípio da segurança jurídica. No entanto, é possível constatar que ele existe nesses termos de imutabilidade e previsibilidade? A resposta inicial deste trabalho concorda com o referencial teórico de Jerome Frank, para quem o direito é regido pela incerteza. A insistência na ideia de certeza jurídica treinou o jurista experiente para lidar com a flexibilidade da realidade usando locuções e construções racionais que permitem ratificar a segurança jurídica, de modo que ele corrobora a segurança e essa, por sua vez, mantem a própria ordem social.
