Precedent, commentary, and legal rules in the Madhhab-Law tradition : Ibn Quṭlūbughā's (d. 879/1474) al-Taṣḥīḥ wa-al-tarjīḥAl-Azem, Talal January 2011 (has links)
This thesis examines the role that scholarly digests and commentaries played in the formation of legal rules in the Muslim legal institution known as the madhhab. I posit that a shared approach to legal rule-determination, and the respect of juristic precedent that it entails, underlies the jurisprudential processes of all of the four post-classical Sunni madhhabs (the Ḥanafī, Mālikī, Shāfi'ī, and Ḥanbalī), and unites them in a wider ‘madhhab-law tradition’. Taking the Ḥanafī madhhab as a case study, the thesis analyses a commentary written by the late Mamluk jurist Ibn Quṭlūbughā (d. 879/1474) upon the digest of the celebrated Abbasid-era Abū al-Ḥusayn al-Qudūrī (d. 428/1037). In discussing the madhhab's heritage of precedent, Ibn Quṭlūbughā's commentary weaves an intricate tapestry of quotations and references from previous jurists and works, providing us with insight into how author-scholars reacted to, and interacted with, other jurists over space and time. Chapter 1 provides a short introduction to the lives of Qudūrī and Ibn Quṭlūbughā, and the contexts within which they produced their works. Chapter 2 employs both quantitative and qualitative analysis of the commentary, in order to deduce historical and geographical patterns out of which a periodisation of rule-determination in the Ḥanafī madhhab is proposed. In Chapter 3, Ibn Quṭlūbughā's jurisprudential theory of rule-determination is studied, examining both the justifications and the processes employed by jurists in arriving at a legal rule in the Ḥanafī madhhab. Chapter 4 then turns to the craft of commentary itself, analysing over eighty case examples for the logical relationships, rhetorical devices, and legal arguments that inform the actual practice of rule-determination through commentary. A final chapter then summarises the conclusions, and situates them within a broader discussion as to the nature of the madhhab-law tradition.

Les timbres amphoriques de Ras el BassitMorin, Véronique 12 1900 (has links)
Sur le site de Ras el Bassit, durant les campagnes de fouilles menées de 1971 à 1984, 133 timbres amphoriques furent trouvés principalement dans le Tell du Meidan. Ces timbres sont des artefacts précieux. En effet, ce mémoire démontre comment les timbres amphoriques contribuent à l’élaboration de l’histoire d’un site, vue ici par l’analyse de ces 133 timbres amphoriques. Tout d’abord, les termes de base sont présentés pour expliquer ce que sont une amphore et un timbre. Par la suite, l’historiographie des recherches faites sur les timbres montre que, depuis le recueillement des informations sur les sites de production, certaines séries de timbres furent datés à l’année près, contribuant ainsi à améliorer les datations des autres sites. C’est de cette manière que les anses timbrées contribuent le plus souvent à améliorer un site. Il existe aussi d’autres apports. Par exemple, en localisant la production d’une série de timbres, les échanges commerciaux peuvent être aperçus. À travers l’analyse de ces 133 timbres, le site de Ras el Bassit pourra être mieux daté pendant l’époque hellénistique. En effet, les couches stratigraphiques en contexte pourront alors avoir un élément datable d’une grande précision, si tel est le cas. De plus, en connaissant la provenance de ces timbres amphoriques, elle démontrera que les échanges (avec des amphores timbrées) commencèrent dès le IVe siècle, ce qui correspond à une reprise des importations grecques. Ces importations dureront pendant toute l’époque hellénistique. / In the site of Ras el Bassit, during 1971 to 1984’s excavations plan, 133 amphora stamps have been found principally in the Tell du Meidan. These stamps are precious artefacts. Effectively, this dissertation shows how the amphora stamps help the archeologists to know the history of an archeological site, in this case the site of Ras el Bassit. First of all, the basic terms will be presented to explain what are an amphora and a stamp. Then, the historiography research on the amphora stamps shows that since the discovery of amphorae workshops, some stamp’s categories were dated to the year, contributing to the dating of others sites. The dating is the principal contribution of a stamp, but there are others. For example, by locating the production of stamp categories, the trade is visible. With the analysis of these 133 amphora stamps, the dating of Ras el Bassit can be reevaluated and more accurate. Moreover, knowing the origin of these stamps, it will demonstrate that the exchanges (with the amphorae with stamps) began as early as the fourth century B.C., which corresponds to a resumption of Greek imports. These imports will last throughout the Hellenistic period.

Notre recherche interroge les modalités selon lesquelles une pratique artistique peut constituer un vecteur de contestation en contexte autoritaire. Elle se situe à l’intersection de deux aires de questionnement. D’une part, elle examine les multiples rapports qu’un monde de l’art peut entretenir avec un monde politique, éclairant les enjeux politiques qui traversent un champ cinématographique fortement dépendant de l’État, ainsi que les pratiques contestataires spécifiques qui y ont court. D’autre part, elle explore des formes de contestation qui se déploient à la marge d’un espace politique verrouillé, mettant au jour certains mécanismes de l’autoritarisme observés dans les négociations, arrangements et conflits entre acteurs du monde cinématographique et acteurs de l’appareil bureaucratique et étatique. Dans un premier temps, nous montrons comment les relations sociales qui se tissent autour de l’organisation et du fonctionnement de la production cinématographique polarisent et réfractent certaines pratiques et enjeux spécifiques au champ politique tout en les reformulant. Nous plaçons ensuite l’analyse au cœur des films afin de repérer et de décrire, à partir des différents procédés propres au langage cinématographique, des thématiques, des catégories et des objets qui relèvent du politique, sur lesquels les cinéastes posent un regard critique, alors même que l’expression d’une opinion contestataire dans l’espace public s’avère problématique / Our research investigates how an artistic activity can also be a vehicle for contention within an authoritarian context. It relies at the crossroad of two areas of questioning. On the one hand, we explore the various interactions between an art world and a political world, shedding light on the political logics at stake in a cinematographic field greatly dependent upon the state, as well as on the contentious practices emerging from this particular configuration. On the other hand, we scrutinize contention expressed at the margin of a locked political space, unveiling some mechanisms of authoritarianism produced by negotiations, arrangements and conflicts between actors belonging to the cinematographic world and actors of the bureaucratic apparatus. At first, we examine how the social relationships woven around the organization and the functioning of film production polarize and refract practices and issues proper to the political field while reformulating them. Then we shift the focus of our analysis on the very heart of the films to locate and describe, from the specific tools of the film language, subjects, categorizations and objects dealing with politics, upon which filmmakers cast a critical eye, whereas contentious expression in the public sphere proves to be problematic

Long-distance trade and the exploitation of arid landscapes in the Roman imperial period (1st - 3rd centuries AD)Schorle, Katia January 2014 (has links)
If as argued the Mediterranean consisted in Antiquity of a unity determined by similar environmental factors and crises which were mitigated through established networks of trade and exchange, the border regions of the Roman Mediterranean, particularly to the South and East, were characterised by a radically different environment. This thesis focuses on the development of three of the arid regions bordering the ancient Mediterranean, namely the Fazzan oases in the Libyan Sahara, the Eastern Desert of Egypt and the region of Palmyra in Syria. These arid regions have received considerable archaeological attention in recent years, and a review of them will highlight the factors which enabled these regions to interact with the Roman Empire through trading dynamics, but also through the development of local resources. Central questions within this thesis concern the extent to which the environment would have tailored the potential of these regions, and if the existence of trade routes and social networks both affected and were affected by settlement and exploitation patterns in the region. Trade was created by geographically much broader social requirements for foreign or exotic goods, yet was restricted by the possibility to pass through these regions. Developments were conditioned by the constant need for balance between the state as a power enforcing and representing peace and security and local entities, and what the local social organisation had to offer in term of rent and stability to the state as an institution. After an introduction (Chapter 1) delineating the aims of the thesis, Chapter 2 defines influential theories and models that will be considered for this thesis, namely environmental factors, social networks and institutional economics. The archaeological evidence is then discussed in each relevant chapter: Chapter 3: The Libyan Sahara; Chapter 4: The Eastern Desert of Egypt; Chapter 5: Palmyra. Chapter 6 discusses major factors that may work as explanations for the development of agriculture, the exploitation mineral resources, and trade in these regions. The choice of regions both inside and outside the Roman Empire also allows a discussion on the rise of economic activities linked to the imperial economy. As such, the thesis moves away from a romano-centric perspective and proposes to look instead for internal factors, such as the development of complex societies with organisational frameworks and social networks which enable them to overcome the challenges of their geo-climatic settings. This study concludes that the developments identified in each chapter were not a factor of environmental changes but human agency. The state, or private individuals or communities successfully organised the resources necessary to integrate the regions into wider networks of intense trade in the imperial period. These concerned both physical infrastructure, and the development of far-reaching social networks.

The aim of the work is to analyze the concepts of humanitarian intervention and responsibility to protect (R2P) with special emphasis on their development in the light of the ongoing Syrian crisis. The text follows the evolution of humanitarian intervention into R2P and introduces theoretical assumptions behind both concepts. It is argued that at the moment, R2P does not bring particularly novel concepts into the international law and can be generally described as a hybrid of legal, political and moral obligations. Consequently, the text includes a case study of the Syrian conflict and an evaluation of the way R2P has been applied during the crisis. Final section of the work is devoted to a suggestion of a new solution for R2P - responsibility while protecting.

La Syrie intérieure est composée d’une mosaïque de milieux et de micromilieux dont les caractéristiques lithologiques, édaphiques et hydrologiques permettent de compenser l’aridité climatique, ou renforcent au contraire les contraintes imposées aux modes de vie et de subsistance, de nos jours comme par le passé. Cette étude multiscalaire – supra-régionale, régionale et microrégionale – de l’environnement des sites PPNA et PPNB (9 500-6 500 av. J.-C.) a permis de comprendre comment ont pu être opérés les choix d’implantation, définies les stratégies de subsistance et l’exploitation des ressources. Au-delà des critères évidents orientant les choix des lieux d’implantation, tel que l’accès à une ressource en eau, il a été démontré que les communautés néolithiques ont très tôt sélectionné des lieux d’installation bénéficiant de milieux propices aux pratiques agricoles et de terroirs complémentaires permettant de mettre en œuvre des stratégies culturales diversifiées. Leur capacité d’adaptation à un milieu contraignant, le développement progressif des activités agro-pastorales ainsi que leur maîtrise croissante de l’eau, leur ont permis de coloniser l’ensemble de la Syrie intérieure aux PPNB récent et final. Les prémices du nomadisme pastoral seraient nées dans ce contexte, et dès lors que l’élevage fut maîtrisé, d’une recherche par les groupes mobiles du mode de vie et de subsistance le plus adapté aux contraintes de la steppe. Cette étude a par ailleurs permis de tester à grande échelle – spatiale et temporelle – une méthode d’analyse microrégionale, s’inspirant de la démarche de type Site Exploitation Territory, et d’en faire l’analyse critique avec comme objectif l’élaboration ultérieure d’un modèle d’analyse plus abouti, si possible en concertation avec les spécialistes des disciplines concernées par ces problématiques / Inland Syria is made up of an environment and microenvironment mosaic with specific lithological, edaphic and hydrological characteristics which compensate climatic aridity or, on the contrary, increase the pressure imposed on settlement and subsistence strategies, nowadays as in the past. This multiangelfish study – supra-regional, regional and microrégional – of PPNA and PPNB (9 500-6 500 BC) sites environment allowed to understand settlement choices, subsistence patters and resources exploitation. Beyond the obvious criteria that have oriented the choices of settlement places, like the access to a water resource, it was demonstrated that the Neolithic communities have early selected settlement places with environment suitable for crop processing and complementary land to conduct varied farming strategies. Their adaptability to a restrictive environment, the progressive development of agro-pastoral activities and also their increasingly water controlling, allowed them to colonize the whole inland Syria during recent and final PPNB. The beginnings of pastoral nomadism could have emerged in this context, since the husbandry is well controlled, from the research by mobile groups of the best adapted settlement and subsistence pattern to the steppe pressure. In addition, this study has allowed us to carry out a large scale test – spatial and temporal – of a microrégional analysis method, based on a Site Exploitation Territory approach, in order to elaborate in the future a complete analysis model, in collaboration with the specialists involve in those kind of study

Over the years the Madrid Peace Conference has been relegated to paragraphs within history books and the importance of the conference seems to have been all but forgotten. While this may be due to the perceived failure of the talks to produce tangible peace negotiations, what one must take into consideration is the fact that neither the Oslo Accords nor the more recent “Road Map†to peace would have been possible if it were not for that first steps taken in Madrid. One must also not forget the diplomacy and countless man hours that were put forth with tireless effort to achieve the goal of a peace conference that would be attended by all desired participants. When studying the Madrid Conference, one must look not only at the conference itself and the rhetoric conveyed by the delegates but also at their personalities and relationships with each other.

Aujourd’hui, les bibliothèques universitaires (BU) en Syrie sont confrontées à une évolution de leur environnement liée en grande partie à la mutation de l’enseignement supérieur et l’arrivée de nouvelles technologies. Ainsi, les BU se trouvent dans l’obligation de s’interroger sur la pertinence de leurs offres de services. En effet, les besoins et les attentes des universitaires ne sont plus les mêmes qu’auparavant. Ces bibliothèques doivent, par conséquent, suivre cette évolution et répondre à leurs nouveaux besoins pour pouvoir survivre dans un contexte où elles ne sont plus la seule source d’information. L’objectif de cette thèse est de contribuer à la réflexion sur l’adéquation entre l’offre et les besoins. Pour y parvenir, des enquêtes quantitative et qualitative ont été menées auprès d’étudiants, d’enseignants, de dirigeants et de bibliothécaires dans cinq universités syriennes. Cette enquête a été réalisée dans le but de connaître la situation actuelle des BU et des besoins informationnels de leurs publics. Nous avons, ensuite, élargi et diversifié la gamme de services proposés aux universitaires tout en partant de leurs besoins tant exprimés qu’implicites. / Today, in Syria, university libraries are facing an actual change in their environment. This change is largely due to the evolution of higher education and the advent of new technologies. In this context, university libraries have to question the relevance of their services. Indeed, information needs have evolved and are no longer the same as before hence libraries need to adapt to evolution by meeting new needs in a context where they are no longer the only source of information. This thesis aims at contributing to reflection on adequacy between supply and service needs. To achieve this goal, a quantitative and a qualitative survey was conducted among students, professors, managers and librarians in Syria to have a clear understanding of the current situation of university libraries and information needs of their publics. We then expanded and diversified the group of services and provided the academics with the basis of their stated and implied needs.

Why do some civilian lives matter more than others? Exploring how the quality, timeliness and consistency of data on civilian harm affects the conduct of hostilities for civilians caught in conflict.Lee, Amra January 2019 (has links)
Normatively, protecting civilians from the conduct of hostilities is grounded in the Geneva Conventions and the UN Security Council protection of civilian agenda, both of which celebrate their 70 and 20 year anniversaries in 2019. Previous research focusses heavily on protection of civilians through peacekeeping whereas this research focuses on ‘non-armed’ approaches to enhancing civilian protection in conflict. Prior research and experience reveals a high level of missingness and variation in the level of available data on civilian harm in conflict. Where civilian harm is considered in the peace and conflict literature, it is predominantly from a securitized lens of understanding insurgent recruitment strategies and more recent counter-insurgent strategies aimed at winning ‘hearts and minds’. Through a structured focused comparison of four case studies the correlation between the level of quality, timely and consistent data on civilian harm and affect on the conduct of hostilities will be reviewed and potential confounders identified. Following this the hypothesized causal mechanism will be process traced through the pathway case of Afghanistan. The findings and analysis from both methods identify support for the theory and it’s refinement with important nuances in the factors conducive to quality, timely and consistent data collection on civilian harm in armed conflict.
